Last sprin: thks bill passed 55 for, and 2 against, here in this Body, and What does, it allows local option for taxing districts to abate property taxes up to ten years on only newly constructed residences, up to a period of no more than ten years. I urge that the Governor's veto be overridden, and we vote favorably for this bill.

Senator Dunn, do I -- I understand that this bill was passed 55 to 2 last spring and, frankly, if I understand it correctly , I don't know how that happened. My questions are; are you saying in this bill that a local option, meaning, I suppose, a mayor or a local council: can designate any new construction and say that that new construction will have the property taxed abated for up to ken years?

Is that on an indkvidual parcel-by-parcel basis or is that a development or -- or an area?
Senator Dunn.
There's no restriction on it. If it were to bring in a subdivision, they could do it for a subdivision. As long as it's a newly constructed home, but it must be newly constructed.

Well, thank you, Mr. President. I rise in strong opposition to this bill, for a lot of reasons. Ifg in fact, there are areas in the State, perhaps in Senator Dunn's district and other districts, where this is used as an economic development tool, I would suggest limiting it# or changing the legislation to rewrite it to some type of a -- kind of like a TIF district, or enterprise zonee or some kind of a area where this might be needed. But in my district, and other districts like mine that are high growth areas, we have developments popping up every day. You just can't keep up with the growth. The local taxing bodies, like the schools, could possibly be educating a11 these hundreds and hundreds of new kids, for up to ten years, with no tax revenue stream coming with them . I think it also puts in the hands of some local governments, some local mayors, or boards, or councils, or trustees, or whoever is going to do this designation, I think it 13 STATE 0F ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 70th Legislative Day January l0, 1990 puts in their hands a great deal of power to -- I don't know, play off one developer agalnst another, or do all kinds of damage. But frankly, I1m not as concerned about that, as I am concerned about the lack of revenue for the -- the school districts. I can't see, frankly, in my district that anybody would do that knowing the loss of revenue it would mean, but just on the chance that someone might, I think this is a bad idea. I really would suggest that if you could change the bill to amend it to make it some type of economical -- economic tool for an economically depressed area, would be a 1ot more palatable.

Well, Mr. President, I think, probably, Senator Karpiel has made some excellent agruments aqainst this legislation. I think perhaps it's not well thought out. And I'm kind of embarrassed to think that it Went a11 the way to the Governor's desk before the problems were found with the bill. This is not limited legislation. This couldz you know, the mayor and the council willing, in any town you'd be able to give this type of a reduction. Realize who's filling up our schools, it's the people that are living in these houses and a11 of this -- the potential here is just absolutely mind-bogglingy as to how much could be given away in tax money, if you started, willy-nilly, granting this type of tax relief back home. It seems to me, if youdre going to make everybody else in this State pay some rather high taxes, and believe me, they are paying high taxes, what is the justification of allowing these homeowners in these new homes not to pay their fair share. And to think you could go up to ten years on this is just incredible, to say the least. o..tmachine cutoffl...

Mr. President, too, arise in opposition to this. Franklye I have been a litkle disconcerted about the lack of sympathy I've seen for many of my municipalities, in kerms of developer contributions for school districts. Some of them do not seem to feel that they have any real responsibility for the schools. Most of my municipalities live, almost exclusively, off the sales tax and other State and federal sources. They aren't particularly dependent on the property tax, so when they abate the property tax, it doesn 't particularly impact on them, but it is absolutely devastating to a school district. And I know, from time to time, all of us have school districts that have to pass referendums, and my reaction would be that if the taxpayers found out that there was a whole new housing area that had gotten some sort of abatemente you would have one heck of a time passing a tax referendum . I -- I can see some use for abatements for economic development, in terms of industrial parksy and perhaps even some commercial ventures, but for residential housing, boy -- I think wedre really opening the door here.

Senator Dunn, I think most of 2s know what -- what wefre trying to do here, and I I applaud you for the efforts, but I - and I was one who was asleep at the switch last spring, as well. This State has spent a lot of time and resources on activities such as TIFs and enterprise zones, to attempt to -- to improve the economic stability of -- of certain communities. This -- this issue here though, I see -- I believe gives -- gives mayors, if you will, a 15 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 70th Legislative Day January l0, 1990 lot of power over school dkstrictsy and perhaps there mkght even be a lack of communication and -- really fear, as other speakers have suggested before me, that that these large subdivisions that have just a tremendous amount of boys and girls going to school, simply Won 't for ten year period be -- be paying their fair share, plus, plus we can't ignore, once again, the impact that the resource equalizers going to have on this kind of activity. So I would just -- I Would urge the Body to -- to reject the measure today, and encourage the sponsor to pursue matters like the TIF or enterprise zones. Something like that to for economic development.

So, you're whamming them twice, and they're going to have an increase in enrollment, as well, and so I don't know how the heck theydre going take care of their particular problems with 16 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 70th Legislative Day January 10e 1990 education.

Thank you, Mr. President. Well, I think you dve you dve raised some issues that maybe do not necessarily address the bill. First of all, this is permissive, and it seems to me around here we make a lot of decisions wherein we trust the local officials that are elected to do things. And it seems to me the arqument was last spring on the tax package if we were going to give these people money, that we ought to trust the local officials, who are elected, to fairly distribute it. It seems to me that I heard that discussion? When you raised the question, Senator Karpiel, about - you don't have a problem with housing in your area : that may be true; but what about areas that have blighted areas? And what about areas that have homeless people? What about -- what about placing the trust in the already elected officials, who are there to answer to the public, to properly administer this? Just because there is an opportunity for abuse, doesn't mean, necessarily, that our elected officials are going to go out and abuse this process. And what's wrong With attracting to a STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 70th Legislative Day January l0, 1990 blighted area, new housing, and housing for the homeless. So, What I'm suggestin: to you is that if there are any abuses in this system y it's something we can come back next year and address, if we have to, or we can look to the locally elected people; and We can have them answer the abuses that they decided. It won't be a mayor's decision, it will be a council's decision. It will be a voluntary decision on their part for them to place no taxes on something in their district. So I urge adoption.

Thank you, Mr. President. I thought maybe we could save a little time by allowing Senator Luft to sponsor the bill, to move on this motion instead of my Motion to Override. The problem with this bill is that we had a dozen, or two dozen, or three dozen other things ùn there and that causes me a dilemma. Because the Governor deleted a bill that this Body has passed on three different occasions. We passed it in the regular Session in the spring. We overrode his amendatory veto in the fall. The House failed by one vote, and we passed it again in the Veto Session. I'm talking about the retpliatory discharge for in-house lawyers. I will not take your -- burden you -- take your time up on that subject. I could not convince the Governor of the merits of this good 1aw and order bill. 1911 wait till 1991 when we have a neW Governor, and I'm sure the bill will then become law with your help and support, as you have given me in the past. I'm going to vote No, but I know it's not -- it's a useless effort. Thank you, Mr. President.

It increase an income eligibility standards for pregnant women seeking Medicaid from one hundred percent, to one hundred and thirty-three percent of the nonfarm income official poverty line, as defined by the Federal Office of Management and Budget. This amendment, which becomes the bill: is the compromise between the Department of Public Aid and the Citizens Assembly on Children. Thank you, Mr. President and Members. The amendment ko House Bil1 2431, which I propose: is necessary because of the enactment last Session of Senate Bill 952. If you remember, that legislation, among a number of other things: amended Chapter 85 to limit the investment authority of public treasurers. The bill reduced the types of classifications of short-term obligation of corporations' commercial paper in which public treasurers may invest, from the three highest-rated papers, to the highest-rated paper as determined by at least two major rating aqencies. The bill further limited the treasurers' investment authority by capping the percentage of public agencies' funds which may be invested in such short-term obligations at twenty-five percent. Previously, as you recall, there were no caps - no such caps existed. This proposal would now revert to the three highest classifications, and would increase the cap on investment of commercial paper to one-third of the public agencies' funds. This proposal is sponsored by both sides of the aisle. Supported by both -- the State Treasurer's Office is on board. The Illinois Bankers Association. Continental Bank. I know of no objections. Ifd be happy to answer any questions, and would move for its adoption.

Also: it says that if the Department of Conservation does not open a facility they 've had there for four years, known as Mazonia Lakes, wedve appropriated money for four years and it's still closed, that if they don't open it by September lst that we -- that they sell it and put it back on the tax rolls.
