Well, I just point this out to everyone here in the Senate, that if we start amendinq these things, We will slow down the process to where We will never get through this process by next weekend. which is our deadline. So I think we have to know what we are doing here, and you have answered it, think, eorrectly. But I guess we are going to have to be very careful. If we want these things to go forward, we simply can't start amending.

Amendment No. to GJR 72 ks an amendment -- I thought that this would have been in the bill, or the -- Ehe resolution as originally introduced, because we diseussed this at great length a year or two ago when a similar resolution was before us. And that is a very simple sentence, this is a one-line amendment that says that the funds that are addressed in this amendaent will not include funds received or expended by school districts. This bill deals with the -- jurisdiction of the Auditor General to audit State funds. 9 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 81st Legislative Day April 26, 1990 If We do not adopt this amendment, the Auditor General will be charged with coming into every one of the nine hundred and fifty-plus school districts in the State of Illinois and doing an audit. That's ridiculuous. Every school district already does it. They should not -- we should not impose this horrendous cost upon ourselves to do this the schools are already doing it themselves. But I would suggest to you, Without this amendment, that's exactly what's going to happen. So this is a technical amendment to clarify the intent. I an -- I presume it's not the intene of the sponsor to audit, to have the Auditor General audit every school district. I kould move the adoption of Amendment No.

Mr. President and Ladies and Gentlemen of the Senate. I am a lawyer. I pay a fee every year: just like the other lawyers do. The people Who are in business have to pay unemployment compensation to the State. I do, too, as an owner of a 1aw firm. And I think, rather than Worry about the Auditor going to a1l the school districts - and God knows, some of them miqht need to be audited I think we should go ahead and pass this amendment and vote for it up -- up or down. I think it is a good amendment# and I think it should go on the ballot and let the people decide for kt. I speak agaknEt the amendment. I don't even see it, and I think we should proceed with the resolution.

I rise in support of this amendment, and just to -- so that no one will vote against this very worthwhile amendment, strictly on the basis of prospectively what the time frame is, I Would point out that SJR 72 was introduced in June of nlneteen hundred and eighty-nine. And there has been, it seems to me, plenty of time to pursue this. But the Eact ïs once you are now confronted with 11 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 81st Legislative Day April 26g 1990 a definition that literally defies logic, Where we are attempting to say conskitutionally that public funds of this State mean everything that's even remotely connected to the legislative, judicial or executive branch, no matter how tenuous. The Illinois Ambassadors, which is money contributed by those businesses and corporations for the promotion of tourism on behalf of the Office of the Governor and the people of the State of Illinois - they'd be covered under this. That simply doesn't make any sense. And so, in an attempt to at least back it up to the extent that is does make some sense, Senator Berman has rightly said, ''Well for goodness sake, it doesn lt apply to the nine hundred and forty-three school districts of this State.f' We are going to make the Auditor General a czar, and nobody ever intended that. would move the adoption of Amendment No.

T rise in opposition to the amendment, and I Would suggest, Senator Berman, that in the -- to the amendment -- to the amendment -- I would suggest in a sense that your amendment, the text of which I do not have: although I listened to your reading of it, proves too much, because if you are going to exempt explicitly school district from the coverage of public funds, as it is defined in this proposed amendment, am not sure Why you Would not also have to exclude a1l of the other five thousand nine hundred and seventy taxing units, plus another one thousand units of local government that are part of the State of Illinois structure of government, as well. I donlt see ehat there is any distinctlon. And so if your basic argument is correct, that this mandates that the Auditor General audit all of the funds of the school districts, then by your amendment, you are making it quite clear that somehow the Auditor General would have STATE 0F ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 81st Legislative Day April 26, 1990 to audit the funds of all of those other thousands of units of local government. And as I indicated, I think, you have really tried to prove too much. It is not -- it is absolutely crystal clear, in my judgment, that this language does not do What you initially suggested, and that the amendment to exclude school districts and school diskriets only, is really b0th unnecessary and actually shous confusioh about What We are attempting to do kn this amendment. I would sug:est that public funds of the State means a1l funds administered directly or indirectly by the legislativer exeeutive or judicial branch, et ceterae does not require the kind of What 1 believe is confusion that your amendment would sow. I think it is absolutely unnecessary, and really intended to seuttle what I think is a extremely important concept. And 1et me just say, a1l we have been saying a11 of this time is that the funds particularly that relate to the two lawyers' agencies are indeed comparable to licensing fees from any other profession in this State, and they ouqht to be subject to the same kind of audit by whatever the appropriate agency ls. And if that is not corrected, we are going to leave a major gap in the thrust of State Government. This amendment your amendment does not help that; it hurts it.

Thank you, Mr. President. I'n rather surprised to hear Professor Netsch give the commentary that she did. The other units of local government are very explicitly stated, in our Constitution and in our Statutes, that they are entities of such as local government. They are eneities unto themselves. The city - - the cities, municipalities, townships are entities unto themselves under our governmental structure. School districts -- school districts are creatures and are controlled by the State. And that is the reason for this amendmenk. It is nat to scuttle this amendment. It is to clarify that the Audltor General will not walk into your school district to perform an audit of your school district. You can bet your bottom dollar that uithout this amendment: he will never be allowed into your cities to do their audit. ïou know that and I know that. Dut I will tell you that under the interpretation of what a sehool district is - namely an entity of State Government - without this amendment, the Auditor General has that power. I urge an Aye vote.
