And it fs a special honor , not only because I 'm the -- I have the privilege of represent ing them , but they are the smallest school in the State - the Findlay Falcons - ever to win the State Championship in this State . With ninety-six students strong, this school has stood tall and won a victory that I think is more than well deserved, and they've won it with the hard work and courage that a1l of us applaud . SENATOR DEMUZIO I : I Well, if I might, for the edification of the Members: then, perhaps I ought to call the attention of the Membership to the fact that the Balanced Budget Note Act indicates that for any supplemental approprlation bill - and that means any appropriation bill that is introduced or amended, including any changes to legislation by means of a -- of the submission of a conference committee report, on or after July lst of a fiscal year, and proposes: as introduced or amended as case may be# to authorize, i increase, decrease, or reallocate any general funds appropriated 1 I for that same fiscal year. The general -- the general funds consist of General Revenue, Common School, General Revenue Common School Special Account Fund, and Education. But more -- more specifically, Senator Maitland, the note's eontents shall be factual in nature, concise and shall include a brief explanation of the nature of the measure and a reliable estimate of the measure's anticipated effect, in dollars, on the State budget for that fiscal year. The note shall include both the immediate k i effect and, if determinable or reasonably foreseeable, the long-range effect of the measure. A brief summary or work sheet of the computations used in arriving at figures contained in the Balanced Budget Note shall be included. Each Balanced Budget Note shall include a discussion of the proposed reduction in other appropriations or increases in State revenue that would allow the measure to be adopted without adversely affecting the State budget for that fiscal year. John, that's very good. I've been here eighteen years. HoW do -- how do you waive a law? I -- I don't know hoW We do that. It just seems to me that We ouqht to comply with the Act as of January the 1st, that we ought not to attempt to circumvent the process and circumvent those laws that -- that -- that we wish to comply with or those that We don't wish to comply With. It seems to me that this is an important subject. It seems to me that that information was one that passed almost unanimously in this Chamber and also in the House Chamber. If we are -- legislators are going to go against that -- those Acts and those laws that we passed, then why are we here? It seems to me that we ought to comply.

Thank you, Mr. President, Ladies and Gentlemen of the Senate. I rise in opposition to this Motion to Suspend the Rules, for the reason that it seems to me I heard - along with every other Member 21 STATE OF ILLINOIS 87th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 88th Legislative Day March 31, 1992 of this Chamber at some great length last June and early July - that the Governor of this State did not intend ever to deal with the fiscal year's budget piecemeal. And it seems to me that's exactly what he is now proposing - a piecemeal approach. As I'm sure everyone is aware, next Tuesday We will have the opportunity I ( to convene in Joint Session to hear publicly the Governor's budget I i recommendations for the next fiscal year. And as everybody also I well knows, part of that pronouncementr obviously, always is, ''What about the remainder of this fiscal year?'' And so# there is usually at the back of that budget book a list of proposed supplemental appropriations to finish out this fiscal year. I don't know of anybody that can stand here and tell me - or attempt to tell me - that there Will not be any other appropriations of a supplemental nature requested. It just doesn't seem logical or reasonable, given the demand on government that we have seen, given the demand on entitlement programsy and confronted with the fact that the Comptroller of Illinois is sitting there with somewhere in the neighborhood of seven hundred million dollars of unpaid bills on her desk and is confronted with a forty-eight-million-dollar General Revenue balance - as of today - I am reliably informed. It just seems to me that this is indeed a piecemeal approach. I had suggested to the Minority Leader that next week would be more appropriate -- a more appropriate time to deal with this. And I renew that request and would urge opposition to this motion, if indeed the Gentleman persists.

As -- like everyone else here, we just received the list that would be the subject matterz I guess, of the amendment - we presume to be the amendment. There are a hundred and seven funds 22 STATE OF ILLINOIS 87th GENERAL ASSEMBLY . REGULAR SESSION SENATE TRANSCRIPT I 88th Legislative Day March 31, 1992 ' ; ! in that list. 1111 read a11 hundred and seven of 'em. No, not really. I think the concern is not Whether or not we should be payin: for the health care of the State employees who have, in fact, been making their contribution to the system, but whether legally we can take from some of these funds for this purpose: U.S. Environmental Protection Fund; the Social Security and Employment Service Fund; yes, the State Pension Fund; the i Unemployment Compensation Special Fund; Pharmacy Disciplinary Fund; Public Dtility Fund; the Lottery; the Road Fund; the Drunk and Drugged Driving Prevention Fund; child support funds; funds for peaple in need of energy assistance; Children and Eamily 1 S I ervices funds; job training funds; the pension funds; USDA Woman and Infant Care Fund; on, and on, and on. We have asked some questions of ''Do we have any authority to take from these federal funds?'' and we Were toldr ''Gee, we think so.'' And we suggested maybe someone ought to call some of the federal bureaucracy and see whether federal regulations allow us to dip back into these funds for purposes of making a transfer from these special federal funds, and other fundsz to pay for past medical bills of State employees. Not an unreasonable question, I would think. We 've learned in the past that the administration has not called the federal agencies often when they have suggested budget solutions that have been found to be illegal under federal law. With that kind of track record, it seems only logical that before we decide that our solution is to take from a11 of these funds - these hundred and seven funds - some money, we should know two things. One: How was the allocation made amongst these funds? A question we have asked and have been told, t'Why, we don't know. In fact, some of them we haven't even figured out yet how much we really need.'' And twog when you get into the federal funds: Can we, in . ' fact, take the money? And if somebody told you, who? So we can have on the record that we have been authorized to make these 23 STATE OF ILLINOIS 87th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 88th Legislative Day March 31, 1992 deductions, and not find ourselves June 30th having to pay all these back because under a federal 1aw it was held to be illegal. I think these are the kind of questions that every Member of this General Assembly should want to know the answers to# before we take the type of action that we have been criticized for in the past - and that is acting without knowledge. I think it -- it is improper to throw this on the desk today, with no answers to questions, and expect us to react. I think it is better that they answer the questions that we have asked, in writing, and then allow us to make an intelligent decision for a change.

Thank you very much, Mr. President and Members of the Senate. Senator Carroll, it -- it's my understanding that you didn't just get this information. I think you had it - or at least your staff had it - as early as this morning. Now what you have before you, as you know and I know and others know Who work in this process, this is a menu of -- of funds that can be utilized - or we can go and touch for the group health policy of the employees within that fund . And I reeognize and that was one of my first questions that there are some funds there that we probably won't be able to tap . We know, in a11 likelihood, that the whole twenty-four million dollars will not be able to be utilized. We - - we know that. But at least a portion of it will be there. So this is a menu of funds that can be utilized for this legi*imate purpose. So to suggest that we ought to know today is simply not proper or just, because we did this last spring and we did it again in January. Keep in mind, Members of the Senatey we are dealing with State employees Who are noW on the hook for millions of dollars of their health care benefits that have been provided by hospitals and doctors across this State, and are now finding 24 STATE OF ILLINOIS 87th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT ' 88th Legislative Day March 3l, 1992 the service shut off. This is an emergency issue. If there are ! ! other questions that need to be asked, allow the amendment to go on# and -- and lek's ask the question later on, as we pass the bill out of here -- or we move the bill out of here. I would onee again, Senator , Demuzio, Senator Carroll, and others, ask you to accept in a favorable way this reasonable request. PRESIDENT ROCK: i Thank you.
