Thank you, Mr. President. This is the amendment that We promised the committee at the time the bill came out. The amendment is as a result of the suggestion of the Illinois State Bar Association, which removes their -- if adopted, will remove their opposition to the bill. It operate -- it moves the bill's operative language from the Dissolution of Marriage Act, paragraph 503(d) to paragraph 503(g). What this does, without getting in a too lengthy an explanation, is to allow the court to consider the conduct of a party when a -- an aggravated battery or a sexual assault is committed against the child, and this would allow - under the amendment - allow the court to decide to impose a constructive trust on jointly held property for the benefik of the injured child. I would ask for its adoption.

Thank you, Mr. President, Members of the Senate. This amendment is identical to a bill that we passed last year, House Bill 298. And it was amendatorily vetoed by the Governor. It was - - the amendatory veto was accepted in the House, and for some reason we did not call it in the Senate. So what this amendment is ts identical to the bill, as amendatorily vetoed by the Governor. And it deals With -- and it's appropriate that we consider this now. You may recall this came up last year When the Chicago Bulls were involved in the championship game out in Los Angeles, and it came to our attention that the State of California was taxing the income of the Chicago Bulls when they played in California. And We, in the State, in effect, were losing that revenue, because those athletes were able to take a deduction on their State income tax. So what this bill does is to impose the State income tax on performances in Illlnois by professional athletes who are residents of states that impose a comparable tax on performances by Illinois athletes. And it begins the 1992 tax year. It only applies to -- as I said, only applies to athletes who are -- who are domiciled in states that have a similar tax . There -- there are no real grants like this. They'd have to be applied for. Therefore, he is not there to do it. It is not another group that can apply for the grants. It is only that one position that will no longer exist.

I -- I think youdre -- you may be mistaken. The problem is that the expiration of that office is, I believe, August of 1985 <sic>. This bill takes effect either immediately or in January. You're goin: to have three years of grant applications that the County of Cook is being cut out from . I -- correct me if I'm mistaken. Unless you want to -- can we take the bill out and look at it, and recall it tomorrow, Frank?

Can do the one correction, 'cause when you understand, I don't think it's controversial. The school districts are not excluded from doing it. No one Would be excluded. It doesn 't stop any district from applying for the grants. All it says is the regional superintendent Won't -- that's a1l it says. No school districts excluded. It doesn't limit any -- Cook County and the City of Chicaqo district could apply. There are no limits like that.

Well, I'd either ask to withdraw it, or agree to recall the bill to make this amendment effective August of 1995. I'm just concerned as to what's going to happen in the three years while he's still there.

Cook County is not excluded. A1l we are doing with this amendment is just not allowing Superintendent Martwick, who the County Board, virtually unanimously, has done away with the position. Wedre simply not allowing him to step in between the school districts and the State Board. See, without this amendment, Superintendent Martwick then can intercede between the districts and the State Board. The County Board has done away with the position. A1l this does is set it up so that the school boards can apply. It doesnlt limit anyone. Takes no money from anyone. Doesn't keep them from doing it. It just makes sure Superintendent Martwick doesnlt intervene between the City of Chicago and the State Board.

Well, Senator Eeats, again, I would ask if you either withdraw it, because if this is good for downstate regional superintendents to facilitate the obtaining of grants, then it ought to be good for at least the next three years in Cook. Otherwisez put in an amendment to make this amendment effective the date that Martwiek expires. That's -- that would be fair enough. I'm not sure where it helps or where it hurts, but as long as he's there he ought to have the same status as we 're qiving to the downstate superinEendents. Why don't you take it out and Wedll -- if ik's meritorious, he'll recall the bill.

What they did is they cut his appropriation substantially, but there is no way that the County Board can eliminate his position, because he's elected to it. And what Art is referrin: to, that's the date of the termination of his elective office. And what you're doing with this amendment, you're excluding Cook County from providing grants to the school districts that are in need of those grants. And I would hope that this amendment would either be withdrawn or defeated. PRESIDING OFFICER: (SENATOR DEMUZIO) Further discussion? Senator Rock. SENATOR ROCK: Thank you, Mr. President, Ladies and Gentlemen of the Senate. I would hope that Senator Watson and/or Senator Keats Would heed the admonition. This, as I understand it# the proposal, as amended, is a proposal from the regional superintendents to afford them authorization to receive grants. And the question then is a logical one. If every other regional superintendent is afforded this authority, why not the regional superintendent of Cook County? It simply doesn't make any sense to exclude the Cook County regional superintendent from a bill which authorizes every other superintendent to do something. That could be al1 part of it. I'm sure there is a concern from the suburban and city districts that if Superintendent Markwick decides that he wants to apply for these grants, instead of the City of Chicago, or the City of Oak Park, or the City of Evanston, that he would have an interesting habit of keeping some. Therefore, the County lowering his budget would be irrelevant. He would start taking these State grants after he applied, technically, for the lunch program in Oak Park.

To -- ko the amendment: T would support it, for the simple reason that this problem, indeed, does exist, and if -- if Superintendent Martwick is not using his funding already to -- to undercut suburban school programs in in Suburban Cook County, canft see why we should give him any more funds through a granting program. because these are obviously not going to where they ought to be going - the monies, that is. And the State Board of Education, after at least two attempts that I know of, in trying to get him to -- to pay for these programs, for which he is responsible, is getting nowhere, and if that's the case, really don't think We ought to include him in this program or any others.

Whaty I think We -- thank you, Mr. President. I think what we have to do is really address the issue of how the grant money is spent. And there is no elected official that can apply for grant money and then spend it in his or her discretion. When you receive grant money: therefs exactly how that money is supposed to be spent. What you're doing with this amendment is eliminating 36 STATE OF ILLINOIS 87th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 119th Legislative Day June 1992 Cook County in getting grants for its school districts, and I think that's wrong.

It begins With the 1993 extensions, based on 1992 levies. That is next year's tax bills. And it takes out the requirement that allowable extensions would be determined using prior year EAV, Which we placed in last year's tax cap legislation for Collar Counties. SENATOR ROCK: I'm not sure everybody understood what Senator Dudycz is trying to do here with Amendment No. 1, but I consider Amendment No. l hostile. And I Would ask the Gentleman to withdraw it. That is a battle that can yet be fought another day. Amendment 66 STATE OF ILLINOIS 87th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 119th Legislative Day June 17: 1992 No. 1, as I understand it and have seen it, incorporates the provisions of Senate Bill 1474, which is still sitting on page 39 of our Calendar, having failed to receive sufficient votes to move it out of this Chamber. The concept has not gotten any better since that time. As a matter of fact, in my judgment, it has gotten worse. And it's worse when it's to be applied to this bill, because I hope you realize that House Bill 3456 is an attempt to provide tax relief this year - not next year - this year for the homeowners of Cook County, in that it purports to raise both the homestead exemption and the senior citizen exemption, in light of the fact that there has been a reassessment in the entire City of Chicago and there has been a dramatic increase in the equalized assessed valuation. And so We are attemptin: to provide some immediate tax relief. Even if -- even if Amendment No. l got on, that does not provide any tax relief until the following year. So I would ask the Gentleman to please withdraw it, given the fact that this is hostile to what We are trying to do to afford some immediate tax relief to your constituents and to mine. And I would urge opposition, strong opposition, to Amendment No. 1.

So that the original bill is an unfunded mandate, but what this does, in reality, then, applies the tax cap freeze. So what you're really arguing ls that an unfunded mandate would be a better way to solve the tax problem than this amendment, which in reality allows for limitations, but not an unfunded mandate. This is not the funding amendment that wedve been considering or that's been brought to my desk, and yet obviously, there's not much agreement on it at this point. So at this time will be just offering this Amendment No. 1 and moving the bill on until we could further sit down on the funding part. So I would move its adoption.

Yes, Senator Pawell. It's -- Well, wedre saying that it -- it's like those services that are preventative that are -- there 's about a dozen now: home health services, home nursing services, homemaker services, chore and housekeeping services, day care services, education in self-care, home-delivered meals. And research shows that it's more cost-effective to provide these services to maintain the elderly in their home, and providing meals in their home is probably a better way to keep them alive and functioning than putting them in some institution and watching over them. And it's also cheaper. So that's all we are doing at this time. There is a proposal - ik's not an amendment - that I - - I have not seen in an amendment form, but there is a proposal for a funding mechanism to change the allocation that Would probably be disruptive to suburban areas, and as a representative of a suburban area, I am concerned about that too. So I'm not prepared to even deal with that at this point.

Senator Savickas, I couldn't agree with you more, but that is not what your amendment does. Your amendment says that the Meals on Wheels, in effect - in which that's what youdre talking about must be provided now through a nutrition provider, which ls funded by the area agency. Now, my my question isy What's your definition of a nutrition provider? In -- in my county, and in on - - and I know in a lot of counties, those are done by -- by townships. The meals are cooked in the township office. They dre not nutrition providers, per se. They are -- they are people who are cooking meals to deliver to these seniors. It is not a good idea, and -- and I am going to ask you to withdraw this amendment, and -- and -- as you promised in committee.

This amendment was originally prepared by the Department of Aging to be put on my original bill to bring it into its proper form. Thank you, Mr. President. Committee Amendment No. l deleted everythinq in the bill, and now provides that the costs incurred as a result of the release of petroleum from an underground storage tank installed after July 28th# 1989, requires that the deductible shall be ten thousand dollars if the tank was insealled and opera*ed in aecordance with the rules of the Office of the State Fire Marshal. It also says that a complete application for eligibility determination is received by the IEPA by December 31st, 1992, the deductible amount of one hundred thousand dollars shall not apply in fact, the site does not contain any contaminant, and -- that it exceeds the groundwater standards adopted by the PCB.

And also on page 2, in line - - in line l4, paragraph shall read, ''No minor taken into temporary custody shall be placed in a jail, municipal lockup, detention center, or secure correctional facility.'' And then we amend it by adding a paragraph in line l9, that says -- paragraph 4, we deleted lines 21 throuqh 26, and inserted a new paragraph, Which says, quote, '1(4) except for minors accused of violation of an order of the court,...'' et cetera, et cetera. And so I move for the adoption of this amendment.
