1 STATE OF ILLINOIS 88TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 30th Legislative Day March 31, 1993 Yes. Mr. President and Ladies and Gentlemen of the Senate, we have with us today a most interesting guest who is visiting in Illinois for two weeks here with the John Marshall LaW School. He 's none other than Dr. Jiri Kroupa, who is the Dean of the laW school over at the Masarykova Unlverzita, Which is in Brno in Moravia. That's the central part of the former Czechoslovak Federation, now part of the Czech Republic. He's here on a two-week visitz which is nationwide. He 's golng to be visiting with the American Bar Association as part of their initiative to develop a sister school tie with institutions ln central and eastern Europe. He is -- is head of the the Department of Political Science and Constitueional Law. Most recently, he 's been an active participant in the preparation of the new constitution for the newly created Czech Republic, which was formed at the end of 1992, and he also participated in the preparation of the previous cpnstltution that came into being with the return of democracy to Czechoslovakia. He's quite an outstanding fellow . Wedve been having a wonderful time this morning speaking my native tongue. I spoke Czech before I spoke Englishr so it 's kind of fun to renew those ties, and he is visiting here, and would like to say hello to a11 of us today. And if I may introduce Dr. Jiri Kroupa .

I -- I would like to note that Dr. Kroupa is accompanied by Ernie Melichar who's the Development Officer for the John Marshall Law School, and when he goes back to the Czech Republic, he wll1 be taking a set of our Illinois State Statutes with him. So as the Czech Republic kind of builds its set of laws, we will have an influence on what goes on there as well. So here we are; the cradle of civilization of the world. Well, it's my understanding now that this amendment was referred by the Rules Committee to the Insurance Conmittee. Senator Demuzio, consistent with the Senate tradition and Senate Rule 5-b Ksic>, the principal sponsor of a -- of a bill controls that bill. Accordingly, if a sponsor Wishes to move a bill from 2nd to 3rd Reading while the Floor amendment remains pending in committee, itls the sponsor's prerogative. Now is that the policy that's going to be; that any Member of the Body can move a motion to adopt or table an amendment when they aren't the sponsor of it? Just a procedural question, like to know. It's not a question as to whether or not the amendment is technical or just changed the effective date or whether it's agreed to. The question comes in mind to the Body is that your -- your ruling that a Member can move another person's amendment when they are not the sponsor of such amendment.

Could you tell what that money is going to be spent for in that district, why it's so much larger than every other district in the State?

I don't think -- Senator Welch, with a11 due respect, don't think -- the -- the amendment is in the amount of a hundred and ten million dollars. I think youlre probably talking about the whole FY'93 federal appropriation. And this is a speedup. I think it is a part of the Clinton economic stimulus package.

Okay . It's an increase for statewide spending . Do we know where that money is going to be spent on the statewide increase of a hundred and ten million dollars? Do we have an idea? And what would it be spent on?

It's part of the five-year plan, an acceleration of that. As far as I know, there is no -- there is no determination as to where exactly that money is going to be spent. I would imagine it will go in -- in the direction of those that are -- that are ready to go -- the -- you know, that are on-line and ready to move.

I was just wondering. You said that this is to implenent the Clinton economic stimulus program . Is that What we're doing here? We're anticlpating the President's plan is going to pass and and we're spending the money already. Is that What weire doing?

Senator, it -- that -- that's right. It is our understanding , it is a part of that plan. It is an acceleration, and it's a release of some of those funds that were -- that were frozen and will be released by -- by IDOT.
Senator Welch.
It's a release of frozen funds, or it's a -- it's a part of the stimulus package of the President that depends upon enacting the energy tax and the BTU tax . Is it -- is it based on enacting those taxes? And if so, does this make us the first State in the nation to spend money to stimulate the economy based on President Clinton's plan?

Senator, don't want to get into a11 the mechanics of the -- of the economic stimulus plan. This is eighty-five percent of those -- those funds were frozen. This is the -- this is the additional money and -- and is being released.

Well, hoW -- how could a President Who 's been in office less than three months freeze all that money? And yet, this is also part of a stimulus plan that hasn't passed. Itls either one or the other. I don't see how it could be both. My understanding is that this is the anticipated speedup of -- of road building programs and bridge building programs that President Clinton talked about throughout the campaign. He's -- he's proposing various increases in taxes and revenue to the federal government to return to the State so that We can get the economy going. And is that what this is? Is this the first implementation of the stimulus throughout the country? That's what lookso..tmicrophone cutoffl...

Senator, you and I both know , this is the authority to spend . This is their best guess of the additional money that will be freed up, and is our -- it is -- it is this State's - State of Illinois' - allocation of those funds. It is their authority to spend those funds, in the event that they cone.

Thank you, Mr. President. I guess the first question is - since I was a little confused, I admit, by the answers to Senator Welch 's questions - what causes this hundred and ten million to come to Illinois, and when does it come?
Senator Maitland.
Senator Carroll, I thought I -- in response to -- to Senator Welch 's final question, I indicated that this -- that this was the - - the final fifteen percent of the money; We Were frozen at the eighty-five-percent level. And think we discussed that in committee. This is that final fifteen percent that hopefully would be released, and this would be our allocation, to the best of IDOT 'S estimation, of that money.
Senator Carroll.
And this -- this allocation of the remaining fifteen percent comes to us automatically, or does Congress have to do something first? And if so, What do they have to do?
Senator Maitland.
assume that it has to pass either the Senate or the House or whatever Chanber it's in: but don't think that is even at issue today. Al1 they are doing is, this is the authority to spend that 63 STATE OF ILLINOIS 88TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 30th Legislative Day March 3l, 1993 money in the event that Congress acts. I don't know -- you know -- I've explained that a couple of times, and think that's that's the reasonable answer.
Senator Carroll.
Well, maybe just because I think that for Congress to act: they have to pass some taxes to pay for It's not an existing prcgram that they froze part of and have not yet released. This is not part of the energy taxr whether it's by BTU or anything else, or an increased gas tax, or the tax on -- on natural gas and oil, or on grazing fees, or whatever it happens to be. Does there not have to be a new tax at the fede'ral level before they can release these funds to Illlnols?
Senator Maitland.
Senator Carroll, we don't know the answer to that for sure. We simply don't. And we crossed, if you recall, some of these same questions in committee, and IDOT gave us the assurance that, with this authority, they would not spend the money if the additional funds were not forthcoming from the feds. There are a number of -- of hoops that -- that they have to -- move through in Congress before the money comes here. This is only the authority to spend.
Senator Carroll.
Thank you, Mr. President. seems to me - maybe, rather than ask further questions - IDOT were prepared to spend these funds, why will they not release the list of what projects they are prepared to spend them on? If you look at the amendment 64 STATE OF ILLINOIS 88TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 30th Legislative Day March 31, 1993 itself, you will see that they have allocated funds to the various subdistricts in the IDOT scheme of things, from Districts l through and then have a statewide. If they, in fact, are planning to spend funds and have planned out alreadyr why can we not then get a list and add it to the districts where more appropriately belongs? And...tnicrophone cutoffl...tn addition and maybe I can ask these al1 at once, to save some time - in addition, the federal fiscal year ends September 30th. What is the hurry now, when we do not know if the money is comingy we do not know where it's goin: to be spente and yet we're being asked to give authority? If nothing happens in Congress, IDOT can, in fact now, take -- since they have linited resources, take moneys ln effect, away from each of our subdistricts by not spending in those accounts, because they noW have more authority to spend in the skatewide account from the existing tax sources. We have given them the authority, by this amendment, to spend on any project they want without limiting it to the districts that the General Assembly said, and the Governor said, should have the money to spend. So I think there's grave concern with this: One, we do not know if there's golng to be a program; two, we do not know what taxes are going to have to be passed to implement the program; three, there's no need to be doing it during this fiscal year because of the federal fiscal year; and four, We're taking noney away from projects theyfve already assured us were going to be done in various districts if no new federal funds come lnr because this gives them the authority to spend it in a different area . Is a1l of that basically correct, Senator Maitland?

Thank you, Mr. President. Senator Carroll, I -- I too regret that we don't have a list of the accelerated projects at this 65 STATE OF ILLINOIS 88TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 30th Legislative Day March 3l, 1993 point. We, as late as this morning, anticipatlng this question, were attempting to get some of those answers. Let me -- let me say, Senator Carroll, think you asked Senator Carroll? Senator Carroll? Okay, okay. This is not unlike what you and I have done on a number of occasions as We give the authority for anticipated revenue. You indicate: why do now; why not wait till September? And I would say to you, and the Members on your side of the aisle, and on this side of the aisle, that we are approaching the summer construction season, and if there is money forthcoming, quickly, to speed up some of those projects, many of them could be completed prior to inclement weather next fall, and think that's critically important.
Senator Carroll, for the fifth and last time.
Well, no, I'm still on my questions With him, Mr. President. Nobody said September. We're going to be out of here May 28th. There'll be the Fiscal '94 budget that we'll have to pass by May 28th. would seem to me by then we would have a better idea there is a stimulus program, we would have a better idea of where those projects would be, and that would be the better time to do it. Webll pass that budget by May 28th and they can, in fact, let the contracts at that point. I think that this is a way of taking away from districts, if nothing else passes, if we do not get these funds; we've given unfettered authority to Illinois DOT to take money away from Schaumburg, Dixon, Ottawa, Peoria, Paris, Springfield, Effingham , Collinsville and Carbondale districts, to spend it on some other program if they so choose, and I think we should not be supportive of this at this time.

Senator Maitland, I would feel far more comfortable in voting for your amendment if I knew where the hundred and ten million dollars was to be spent. don't know if it's going to be spent Chicago, or Dupage County, or downstate, or where. Now, 67 STATE OF ILLINOIS 88TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 30th Legislative Day March 3l, 1993 it seems to me that this economic stimulus package that you are so in favor of in Congress, if it passes, it certainly will have -- afford us the opportunity, I suspect the opportunity since wefre going to be in Session - to really have IDOT list Where all these projects are and how much money is going to be spent in what districts. What's the hurry? Maybe it is a good amendment, but it just seems to me that today, without knowing where a hundred and ten nillion dollars of Road Fund money is going to be spent, I think you're buying a pig in a poke today. Let's get the list from IDOT so We can make an intelligenty competent decision as to whether or not this is the appropriate public policy for us to take today. Can you get us the list, Senator Maitland, so that we would have the opportunity to know what projects and what districts these dollars will be spent in?

Senator, I've -- you dre -- I've answered the questlon twice, and Ifm going to answer it again. The third time: We don 't -- we don't have the list. This is not unlike authority that we've granted before. IDOT has assured us that this does nat affect any projects that are ongoing if the money doesn't come. If you don't like the amendment, I would suggest that you just vote aqainst it. It's going to benefit your district and everybody else.
Senator Collins, for what purpose do you arise?
Well, 1et me just continue because I don't know that; you don't know that. And so, what do we have to go on here? It's my understanding that we have sixty days after the bill pass in Congress to make that decision without losing the money. So I don't understand what the rush is. I think it's -- it's fair that -- that We on this side of the aisle -- at least if you 're not going to allow us to participate, the money to be distributed in a fair and equitable way throughout the State that would impact on our districts, at least we ought to know where -- what you're going to do with it before the vote is taken.

Yeah. Thank you: Mr. President. I don't have a question, but to reiterate what has been said by my colleagues on this side of the aisle; and that is# Why are We rushing into somethin: that we don't even know where the money's going? But I am pleased to see the Members on the other side of the aisle who were so critical about the stimulus program coming out of Washington, but they 're eager to jump on board and try to grab the dollars that they don't even know where they're going to be spent. As Senator Carroll pointed out, it may be some taxes tied in here to get this. But you want to spend the dollars and at the same time criticize. I would think that the Members on both sides of the aisle should want to know where we are going to spend one hundred and ten million dollars, rather than have us try to buy a pig wrapped in a blanket. But also pleased by your putting this forward -- this amendment forward, that you recognize that the President has a good program; you recognize that it's needed. And since you recognize that, then give each of us, on both sides of the aisle, the power to decide or at least give us the opportunity to have some input as to Where the stinulus package will go for the Road Fund, because you don't know and you don't want to be voting in 69 STATE OF ILLINOIS 88TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 30th Legislative Day March 3l# 1993 the blind. When this bill Was was heard in committee, we had removed all the operation requests in the amount of five million nine hundred and eighty-eight thousand seven hundred dollars because we weren't certain that DCFS was going to be able to put on the number of people that they had thought they were going to be able to put on to meet the B.H. Decree mandate by July 1. We have discussed this with the Agency at great length and are reliably convinced that the amount we are putting back in is the amount that the Department will be able to spend between now and -- and July 1. I just Want to 'say that I think that this is the only part of the bill that really makes a 1ot of sense at this particular point in time, because we have a -- a lot of time to do the rest of the supplementals that We're in the process of doing. However, this particular one, think, takes care of some needs that that have been out there. And I'm just curious how many children we could have saved if we would have done this whenever we were looking at the problem last year. And I think it's unfortunate that we waited this long, but I think this is the one part of the bill that nakes the entire supplemental palatable.

Thank you very much, Mr. President, Members of the Senate. Senate Bill 3l2 is the supplemental appropriation bill for FY'93. It appropriates two hundred and sixty-nine million ten thousand five hundred dollars of General Revenue, eight hundred and twenty-four million one hundred and nlnety-eight thousand dollars in other funds, for a total of one million ninety-three thousand - - one billion -- one billion ninety-three million two hundred and eight thousand dollars. And 1et me just briefly go over some of the components in it, many of which we have already discussed. The 75 STATE OF ILLINOIS 88TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 30th Legislative Day March 1993 Department of Alcohol and Substance Abuse: it -- it funds the additional Medicaid treatment liability in the amount of 8.4 million dollars. It appropriates thirty-six million nlne hundred thousand dollars for group insurance speedup. We had added an addttional twenty-one million there to shorten that -- the number of days in the payment cycle. That, of course, will come off of the FY '94 appropriation. It fully funds a substitute care shortfall in the Department of Children and Family Services. We believe meets the spirit of the B.H . Decree, by allowlng the hirlng of the people necessary to -- to meet that mandate by July l of this year. In the Department of Public Aid, increases by a hundred and twenty million dollars Medicaid spending for hospitals. It reduces the transitional line item, which is a which is a surplus at this point from AFDC and We'1l use that revenue to fully fund the nursing home grant program that has been underfunded by about eleven million dollars. We anticipate that that Will pay al1 of those individuals who are paying the tax whose income is below fifty thousand dollars in the amount of the two-thousand-dollar grant. This w111 fully fund that. Mr. President, that's the -- those are the major components of the supplemental. I would seek your support, would be happy to respond to any questions that any Member might have.

Why, thank you, Mr. President. Are these at the level that the Governor had recommended for each of the categories, or has there been any additions to the Governords request?
Senator Maitland.
Senator Carroll, the -- the current level of the bill - and I - - I did misspeak - is at tWo hundred and eighty-six million dollars in General Revenue. Two hundred and eighty-six nillion eight hundred eighty-one thousand dollars. Much of that is the twenty-one million dollars that -- that is added to Central Management Service for speedup of health care payments and that comes off of the FY'94 appropriation.
Senator Carroll.
Thank you, Mr. President. Have We cut anywhere in Fiscal '93 the twenty-one million to pay for this, so that we would have the cash? I don't think we've ever heard that there's surplus cash around, and I don't believe there's been any revenue increases. And while it may be a wonderful idea to pay the bills early, was there a concomitant cut somewhere in spending so that we could afford it this fiscal year?

Senator Carroll, the revenue projections are -- are slightly above what we had predicted, and we prepared for you a balanced budget document, which -- which you have seen and all Members have Seen .
Senator Carroll.
I think what bothers me about that, Senator Maitland, in a1l seriousness is, Governor has said we're not going to pay -- originally said, when the budget came out last March, that We would not pay seven hundred and sixty-five million dollars in bills this year; that would be our lapse-period spending that goes into the next fiscal year. It's my understanding he just said that we were going to go about nine hundred and eighteen million dollars that We 're pushing over into Fiscal 194. So, in fact, there is not more revenue; there's less. And we're -- in fact, we're going into greater deficit funding of government by pushing another hundred and fifty, sixty million dollars into the next fiscal year. There cannot be another twenty-one million to pay for this, except to force more money to other vendors into the next fiscal year. So it may mean, yes, that our bills get paid in a more tlmely fashionr that our doctors are happier because they got paid, but other people who do -- will do business with the State, according to the Governor, are now getting pushed off for another year because there is no extra income. Otherwise: why 78 STATE OF ILLINOIS 88TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 30th Legislative Day March 1993 would the lapse-period spending have to go up to such a huge amount that's getting pushed into the next fiscal year? There is no cashr and al1 wedre doing is paying our own bills to stiff someone else.

Thank you, Mr. President. just wanted to say that I want to congratulate the Republicans here in the State Senate. In spite of all the arguments in Washington, D.C ., against the President's stimulus package, that it's not needed, you sve shown the foresight and said that we're going to spend that money because we need that stimulus package here in Illinois. Illinois is going to be the first state to back President Clinton in -- in building up the economy, getting the economy moving again. And I just want to say that in the halls of Congress as they debate those taxes and those new revenues, that here in Illinois they'll be able to shoW a piece of legislation where al1 of us, Democrat and Republican, went on record saying that we need that money, the economy needs the stimulus, and wefre a11 going to vote to pass this. So I want to congratulate you and I'm voting Yes.
