Senator Topinka and I introduced this legislation -- or this resolution because of the fact that the Metropolitan Water Reclamation District of Greater Chicago was planning an expansion of a stormwater and sanitary -- sewer reservoir in and about the Village of Mccook, whlch is part of Senator Topinka 's district and part of mine. The original 1986 proposal contained no provisions for the closure or the abandonment of the highway. Lo and behold , Senator Topinka and I learned of the closure of 55th Street, which 8  STATE OF ILLINOIS 88TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 42nd Leglslative Day April 28, 1993 would physically really damage our district, not only to the buslnesses, but to the residents which live in thls community. And what this resolution does is urges the Metropolitan Water Reclamation District of Greater Chicago to reconsider its plan to re-close -- or tc close 55th Street. It urges the U.S. Army Corps of Engineers and the Illinois Department of Transportation not to approve a plan which will result in the abandonment of 55th Street: should the Reclamation Distrlct pursue the abandonment. And would thank Madam President for callin: this Senate Resolutionr and just ask for its adoptlon.

Madam President and Ladies and Gentlemen of the Senate, this urges the Emerçency Management Agency to convene an Emergency Management Advisory Committee in order to study the Emergency Operatlons Plan and any changes which should be undertaken to facilitate additicnal coordination between the Emergency Management Agency and local governments and other entities and any groups that would be involved in handling emergencies, disasters and things of that nature in the State of Illinois. They have contributed. They endorse it, and to my knowledge, no one has a problem with it.

Yes. Madam Presidentr Ladies and Gentlemen of the Senate, what this does is clarifies the legislative intent in -- to how it includes a11 agencles, departments, boards and commissions of -- of State Government which publish annual reports under the State Printing Contracts Act's jurisdictions. What occurred was, was last year we put through a bill that said there would have to be a disclaimer on the annual reports of the various agencies of the State of Illinois. There was some question on Whether or not the boards of -- the Board of Regents and the Board of Governors and the University of Illinois would fall under this Act. And it is the desire of this resolution to show that that is indeed the intent, and that they do indeed fall under the Act. PRESIDING OEEICER: (SENATOR GEO-KARIS) Go right ahead, Senator Watson.

Thank you, Madam President. This resolution creates the Chicago School Turnaround Commission, to help those reform groups and others assist in -- in the actual reform that's going on. And we a11 recognize that reform is an important part of certainly of the Chicago public schoolsr and reform is working. And this Commisslon is the one in -- which hopefully will help assist the reform groups and others to accomplish the reform desired . This would conslst of eighteen Members: nine appointed by the President of the Senate, and nine appointed by the Minority Leader of the Senate; three public members with significant experience in corporate management; three public members with significant experience in education; three public members with significant experience community involvement. Each -- Minority Leader and the President would have the opportunity to appoint nine Members. This was amended, and the repcrting deadline Was changed from sixty days from the adoption of the resolution to January 1st: 1994. So that's the that's when we would ask for their reporting to the General Assembly -- to the Senate. And also, Senator Shaw had an amendment which we adopted that said that the Commission appointments shall reflect the racial, ethnic and gender compcsition of the population of the City of Chicago, based on the 1990 Census data. This was -- a similar resolution was adopted, although we did change some of the language this past Session. And Senator Rock, who's very interested in this resolution and certainly supports our efforts here, had appointed Members of the Commission, but because of the fact that We ended Session, that resolution just died, as a result, and nothing really Was accomplished. Thank you, Madam President and Members of the Senate. I ask for a No vote on.thls resolution. As Senator Watson pointed out, school reform is underway. This very Body gave it its life. This Turnaround Commission is unnecessary, and it flies in the face of an already organized group, the Citywide Coalition on School Reform, which already has members from business, from civic organization, local school councils, and the entire reform community. There is -- if you are looking at the same thing that I'm looking at, no school reform group has asked for this, and those of you Who have been around for the last three or four years know that it is a vocal community that has brought to this Body numerous bills. We have some this last time . This is not necessary, and I ask that you not put another burden on the Chicago school reform community.

Could you explain that? Because -- I recall Senator Rock nade those appointments. So, explain that particular Section of the bill <sic>.

And, Senator Watson, did you hear the questlon addressed to you by Senator Jones?

Yes. As you know -- as you know, Senator Jones, there was a lot of confusion over this particular issue. The intent here is to allow you to make those appointments. You, as Minority Leader, now will make those nine appointments.

Yeah. Thank you, Madam President. Now, in commlttee When this resolution Was up, the President of the Senate then was Philip Rock. Now the President is Pate Philip . Now , those appointments that are currently there, are those appointments -- those appolntments become the appointments of the President, which is Philip right now. Am I correct?

No, you 're not.

Well, this is not What was discussed in committee. This is not what the chairman of the committee - Exec Committee - so stated. This is not what you said in committee. When this resolution Was up, the Minority Leader did not make any appointments. I am now the Minority Leader. So, therefore -- the Minority Leader last Session did not make any appointments. Since that Minority Leader did not make any appointments, a11 the vacant 14  STATE OF ILLINOIS 88TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 42nd Legislative Day April 28, 1993 appointments belong to the Minority Leader. I am now the Minority Leader. The appointments that are currently there would be *he appointments of the President. So you cannot have it both ways. And -- and this was the agreement and the understanding that we reached in the Executive Committee. So the current appointments there are the President's appointments. Now, the President, if he so desires, can keep those appointments or replace them. As the Minority Leader as the Minority Leader - it's up to me to make the Minority Leader's appointments. Let's get this matter cleared up in its entirety right now, Senator Watson.

Well: Senator Jones, think if you read the resolution, or this -- this particular paragraph, and read it carefully, you would concur. Now, 1et me just read 'RESOLVED, That any appointments made pursuant to Senate Resolution 1144 of the 87th General Assembly are valid and shall remain in effect unless a replacement appointment is made by the respective appointing authority ...'' You, being an appointing authority as the Minority Leader, can make that -- can make those appointments, just as Senator Philip can.

Well, whak I'm -- the point I'm trying to clear up now is that in the role last Session, Pate Philip was the Minority Leader. He did not make any appointments; therefore, that falls to this side of the aisle, as the Minority Leader, to make those appointments. So the appointments that are currently there falls to the President. So therefore, those persons that are currently appointed are the President's appointments. Senatory is my understanding that your purpose for this resolution is to provide assistance to the Chicago LSCS local councils - and to the School -- Board to ensure the implementation of the Chicago school reform , which was basically creating the new 16  STATE OF ILLINOIS 88TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 42nd Legislative Day April 28, 1993 local school councils, giving them local control. Did the local school councils request this kind of assistance, and did they have a specific reason as to what necessitated this need for the creation of this Commlsslon?

No, I'm not -- I don't believe that the local school councils, as such, came -- came to me and asked for this -- this resolution at know that there are some members of those local councils who support this concept and support the effort of the Commission, or at least the the recommendations of the Commission.

I'm sorry, but I can 't -- I don't know whether your mike was on or whatr but can't hear him because...

PRESIDING OFFICER: (SENATOR GEO-KARIS) Could we have some order in the Senate? It's very difficult for the sponsor of the resolution and those who are -- wish to make inquiries to be heard. We'd appreciate it if you Would tone it down.

Yes. Senator -- Senator, when -- when -- when the Legislature created the Oversight Authority in Chicago, it was for a specific purposer because the Chicago school system y at that time , was on the brink of bankruptcy . And so they -- they created this financial Authority. There Was a purpose there, although disagree with the Authority, but at least there was a purpose. So what I'm trying to find out here -- we created the local school councils for the purpose local control - the whole reform 17  STATE OF ILLINOIS 88TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 42nd Legislative Day April 28, 1993 legislation. NoW you're back saying that We need to create another committee somehow that supersedes that committee ln some respect, that Will help them or tell them how to implement the reform that we passed. And I wanted to know who asked for it, and to -- what specifically will they do? How will they be respcnding to what specific problems or what areas of reform -- of the reform that they need to implement? And think that this is something that needs to be done. It's nothing punitive here. Certainly that oversight board probably would have a better handle. would imagine that this committee, or Commission, would ask for some input from that body, but I think that there's -- there's more far-reaching issuesr besides financial, that this -- this Commission should be involved in, not necessarily just with the the public school oversight committee.

We have the -- we set some reform into place a few years ago, and we have not given those reforms a chance to -- to work, and it's my understandinç in many school districts throughout Chicago that the reforn is working. The problem that we dre having in Chicago same as elsewhere in Illinois, every school district in this State the State has not shared its responsibility in terms of funding. We could pass this resolution and go back to our community and tell people in our conmunity we have done great things to take care of the problems of Chicago . This a political issue. That's a11 is. It's designed to get votes. But What the children of this State need is some money to be educated. And I Would ask the Senator if he would withdraw this resolution, because he, as Well as do, know that money is the answer to many of the problems that -- not only affecting Chicagc, affecting a1l school -- school districts in this State. And without those of us who serve this Body biting the bullet and making sure that our children are educated -- not rhetoric - we can come and give rhetoric and pass fancy and beautiful resolutions and go back to our respective communities and talk about what we have done to reform Chicago, and to and to Chicago is spending too much money. So is every other school district in this State with a low taxing body. But that is not the answer. What you're doing is criminal to the children who are trying to get an educatlon in this State, because you're jawboning an issue as it have been jawboned over the last ten or fifteen years. But the youngsters who are coming out of school is stlll not being educated in my district and your district. And I don't know what the -- a1l of the answers is, but I know that the cost of doing business in educating our chlldren keep going up because our demands are greater: new equipment coming into the schools. But you don't -- you don't want to deal with that. You Want to deal with some paper down here and some press releases. mean, this is a very important piece of leglslation here, and if we're just going to talk over it, then no one will get the siçnificance of We had two key answers here, and I want everybody to hear this. One answer was that a11 of these members, half these members, a third of these members, or possibly all of these members, could come from the suburbs, or come from downstate, or come from East St. Louis, or any other part of Illinois. There is nothing in here, on this so-called Commission, that'll make sure that at least the membership is from -- people from the City of Chicago. That was the first answer, and he said there is a possibility. The other question I asked was: Can this Commission be made up of people who are in support of the voucher system, and the answer was, yes, they -- it can. Nowy why does that have significance? The reason it has significance is because if this Commission comes out with a report that says the Chicago 26  STATE OF ILLINOIS 88TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 42nd Legislative Day April 28, 1993 public schools should be shut down, or the Chicago public schools should be revamped, or the Chlcago public schools should simply go to a voucher system , then those people who want to destroy the Chicago public schools, who want to have a voucher system , they will be armed with a report from a Commission, and they Wilb be able to hide behind that Commission 's report. And they will be able to say: ''We11r we're doing this because this Commission says that we need to do this.'' We do not need another layer of bureaucracy to try to solve the problems of the Chicago publlc schools. You have the local school councils; you have the School Finance Authority; you have the Board of Education. You have a 1ot of people in the reform movement already trying to solve this problem . Why come up With another layer of bureaucracy? And obviously, since they're not going to be compensated, no poor people are going to Want to serve on this Commisslon, because they have to run around; they have to spend money; there is a cost involved, and it says here that they will not be reimbursed. So how are you going to encourage some poor person who has children in the Chicago public schools, like I do, to s1t on thls Commlssion? I say it is wrong. It's a bureaucracy. It's like a Trojan horse. They're going to roll this Trojan horse up to the door, and God knows what's ln this Trojan horse. Vouchers could be in thls Trojan horse. People who want to destroy public schcols could be ln this Trojan horse. We should vote this bill Ksic> down, and I urge a serious, resounding No vote.

And those of us from outside the City wbo -- I'm amazed somebody over there didn't mention: Why is a downstater coming to the City and trying to implement a program by which we're trying to help the Chicago public schools? Why should a downstater be doing that? Well, I've been there, Senator Shaw. And you mentioned and you're right. And I share your problems and your concerns for the young people of the CiEy. And we ought to be doing sonething about This is not eriminal, What we're doing here. All we 're trying to da is establish a Commission by which we 're putting some expertise at the table to make some reconmendations by which we can make some change and help facilitate - facllitate - the reform thae's goinq on in the City . And you're right; it is working. The local school councils are working. Absolutely. But a lot more needs to be done. And what is wrong with asking a group of people who's got some expertise, who could come to this General Assembly and make that recommendation that further change needs to be made? What's Wrong With that? We're so scared of some kind of input from people on the outside. What matters if they live in the City of Chicago? Senate Resolutlon 11l is a resolution that tries to ensure that senior citizens that are on Medicare and Medicaid are -- receive information through the media of the Department of Public Aid so that they can participate in a program known as the Qualified Medicare Beneficiary Program better known as the Medicare Buy-in Program . The Buy-in Program was expanded by the Federal Government to cover beneficiaries with incomes of up to ten percent over the federal poverty line as of January of this year - January 1st. There are approximately one hundred and twenty-one thousand indivlduals in the State of Illinois who are not instituticnalized seniors Who don't receive these buy-in benefits. An estimated two ou* of five low-income elderly households spend more than twenty percent of their income on health care. This resolution seeks to urge the Illinois Department of Public Aid to improve services to seniors by doing more effective outreach, by having more public service announcements broadcasts informing seniors that they are eligible - by training caseworkers regarding eligibility on the 29  STATE 0F ILLINOIS 88TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 42nd Legislative Day April 28# 1993 Buy-ln Program, by providing flyers and by working with local Social Security officers to refer seniors to Public Aid offices. The Illinois Governmental Law -- Enforcement Training Board is responsible for certlfying the police training academies throuçhout the State. And currently there are six different police academies in Illinois, and each one is using different police pursuit procedures in the instruction of their recruits. This resolutlon states that the Illinois Lccal Governmental Law -- Officers Training Board shall convene a committee within one month of adoption, and they would be evaluating al1 available police procedures in regardlng pursuit. The commlttee shall present to the Board a recommendation for a standardized model for police pursuit in the use of training of a1l police and correctional officers. The committee will be composed of eleven members. The chairman shall be a member of the Governmental Law Enforcement Training Board, one each of the six police officer training academies, one designee from the Illinois Sheriffs' Association, one designee from the Illlnols Fraternal Order of Pollcer one from the Illinois Police Benevolent and Protectlve Association, and one designee from the Illinois Chiefs of Police Association. It would requlre amortization of the unfunded liability over an extended period of time. As many people know, the five State-funded pension systems are in very serious financial problems, and we passed a bill a number of years ago to try to deal with it, and yet that bill has not been funded. So, these bills are bills that deal with the subject matter, and again, we're not voting on the merits yet; wedre simply saying that we think that we want to simply extend the deadline with regard to these bills, so that if ln the future and sometime this year they wish to be called by the sponsor, that we'd have the ability to do so. And that is simply the only request we have. It doesn't -- if you don't want to vote for the bills, you can vote No. A1l we're asking for is to extend the deadline. I think it's a reasonable request, and I Would ask for an Aye vote, and be happy to answer any questions.
