So We had to postpone the softball game from the 17th till the 20th, which Will be Thursday evening. We're trying to work that out with -- with - - with the President now and -- and the Speaker, and hopefully that's the night we'll have the -- the event. Thank you, Mr. President. House Bill 35, as amended, is in the same position as Senate Bill 902, which is the carjacking leçislaticn we 're propcsing thls Session in Illinois. Proposed by Secretary of State Ryan, this bill, as Senate Bill 902, creates the offense of carjacking. It provides that if an aggravatin: factor is present - in other words, if the person who is occupying the vehicle is -- is physically handicapped, over sixty years of age, or a passenger under eighteen <sic> (sixteen), or if the -- the defendant is armed with a dangerous weapon - that it's a Class X felony with a minimum seven-year term . And if, as was the case here in Springfield, there is no person that is armed or no special aggravating factorr but nevertheless a man or a woman is - - is yanked out of a car and the car taken in a carjacking situation, it'll be a Class l felony with a minimum four-year prison term. think this is much-needed legislation as We see, really, the spread of this terrlble crime across our -- our land and in Illinois. And I would urge the same unanimous vote that we gave to Senate Bill 902. I'd be happy to answer any questions.

think now that requires -- as the bill was initially passed from the House, it mandated that these particular services be done by Public Aid. It's my understanding noW that with the amendment, DORS can come in and bring in their physicians to review and it helped make the final decision, where before it was strictly a mandate which would have caused a -- think a four- or five-hundred-thousand-dollar-a-year cost. This basically puts the control back into DORS' hands, Which they Would have otherwise.

Well, the -- the bill extends the benefits to people eighteen years and older, and there 's a provision in the amendment that talks abcut how they 're going to determine whether or not these people require specialized care at home. I just am curious how it's not going to cost any extra money if it's going to clearly be extending benefits to people who now do not have the service available to them . Do -- do you know? I mean, you make it permissive, but permissive within -- within the bounds of an appropriation or -- or what?

And it's my understanding, with the -- with this amendment, DORS and the Department of Public Aid have gotten together and worked it out so they don't anticipate there to be any additional cost more than there Would have been the circumstances had remained the same. This particular proposal seeks to define what an ''interest in commercial real estate'' is. Well, thank you: Mr. President. House Bill would authorize the township board of trustees to make contracts relating to insurance for a duration not to exceed the board 's term by more than one year. Currently the 1aw says that they cannot make it beyond their term, and what happens is township government on some of the insurance contracts goes beyond their term. And rather than having to re-bid a contract that is favorable for the township, it allows them at least to go one year beyond. And also With new trustees being skorn inr they wouldn't have to sEart a1l over again. It also contains two other provisions. One is that it allows townships to create committees on literacy. It also provides that when a township is selling personal property valued at less than two hundred dollars, there's no need for voter approval. There's a second amendment that was added that townships could impose reasonable fees for recreation and instructional programs which are sponsored by the townships on programs they wish to do. So I do ask for your favorable support.

What the amendment does is it said that in the -- in February 37 STATE 0F ILLINOIS 88TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Leglslatlve Day May l1r 1993 1993, the Illinois Supreme Court held a person seeking to rescind the summary -- suspension of tbeir licenses and privilege upon their arrest for DUI had a right to a hearing thirty days from the date of the filing of the petition challenging the suspension. It also the court also held that it was the State's obbigatlon to give them that hearing within this time, and that the failure to do so required the recession of the suspension. So consequently: thousands of suspensions would have been rescinded under this technlcality. And so What this -- this amendment doesr from the State Bar, is it gives the opportunity of hearing statutory summary alcohol or other drug relations... The amendment amends the original contents of the bill. It clarifies that the drug and alcchol evaluations are to be used by the court for censoring <sic> (sentencing) purposes, and also adds a provision stating that the local prosecution authority would also have to provide information to disclose test information upon demand before *he statutory summary suspension.

Thank you, Mr. President. House Bill 1162 is an initiative suggested by the Illincis Supreme Court in its 1991 annual report that we review the Contributlon Statute as to the Statute of Limitations. Although the bill passed a hundred and eleven to nothing in the House, the Medical Society indlcated some opposition to it as would apply to medical malpractice claims. So the Senate amendment in committee removed medical malpractice claims from this leglslation, and the Medical Society withdrew its opposition. It provides basically that if -- if you are sued and another person or another entity is responsible for the actlon rather than -- than yourself, you can bring an action of contribution or indemnlty. This gives you a two-year period from the time that you are sued to bring that action and bring that third party into the suit. House Bill 1526, as amended, prohibits persons from transporting or accepting grease trap sludge from off-site disposal, unless the sludge is accompanied by a shipping manifest containing specified information. The bill details what sort of information is required. The generator, transporter and management facility operator are required to retain the shipping paper for a minimum of two years and have it available to the Illinois EPA or any affected sewage agency. The bill provides a tracking mechanism to assist sewer treatment plants in identifying exactly when and how much grease trap sludge is being dellvered to them before they agree to accept it. The provisions of House Bill 1527 Were incorporated lnto 1526. That's the amendment. The amendment requires a license for the disposal of grease trap sludge and registration by the collector of grease trap sludge. Current 1aw prohibits the -- the land application of untreated grease trap sludge. This bill does the -- a number of things, including prohibiting disposal of grease trap sludge into a treatment works unless the owner of tbe treatment work grants written permission; requires -- reglstrants to prepare an annual report whlch would be available for five years; deems that the Metropolitan Water Reclamation District of Greater Chicago is in compliance with the requirements of the bill. It amends the Illinois Vehicle Code and the Litter Control 62 STATE OF ILLINOIS 88TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49*: Legislative Day May l1y 1993 Act, and exempts potentially infectious medlcal waste from debris required to be cleaned up by a tow truck operator or the persons removing a wrecked or damaged vehicle from the highway. The second bl1l was House Bill 698, which was Senator Palmer'sr and amends -- prohibits the manufacturers of motor vehicles from reselling nonconforming vehicles unless the nonconformity has been corrected and disclosed. House Bill 1198 was the next one, Senator Woodyard: Authorizes the Secretary of State to cancel the driving privileges of a person who fails to pay civil penalties due to the Illinois Commerce Commission, and changes the statutory organization titles from ''field operator <sic> (operations) staff' to ''police''. Next one was Mccrackents: Amends the Vehicle Act to authorize munlcipalities to administratively adjudicate vehicle compliance violations. 1513 Was Woodyard 's: Makes numerous changes in existing 1aw in attempt to clarify and/or provide consistency with the State and federal laws. And then the last one was a request by the Secretary of Stater and was a technical bill, and it was mine. House Bill 1576 is in response to a Federal Act just passed in 1992, and it requires that the Liquor Control Commission submit to the Governor and the General Assembly by January of 1994 a report based on a study of such things as the numberr type and location of retail tobacco distributors in the State; *he number of reported citations and successful convickions for violations of the State the sale to <sic> tobacco to minors; access and availability of tobacco products to individuals 65 STATE 0F ILLINOIS 88TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Leglslatlve Day May 1lr 1993 under the age of eighteen, et cetera . And in conducting the study, the Commission shall also conduct random, unannounced inspections of retail distributors, and consult with DPH, DASA: ISP and other agencies, et cetera. It also increases the fine for offenses of sales to -- to minors. Half of the fines go to the local enforcement agency and half to the State. And if we do not enforce this federal legislation, we could lose ten percent of the money that goes to DASA from the Federal Governmenty and that Would be, this year, four million -- almost five million dollars.

The amendmenty first of all, just adds McHenry Counties, and that was at the request of Senator Klemm . 66 STATE OF ILLINOIS 88TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day May 1l, 1993 What this does, this amends the road improvement impact fee Section, and it provides that the unit of local government imposing an lmpact fee may amend the comprehensive road improvement plan no more than once a year, prcvided that the comprehensive road .improvement plan -- the cumulative anendments do not exceed ten percent of the total plan in terms of estimated project costs. There's a number of our counties - including mine, and also Cook and -- and Lake, and now it would be McHenry - that do impose these impact fees. What they have is a planning commission that decides where these varlous subdivisions and -- and retail operations are going to go, and then they plan the the roads accordingly and will impose impact fees. Unfortunately, what happens is every once in a while a developer comes in and says, ''I Want something different''. And that's What Welre really talking about.
