But the industry that has been honored by the Herrin people consists of the East Side Lumberyard Supply Company that has been in operation for some time. And Don Reisr Sr., is here with us today, and he's a very important man, because he's also the treasurer of their family corporation. Last year We passed out House Bill I 1261, and in that legislation, we extended grandfather clauses to certain trucks, and we inadvertently omitted those vehicles that have farm plates. As a resultr there's -- farm trucks having five axles or more are now being prohlbited to take -- or to carry a certain amount of weight, as they had in the past. As a result of that, we've got people being stopped on the highway, thinklng they are a legal weigbt: and being stopped and arrested, fined, because i they are in violation. This legislatlon brings this weight limltatlon back up Eo what it was previously, and they would now - - farm plate vehicles would have to pay the same : one-hundred-dollar fee and -- and carry that same weight that they ' carried prior to the legislation We adopted last year. Thank you, Mr. President, Members of the Senate. As you can see from the number of this bill, it has been around quite a long period of time. Back ln 1993, lt did pass the House 108 to nothing. This bill was held in -- in, I believey Rules Committeer 9 ' STATE OF ILLINOIS 88TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 117th Legislatlve Day May ll, 1994 i and eventually put into a conference ccmmlttee report. And as far as I know, it did not contain controversial provisions, but nothing ever happened with the other provisions that were in that conference committee . So thus, we've called this bill back. What it does is allow a county board or -- or a legal entity, unit of local government, to sellr lease utilities back to a -- to a -- a -- a public utility company. The reason for this, as I understand it, quite a number of rural areas, particularly around some of our urban areas, want city water, as an example, and yet there are no funds to do that. The county board, under present law, can presently come in, put in the utility system. The county board does not really want to run that -- that utilityr and this Would allow those -- those counties to go ahead and -- and sell that back to a public utility to run frcm then on. .

What this bill does -- in February, the United States Departnent of Transportation promulgated new rules concerning drug and alcohol testing of certaln employees of transportation systems throughout the United states. We have drug testing now for the Regional Transportation Authority 's Service Board, the CTA, Metra, and the PACE suburban buses, but We need to make a change ln our laN to include alcohol testing, which the United States Departnent of Transportation now requires. So baslcally this is a technical change to the Regional Transportaticn Authority to conform With federal law. And I'd appreciate a favorable vote.

House Bill 1332 Was amended in committee after a number 11 STATE OF ILLINOIS I 88TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 117th Legislative Day May l1, 1994 of public hearings and extensive discussions between the Illinols Press Association, Broadcaster's Association, the Municipal Clerks' Association and other interested groups. We have an agreed bill here, and I thlnk itls interesting that the organizatlons that represent our public officials, and Common Cause and the Press Associationr a1l of them -- a11 of them are in agreement. What we've -- what we have done here ls to clarify, and in essence what we've done is to extend the tlme frane in which clvil actions may be brought for alleged violations of the Open Meetings Act. We've extended that from forty-five days to sixty days. We have clarified certain language to define better what the subject matters are that can be held in closed session. We have deleted the requirements regarding taplng of closed sessions. Be glad to respond to any questions. I want to thank Senator Klemm and Senator Geo-Karis, among others, for the time that they've spent on this bill. Be glad to respond to any questions, Mr. President.

Thank -- excuse me. Thank you, Mr. President. I just want to reiterate what Senator Berman says. The Executive Committee last spring put three bills on this subject into a subcommittee. Contrary to what nost people thought, it was not a -- not a death knell for that, and there was a lot of work done over the summer and fall. This is the result of itr and it is agreed upon by a1l . the parties included. And I too Want to say thank you to everyone for their hard work.

Thank you. Ladies and Gentlemen, House Bill 1635 amends the County Codes in regard to storm management in Cook Countyr and I . emphasize, this is a Cook County bill only. It does tWo things: One, it deletes the inactlve Upper Des Plaines River Watershed Council, which is no longer -- no longer in existence; secondly, it more clearly defines who shall be members of the Stormwater Managenent Committee. It clearly specifies that the chief elected I officer from each county, tcwnship and municipality shall be member -- shall be members. I know of no opposition to this bill, ! and I ask for a favorable vote.
