Provides for the distrlbution of the proceeds of that action. Authorizes the Director to suspend, deny or revoke licenses of persons found to be representing unauthcrized insurers. Provides that surplus line ! insurance may be procured from an unauthorized insurer. Provides l that surplus lines insuranee may be procured from an unauthorized company that has a policyholder's surplus of fifteen million dollars, rather than five million dcllars. Repeals the Product Llability Insurance Act. Amends the Religlous and Charitable Risk E Pooling Trust Act to authorize the Direetor to conduct financial examinations. What this bill Would require would be that an operator of a I motor vehicle repair place of business would be obligated to notlfy the police if a vehicle was stolen, and after that notification, notify the owner or the customer of that theft of the vehicle. I -- I submit this bill to you in that there are those cases Where -- where a car might be stolen from a -- a I business and the owner not notified. The car might be recovered, and instead of having the ordinary expenses that the car would be ! in for originally, it's incurred a 1ot nore -- more expenses, plus just the aggravation of knowing -- or not knowing, I should say, that your car has been stolen. The business offense fine is five hundred and one dollars to a thcusand dollars. This is a standard previously set. I ; certainly know What the distinguished Senator wishes to accomplish eo kry to accommodate a -- a constituent who had his car stolen ! i and -- and apparently didn't get notified as quickly as he wanted ! to, but it seems like we 're overreacting to a situation that certainly isn't a statewide problem, by nandating to small i businesses, which amcunt to thousands in Illinois, kho do repair work from anywhere from repairing or replacing a Windshield Wiper ! to major body repair -- to have to have them put in the position I of actually codlfying that khey, in factr may be breaking the law by not reporting it as quickly as perhaps the person whose car is d stolen's lawyer thinks would be appropriate. So noW we have a small business person in Illinois Who's tryin: to defend ë themselves against a vehicle stolen, and then probably ending up I having to say, ''We11, comparative fault here. You could have had a -- a young man or a young woman working at khe lot during Sunday ! when the car uas stolen; you could have hired that person. So you 're responslble, Mr. Car Repairnan for that car stolen, and we ; expect you to kind of compensate our -- our losso'' I can certainly see what this will open up in the -- in the legal fieldr : and I just think we're going too far. This bill basically flew out of committee with all of the testimonyr and I think it's a good bill. We heard it in the Transportation Commlttee, and While I appreciate the concerns of a prior speaker, I think they 're misplaced. This is not the creation of a private cause of action; it is a business offense for failure to report a car stolen. I mean, it says you 've got to call the police and ycu 've got to 1et the person whose car it is know that it's been stclen. It's not that complicated a bill. It has nothing to do with prlvate lawsults. It has nothing to do with reimbursing anybody for the loss of a car. And in particular, there was some discussion in committee about the scenario suggested about Whether it would -- this is a negligence standard . Well, it is not. If someone is too late reporting a vehicle stolen because they -- they -- they didn't know, and perhaps they should have, this bill does not apply. It only applies when they know that the vehicle is stolen. So, it doesn't have anything to do with negligence or who you should have hired. It only applies when the -- the repalr shop knows that the vehlcle has been stolen, and then fails to report it. So, I think it's a -- it's a qood bill. PRESIDING OFFICER: (SENATOR GEO-KARIS) Senator Lauzen. SENATOR LAUZEN: Thank you, Madam President. I certainly respect the gocd intention of the billy but you have to ask yourself, ''Who becomes the criminal if the car is not recovered?'' In serving the small businesses that many of us. do, we know how many -- how excessive the burdens are at this point already. Thank you, Madam Presldent. I join thcse Who are in opposition to this bill. Senator Klemm used the wcrd ''overreacting''. I think wedre overregulating. I can't imagine the circumstance when a bustness owner would not report a -- a stolen vehicle. It's just inconprehensible to me. Maybe once ln a million times happensy but do we need a laW on this? Secondly, I'm a little confused about the word ''inmediately''. As Senator Klemm said, lf the -- if the theft occurred on Friday night, and the owner walked in or the business owner walked in on Monday morning, would he be accused of -- of not doing h1s duty if -- if he didn't discover it until Monday morning? I really do think this is overregulatingz and -- and we ought to turn our backs on laws like thls.

We did have this discussion during the time that we were looking at this bill in the Transportation Committee, and if you will note on your books, as Chairman of the Transportatlon Committee, I did vote for this bill. It is true: perhaps it is only once ln a million times that somebody would not take the time to report such a theft. Botton line is, if it were our constituent who was . complaining because his car was stolen seventy-two hours before, k the owner knew it, and very frankly, didn't bother to tell the i owner of the vehicle, I think we too would be upset. The bill speaks -- speaks very clearly to -- to, as Senator Hawkinsan stated so eloquently, that it is With full knowledge that the -- the vehicle is gone. We 're not talking about penalizing anybcdy that ls -- is an owner or operator and their employee took the car out for several hours or took it home overnight, for -- for instance. We 're not talking about those -- those kinds of cases. Wedre talking about some -- some cases where the car was -- was actually removed and stolen. The questLon of recovery and liability is not in play here. It's a small business offenser and I don't think any responsible operator would object to having something like this on the bocks. I think it keeps everybody on a equal playing field, in that it would be a credible -- credible thln: to say, ''We operate under these rules that say that we owe our customers the -- the -- the commitment that we would report their vehicle stolen to the proper law enforcement authority and then to them.'' So With that, Madam President and Ladies and Gentlemeny I would hope that you Would give House Bill 2849 a favorable vote.

This bill comes to the Legislature as a reconmendation of Auditor General Bill Hollandw and it ls to make a small change in the Court of Claims Reporting Act to conform to What is policy todayr and that's tbat once a year -- once a year, they report to us in the General Assembly a list of a11 the claimants in the decisions. The 1aw requires it to be every two years. It's a needless waste of paperwork. It's an Audltor General's recommendation. And for those of you Who serve on the Appropriations Committeer you know that you have immediate access to these claimants' reports a1l the tlme anyway. And it's just scmething that saves money and is a recommendation of the Auditor General. And I'd appreciate an Aye vote.

Bcard does 1et individuals know -- victims of crime know when the i person is put on probation or supervlsed release or electronle detention, et cetera, but there are many tlmes, accordin: to the ; State's Attorney Association - the Sangamon County State's Attorney testified at our committee hearing - that victlms of crine perhaps spend the rest of their life in fear that this ; person is still out on parole, where, in fact, perhaps the -- the criminal died a nornal course of death or died in an accident, et cetera, and they would like to know that to have a little peace I i of nind to live a family life withcut fear of retribution by the - - the criminal.
