On November 8th, 1994, voters of Cook County, an advisory referendum , told the General Assembly that they also wanted tax caps that were granted four years ago to the five collar counties. Eighty-three percent of Ehose who voiced an opinton on tax caps clearly stated that they did support legtslation which would restrict local governments' abilities to raise their property taxes by requiring a referendum for any property tax increase over and above five percent cr the Consumer Price Index, whichever is less. House Blll last week, we passed Senate Bill ly bringing tax caps to Cook Countyr by a vote of 46 to 12, and House Bill 200 is an identical bill to Senate Bill with one exempticn. The exemption is that where Senate Bill exempted debt service for bonds issued prior to the effective date 5 STATE OF ILLINOIS 89TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 15th Legislative Day February l0, 1995 of ehe bill, House Bill 200 exempks debt service for bonds lssued prior to March 1995. Other than that, it is identical to Senate Bill Which does the following : It extends tax caps to non-home rule unlts in Cook County and Eaxing distrlcts in the collar counties that were -- were not already capped; iE keeps prior year EAV in Cook County in calculating the accountable amount of extension; it limits the 1995 extension, which is the 1994 levy payable this year, to one hundred and five percent of 19931s levy; and beginning with the 1995 levy year, payable next year, lt limlts the growth to Ehe lower of five percent or the CPI, whichever is lcwer; and finally, clarifies upon dissolution of a TIF financing districtr a11 of the increment ts to be calculated as new property. This bill is in response to a -- a court case from last year that says that a person even consents to receiving psychotropic drugs, it still must go to court. And obvlously, there are thousands and thousands of patients and people out there who know they need this medication, but this still must go to court. clogging up the courts. It's inhibiting the ability of guardians and the patients to receive the drugs that they need. The bill did pass the House, and -- and I had every intention of getting it out of here in Veto Sessicn; it simply got tied up the last day of Veto Session, but I've been called by judges, by lots of organizakions Ehat are -- are havlng a terrible problen because of this court decision.
