Senate Bill 146.3 was a I btll we passed with overwhelming numbers in March of 1996. Seems . 1 I like ages ago. The bill said that any home rule municlpality, or 1 any munieipalityg that -- or local government that had not j implemented a real estate transfer tax could not do so Without a I I referendum Of the citizens that lived in that munieipaltty or 1 I level of government. It also said that any municipality -- or I ' level of government that had a real estate transfer tax eould not I . increase it without a referendum. It passed overwhelmingly in I the Senate. In the House, the Illinois Municipal Leaguey Northwest Municipal Conference and a number of other people apparently worked diliqently formore than eightmonths in -- in j suggesting corrections and changes. These two amendments represent action taken to meet the concerns of municipal 1 I advocates. Although it does not fully meet their concerns, I j think the only thing that would completely meet the ccncerns of some municipal advocates would be no bill at all. But inasmuch as real estate transfer taxes is not an approprtate way to raise j revenues, since it -- it does not broadly raise revenue - it aetually is kind of arbitrary and capricious in its methods - I I urge us to adopt these two amendments and send this bill on to the Governor. The I ! riqht to transfer real estate is a common-law right that goes back I to the days of the Magna Carta. We've had municipal abuses, even ! I some concerns that some municipalities Were usin: it as a Way of I I preventing some migration into thelr communities to kind of ! preserve the character they currently have. And to the best of j I our knowledqer everybody that's currently passed a real estate I transfer tax ordinance is raising revenue wtth it. The question I I comes, some people are trying to do what they did With the balloon I I levy in the days of tax caps, which is pass an ordinance, raise I I the tax, and say we're golng ta come baek and collect it later 1 I only if we need it. Well, we allvknow in -- the inevitability of ! I -- of issues like that. But, they eould, I thlnk, still pass an I ordinance if they -- if they worked real quickly over the next few 2 I days. They have the rlght to tax transactions that take i i place in telecommunicaelons. They have the right to implement I I eheir own sales taxes. They have the right to tax gasoline. f : Th 's no reason for them to use an arbitrary method like a real l ere I estate transfer tax, where one neighbor might -- might live in a i I house for twenty years and not pay any taxes at all and someone I ! who moves into your community and moves out in three years would I ' pay the tax twice. It's just noe a good way to raise general ! I revenue. It's an inappropriate meansy and franklyy I'm surprised ! I at the -- at the level of discourse and -- and how hard the 1 nunicipalities are working to try to prevent what I think is a ! $ very reasonable methody Which is a referendum. Howeverr with each increase l in the criminal penalty for a crlmee it adds 'to the county's cost ! ' j of prosecutlon, in terms of detention, prosecutors, court security , and records. As penalties increase, ccmmon sense and supporttng ! I data clearly suggests that pleas so down and trials and related ! I litigation costs go up. For instance, a Class X felony costs ! I about twelve thousand nore on the avera:e per person than a Class : I 3 felony. For this in -* in a county the size of Cook - youdre ! ! talkin: about eighby-seven thousand people - we're talking about j dollars trenendously going up. In the past four years alone, the ! I -- the public safety budget for the County of Cook has gone from I I four hundred and thirteen nilllon to seven hundred and j seventy-nine million. This is not the Way that 1 1 khis Legislative Body is supposed to be handled. We are not the I only Legislative Body in this State. Those individuals kho I represent the counties and the Runicipalities are also elected by 1 ! . their constituents. We need to allow them to have the right to ! raise taxes to fund those goods and services that are important to I I kheir various eommunities. Nawr as Senator j Rauschenberger says, we already pay back into the municlpalities i i part of our taxesr and T think it's wrong not to have a / referendum . I feel that the imposttion of -- or, increase of a real estate transfer eax without the prior approval of the -- of 1 the voters iswrong. I think it's like asin tax. It -- it's 1 wrong if there's no referendum. A1l this bill does is allow a l referendum. Let the Will of the people decide. If they need more j money for their particular municipality, they can do it by voting 1 for *he referendum. They'll know what their needs are. Because it seems to me, slowly but surely, We're just eroding home rule to the point where it may become just a -- just a -- just a shell of what I think the Legislature intended it to be. I'm 1 j concerned about home rule. It seems to me that ke ought to be i 1 giving the municlpalities, in particular: some credit for being i ! fairly good legislators and considerate of their oWn people. So I 1 I guess this is not in the form of a question, Senator 1 Rauschenberger, but if you'd care to respond, Where are we golng ! ! to the -- with -- with home rule.in view of something ltke this -- ' I consider it bein: an erosion of the power given municipalities ' OVer many, many years under many, many Conditions? ! ! Constitutional Convention, the idea of home rule was an I 1 experimental effort. It was an effort to give local governments ! more authority. It's an effort, though, ehae vas designed in the ' J i Constitution to be controlled by the Legislature. Any time that ! ' j - - that it was felt that municipal governments or local I 1 governments went too fary the Constitution provided for the I I Leglslatures to override them wlth supermajorieies in b0th 1 Chambers. Wefre talklng about a situation Where, yes, welre i I acting to interdict home rule powers. We've found an area, a I i situation, tha: was certainly -- it should be made clear to any I resident of Cook County, if you saw Board Chairman Stroger's 1 proposal toincreasethetaxahundredandfifty--no--fifteen hundred percent, that this is an area that the General Assembly t needs to act to llmit home rule powers.

SENATOR RAUSCHENBERGER: The real estate transfer tax ls a separate tax base from the property tax, so it is not related. PRESIDTNG OFFICER: (SENATOR DeANGELIS) Senator Jones. SENATOR JONES: Well, then, I'm glad you cleared that particular pcint up, because reading news accounts of the proposal in Cook County, there are many persons who thought the -- the County Board was trying to increase their property taxes, Which was not the case. But, againz I -- T fall back on to what Senator Trotter has to say, as well as many others. You're talking about home rule units . of government. And we pass on many, many nandates to these loeal ! I home rules of government. Even thouîh -- f kncv you talk about I the sales tax and the income taxy but that amount does not, in any 1 I manner, make up for the mandates that we constantly impose on I I local units of government. I don't think we should be here trying I J to dictate to local units of government, especially those home I I rule powers that were given them, how and when they should raise i I . the necessary revenue. so I rise in opposition to the bill, ' I i because what we are doing, as Senator Butler pointed out, you are j ' ! 13 I STATE OF ILLINOIS 89TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 121st Leqislative Day January 6: 1997 constantly eroding the powers that We have <iven local units of I 1 government and it makes them -- ik make -- make italmost 1 impossible for them to get the necessary revenue they need to -- ( to run their units of government. Tt-- it's kind of curioustonethat i I we're talking about home rule unitsw which have multiple ways to i ! tax thetr residents already, and many of them take advantage of a I i (Jreat deal -- great number of those Ways. I -- I'm not sure I ' I . 1 understand vhy they -- they've stuck their feet in the sand here f to try to pick a fight about a real estate property kransfer tax. 1 I S econd point is, the normal constitutional appeal to local l I governnent being out of control is to the Legislature. . So l I although. Senator Jones, ' I generally respect all of your points in I j debate, I -- I thlnk you're absolutely wrong. This is exactly the I / time for the General Assembly to invelve itself. When local j governments act in ways that are not responsible or that are out 1 I of control, we're the natural constttutional appeal. As to what l J the whole point of home rule is, and for some downstaters who I I might not have a lot of home rule colnmunities# home rule is an I I experimental form, which came out of the 1970 Constitutional I 1 Convention, which was designed to be controlled by the I i Legislature. We're actinq tonight to eontrol excesses by local I I government. We're not taking away a single nunicipality's 1 . I transfer tax. If they have one, they get to keep it. I certainly respeet the previous speakers' experience and also their opintons. 1 thtnk it is remarkable, and I know that for the last four years of listening to debate, tha: when people refer back to 1974, that was just talked about: that was the last case Where, you know, the agreed bill process wasn't observed. A 1ot of the problems that we have in these systems, in my opinion, are -- are due to changes made at thak time. But I don't see how anyone can nake a judgment on the contenk of this bill, which, as the experienced Members of the opposite side of the aisle have pointed out, is merely a vehicle bill. To make a judgment that anyone is going to be better off or worse off on a bill that, at this point, says that -- what this does is it changes an immediate effective date on a ' bill, to me, it's remarkable, then, to nake a judgment on the ! content. This issue will be debated . If it comes out on a . committee -- conferenee committeer itfll be debated in committee ! and on the Senate Floor. I am eager to address the concerns that ' ! have been raised.
