Senate Bill 101 makes changes in the public pension systems to bring those systems into compliance with federal statutes that have changed in the last few years regarding changing how assets are arrived at by the five public pension systems from book value to market. Makes the corrections or changes under the pension systems to comply with Section 415 of the Internal Revenue Service Code. Makes the changes to comply with the federal Uniformed Services Employment and Reemployment Rights. Changes the Chicago Teachers' System to allow the prudent person rule in their investment authority. And lastly, allows the State Board of Investment to register investments in banks or trust companies authorized to do business in Illinois, but not necessarily domiciled in Illinois. This bill proposes to extend a pilot program that was established in 1990 that allows some nursing homes, only those that are strictly private-pay, to participate in a program whereby they can choose to be licensed by the Joint Commission on Accreditation of Health Care Organizations in lieu of Department of Public Health. Many of these facilities find this to be a more constructive process. And we haven't had a lot of nursing homes able to participate in it as of this point. So the extension would be until the year 2000, at which time a final -- or, 2001, at which point a final report would be submitted.

Any nursing homes that have egregious violations that we would be concerned about patient care, and we would want to be sure that the Department of Public Health were overseeing, would also be ineligible to participate.

The bill requires the Department of Children and Family Services to notify the public when a child care institution, maternity center or group home undergoes a change in the range of care or services offered, the age or type of children served, or the area within the facility used by the children. Requires notification to be in a newspaper of general circulation. This bill was prompted by a -- something that occurred in Springfield. Certainly not -- certainly not germane to Springfield. It could've occurred anywhere in the State of Illinois. We had a situation, a center referred to as a Parkside center, that in 1992 they applied for a child welfare agency license. Because it changed the zoning in the area, it required the municipality to hold a hearing for a zoning change. The public was notified -- or, the residents were notified. The zoning was granted, as was the license. It allowed for capacity of ten males 29 STATE OF ILLINOIS 90TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 15th Legislative Day February 28, 1997 ranging from ages thirteen to eighteen. In 1994, the Parkside center applied for a child care institution license, increasing the capacity from ten to twelve males and the range from thirteen to eighteen to twelve to twenty-one, and it allowed for a more aggressive, a more impulsive, and in some instances, pixilated individual. Because the municipal zoning was so broad, it did not require a change in the zoning; therefore, the public was not notified. In November of '96, three young men escaped -- or, excuse me, ran away from the center and allegedly raped a young girl in the neighborhood. This bill will go, I hope, a long way in protecting the residents from this occurring ever again. Thank you.
