The original bill was introduced at the request of the Savanna Local Redevelopment Authority to affect the Savanna Army Depotr Which will be abandoned by the Department of Defense between 9/2000 and 7/2001. It would permit two changes in regard to enterprise zone law. First, the existing Vermilion County enterprise zone may be extended to thirty years or a lessor time frame as determined by local authorities and certified by DCCK. And secondly r the legislation authorizes an additional manner in which DCCA may certify an area as an enterprise zone and they are: If the county board of any county in which a current military base ts located, in part or in whole, or in which a military base has been closed wîthin twenty years or -- of the effective date of this bill is located, adopts an ordinance to designate the military base as an enterprise zone and if the property otherwise meets the qualifications for an enterprise zone as prescribed in this Act. Mr. President and Ladies and Gentlemen of the Senate, House Bill 2557 permits eounties to pass an ordinance providing that legal and nonconforming uses under the county zoning code may be eliminated in three very limited circumstances. One, when khe existinq nonconforming use is discontinued ; two , when the buildings are adapted to -- a permitted use ; and three , when the buildings are destroyed. If any of these three events happen, then the property owner must rebuild or reuse the property for only legally permitked uses under the county zoning -- code. It does not provide for the termination of any use, even a nonconforming use , unless one of those three events takes p lace, and it does not alter, in any way, the current public process for making changes to the county zoning ordinances . It provides that a person who is otherwise qualified 16 STATE 0F ILLINOIS 90TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 99th Leg islative Day May 4, 1998 to vote and who has not moved but whose address has been changed because of the implementation of 9-1-1 emergency telephone system is eligible to vote by signing an affidavit at the polling place. An Emergency Telephone Systems Board in any county which implements 9-1-1 system that changes a person's address shall notify the person of the new address and that the person shall -- should contact the local election authority to determine if the person shall shall reregister to vote. In comm ittee we discussed this situation on the 9-1-1 and agree with the Senator that something has to be done. However, I feel that the -- if we depend upon the signing of affidavits at the polling place on election day, we are going to encumber the voting process to the point and to the extent where people will be angry , people w ill leave the polling place, we will have discord and -- and complete turmoil at the polling place on election day , if we 're going to qo that route . I have suggested and I Would -- had hoped that there would be some attempt made where the 9-1-1 authority could give to the election authority the chanqes of address and then the election authority would mail out a new registration ca rd , so -- and if it came back , you would know that there was a problem, rather than having all of this take place at the polling place on election day. And I've discussed this With Senator Luechtefeld. I think it's a problem that needs to be resolved because it 's going ko happen elsewhere in the State . Well , Senator, I -- you know r I think there will be some confusion. I think part of the bill does give the -- or, at least, instruct the Emergency Telephone System Board in any county to -- to notify that person that his address has been changed and he needs to reregister. That, I think: could take . -- Will take . . I care of some of that . My concern is -- and I understand what you dre saying, but my concern is that there 's even many more angry people who simply do everything that they need to do to vote and then are not allowed to vote, or their -- their vote's simply, on the day of the election, thrown out. And so, again, I -- I understand what you 're saying . I think that in the future there 's a possibility of -- of taking a look at this again, but right now, we 'd like to, I think, go ahead with this.

I am particularly distressed, obviously, because of the fact that in our recent colleague, in Senator Severns ' petition challenge, many of the signatures that were obtained ' on the petitions were challenged on the basis that the address had changed through the implementation of the 9-1-1 system and not due to a voter's having moved. You would think, for heaven sakes: that the State Board of Elections and those who Worked on that challenge would recognize that this syskem was going ko be in place and, in factz the person hadn't moved and, therefore, should never have been challenged in the first place . The questiony I guess, have here is I see that there 's going to be some ambiguity continued to -- to exist as a result of -- of this bill. And I would like ko ask youl What ambiguity is *he staff referring to in this analysis that may still exist as a result of this bill?

But it seems to me , in this situation, that 1 whoever would not acknowledge that those people could vote made a bad decision and didn't use very good common sense or judgment. That's my opinion.
