Reading and Approval of the Journal. Madam Secretary.
Senate Journal of Thursday, May 5, 2005.
Senator Hunter.
Mr. President, I move that Reading -- the Reading and Approval of the Journal of Thursday, May 5th in the year 2005, be postponed, pending arrival of the printed Journal.
Senator Hunter moves to postpone the reading and approval of the Journal, pending arrival of the transcript. There being no objection, so ordered. Illinois Information Services requests leave to videotape proceeding. There being no objection, so ordered. At this time I would like to recognize and bring to the Podium Senator Winkel, who -- in whose district the University of Illinois in Champaign sits, and he has a presentation to make. Senator Winkel.
Today I have the privilege of introducing some special guests from the University of Illinois at Urbana/Champaign. First, our new President Joe White. President White. And our new Chancellor for the Urbana campus, Richard Herman. Also with us today is a truly extraordinary group of student athletes and their coaches. This year’s fighting Illini basketball team. They’re here with us today. This team set a school record and 1 STATE OF ILLINOIS 94th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 38th Legislative Day 5/10/2005 tied the NCAA record for wins in a season at thirty-seven and two. They advanced to the Final Four. The fourth time it’s happened in school history and our first National Championship game. This year they won a second consecutive undisputed Big Ten Title and won the Big Ten Tournament Title. They began the season with the longest winning streak in school history at twenty-nine and zero. This team moved to number one in the national polls for the third time in school history in early December and remained at number one for the rest of the regular season, fifteen weeks. A school record. And this great team had three all Americans: Luther Head, Dee Brown and Deron Williams. And Dee Brown was named Sporting News Player of the Year. And their coach, Bruce Weber was named Big Ten Coach of the Year and National Coach of the Year by nine different services. All of that is very amazing and will -- remembered long by -- by -- by all of us. It’s just truly amazing. This team electrified and united at the State like no other team since the 1985 Bears. Nearly everyone in the State was wearing orange and was following this team. And for my Chicago colleagues, there was a billboard campaign that proclaimed Chicago is an Illini kind of town. Indeed, the Tribune, Sun-Times and every TV and radio station in Chicago adopted the Illini as Chicago’s team. Not only that, Illinois was a regular in USA Today, ESPN, Sports Illustrated and every other major news service. And we saw three thousand fans line up at 2 a.m. to see the team when they returned after winning the Chicago Regional. And we saw more than six thousand fans who cheered on the team as they left for St. Louis and nearly thirteen thousand fans that filled Assembly Hall in Champaign to watch the National Championship Game. And when they returned from St. Louis, twenty-one thousand fans gathered to cheer them at Memorial Stadium. And let’s take a look at the individuals involved with this team. Bruce Weber is a coach with a solid character. He’s a superb roll model and an example of how athletics at the University of Illinois can truly benefit the entire State. Coach Weber is a grounded family man, strong in his values and his faith. Now, let’s look at the student athletes. Jack Ingram is an Engineer. Nick Smith is earning his MBA. And every senior will graduate on time. Dee Brown was not only on the cover of Sports Illustrated, but he is a solid 2 STATE OF ILLINOIS 94th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 38th Legislative Day 5/10/2005 student on and off the court, and he is on track to graduate on time at Illinois. And of course, we hope he does. This team has become our team. A team that has become a favorite of the entire State. The team has served as a wonderful example of leadership and willingness to sacrifice oneself for the betterment of the team. Remember, how many times did ESPN or CBS count the number of passes that this team threw during an offensive -- offensive set, and how many assists did they rack up during every game. We can all learn a valuable lesson about giving up oneself for the - - betterment of the team from these great student athletes. Ladies and Gentlemen, please give a warm welcome to Coach Weber and this year’s Fighting Illini Basketball Team.
(Remarks by Coach Bruce Weber)
It is my understanding the -- the students have to go back, because this is the week of finals. I know they all do well. They -- they do well on those finals as they did in the game, we all are very proud of ‘em. Very good. Senator Schoenberg. What purpose do you rise?

PRESIDING OFFICER: (SENATOR DeLEO) 3rd Reading. Senator Rutherford, for what purposes do you rise, sir?
An inquiry of the Chair. 33 STATE OF ILLINOIS 94th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 38th Legislative Day 5/10/2005
PRESIDING OFFICER: (SENATOR DeLEO) Please state your inquiry, sir.
I notice as we’re going through the Calendar and I look up there and I see page number -- it says we’re on page number 10. We’ve been on page number 10 for quite a while. Could you tell me, is there something wrong with the electronics?
PRESIDING OFFICER: (SENATOR DeLEO) On our new digital board here it only accommodates two digits. It hasn’t been corrected yet. So ten is actually one hundred and, and we can’t see the third number. So, as soon as this wonderful -- electronic board gets figured out this summer it will say -- it will have the fifth digit. Will say page 107. So, page ten is now page 107. Senator Rutherford.
Now, Mr. President, another alternative to that may be that we don’t introduce so many bills and we have such a massive Calendar that we have a huge spine on it and that our electronics can’t even handle the capacity to it. Is this -- I just note that we do have a huge, huge Calendar and the electronics will only allow us to go up to page 10. Is that what we’re seeing? Thank you, Mr. President.
PRESIDING OFFICER: (SENATOR DeLEO) Thank you and if you notice, Senator, that these are House bills, not Senate bills. So, it’s House members. We’ll take a break right now and, Madam Secretary, Committee Reports, please.
Mr. President, I have a motion to re-refer. Pursuant to Senate Rule 3-7, we move the following Senate Bills be re- referred to the Senate Rules Committee: Senate Bills 29, 55, 56, 71, 73, 103, 113, 118, 130, 134, 146, 149, 166, 167, 168, 177, 178, 179, 180, 181, 182, 194, 195, 196, 207, 212, 213, 218, 228, 237, 238, 240, 249, 258, 259, 267, 268, 269, 281, 282, 289, 314, 315, 342, 344, 351, 374, 376, -- 386, 387, 408, 410, 418, 421, 425, 428, 437, 448, 453, 462, 474, 515, 532, 540, 548, 551, 552, 573, 576, 578, 579, 580, 614, 617, 772, 773, 777, 779, 781, 782, 783, 784, 785, 786, 787, 788, 818, 944, 1094, 1224, 1229, 1231, 1295, 1303, 1327, 1329, 1450, 1455, 1456, 1473, 1496, 1504, 1506, 1507, 1508, 1510, 1511, 1512, 1513, 1643, 1653, 1691, 1692, 1695, 34 STATE OF ILLINOIS 94th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 38th Legislative Day 5/10/2005 1713, 1721, 1724, 1725, 1743, 1744, 1764, 1766, 1805, 1808, 1810, 1811, 1837, 1838, 1845, 1846, 1852, 1859, 1861, 1871, 1872, 1877, 1881, 1886, 1889 {sic} (1887), 1902, 1918, 1919, 1920, 1921, 1923, 1924, 1925, 1926, 1927, 1928, 1929, 1948 {sic} (1958), 1951, pardon me, that was 1961, 1963, 1998, 2006, 2013, 2028, 2031, 2041, 2050, 2051, 2056, 2057, 2069, 2073, 2074, 2075, 2096, 2100, 2105 and 2114. As you know, Mr. President, tomorrow…
PRESIDING OFFICER: (SENATOR DeLEO) Please give the speaker your attention.
…is the annual softball game between the House of Lords and those commoners across the hall. We have to defeat the House and prove once and for all that the upper Chamber is superior, far 40 STATE OF ILLINOIS 94th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 38th Legislative Day 5/10/2005 superior, to those young underlings across the hall under Speaker Madigan. Well, I want you to know the morning line is the House by ten wins and being a betting man I actually got four runs against some of those House dummies who think they’re going to defeat us. Today we’re going to have our first little scrimmage game against the lobbyists at 5 o'clock. From 5 to 6 just a couple innings, ‘cause some of you are real old and we don’t want you to get too tired. But tomorrow we will be at the Firefighter’s house and defeat the House once and for all in our annual softball game or die trying. And we’re going to autograph this ball right here for Adeline Geo-Karis, who has called our game for years, in her honor. So, sign this ball today for Geo, which we got from DeLeo, the Italian stallion.

We’re going to 3rd Reading. Senator Watson, for what purpose -- oop! Senator Hendon, for what purpose do you rise?
Thank you, Mr. President. A lot of Members have asked where the practice was tonight. They thought it was at the old park, in Lincoln Park. We’re going to practice - I handed them out -- at the Firefighters Lake Club so you can get used to that field. It’s a different field. We are not playing in Lincoln Park. We’re playing at the Firefighters house on Lake Shore. So, we’re going to practice also on Lake -- at the Lake Club. If anyone needs the directions they can get ‘em from me.
PRESIDING OFFICER: (SENATOR DeLEO) Thank you. Senator Geo-Karis, for what purpose do you rise, ma'am?
Mr. President and Ladies and Gentlemen of the Senate, can you please tell me what we’re going to do right now?
PRESIDING OFFICER: (SENATOR DeLEO) I’m going to do that in just one second. Just bear with me one second.
I -- I…
PRESIDING OFFICER: (SENATOR DeLEO) Okay. Ladies and Gentlemen, because we were not prepared and it is getting late in the day, we’re not going to be going to 3rd Readings. We’re going to go to Supplemental Calendar No. 1 which that’s been distributed. Motions in Writing. So, on Calendar -- Supplemental Calendar No. 1 is the Order of Motions in Writing. Motions to Re-refer. Madam Secretary, could you read the motion, please? 64 STATE OF ILLINOIS 94th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 38th Legislative Day 5/10/2005
A motion in writing, filed by Senators Viverito, Cullerton, Hendon, Petka and Roskam. Pursuant to Rule 3-7 we move that the following bills were referred to the Senate Rules Committee. Those bills were read previously today.
PRESIDING OFFICER: (SENATOR DeLEO) That’s correct. Thank you. Senator Viverito.
Thank you, Mr. President. Mr. -- Mr. President, in order to clear our Calendar Rules Committee has moved to refer to a -- a number of Senate Bills from 2nd to 3rd Reading. The Rules Committee. The bills are listed in Supplemental Calendar No. 1.
PRESIDING OFFICER: (SENATOR DeLEO) Okay. Senator Viverito moves that the Senate Bills listed on the Supplemental Calendar No. 1 be re-referred to the Senate Rules Committee. Is there any discussion? Is there any discussion? Senate -- Senator Roskam, for what purpose do you rise?
Thank you, Mr. President. Just in wholehearted support of Chairman Viverito’s motion and I think we may be able to move from this bound version of the Senate Calendar, which is a real delight, to our old folded copy and get back to the staples. So, with this motion that was supported unanimously by the Rules Committee, I think we can go back to our -- our -- our former way of keeping track of the Senate business and I urge the passage of the motion.
PRESIDING OFFICER: (SENATOR DeLEO) Thank you, Senator. Senator Rutherford, for what purpose do you rise?
A question of the sponsor.
PRESIDING OFFICER: (SENATOR DeLEO) Sponsor indicates he’ll yield for a question, sir.
Mr. Chairman Viverito, earlier we talked about how the electronics did not have the capacity to be able to put the page numbers up there when we went past three -- we went up to three 65 STATE OF ILLINOIS 94th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 38th Legislative Day 5/10/2005 digits. Is this moving these off the Calendar going to put us to less than one hundred pages on the Calendar so we can have the page number properly noted on the -- on the tote board?
PRESIDING OFFICER: (SENATOR DeLEO) Senator -- Senator Viverito.
Thank you, Mr. President. We hope to be able to do that for you, Senator.
PRESIDING OFFICER: (SENATOR DeLEO) Senator Rutherford.
We recognize it’s going to cost an awful lot of money to have to reconfigure that board so we can put up to one hundred pages. I like the idea better of keeping this Calendar thinner, re-referring them to Rules so we’re down to two digits on our pages and I stand in strong support of Chairman Viverito’s motion.
PRESIDING OFFICER: (SENATOR DeLEO) Okay. Seeing no further discussion, all those in favor will say Aye. All those opposed will say Nay. The Ayes have it, and the resolution -- the motion is -- is adopted. Senator Halvorson. Senator Halvorson, you were seeking recognition, ma'am?
Thank you, Mr. President. I would like the Senate to recognize we have a very special person on the Floor with us. The former Senate President Phil Rock. If the Senate will -- will welcome him.
PRESIDING OFFICER: (SENATOR DeLEO) Senator Rock. President Rock, welcome back. It’s always a pleasure to see you. If I could have the Body’s attention for just a moment please. I have an announcement to make. We have some committees meeting this afternoon. I’d like to announce those committees at this time. We have at 2:30 today Appropriations I in Room 212. So, once again, Appropriation I in 212 at 2:30, Appropriation II at 4 p.m. 66 STATE OF ILLINOIS 94th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 38th Legislative Day 5/10/2005 and Appropriation III at 4:30. The Senate stands adjourned. 67
