Thank you, Mr. President, Ladies and Gentlemen of the Senate. I’m very pleased to be before you with an agreed bill on the Elevator Safety and Regulation Act. As you may remember, this has been the source of some consternation over the last several years. We’ve worked very hard to reach an agreement with all of the stakeholders. In essence, what this does is it devolves back to the local municipalities, if they want it, the ability to regulate their own elevators, as well as provide safeguards for certain major installations, that they not be imposed upon building owners and condominium owners more quickly than necessary. I know that our Republican colleagues have had some questions and -- and wanted some time to review this. My understanding is that they’ve reached -- you have reached a level of comfort, but I’m happy to answer any questions that I can.

Senator Harmon, while the Elevator Safety Board has definitely caused some major concerns with safety -- or, with senior-occupied condos in the suburbs, there were also concerns from downstate concerning these new requirements in the Code. What is in this bill to help alleviate those costly requirements concerning those people affected in our small communities in downstate?

Thank you, Mr. President. Senator Jones, that’s an excellent question. The -- the bill applies uniformly across the State. The initial concerns brought to me were from condominium owners. Having talked with colleagues from downstate Illinois in particular, you have similar concerns in smaller office buildings. This is a uniform standard that applies to all buildings. So I believe your concerns would be addressed.

Thank you, Mr. President. In short, Senator, what we -- we’ve done is devolve to the local authorities the ability to make case-by-case decisions with respect to elevators in their jurisdiction. Those can be appealed to the State Board. At the same time, the State Board can set statewide policy variances and the like that apply not on a case-by-case basis, but uniformly across the State.

One of the things that happened several years ago when we passed this bill was the control went from the local to the State level, with the exception of the City of Chicago, which maintained local control. What we’re essentially saying is the same rules apply to everyone. If a municipality enters into a local elevator agreement with the State Board, then they will return control for the local authorities on those case-by-case determinations.

Senate Bill 2009, as amended by Senate Amendment 4, would amend the Public University Energy Conservation Act and allow Eastern Illinois University to build a state-of-the-art renewable energy center on the campus of Eastern Illinois University. It would replace an eighty-nine-year-old Indiana coal-fired plant by having a power facility that will actually burn wood chips. It is an agreed bill. The nine or ten association trade groups and labor representatives we’ve been dealing with all signed in in favor of the bill yet this morning. And the environmental groups are also in support of the bill. I’ll be happy to answer any questions, Mr. President.

Yes. Thank you, Mr. President, Members of the Senate. We actually passed our supplemental a few weeks ago and we ran out of time to pass the BIMP. So this is the budget implementation for the spring supplemental. The provisions are needed to implement the American Recovery and Reinvestment Act, which is - -- of 2009, which is the term used for the federal stimulus package. It includes some language requiring the RTA to purchase alternative fuels. It requires IDOT, in their projects that would be funded with this money, to comply with the Business Enterprise for Minorities, Females and Persons with Disabilities Act, and requires IDOT to appoint representatives to a professional and artistic services selections committee. Also, it maintains the existing transfer of funds generated from drug rebate agreements into the Drug Rebate Fund. And temporarily increases appropriations for the hospital assessment 16 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 39th Legislative Day 4/23/2009 plan. And it also allows these funds to supplement IEPA’s existing clean water programs to be used to make both grants and loans to applicant communities. Thank you. First, Mr. President, I rise in support of the bill. I believe everyone in the Chamber on our side support the bill. There is an issue that has come up, just recently in fact, since the Executive Committee passed it yesterday, and it has to do with the professional and artistic services committees language that’s referenced on page 2 of the bill. Specifically, the new language says that the committees shall comply with all requirements of the Open Meetings Act. If the committees -- and here’s the concern, if the committees are dealing with bids or bid language, is that going to create an issue, where, obviously, bids are supposed to be sealed or private, as opposed to having them in a -- a committee that is subject to the Open Meetings Act?

Well, I understand that the committee was meant to be advisory in nature and, therefore, we would be able to avoid 17 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 39th Legislative Day 4/23/2009 that problem. But, Senator, I would suggest that if we find out that there is a problem -- I think what we should do is pass the bill and work with you on whether or not we need an -- an amendment. And perhaps we could ask the Governor to do an amendatory veto since it is -- we’d like to pass this today since it’s the BIMP. And if there is a need for a change, perhaps we could do a trailer bill or even an amendatory veto.
