Thank you, Mr. President and Members of the Senate. The resolution recognizes 4-H Day at the Illinois State Capitol. And I’m not going to read the entire resolution, but I would -- would like to highlight a couple of points in the -- in the resolution, because it talks about some of the benefits of 4-H and -- and the good that it does for youth here in Illinois. 4-H is the largest… Thank you, Mr. President.
PRESIDING OFFICER: (SENATOR HARMON) Ladies and Gentlemen of the Senate, if you could please give your attention to Senator Sullivan as he presents this important resolution.
Thank you, Mr. President. 4-H is the largest youth organization in the State of Illinois, with nearly three hundred thousand Illinois youth participating. 4-H is part of the University of Illinois Extension and is available to all youth in every county in the State of Illinois. There are more than twenty-four thousand adults who volunteer with 4-H across the State. Research has - and this is an important point to me; I think something that we all need to keep in mind - research has 29 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 93rd Legislative Day 3/9/2010 shown that 4-H members do better in school, are more likely to see themselves going to college, are less likely to engage in risky behaviors, and contribute more to their communities. Where -- at the end of the resolution, it says - and I’ll read here verbatim - “Resolved, by the Senate of the 96th General Assembly of the State of Illinois, that Tuesday, March 9th, 2010 is 4-H Day at the Illinois State Capitol, saluting the rich traditions of Illinois 4-H, the outstanding accomplishments of Illinois 4-H members and leaders...” And just on a personal note, Mr. President, Members of the Senate, my -- my wife and -- and -- and I have four children and they have all been active and participated in 4-H over the years. My wife is even a 4-H leader. And I -- the thing I like about 4-H is, regardless of where you are in the State of Illinois, regardless of what resources that you have available to you, whether you -- there are opportunities for you in 4-H. If you have, as my children, and my sons especially, did -- if you live on a farm and you have -- you want to show livestock, you can do that. But if you live in the city and most 4-H members in this day and age do not live on the farm, they live in the city, and there are other opportunities for them, whether it be public speaking, whether it be horticulture, whether it be cooking, whether it be a multitude -- robotics. And if you’re down in the Rotunda, I hope you go down there today and see some of the displays down there. There are tremendous opportunities for our young people. And, Mr. President, if I may as well, up in the gallery, on both sides of the Chamber, we have Illinois 4-H youth from all over the State of Illinois. And I -- it is wonderful that they are here today. We -- we -- I got to speak to ‘em down in the 30 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 93rd Legislative Day 3/9/2010 Rotunda, but I’d also like, Mr. President, if we could, to recognize those individuals.

Yes, thank you, Mr. President, Members of the Senate. I think it’s appropriate at this time that we have finished the certification for the primary that we point out that, as an institution, the Senate, I think, has done a -- a remarkable job in providing candidates for other offices, whether it be statewide offices or -- or local offices. And I just wanted to point out the fact that a number of Senators - I think -- believe nine Senators - ran in the primary. We had some that 32 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 93rd Legislative Day 3/9/2010 won and some that lost. I -- Senators -- on our side of the aisle, Senators Link and -- and Hendon ran for statewide office; Senator Pankau and Murphy and Dillard ran, and were unsuccessful. But we -- we think and we know that they did -- all of them did an excellent job in -- in representing the Senate as Senators. Senator Rutherford, Cronin and Hultgren were successful. I congratulate you. And certainly I want to congratulate Senator Brady as well. You know, it’s the -- we did a little research on this and it’s the first time that a sitting Member of the General Assembly is running for Governor since 1904. And I just wanted to let Senator Brady know that -- given the fact that he’s in the General Assembly and he’s running for Governor, that if there’s anything we can do procedurally with regard to our schedule or his committee assignments, I wanted to offer that so that there’s no inconvenience with regard to his -- his -- his campaigning for Governor. But with this honor, of course, also comes some responsibilities. And I just wanted to clarify that we had scheduled -- had scheduled, before the primary, Appropriation Committee hearings on proposed budget, and this is not a press release, but rather legislation that we are debating. And I just want to make sure that -- that -- that he knows that we are not playing politics with the State’s budget woes by introducing pieces of legislation. He has, as I said, the first time in a hundred and six years, the opportunity to introduce legislation as a sitting Member of the General Assembly for a budget year that he intends to be the Governor. And that’s a unique opportunity and we want to make sure that he understands that we’re being very serious and not playing politics. Well, you know, I personally, as a candidate who was referenced, appreciate the gracious remarks from President Cullerton. I think a lot of us on both sides of the aisle did work very hard this year to try and put our stamp on the State. And we all know we’re sitting here in the midst of a very difficult budget situation, and those of us on the Appropriations Committee have been looking at Senator Trotter’s ten-percent across-the-board amendment. And the President made reference to the fact that it was not intended as a political gesture to file the ten-percent amendment and have the hearings, 34 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 93rd Legislative Day 3/9/2010 and we certainly appreciate that, as members of the committee and on this side of the aisle. But I guess one of the things I would be interested in hearing - and I think it would be helpful for the -- for the -- for the rest of this Session - is, if it is not a political gesture, is it the stated position of the sponsor of the amendment, Senator Trotter, and is it the intention of the Democrat Caucus in the Senate to support ten- percent cuts in spending in the current fiscal year, as that amendment requires?
PRESIDING OFFICER: (SENATOR HARMON) Senator, I’m sorry to interrupt, but is this an inquiry of the Chair or a point of personal privilege? That we are not debating any particular measure, I just want to make sure we are on the correct order of business, Senator. Is this a point of personal privilege? Senator, we -- we haven’t -- we haven’t -- we -- we want to turn your microphone back on so that you can be heard. Senator Murphy.
Thank you. I -- it -- we’ll call it a point of personal privilege. But I think the people in this Chamber and the people of this State deserve an answer on whether we’re serious about cutting spending or whether or not this was in fact a -- a gimmick, as has been intimated by some. The President says it was not. I take him at his word on that. And I guess what we would like to see and hear: Is this a serious effort at reining in spending to bring this year’s budget into balance? Do you support the amendment? And when can we count on a vote on it?

Contrary to what was written in some recent reports in the newspaper, we did not block them. We have assigned your amendments to committee and we continue to have hearings on those amendments. It’s a very serious budget crisis. My only point is, we’re not playing games. We’ll see what happens in the committee. But we’re taking it seriously.

Senate Bill 384 actually amends the Department of Natural Resources Conservation Law of the Civil Administrative Code of Illinois, the Fish and Life {sic} (Aquatic Life) Code, and the Wildlife Code. And what this does is provides that veterans and individuals returning from service abroad may submit verification of service abroad for a free hunting, fishing or camping pass at one of the Department’s office. What this does is to allow - this legislation - as they return, they would be able to have access to our public works and public parks and fishing and wildlife.

This was just a loophole in the legislation. And it was requested by the Veterans Administration.

Thank you, Mr. President. Senate Bill 2507 allows Wilmington Community School District Number 209-U to exceed its debt limitation and issue 2.285 million dollars in bonds, so long as the proceeds are used for projects approved by the voters on March 21st, 2006, when the referendum was approved. Prior to the issuance, the school board must determine, by resolution, that those projects are required because of the age and condition of the school buildings and that issuance is authorized by legislation exempting the debt from the district’s 55 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 93rd Legislative Day 3/9/2010 debt limitation. It’s my understanding that you can borrow up to a certain ratio of your EAV, and currently that ratio is 13.8 percent. This bill would allow this school district to borrow up to 14.4 percent of its -- EAV. Obviously, EAV in -- in our area, like in many areas around the State, that number has gone down. Equalized assessed valuations have suffered throughout the State. But this -- this referendum was passed in March of 2006. The school district in Wilmington has two projects left, one to a K through 1 building, and this bill will allow them to issue the remaining bonds, 2.285 million dollars, so they can finish those projects.

So this is no increase in borrowing. It’s just that they went against a technical requirement in their bond agreements and so they have to get permission from the Legislature to -- so it’s no additional borrowing. It’s just that they have to fulfill all the bond covenants. Is that right?

Thank you very much, Mr. President, Ladies and Gentlemen of the Senate. This is a -- a trailer bill left over a couple years ago from the Flood Prevention District Act that we passed. And it passed the Senate last year, but it got made into another life form in the other Chamber in their magical, mystery machine. So we are back. And what it does was allow a -- it -- it allows, by law, a -- a levee district to annex property that is being served by them. An audit of the bottomland showed that there are many parcels that are in the levee district and protected by the levees and they don’t pay any taxes to the -- to the levees, which ups the taxes for those who are paying. So it’s a matter of equity.

Thank you. Senator, you know, I voted against the bill in committee and I think you understand why, and I just want you, if you would -- and I’ll probably be the only No vote on the Floor as well. But -- but could this be considered a forced annexation? And how did these people get left out of the district in the first place?

Well, Senator, it’s -- it’s -- it’s -- I wouldn’t characterize it as a forced annexation. It -- it is a -- it is an effort by the General Assembly to bring -- to complete the legislative intent of establishing these Acts fifty/sixty years ago, which is to establish a tax base of those who are protected by the levee. And -- and the -- answer to your question, we don’t know. I -- we were quite surprised to - and I actually talked to Senator Frank Watson about this - we were surprised to see the numbers of parcels and the -- the -- the size of the parcels that are not included in these two levee districts. One may assume that it was through an oversight or one may assume something darker, considering the past history of these levee districts, not the current ones - years ago.

Senator, in a previous bill, maybe last year, the one that you’re referring to, I believe that I was a No vote because I was concerned that what this does is subjects these people who would be annexed into this to taxes and fees that they had not passed a referendum on. The people who are currently in the district have passed a referendum to be taxed and had the fees applied to ‘em. Is that -- do I have my -- is my memory about right?

Senator, I don’t agree with that description. I’m -- I cannot tell you how these districts were established by law. They were established at the time the federal government built this string of levees down the Mississippi River and turned them over to these areas, and the State General Assembly - we - created these levee districts. I’m not certain this was done by referendum. And -- and -- and -- but this bill says in effect that if one is protected by the levee, one is subject to paying for the cost of that levee. Since -- this is a minority of landholders that are not paying, and they are receiving the benefits of that levee and they’re not paying. So, again, it’s 60 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 93rd Legislative Day 3/9/2010 a matter of equity. When I passed the Flood District Control Act, numerous questions were asked on the Floor about the quarter-cent tax being paid countywide and that was necessary to raise the money to reconstruct the -- the levees. And -- and in the answer to those questions, I pointed out that there will be a bill which will establish a more uniform of taxation for those who are actually receiving the direct benefit of the levees.

Just a final clarification. I think that that’s a very good justification that you’re mentioning, that if we all benefit, we all pay the tax. My analysis, though, says that the -- some of the taxing powers in -- of this district were put there by referendum. These folks -- these folks have not passed the referendum. I would assume that the geography of the area has stayed the same since the original were in there and these people were not in there. And so wouldn’t you think that there’s more to it than, oh, well, somebody just forgot ‘em? Isn’t -- isn’t there more analysis of -- well, why were they omitted in the first place?

Senator Lauzen, those are very good questions and I -- and I accept an analysis that the -- that there may have been a vote on these levees years ago, but I -- and I don’t know why these parcels were not added. So I’m -- I’m asking for an Aye vote to let the people of the Metro East continue their efforts to fairly manage this and raise sufficient money to keep these levees functioning.

And they were supposed to come back with a report as of June 1st of 2010; however, they did not get funded… I -- I 62 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 93rd Legislative Day 3/9/2010 apologize. 23 -- 2523, I’m sorry, amends the Business District Development and Redevelopment Division to allow municipalities to pledge additional revenue streams to back bonds. Basically, about three years ago, we created the Business District Act that allows for us to add an additional one-percent sales tax in order to recoup some of the developers’ costs. The law currently exists. I think there are probably about forty of these already and all we’re trying to do is to use that -- that revenue stream and issue bonds to pay the project up front. The business district already exists. We just want to take that revenue stream and -- and bond it up front.

It’s -- I think it’s a slippery slope.

What this bill does is it allows the general administrative endorsement if the certificate holder has two years as a chief school business official, rather than requiring the two -- full-time teaching experience. The idea being that superintendents are not -- their emphasis is not on instruction and that’s the job for the principal. And I would ask an Aye vote.

Thank you, Mr. President. We have realized in the last four years that tuition increases at community colleges have risen at a much faster rate than any time in the history of Illinois. And many schools who receive the equalization grant fall below the amount of money necessary to receive that grant. What they used to do is have to then raise their tuition to eighty-five percent of the statewide average. What this bill will do is to lower the tuition rate and standard fee criterion to receive the equalization grant to seventy percent of the statewide tuition and fee. It does not reduce or increase any college -- college’s portion of the equalization grant that they would receive under the statutory -- formula. I’d be happy to answer any questions.

First, it resolves confusion as to the proper remedy for the courts to apply by providing that any person who suffers actual damages as a result of a violation of the Home Repair and Remodeling Act may bring an action under the Consumer Fraud and Deceptive (Business) Practices Act. Secondly, the Home Repair and Remodeling Act requires a contractor to give a pamphlet to his -- his -- his customer, as well as to have a signed contract with that customer. However, what the courts have found is that some of these consumers are using the Act to get out of paying the balance due on a home repair or remodeling contract. So the courts are asking for a clarification of this. I think what we are doing through this bill is saying that unless there’s actual damages, a consumer cannot get out of paying the balance due to a home repair or remodeling company by using these two technical provisions in the Act of requiring a pamphlet to be given and requiring a written contract before work on the project. This is an initiative of the ICCB and is being proposed as a way to help alleviate the issues of the Board right now, and community colleges and the State alike, as they face cash flow problems. Yes, thank you very much, Mr. President. Senate Bill 2549 creates new requirements for which rainwater can be stored and used for plumbing. Also, this bill allows buildings -- public buildings to use rainwater harvesting systems for the use of plumbing, but not for the use of consumption. The bill also requires the Department of Public Health to adopt and publish a minimum code of standards for rainwater harvesting collection systems and rainwater harvesting distribution systems by March of 2011. I also need to read something into the record, if that’s okay. The intent of this legislation is to encourage the voluntary development and installation of rainwater harvesting collection and distribution systems. Such systems are vital to increasing water conservation. The legislation requires the Department of Public Health to establish design and installation standards. The legislation also makes clear that existing rain barrels in other outdoor irrigation systems are not affected. This legislation applies to the collection of rainwater for non- potable use indoors for things like flushing toilets. The legislation defines what is and what is not plumbing. This term is relevant because it raises the issue of when it is appropriate to use a licensed plumber. It amends both the Code of Civil Procedure and the Illinois Marriage and Dissolution of Marriage Act to prohibit the stay of a child support order simply by the party who’s been ordered to pay that child support filing a motion to stay the judgment. Apparently, the Illinois State Bar Association has run into a case or two where individuals who are court ordered to pay child support were actually able to suspend their obligation, for sometimes months at a time, simply by filing a motion to stay that. This simply would make clear that that is not permissible under Illinois law. Be happy to answer any questions, Mr. President.

Thank you. You know, I -- I just caution people on this piece of legislation that Public Act 96-44 authorized forty-one thousand four hundred and sixteen dollars to be swept out of this fund. There’s -- there’s still about ten thousand dollars to be swept out of it. The Comptroller says there’s only about 76 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 93rd Legislative Day 3/9/2010 eighty-one hundred dollars in there now. Plus the fact that this -- this increases the fines and penalties from five hundred dollars to a thousand dollars and seven hundred and fifty dollars to fifteen hundred dollars. And so, I would just encourage people to vote No on this. I mean, it’s time that we started leaving the funds in these -- in these special funds and quit raiding ‘em and we wouldn’t need to be doing this. So I would encourage a No vote.

Senate Bill 2579 amends the Illinois Estate and Generation-Skipping Transfer Tax -- Tax Act by giving the State Treasurer the ability to waive late payment penalties that are imposed on country treasurers if the reason that the payment was late -- due to an extraordinary force, including, but not limited to, the occurrence of a natural disaster that cannot be foreseen, cannot be avoided by the exercise of due care, and for which no person can be held liable. The State Treasurer would then make the determination. This is brought to us by the Treasurer’s Office because of a -- a tornado that hit a county and their payments were late.
