Yes, Senate Bill 2529 is the coroner’s fee increase. This is a fee that the coroners -- hasn’t been increased for the last twenty years. And what this does is -- like sworn testimony, it goes from three to five dollars; toxication {sic} costs from fifteen to twenty-five; and artist’s and -- drawings from fifteen to twenty-five. And the biggest jump is cremate of a dead body, went from ten dollars to fifty dollars. But on the cremation, that -- that they can waive that. Thank you. This is kind of a follow-up on -- on Senator Dahl’s question. It was my understanding, Senator, that there was an agreement that these fees would be set as a cap, rather than as a set fee. And I think Senator Althoff was a part of that discussion, if I remember correctly. And I haven’t seen anything that would indicate a change in the original legislation. And maybe she can address that if I’m in error.

Thank you. As my name was used in debate, I will try and answer that question. We are pursuing that. Currently, the statute is something that sets these fees. We’d have to go through an entire process and the coroner association would like these fees to go into effect as soon as possible. Senate Bill 2601 requires individuals seeking admission to a nursing home to be orally screened for risk factors related to hepatitis B, hepatitis C, and HIV. This screening must be done within ten days of their admissions and the results held confidential per State law. It also mandates that individuals identified with these risk factors to be provided immunization upon admission to a nursing home and the medical records be documented such as. The -- final is that it excludes nursing homes licensed or regulated by the Department of Veteran {sic} (Veterans’) Affairs from this Act.

Actually, Senator Trotter, that’s a nice segue into my second question, which is, who is going to pay for the screening and vaccinations? And assuming it’s the long-term care industry and the facilities where these people might be going, what is their position on this legislation?

There is no opposition to this legislation from the nursing home industry - at least none that has been recorded. Who will pay for it? It’ll be paid for through Medicaid and that is not -- and those that are not covered by Medicaid will be covered by private insurance companies.

Senator Trotter, did -- did the Department give you a figure of how much it might cost them? And -- and here’s -- here’s -- the base of my inquiry is, we’re saying that we want to make sure these people are screened - not only for their own good, but obviously for the people who are going to be surrounding them - and we’re carving out an exception for people who are served by the Department of Veterans’ Affairs, who, I would assume, would be veterans, at least to some extent. So, can you give me a better idea, one, whether -- whether the Department told you how much it would be, and maybe help me a little bit on how I can explain that back home of why those folks shouldn’t be protected like this?

Since you asked the question in committee, I have personally reached out to the Department to try to get a number of how many people would be excluded from this screening test. That number -- I have not been given a number. I agree with you. I was adamantly opposed to having them excluded from this legislation. We believe that we want to give the best care and deliver the best services to all the citizens of the State of Illinois, and especially to our veterans. The Recovery Trust Fund is one we have some -- some concerns with. Can -- can you tell me what the -- what the purpose or the reasoning is for setting up this additional fund?

Essentially to create a -- a dedicated fund, which are dollars which will go for these - in health services - will go solely and exclusively to health care. So what this basically does is, the dollars that will be coming in will not go into the General Revenue Fund, which we feel can be used for any purpose; but dollars that are -- are specifically earmarked to deal with health care services will go in this fund and this is a better way in which we can keep track of that.

This fund also, though, allows the Department to take administrative costs out of this even though their administrative costs have already been given to them in the budget. So this increases the amount of dollars that the Department gets to run administration. How do -- how does that balance out then with -- with the budget that they’ve already been given for that year for administration?
PRESIDING OFFICER: (SENATOR CLAYBORNE) Senator Trotter.
That is partly correct, Senator. What happens is, is that there are some administrative responsibilities that are covered under GRF, which is for -- to administer this kind of program. However, all of the activities and the administration is not covered because of the different regulations and guidelines that have been set forth by the feds. There’s a different body of individuals, of bureaucracy, that has to be set up and utilized at this point. This will allow those dollars that are coming out of those things that are governed by the federal laws and mandates, that it will be covered through these funds. Which, essentially, we’re setting this fund up so we can, again, maximize getting federal reimbursements. So these are a lot of their dollars.

Aren’t these individuals -- their -- we’re currently funding them in their regular budget, so these individuals are being funded. We’re not adding more staff to do this. So, the question is, where is this extra money that’s coming into the Department, where is that going to be going? Well, let’s see, that’d be a question. Where’s the extra money going to?

Thank you very much. It’s -- it’s not extra money. I mean, we’re really here, I mean, drawing this fine line of who’s doing the work and what work are they doing. To enable us to capture these dollars from the feds, there is other work. There are other administrative responsibilities which takes on a -- not just your regular clerical personnel. These are people who understand federal laws, understand - and has to understand - how to not only get those dollars, but also how to spend those dollars. So, as that, we -- we’re talking about a special individual with special duties who will be overseeing these federal funds that we’re getting in large part because of our Medicaid enhancement that we’re getting now through the ARRA funds. So it is -- it’s a special deal and it’s a special fund dedicated especially to deal with health care-related issues. And, again, that’s the -- the whole purpose, is so the dollars would not go into General Revenue Fund so there’d be no confusion on how those dollars are being spent.

So, when you talk about we need to have a -- get special person with special training to do that, I -- I think that those people are already there. The second thing is, this doesn’t have an effective date until January 1. So the issue about an enhanced match, that’s all over with -- would be over with anyways unless that enhanced match were to continue on. So, the only thing this is really doing is, is taking more flexibility away from the administration and adding more administrative costs to the Department at the expense of the General Revenue Fund of -- of the State.

You know, arguably -- I mean, we could go on and on here and -- and probably still never agree on the intent or the -- the real purpose of why this is being done. And -- and you’re - - you’re also correct that the funds do run out or at least the ARRA program does end December 31st, 2010, which makes it more important that we have these individuals who have knowledge of how to get grants, how to get dollars from the federal government, be in place. More importantly, because now we’re going to be seeking new dollars, new opportunities of how we’re going to get back our dollars from the federal government - and those are our taxpayer dollars. And if we do not get those dollars, they will go to another state. So, to fulfill our purpose of, one, maximizing all of our efforts and returning 60 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 95th Legislative Day 3/11/2010 dollars back to the citizens of the State of Illinois, individuals with that specialized training, I think, need to be in place. And -- are we talking about five employees? Are we talking about one employee? We don’t know. It’s not there yet. So this -- the argument itself is a hypothetical one.

Thank you. To the bill: Again, Senator, I understand what you’re trying to do. I think there are a lot of good things in this bill. The -- the biggest concern is that we’re diverting twenty-three million dollars out of the General Revenue Fund at a time when, clearly, we have significant budget problems. We’re adding more administrative costs at a time when we really can’t afford to add more administrative costs. So, I guess I would caution everyone whether or not this is the right time to be setting up this new fund and diverting these dollars away from general revenue. Thank you.

By creating this dedicated pot where the dollars can only be spent on health care-related ideas and services, I think is -- is the best way to go. This is answering the question that many have been asking through the years.

Senate Bill 3001 would allow county boards to establish by resolution or ordinance an affordable housing trust fund for the purpose of providing financial support for affordable housing activities that address the housing needs of low-income and moderate-income households as determined by the county board. Such a trust fund would be funded by a surcharge on the recording of any real estate-related document in the county. This is a permissive piece of legislation and a tool for counties that need options for affordable housing. I’d be happy to answer any questions.

Thank you. It is specifically for affordable housing. There is an affordable housing trust fund. There is a framework in which the counties could work within. And let me also say that this fee - we’re talking about five dollars - there is a cap on it. And because of that - for instance, in the County of Lake, you can raise, let’s say, up to five hundred thousand or seven hundred thousand dollars - you can then leverage that money into more money through different types of grants.

Can I read directly from the proposed legislation so you -- so everybody will understand exactly what it is? Any county that establishes an affordable housing trust fund pursuant to Section 5-1132 of this Code may provide by ordinance or resolution for an affordable housing trust fund surcharge for the recordation of any real estate-related document for the purpose of funding that affordable housing trust fund in the amount of five dollars - five dollars - in 2010 and ‘11 and thereafter it {sic} (as) may be determined by the county board. The total amount of the surcharge shall not exceed seven dollars between 2012 and 2015, nine dollars between 2016 and 2019, and ten dollars thereafter. The county board shall not increase the surcharge more frequently than once in any four-year period.

To the bill itself: I’d just like to point out to the Members of the General Assembly, there are already several different revenue streams that are out there to provide for affordable housing, revenue streams such as the Rental Housing Support (Program) Fund, the Illinois Affordable Housing Trust Fund, and there are many, many federal programs, as we know. And it just seems to me that when we’re looking at the economy that’s out there and that we’re looking at the cost that could potentially be involved and the fact that this is a sliding fee - five dollars initially and up to ten, depending on 66 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 95th Legislative Day 3/11/2010 county board action over a period of time - that it just doesn’t seem this is a wise thing to do at this point. So -- I do know that -- that many of us -- many of you have been lobbied heavily by the Realtors, and I ask you to think long and hard. We are going through a recession now. Many people’s homes have been foreclosed upon. And we -- you know, this is simply a tool; it’s an option. There will be a fee of five dollars, but not a lot of money attached to this. We are simply saying to our counties, if you have put an affordable housing trust fund or commission together, here is some leverage that you may use if you want to go down that path. Because quite frankly -- I’m from Lake County. This is something that is a -- a top priority in Lake County. My guess is that it’s a top priority -- it could be a top priority in other counties. And it’s up to us to give our counties the tools they need to make sure that we have affordable housing in place, not just -- you know, this is moderate too. This is some -- for moderate housing. This is something that is important to the everyday citizen and it’s something that we should stand behind and make sure that our counties have the option to move forward on. So I ask for an Aye vote. I know it’s difficult. I know the Realtors have talked to you. And I would think that’d be a relatively straightforward thing just to narrow, that City of Chicago will do it for City of Chicago and anybody else who wants to do it can do it on their own. You know, maybe it’s permissive. Why not take the more -- that -- that approach rather than this approach where one group -- a -- no -- a -- a different group that has all of its responsibilities has someone somewhere else dictating to them their tax policy? Why not just take the -- the more -- and please forgive me for the description, but the more straightforward approach?

Senate Bill 3095 amends the Property Tax Extension Limitation Law in the Property Tax Code, providing that the definition of an “aggregate extension” does not include special purpose extensions made for the purpose of a county funding the care and treatment of its citizens who are mentally retarded or under a developmental disability. Senate Bill -- 3095 goes under -- on to provide that the taxes levied under the Act must be approved by referendum. This is a front- door referendum. It repeals a Section of the Act providing that taxes levied under the Act, in this case, would be subject to a backdoor referendum. So I state, once again, that this is a 80 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 95th Legislative Day 3/11/2010 front-door referendum designed to assist those who can least able -- are least able to take care of themselves. Thank you, Mr. President. The -- the original intention of this bill, to help the groups providing mental health services for people around the State, especially in our area, is certainly laudable. Unfortunately, this bill is an exemption from the tax cap. Now, originally what they wanted to do -- what the organization wanted to do - again, laudable - they just wanted to be sure that their funding within a county budget was protected. We drafted legislation. That could have been done. That is a narrow kind of legislation to make sure that their interests were protected. Unfortunately, this went beyond it to where now it’s again an exemption to the property tax. Pass this and you’re passing a puncture to property tax caps. Proponents of the bill will point to the front-door referendum, but that only helps the property taxpayer in the first year. As assessments rise in future years, the dollar amount of the extension will escalate right along with it, even though the voter-approved rate will stay the same. The whole point of the tax cap is to reign in the growth of the actual dollar amounts, and this bill defeats that purpose. So I recommend, very reluctantly and unfortunately, a No vote, because we could have solved this problem with much more narrow legislation.

I had taken this around to Members and explained this to them, that this was a front-door referendum. This is something that we’re putting before the people and allowing them to decide if they’re going to help our most vulnerable citizens. It amends the Criminal Code of 1961 to set and enhance penalties for offenses related to dog fighting. There was a dog fighting incident that took place in Maywood in September of 2009. What we found out is that it was in the home of a daycare. What this bill would do, would increase the purpose {sic} of conducting an activity involving dog fighting within one thousand feet of a school, a public park, a playground, child care institutions, day care centers, part day child care facilities, day care home, group day care home, or a facility providing programs or services for persons under eighteen years of age. Senate Bill 3629 amends the Illinois Vehicle Code and sets forth procedures for allowing golf carts, ATVs and other non-highway vehicles on community streets. Last year we passed two different bills that actually were inconsistent and -- and what we’re trying to do with this legislation is make some clarification. The legislation provides that all non-highway vehicles and all low-speed vehicles are prohibited on local streets unless the community specifies otherwise. There’s also language concerning safety equipment, driver’s license, insurance. And it also has language in there with regard to the use of ATVs for the purpose of -- for -- agricultural uses. Senate Bill 3644, as introduced, amends the Illinois Wage Payment and Collection Act by requiring an employer to pay an additional penalty to an employee if the employer does not include all commissions earned by the employee in the final compensation paid to that employee either at separation of employment or not after the next scheduled paycheck. This was actually identical to Senate Bill 92 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 95th Legislative Day 3/11/2010 1547. It passed the Labor Committee, but it was held due to a concern raised by the Realtors. That concern has been addressed in Amendment 1 to this bill that does exclude the definition of an employee under the Real Estate License Act. So we’ve addressed that concern.

Thank you, Mr. President. This is Senate Bill 3646 and it passed out of Revenue Committee unanimously on the Agreed Bill List. In the fall Veto Session, the General Assembly repealed a small business tax increase that was included in the budget implementation bill and that provision would have increased the income tax on large amounts of partnership income by fifty percent. Unfortunately, the repeal failed to include this certain type of business here, which is publicly traded partnerships. And this bill just rectifies that.

Senate Bill 3658 is -- creates an income tax credit for qualified rehabilitation of vacant buildings for commercial or industrial business use in enterprise zones, river edge development {sic} (redevelopment) zones, and foreign trade zones. The bill will provide eligible taxpayers with a tax credit of twenty-five percent on qualified rehabilitation expenditures or fifty thousand dollars per building, whichever is less. This is an opportunity for us to incentivize using existing infrastructure when you’re trying to start a new business instead of building new so we can clear up some of those vacant, blighted storefronts and other places that already exist. Presently, our criteria is at least a hundred and twenty percent of the State’s annual average unemployment rate. What this bill does is to reduce that rate down to any county or any area that has a ten-percent rate of unemployment for the years 2010 and 2011.

About three years ago, we established in this Chamber the College and Career Readiness Act {sic} (Pilot Program), which was -- the goals of which were to reduce remediation for entering students into the higher education world, to diagnose for college readiness, and to help align high school and college curriculum. This -- this pilot program has been -- has been very successful. And one of the positive things we’ve done and what this bill will do is to provide seven additional sites. My only concern is that, again, this is one of those bills that’s subject to appropriation, and I just wish that we’d have been able to find a place -- a revenue stream, Senator, to -- to fund the bill. This grew out of a discussion, actually, with Senator Raoul on the Criminal Law Committee and the Cook County Public Defender’s Office. It narrows the application of the law to a situation, along with other situations, where someone tries to run over a police officer, a firefighter, et cetera, by operating a vehicle in such a manner that they would be reasonably apprehended of being struck by the vehicle.

Thank you, Mr. President, Ladies and Gentlemen of the Senate. Senate Resolution 560, as amended, creates the Task Force on Eliminating Racial Bias in Suspensions and Expulsions. The Task Force is to consist of eleven {sic} (fifteen) members 143 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 95th Legislative Day 3/11/2010 who are to examine the causes of the racial gap in suspensions and expulsion rates, consider the long-term implications of inequity, and issue a report to the General Assembly by May 1st, 2010 that makes recommendations for removing bias from the suspension and expulsion process. The Task Force is to serve without compensation and is to dissolve upon filing its report with the General Assembly. I’m sure many of you are familiar with the “Decatur 6” incident that happened over ten years ago. And there was a study done recently - a ten-year study - and it implicated that African-American students were being expelled at a much higher and alarming rate than all other students. I hope that this Task Force can be immediately put in place so that we can begin to look at the differences of the school districts and how they derive at expulsions and suspensions. I don’t know that it’s a racial issue. I think it’s pretty much a policy decision making that’s taking place with local control. So we would like to look at this. Examine if it’s -- zero tolerance is making the difference, or what’s really happening. And I really would appreciate an Aye vote.

Thank you very much, Madam President, Members of the Senate. I want to begin by first apologizing to everyone, because the only reason why you’re here this late is to hear this bill. Right. Right. Senate Amendment No. 1 to 3707, the bill {sic} allows for a four-month lapse period for all medical bills, instead of two months, and phases down to aggregate the amount of bills the -- the Department may carry to the next 145 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 95th Legislative Day 3/11/2010 fiscal year. And what -- simply what it does, it -- it deals with our carryover procedures of -- of lapsing dollars from year to year. We ask that we have a -- a ten-year phase-out program into this bill, which will bring down some things that we have done and has been overused and wrongly used in previous years. And it brings it down to a hundred twenty million dollars for each year until FY’2020 when there will be no bills for services that were incurred and received which are not paid during the fiscal year or during the four-month lapse, which has been asked by the federal government. It also asks that there is a requirement that at least seventy-five percent of all eligible persons receiving full medical assistance benefits must be enrolled in some sort of -- managed care program.

In committee today when you presented the bill, we had a discussion about the managed care portion that you referred to in the end of your comments. Could you -- and -- and there was -- there was some confusion and the Department was not there to testify or give any clarification. Could you, Senator, kind of go through that a little bit with us as to why the ceiling is being set at that part -- at that particular level and what your thoughts are behind it? ‘Cause I think it’s really important 146 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 95th Legislative Day 3/11/2010 for this Body to know that.

Thank you very much. What we were talking about, one -- and just -- because there’s -- there’s all these different definitions of things. In this case, what we discussed in committee was not the floor or a ceiling where we’re going, we’re talking about a floor of seventy-five percent is where we are trying to get to. The major discussion was all about the definition of managed care. I mean, there are some here in this Body and in the administration that believes that -- that we’ve already achieved seventy-seven percent of managed care delivery in our service system. And there’s others who say, based on a different understanding of what that definition is, that we have not achieved that and is this going to be the goal that we’re going to achieve. We’ve asked, in this bill, seventy-five percent of individuals enrolled into our Medicaid programs must have managed care. Our definition is, of managed care, in part, is that we are achieving that and we’ve done it to seventy-seven percent, and that includes the PCCMs, which is the patient care -- managed care programs that we have, and our disease management programs, which would have gotten to that number. But because there is not a clear definition for all parties involved, that we said we’re going to at least try to achieve up to seventy-five percent of managed care delivery system here in the State of Illinois in which all Medicaid individuals will be covered under a managed care program. I agreed to, in committee, to look at the other mindsets and definitions of what 147 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 95th Legislative Day 3/11/2010 that means, but as a State we need to be at least looking to include seventy-five percent of those individuals in the Medicaid program up under a managed care program.

So, Senator, is it your intention to put this amendment on now and then vote on it on 3rd Reading? Or were you going to hold it till we can all get a clear understanding of those definitions that you talked about? And I believe the report that was mentioned in committee was the Lewin Report that came out a couple years ago that basically stated only about ten to twelve percent of our people are under any kind of a managed care, as far as Medicaid goes. Is it your intention to move forward with this?
PRESIDING OFFICER: (SENATOR LIGHTFORD) Senator Trotter.
Senator Pankau, yes. It’s my intention to go forward with this bill because that is just one part of this bill. This is also to deal with how we deal with our structural problems that we have in the State of Illinois. And that is carryover and lapse-period spending, which is a large part of this bill. So, with that, I believe there is so much substantive things that -- that we can accomplish by doing this. Not playing games with creating programs. Not being able to pay for ‘em. And in this fiscal year, or -- or the fiscal year that we’re involved in, that it is necessary that we go forward with this, and -- and just to bring back the credibility to the individuals in the 148 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 95th Legislative Day 3/11/2010 State of Illinois that we are going to pay our bills on time and with the right purposes of doing so. Now, the second part of the bill, which you are now inquiring about, that report which came out of - I say, we’ve had so many task forces and commissions - it was the Senate Committee on Deficit Reduction, when we heard one man’s opinion, the Lewin Report, and I say one man’s -- one industry’s definition of what we should do. We’re trying to embrace parts of all of that, and part of it is we are doing that and we’re doing it because that was based and predicated upon what we did on our task force of Medicaid -- which you sat on the committee. I’m on so many task forces, like you. The Medicaid Management Task Force that we were doing. And -- and we’re putting in place right now a demonstration project in the collar counties to look at those aspects of that and -- and where we can have the most savings. But going back to the original question, I want to go forward with it. I think this is still a work in progress. It’s something we have to do. I acknowledge, like you acknowledge, that definitions of the -- the -- the whole dynamics of the language - there’s so many interpretations - that we still have to work on that. But there is so many positive things in this bill that we’re presenting today, I want to go forward with it.

Yes, I think we all agree that the Section 25 issues that you talked about, not putting our Medicaid bills into the next years for payment and allowing them to accumulate like we have in the past, is a very good part. And, in fact, I believe you 149 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 95th Legislative Day 3/11/2010 took Leader Radogno’s suggestion that you were going to do it over three years, which was very aggressive and you’re actually spreading it out over ten years. Would you be willing to hold it on 3rd so that maybe early next week we could work on those definitions to add one more amendment to it and then pass it out?

Because we are -- right now we have a lot of budget issues. I mean, we can get to the semantics of what this definition is about managed care. That’s almost secondary, again, to now dealing with -- now that we’ve had the report, or at least the plan of the Governor, how we’re going forward, we have really less than two months to deal with our budgetary issues. I want to move it forward. But I will talk to the Representative who picks the bill up and encourage them to amend it over there. But I think because of our truncated Session that we have, going until May 31st, we need to go forward, especially with these budgetary issues to do so. And I don’t want to have this bill die because we’re -- we’re now dealing with the semantics of what does managed care mean.

And so to clarify those things and maybe put in place a true managed care proposal, I think would be fantastic for your leadership abilities in the Senate. I urge you to maybe think about waiting a couple more days to call it on 3rd and let’s work together. Thank you.

I would like to see this bill move forward. We know we have many issues in the State of Illinois. Medicaid certainly is part of it. It’s the largest part of our budget.
