Thank you, Madam President, Ladies and Gentlemen of the Senate. I was deeply saddened on Friday to learn of the passing of Mr. Michael Rosenquist, who passed away at the young age of thirty. Mike was an attorney in LRB and he worked on financial regulation, education and utilities. I’ve entered a death 6  STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 97th Legislative Day 3/15/2010 resolution that will automatically be put on the Consent Calendar. Mike was a graduate of Fenwick High School, Class of 1998; graduate of the University of Wisconsin-Madison, Class of 2002; and he got his law degree at Marquette University School of Law in 2005 and came to Springfield. He’s a native of Chicago and leaves behind his mother and father, John and Kathleen; his brother {sic}, Patrick and John; and sister, Kristin. He was engaged to Christine Infanger, and was a friend to many. I worked with Mike a lot the last three years. He was wonderful to work with and always was willing to help on any matter that was presented to him. He made the people that came to see him feel at ease and he took time to explain anything that you may have had a question about. Mike was known as “Rosey” to his coworkers in LRB. The entire Reference Bureau is at a loss now, as are many staffers and Senators who had the pleasure of knowing and working with Mike. On March 12th, 2010, the world lost a wonderful man and his memory should never be forgotten. I ask the Senate to please take a moment of silence to remember Mike Rosenquist.

Thank you, Madam President. This is a bill brought to us by the Illinois Municipal League. It simply clarifies conflict of interest requirements for village officials when they may hold equity in a firm doing business with the village. Basically, if it’s held in a mutual fund, it’s excluded. What this Act does is it includes kind of an evolution in financial securities called the “exchange-traded funds” to be treated like a mutual fund. I ask for a favorable -- favorable consideration.

Senate Bill 3290 makes several changes to the statutory language regarding programs administered by the Department of Healthcare and Family Services. These are changes that the Department had asked for. And it does basically four major things with regard to a revolving loan fund and basically language that they had asked for. Yes, thank you, Madam President, Members of the Senate. Senate Bill 3347 amends the Environmental Protection Act to prohibit the sale and distribution of wheel weights that contain mercury. New vehicles that are equipped with these weights also are not to be sold after January 1st, 2012. We’ve worked with the industry groups on this bill and I don’t know of any opposition to it.

Thank you, Madam President, Ladies and Gentlemen of the Senate. Senate Bill 3386 makes two changes to the guardianship of minors Section of the Probate Act. First, the bill defines when a court has jurisdiction to proceed on a petition to appoint a guardian even when there is a living parent. This would apply to family members attempting to obtain custody. And second, the bill creates guidelines for a petition to terminate a guardianship filed by the minor’s living, adoptive or adjudicated parent whose parental rights have not been terminated. This will provide statutory guidance to our courts on the standard for terminating a guardianship at the request of a parent. I know of no opposition and I’d be happy to answer any questions.

Thank you, Madam President and Ladies and Gentlemen of the Senate. Senate Bill 3467 builds additional safeguards into the Sexually Violent Persons (Commitment) Act. Under current law, when a sex offender becomes eligible for release, he or she must be eligible -- or, evaluated for commitment under the Sexually Violent Persons Act. The evaluation is done currently today by the Department of Corrections with the help of expert evaluators. If the Department of Corrections fails to submit the file for review or if the expert retained to review it concludes that the inmate is not eligible for commitment as a sexually violent person, the inmate is released or the Attorney General builds -- brings a petition to commit the inmate as a sexually violent person. So, the safeguards are as follows: Currently, in addition to the AG, the local State’s Attorney can also petition for commitment under the Sexually Violent Persons Act, independent of the Department of Corrections; secondly, giving statutory authority to the local State’s Attorney and the Attorney General to -- to retain experts to determine independently if the petition should be filed; provide the expert testimony necessary to -- to prove the case or provide a 38  STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 97th Legislative Day 3/15/2010 -- a Department of Correction’s finding to a person who should not be committed pursuant to the Act. The -- the last two provisions, which are very, very important, if the Department of Corrections declines to refer the case for evaluation, they must send a report to the Attorney General’s Office. The Attorney General can then get an independent evaluation at the time. Additionally, these enhancements provide that the offender’s parole period will commence upon the offender’s discharge from the sexually violent persons program. The requirement will provide greater protection for communities and ensure offenders will serve the statutory supervised period. And lastly, and probably one of the most important pieces of this enhancement, a sex offender who is serving time for an offense that could qualify for commitment under the Sexually Violent Persons Act is not eligible for meritorious good time. This prevents release from {sic} the offender so they cannot be -- so they’ll be properly evaluated before commitment. This is a -- significant effort has gone into this bill - Attorney General Lisa Madigan’s Office, the Cook County State’s Attorney’s Office. And I ask everyone for a favorable vote.

The intent of the bill is to address a problem the industry has encountering -- has been encountering in the northern part of the State with regard to what’s called “wreck chasers” or rogue tow truck drivers who misrepresent their affiliation, sometimes posing as a municipal entity, insurance company, or other legitimate entity. What this does is, if they make a false claim, they will be -- potentially a violation of the Consumer Fraud and Deceptive Business Practices Act is the penalty. It only covers the five counties which currently are covered under the Commercial Towing Act. Ask for a -- a favorable consideration.

The bill authorizes the Treasurer to segregate up to two percent of its investment portfolio in the Technology Development Account and 64  STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 97th Legislative Day 3/15/2010 allows the Treasurer to make investments from the TDA that help attract, assist, and retain technology business in Illinois. Bill also authorizes the Treasurer to solicit proposals from entities to manage and be the General Partner of the Technology Development Account, which would consist of investments from the private sector investors which must invest, under the authority of the Treasurer, in tandem with the TDA. The bill unanimously passed. It builds on an effort we’ve had in the past, the TDA part I, where we’ve been able to take about twenty-five million dollars, catalyze that to about a half a billion in private equity venture capital investments, to create several thousand jobs without raising taxes. It’s a great economic developmental tool. We’d like to build on that, double it, and make sure we create even more jobs and be able to support innovative start-up companies in Illinois.

I’m going to be very clear about this. The early stage seed investment credit allows a credit of twenty-five percent on investments by the claimant with a certified fund manager into a certified early stage business, for up to two million in investments per year. A maximum of ten million of the credit may be claimed in Illinois annually, which would equal forty million worth of certified investments. The angel investment credit allows for a credit of twenty-five percent on direct angel investments in a qualified new business venture, for up to two million in investment per year in a business and a maximum of ten million of the credit may be claimed to Illinois annually. The -- the reality of this bill is it puts us on par with other states that we are competing with. Illinois and several of our communities, we’re rank about sixteenth nationwide out of six hundred communities when it comes to research and development, both on the government side and the corporate side, in new innovative industries and private equity and venture capital firms. And we’re looking for ways in which we can provide a more competitive environment to support companies that are creating jobs in Illinois.

Senate Bill 3734 expands the definition of “drug paraphernalia” to include individual tobacco wrappers, otherwise known as blunt wraps. As many may -- may or may not know, traditionally blunt cigars were hollowed out by many young people to smoke marijuana and crack sometimes. And a company has -- or, several companies have come up with the idea of relieving them of the obligation to hollow out the cigars and have flavored the wraps with candy flavors, making it more attractive to young people. So, these blunt wraps would, according to this bill, become drug paraphernalia. And it retains the current penalties for drug paraphernalia as a Class 4 felony -- for -- a Class A misdemeanor for possession.

The funds for counseling grants will be split, with seventy-five percent outside -- going outside of Chicago and twenty-five percent going to the City of Chicago. And the program is subject to appropriation.

I need to point out to the Members, although I agree with the noble idea of where this is -- where -- what the intention of the speaker -- previous speaker’s intent on this legislation, but it must be pointed out that we don’t have a fiscal impact determination to the tax relief grant program that it would be under other grantees - so we argued a bill a little earlier this afternoon with a similar pool of people - by slightly reducing that -- that pool of resources available to the tax grants in fiscal year ‘11. And I definitely have issues with it in terms of it not having its -- there’s no available lines within the budget to do that. So, I would just ask Members to -- to -- as we all indicate we don’t want to tax -- we don’t want to -- we all look for increasing programs at this stage in Public Health and Human Services and other areas. I would be the first to vote for it. Unfortunately, it had -- what’s good for the goose is good for the gander, if you will, in this example, and I would just point that out. And at this point, I wouldn’t be able to support this legislation under its current form. And I would ask the Members to please review their analysis.

Thank you, Madam President, Ladies and Gentlemen of the Senate. Senate Bill 3747 is an initiative of the Illinois Realtors’ Association and creates the Transfer Fee Covenant Act. The Act provides that any transfer fee covenant recorded on or after the effective date of the Act shall not run with title to real property and is not binding or enforceable at law to any subsequent owner or purchaser. Give you an example, we all know what kind of transfer fees we have when we sell real estate. We pay a transfer fee to the State, to the county, and to some municipalities. What some landowners, some developers are doing is installing or recording a transfer fee covenant which would run with the land and that original landowner would get a transfer fee upon every successive sale of that land. We think this is bad public policy. We’re being proactive and we’re going to prohibit this practice before it starts in the State of Illinois. I’d be happy to answer any questions.

Senate Bill 3763 is an initiative of the Illinois Association of County Engineers and updates and clarifies the language used in the statute related to the relocation of an existing county highway and the rights, responsibilities for sections of old highway not incorporated into a relocated section. The current language is -- is written in a manner that may lead some to believe that the portion of a highway not incorporated into the relocated section of highway has been written off by the county. The current language states that this type of original highway section is considered abandoned. This bill will take the word “abandoned” out. And this legislation does not change the meaning or the -- or the intent of the original legislation in classifying a no longer used area of county highway, but it does reflect much clearer language that the county has -- has authority and ownership over the area and has a right to utilize or transfer that land as the rightful owner. Senate Bill 2541, as amended, creates the Uniform Emergency Volunteer Health Practitioners Act. The Act attempts to regulate the provision of health and veterinary services through volunteer health practitioner registration systems for a host entity or disaster relief organization in the event of a declared emergency. The Act is administered by the Illinois Emergency Management Agency. It also outlines -- the bill also outlines the regulation of services provided during an emergency, registration system requirements and procedures, provision of services and workers’ compensation coverage for volunteers. I think it’s also important to note that we’ve had extensive discussions about this proposed bill, this Uniform Law Commission-proposed Act, and it -- we are confident that the Good Samaritan Act does apply to these volunteer health practitioners. This was originated by the Uniform Law Commission in response to Hurricanes Rita and Katrina. The goal is to make sure that volunteer health practitioners who want to come into our State after a disaster are able to come in because they’re already preregistered, there are already those registration systems in place. This is good policy. I ask for your support.

Senate Bill 3025 is an initiative of the Illinois State Dental Society. The bill amends the Dental Practice Act to make confidential the information gathered by the Illinois Department of Financial and Professional Regulation during a disciplinary investigation of a licensee. The amended bill creates two exceptions authorizing the Department to disclose such information, first, for disclosures to law enforcement agencies pursuant to a subpoena in an ongoing criminal investigation and then, secondly, to dental licensing authorities in other jurisdictions pursuant to an official request. This is to protect dentists across the State of Illinois. Obviously, many of these investigations are -- are -- are either dismissed or the -- the dentist is found not to have violated any disciplinary rules, regulations. I think this is a good bill and I ask for your support.

Thank you, Mr. President. Senate Bill 3214 does a number of things with regard to the Joliet Arsenal Development Authority, located in my Senate district. First, it extends the sunset of that Authority by ten years, to 2020. Second, it adds an additional member to that Authority. That member must be from Will County and would be appointed by the Will County Executive with the advice and consent of the Will County Board. And third, it codifies the custom and practice of having appointments made by the County Executive with the advice and consent of the County Board. Currently the -- the law states that the County Board shall make these appointments, but that’s not what happens in practice. In practice, current County Executive Larry Walsh - some of you may know who he is - appoints these folks and then the County Board would give advice and consent. It’s the same mechanism we have under the Governor’s appointments. I’d be happy to answer any questions and I ask for your support.
