Thank you, Mr. President. Floor Amendment 3 removes the bill. It requires –- this is about the helmet -- riding –- using a helmet while riding a bicycle. Reduce –- it takes out the -- the penalty for court costs, and it also –- I think that’s it. We took out the court costs and it didn’t apply to rental of bicycles.

54 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 98th Legislative Day 3/16/2010 Thank you very much, Mr. President. Senate Bill 2824 limits the prohibition on “sex offenders” being in a public park or loitering near a public park to “sexual predators”, as defined in the Sex Offender Registration Act, and “child sex offenders”, as defined in the current child sex offender law, but excludes those convicted of criminal sexual abuse involving consensual sex when accused is under seventeen and the victim is between nine and sixteen years of age and when the victim is thirteen to sixteen years of age and accused is less than five years older. Convicted sex offenders are four times more likely to reoffend than other offenders. This propensity presents a significant threat to public safety. Current law places restrictions on where child sex offenders can reside and go. Senate Bill 2824 extends the prohibitions on child sex offenders to include being in a public park or loitering near a park. It also prohibits sexual predators, the most dangerous of other sex offenders, from being in public parks due to the danger they pose to society. Sexual predators are already subject to lifetime registration under the Sex Offender Registration Act. Public parks offer many opportunities for sexual predators and child sex offenders to have easy access to potential victims. Children and lone adults frequently use parks for recreational activities. By their nature, parks have many obscured views and other distractions that other opportunities -- or, that -- excuse me, that offer opportunities for sex offenders to access potential victims. This legislation is necessary to protect users of public parks from child sex offenders and sexual predators who use the attributes of a park to their advantage to have access to potential victims. Thank you, Mr. President, Ladies and Gentlemen of the Senate. Senate Bill 3060 is an initiative of the Department of Natural Resources. It amends the Boat Registration and Safety Act. It corrects a -- an error in the original law as the -- as it applied to sailboats, but more importantly, it -- it expands the requirements for wearing life jackets to the sole occupant of -- of a vessel. We did amend the bill, subsequent to the first committee hearing, to address concerns raised in committee about how this would apply to -- to a fisherman using a trolling motor. I think Senator Jones may wish to ask me some questions 57 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 98th Legislative Day 3/16/2010 about that so that the legislative intent is clear. But I -- I hope that, with the amendments, we’ve eliminated most of the concerns.

Senator Harmon, I think the clarification on the trolling motor, it says in the -- in the legislation intermittently using a trolling motor. And I think what Department of Natural Resources and you and I have come to an agreement on, we’re talking about the -- the big motor on the -- on the -- on the boat being used intermittently, but when they’re using a trolling motor itself, the electric trolling motor, there is no restriction on that.

Thank you, Mr. Chairman {sic}. This is what happens when you let suburbanites draft bills that apply to fishermen. You’re exactly right. We are -- we are not intending to -- to limit that ability. And we certainly, I think, have an agreement in principle to amend this in the House to make the language more clear.

Also, I talked to Natural Resources this morning - Mike - this morning, and there is a question in here about private lakes, which concern me, that I didn’t want a -- a farmer out here that had a one-acre lake or a three-acre lake and wanted to go out there and fish on his own pond and the game wardens are going to come out, start writing him a ticket because he didn’t have a life preserver on. But it’s my understanding, with -- with Mike this morning - and you probably had the same conversation - is we’re going to amend that over in the House to specify what private is. Because I didn’t realize it, but a private lake could be Springfield Lake here. As big a body of water as that is, we don’t want people out there on that body without a life jacket on. And so, I think they’re going to clarify it over in the House, and if that’s your agreement, I’m fine with the bill then.

Thank you. Senator Harmon, as I suspect Senator Jones does, I have a significant contingent of fishing that goes on in my district. And so I want to -- I guess I want to ask some questions about the way the bill is drafted now. Is there a definition of what intermittently is and, also, is there –- are 59 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 98th Legislative Day 3/16/2010 -- are there –- is it specific as to what motor that intermittently restriction applies to?

Thank you, Mr. President. Senator, you’re clearly testing the outside border of my knowledge of this issue. But, my understanding is that the -- the primary motor for the boat could be used intermittently to move from spot to spot without requiring the sole occupant to don a life jacket. Similarly, the -- the -- the trolling motor, the electric motor that may be used to stay in one place against the current, could -- could run without forcing the -- the fisherman to put on the life jacket, even if it’s on for more than five or ten seconds at a time. Again, you are -- you are getting to the edge of my knowledge of the issue, but I do believe we have an agreement in principle to clarify this in whatever way is required as the bill moves to the House.

The other issue, Senator Harmon, was the one that Senator Jones raised about public versus private bodies of water. What -- what exactly does the bill say now regarding that issue?

Thank you, Mr. President. Right now, the bill would apply to all bodies of water, public and private. And I think I’ve - - the position I had is coming through in the conversations we’ve had with the Department since then. A small pond or -- or -- or lake that is solely within the property of a particular owner probably shouldn’t be covered by this. A body of lake -- a body of water like Lake Springfield, a private lake that’s owned by a homeowners’ association, a larger body, probably should be. And I think that’s what we’re aiming for with the House amendment.
