He’s joined by his father up in the Chamber, my brother, Joe Kotowski, who teaches at Oakton Community College. And Lucas is a great young man. He’s a junior at Northside College Prep. He plays -- he plays lacrosse. He is someone who plays saxophone. Guys, this is important information here. Talking about my nephew, my godson, Lucas Kotowski. Thank you for your understanding. And he is -- he wants to be -- I think, be a lawyer. And he argued a case - and you guys got to know this; this is interesting stuff - he argued a case - it was a mock trial at the Kluczynski Building, great Polish establishment, downtown Chicago - on dog fighting - dog fighting of all topics - and he won the mock trial. I think he wants to go to a school in Illinois, because, unlike me, he will raise the GPA - any school he goes to. He’s a very bright young man. He’s an awesome kid. The amendment simply provides that during the 2009-2010 school year and each school year after that, for school districts located in more than one county that use an estimated equalized assessed value to calculate the limiting rate utilized in specified calculations, that the State Board of Education shall make estimated payments of the resulting general State aid claim until the actual limiting rate becomes available and is provided to the State Board of Education by the affected school districts. Lowanda Johnston and her nieces -- niece Tammy, and Tammy has her three children here, Tim, Ben, and John. Lowanda’s husband, Curt, who was the captain of Sesser Fire Department {sic} (Protection) District passed away a few weeks ago. Curt and his family has always been a friend to me. This is a charitable sharing trust, the Medical Sharing Trust, in which people of the same denomination give a covenant that they will pay the medical bills of someone who incurs those 50  STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 99th Legislative Day 3/17/2010 bills without necessity of buying insurance. And they enter into this freely, voluntarily; there is no coercion. They can either do it or not. They trust and -- and have faith that the participants will perform this act. The Insurance Department had some concerns so we amended the bill, as I indicated. This is very similar to a bill we passed in the previous Session of the General Assembly also. Yesterday -- or, this morning I had a discussion with a representative of Attorney General Madigan’s Office and she had further concerns. They don’t want to regulate them. They prefer that this be treated as insurance. So, we have kind of an “After you, Alphonse” situation between the Department of Insurance and the AG’s office. I would like to move this to the House and further discuss how we rectify who’s going to -- I don’t -- I think it can be done, so does Kathy Saltmarsh of the Attorney General’s Office. And I talked to Department of Insurance again today about it and it’s just going to take some doing in the House. It’s too late now.

Thank you, Mr. President, Ladies and Gentlemen of the Senate. Senate Bill 3180 creates the Common Interest Community Association Act. The Act affords similar protections to owners of single-family, townhome, villa, or other properties in common interest communities that are currently afforded to condominium property owners. This is essentially protection against runaway or dictator boards who do not allow participation by unit owners in these common interest communities. Specifically, the bill allows for procedures to elect board members, allows unit owners to inspect the financial records. It allows unit owners to speak at meetings and it prohibits boards from banning the displaying of American or military flags. We have had great participation in this endeavor. We’ve had AARP. We’ve had the Realtors. We’ve had the Illinois State Bar Association, Members on both sides of the aisle and in the House. Mr. Mark Pearlstein, who’s an expert lawyer in -- in this area, has been of great assistance. We’re going to move it over to the House, Mr. President. And we will continue to work on this bill in the House because there are a few cleanup items. I’d be happy to answer any questions.

You know, 58  STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 99th Legislative Day 3/17/2010 during these tough economic times that we’re facing in the State of Illinois and in this country, some of the things that we have been sent here to the Illinois Senate is to some -- protect some of the bread-and-butter issues that affect working families and the poor and the middle class throughout this entire State. One of those issues is continuing to make college affordable and accessible to all families, especially the working class. And that’s the whole purpose of why public universities exist in the State of Illinois. The whole concept between -- behind land- grant colleges, that was instituted by our late President Abraham Lincoln, was to give the opportunity for the working class and peasant families to be able to attend a public university right here in this great State of Illinois. And this bill goes one step further and continue to -- in that spirit of making college affordable and accessible to working families. What I have done is -- what -- Senate Bill 3222 simply codifies a practice by Southern Illinois University and the U of I, our two flagship universities, which gives working families an opportunity to continue to make college affordable when students have -- face a fifth year in higher ed.

Thank you, Mr. President. I just rise in support of the Senator’s bill. When you first came to me about this bill, I was skeptical, but the -- the more we talked about it, the more it made sense. The universities are on board with this. Again, the philosophy of the Truth in Tuition bill is so that families can plan. It appears it -- it is -- it is more of a oddity now 59  STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 99th Legislative Day 3/17/2010 to graduate in four years than it is a practice and so I think that the universities realize this. They have -- they -- they themselves plan for this financially as well. And I urge its support.

On the contrary, my dear colleague, Senator Lauzen, this keeps the incentive in place. I -- I left the sanctity of the 61  STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 99th Legislative Day 3/17/2010 Truth in Tuition Act alone. I have not changed -- this bill does not change the Truth in Tuition Act and leaves it at four years. And, in fact, it provides a further incentive to working families so that -- because they will have to pay an increment. Their tuition does not remain the same. Their tuition will go up one increment from what would be their sophomore year. So, there is a continued incentive to ensure that students finish on time, and if they don’t, they will have to pay an additional increment. I do -- also want to respond to the former speaker that -- that talked somewhat about the unintended consequences. I think that it’d be foolish and I think we need to understand and we need to recognize that even at Northern Illinois University and at universities all across the State of Illinois, they are all engaging in some form of practice outside of the Truth in Tuition Act already, independently. Northern, Southern, Northeastern, UIC, Illinois, Chicago State - all universities are engaging in a practice outside of the Truth in Tuition Act to help working families and to make college affordable for students who, for economic reasons, have a difficult time finishing within those four years.

I think, on the contrary, we cannot continue to allow public universities to do what they want to do in the State of Illinois. That is contrary -- contrary to the spirit and the reason why public universities were enacted by late President Abraham Lincoln. And, in fact, on the contrary, Senator Luechtefeld, your Chancellor, the great Glenn Poshard, who I have a lot of respect for, the Chancellor at Southern Illinois University in your district supports Senate Bill 3222 because they are already engaging in the practice of helping working families, working poor, trying to get a public education in this great State of Illinois.

I have rarely agreed with you, Senator Luechtefeld, but you know what, when a great central and downstater from the State of Illinois, like Glenn Poshard, has a great idea and a great practice, we should adopt it as the -- the law of the land. I think it’s a phenomenal concept. He’s a visionary for all students in Illinois and there’s no one else except Glenn Poshard who knows what’s best for working families. So, therefore, I want to codify his vision, his practice for students like they have in the benefit in Southern Illinois University. Why shouldn’t all families throughout the entire State benefit from such a great idea?

PRESIDING OFFICER: (SENATOR CLAYBORNE) Senator Raoul.

To the bill, Mr. President. I wasn’t going to speak to this bill, but I -- you know, I’ve been involved in higher education, mainly working with students who start their career in higher education through the community colleges, and many students do so because of the lack of affordability of higher education. We were converged upon by many students during our 65  STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 99th Legislative Day 3/17/2010 Veto Session, surrounding the MAP grants. And wouldn’t it be a wonderful world that all students who were in college came from families that -- that -- that they had the financial support where they didn’t have to work part-time and they could take a full load. They could take even an extended load and maybe finish college not in four years, but in -- in three years, because they have the financial resources to back them and they don’t have to worry about taking on one or two jobs while they try to take on a full load - but that’s not the world we live in. It -- it may be the predominant population of some of you- all’s districts, but in many districts, that’s not what we’re dealing with. We’re dealing with people who -- who may be single parents. We may -- we’re dealing with people who have all sorts of situations, where the average load is far less than fifteen hours per semester. So there’s no way that they’re going to finish in four years. So, we can begin to deal with things as if every student in the State of Illinois comes from an affluent family, where they don’t have to work extra and they don’t have to deal with circumstances that may take them beyond four years. I have to confess, in my circumstance, I relied on my parents heavily to subsidize my college education and -- and I -- I probably should have finished in four years, but it took me a little bit more than four years. So I can imagine what other students, who have to deal with a whole lot more than I had to deal with, have to do. So, I -- I -- I urge your support on this bill. I -- I might add that, as Senator Sandoval pointed out, the University of Illinois, Southern Illinois University, Eastern Illinois University, Northeastern Illinois University and the Illinois Board of Higher Education are all 66  STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 99th Legislative Day 3/17/2010 proponents of this bill and there are no known opponents to this bill. And I -- I -- I’m sure that there are not deaf ears at the other public universities. So, if they were opponents to it, they would speak out to it and they haven’t done so. So I urge all my colleagues to vote Aye on this bill.

Thank you, Mr. President. I just wish to echo many of the sentiments that my colleague before me just expressed and I want to provide myself as an example of somebody who struggled through the difficulty of obtaining the types of classes that we needed in order to graduate on time. We’re cutting back -- we’re cutting back funding to our universities and we’re going to find it hard to find the professors or to continue to -- to employ the professors that are going to provide those one- hundred-, two-hundred-, three-hundred-level classes that students are required to take in order to graduate on time. If you took a sample of our student population today, you would find that more of them are needing five years to graduate, and more than not, and more than ever before. And for those of us who have had to work their way through school and have never had the benefit of being provided financial assistance from their friends or their family, I can assure you that this is the least that we can do to provide the top-notch public education at a four-year matriculating college or university here in the State of Illinois. I strongly support Senator Sandoval’s bill and urge an Aye vote.

Thank you, Mr. President. I realize this is the second time on this issue, but let -- let me try to explain it from a mathematics standpoint. If -- if, for example, you entered the Illinois State University at, say, a tuition rate of five thousand dollars, you would pay that your first, second, third and fourth year. Okay? Under the current system now, the universities, what they’re doing is just reaching back a year. So -- so -- I’m sorry. So, at the end of that four years, the new freshman rate may be up to nine thousand dollars. So the university could, in fact, charge you, for that fifth year, nine thousand dollars. It’s only in discussion of this bill that we’ve found out that the universities are voluntarily, all right, allowing a reduced-tuition fee. They don’t have to do that. And it -- based on the fact that we have so many students that it takes more than four years to graduate -- in fact, I don’t have the number in front of me, but I believe the University of Illinois has the highest four-year graduation rate in the State, and I don’t think it’s fifty percent. I believe it’s like forty-eight/forty-nine percent. So that’s the highest in the State. So, obviously, you know, there are others who need this. But the point is, is that the universities don’t have to do this. This would make it uniform. It would allow that fifth year at a reduced rate. It would not be the same they paid as an entering freshman. The incentive would still be there to graduate on time because they are going to have to pay more money - all right? - although not as much as they would normally have under the old system. And so, I would advocate, 68  STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 99th Legislative Day 3/17/2010 again, for the passage of this bill. And, again, the philosophy of families being able to plan for that fourth and fifth year would certainly be advantageous to them. Thank you.

And these responsibilities are contingent on the Department of Agencies {sic} adequate funding. I believe now that, as we look at high school, I think all of us would love to make sure that we can teach abstinence over everything else, but the reality of it is, that it’s not really going on in our schools. So, I -- I agree with Senator Cronin. I -- I commend him for this kind of legislation. Our young women and men need to know that there is responsibility that comes with a pregnancy, especially if they’re consuming alcohol and drugs. So, I -- I urge an Aye vote by all of the Members of the Senate.

To the bill, Mr. President. I rise in support of the bill. The irreparable damage - and this is irreparable damage - that’s associated with the consumption of alcohol to fetal development is something which we must address in Illinois. And these poor children are a burden to themselves and to others and it could be easily prevented with a knowledge of the damage that is caused by alcohol consumption. It’s very simple. And many of it -- many of these things occur because of woeful ignorance. This is a necessary and good bill for the common good and I would urge an Aye vote.

This is a initiative of the American Institute of Architects - a very creative idea. Basically, what we’re going to do is amend the Capital Development Board Act and ask them to work with the Department of Commerce on developing a common energy efficiency standard for buildings. This proposal, Senate Bill 3570, is to allow pre-professional graduate assistants the same rights as represented by the union as other graduate assistants. This is a matter of fairness. The PGA does the same work as other educational workers who are covered under the Illinois Educational Labor Relations Act and the PGA should have the same right Act. And what we’re here doing is just trying to give students the same rights that other -- other students have and - - which includes the right to organize. I’ve checked with SIU. They do not have a problem with this bill because they say they do the same thing. It’s already working there. So I just ask for a favorable vote.

I want to add - if you recall, I -- I brought in and passed a bill concerning the licensure of midwifery in the State, which passed the Senate, went over to the House, still there. And just to let the proponents know and the opponents know, that this is a good example of this bill. This baby had a midwife and the baby had some distress. The trained, observing midwife got my daughter, the young mother, to the hospital in time for a C-section, which was medically necessary. This is very similar to the MAP program. Currently, if you do a full year of tuition, it’s about a five-thousand-dollar MAP grant. This would be an additional tool to encourage the -- the student that attends a two-year university to kind of grab a -- the lever to -- to step up to a four-year baccalaureate to finish up. It -- the intention here is part of the economic recovery packages that -- whether they’re angel tax credits or expanding the life of an enterprise zone or creating innovation zones. There’s -- there’s a whole package of economic recovery bills that we’re running. This is one that can be very helpful for -- for young students who are caught up in a -- in a down economy right now and proposing it as a -- as a -- as a tool to help them.

Just to the bill: You know, we have had, in the last couple years, this group called NCHEMS - the National Collegiate {sic} (Center for) Higher Education Management Systems come in and talk about the need for greater certification in this State, both at the associate level and a bachelor’s degree, if we’re -- if we’re going to attract businesses and have a skilled work force. This, to my way of thinking, Senator Bond’s bill, would attract the interest of non-traditional students, those -- those people who are perhaps beyond the eighteen- to twenty-two-year-old age group who -- who do get a MAP grant to complete their associate’s degree, and this would give them an additional incentive, I think, to go on to their -- to obtain their bachelor’s degree. So, it would not be focused, I think, not just on the eighteen- to twenty-two- year-old group, but on many of the non-traditional students and it would help them in their quest for a bachelor’s degree. Not to be redundant from Senator Maloney’s comments, but in addition to the non-traditional students, the traditional students that go to community colleges, to my knowledge, having worked with the largest community college system in -- in the State, are often students who otherwise wouldn’t be attending a higher education institution, both for economic reasons as well as other social reasons. So, I -- I -- I urge support of this bill, because, you know, while I don’t have the data, you know, I’d -- I’d be willing to wager that the data would support that the socioeconomic circumstances of the community college population is -- is -- is different than that -- that of the regular four-year college population in the first two years.

Thank you. Just -- in reading some of the research, there’s -- this was piloted in Virginia and this isn’t just a -- a flat grant anybody can have. It’s required -- the financial need test, it -- to qualify for the financial aid; maintaining a 3.0 GPA or better; and, also, the -- obviously, the residency requirement. But, in Virginia, they’ve appropriated, in fiscal year 2010, two hundred and fifty thousand dollars, and then in the next year, five hundred and twenty thousand. So, it’s in the -- depending on the demand for this segment of students who want to go on to a four-year. If you want to use Virginia as a proxy, it’s under a million. The bill changes the definition of “veterinarian-client-patient relationship” to include a licensed veterinarian who has access to the animals -- animal patient’s records and has been designed -- has been designed {sic} (designated) by the veterinarian with the prior relationship with the animal patient to provide reasonable and appropriate medical care if he or she is unavailable. This is an initiative of the veterinarian’s association and this is a result of much debate and compromise. I’d be happy to answer any questions about the bill.

The amendment represents a compromise between the Illinois Municipal League, on behalf of their municipalities and municipal groups, and the Office of the State Fire Marshal.
