Lincoln’s ChalleNGe Academy is an example of how government helps to provide a hand up to help young people learn how to helps themselves and their communities. United States Marine Corps Lance Corporal Robert “R.J.” Newton was twenty-one years old, of Creve Coeur. He passed away on August 23rd while supporting combat operations in Afghanistan. This was his second combat deployment. Lance Corporal Newton enlisted in the United States Marine Corps shortly after graduating from East Peoria Community High School in 2007. He served with the 3rd Battalion 7th Marine Regiment of the 1st Marine Division. He was the recipient of numerous medals and decorations for his meritorious service. He is well known among his peers for his great pride in being a United States Marine. Also, Sergeant Mark Simpson, forty years old, died on September 26th, while serving in Afghanistan. Mark was born and raised in Peoria, was a graduate of Richwoods High School, joined the U.S. Army in 2005, served two tours of duty at Fort Drum and Fort Hood before deploying to Afghanistan. He is also a recipient of numerous awards. Mark was laid to rest in Central Texas State Veterans Cemetery. His parents are George and Carol Simpson and are constituents of mine. I would like you to join me in just a moment of silence to remember these two fallen heroes.

It would cost them thousands of dollars. So we’re just merely having the threshold at thirty-one miles an hour over. That’s all we’re doing.

Yes, thank -- thank you, Mr. President. Senate Bill 3965 has been in the works for almost six months and we recently worked out a compromise and an agreement with RTA, Pace, CTA and Metra. They signed in today as proponents and they are all in support of this legislation. What we are asking is that the Office of the Executive Inspector General be authorized to be the watchdog to oversee the workings of these transit agencies. By doing it this way and not having separate inspector generals for the transit agencies, we will be in a position to hit the road running and make sure that we consolidate and do not have to expend additional funds because this particular office is already in place. We also heard testimony today from the Office of the Executive Inspector General, who -- who weighed in in total support of this legislation. I’d be happy to answer any questions.

Thank you, Mr. President, Ladies and Gentlemen of the Senate. I’d like to just bring to the attention and remind everyone in the Chamber this afternoon that just over six months 16 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 130th Legislative Day 11/17/2010 ago as we were here in the Legislature in May, we awoke to the tragedy and the tragic story of one of our Metra -- one of the transit executives, particularly Phil Pagano at Metra, who committed suicide on the tracks of the Metra railroad system in northeast Illinois. And the result -- I don’t have to belabor the history of - because it is still being investigated - belabor the history of the -- the reasons for that, but to say that they were for reasons of lack of accountability and transparency over at this transit agency that had led to perhaps this very tragic incident over at Metra. You know, much has been said about bringing transparency and accountability to State government, particularly today to the transit agencies in northeast Illinois, the RTA. And much has been said about, you know, hiring inspector generals throughout the different State agencies and city governments and local governments. And I stand in favor of bringing greater accountability to the transit world, the transit agencies, particularly the RTA. We also bring to -- want to bring to mind that it isn’t a cost-effective way -- it isn’t cost-effective to the taxpayers to have inspector generals running all over the place, stumbling amongst each other, when we have, you know, a good inspector general; for example, the Executive Inspector General here in the State of Illinois, which is a very independent inspector general. I also want to bring to people’s attention that, you know, we’ve had a very effective inspector general in the City of Chicago, like David Hoffman, who was not an independent inspector general, but he was appointed by the City of Chicago. The reality is, is that accountability and transparency is incumbent upon experience and leadership and the track record of 17 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 130th Legislative Day 11/17/2010 accountability. And so I think that -- and support this concept -- and proposed the concept of bringing the Office of the -- Executive Office of Inspector General of the State to be the Inspector General of the RTA. And I also am a big supporter of making sure that accountability is fair-handed and even-handed to all the transit boards, not only to specific transit boards like Metra or Pace. I think what’s good for the goose is good for the gander, and all transit boards, including the Chicago Transit Authority, should have greater oversight by State government. So I stand in support of Senator Garrett’s effort and the -- and the effort of many State Senators here in the Chamber today who want to bring greater efficiency and accountability and transparency to State government. I think everyone in this Chamber is good government -- I believe that everyone in this Chamber wants to bring good government to the people of Illinois. And here’s one opportunity to do that today to our transit agencies in northeast Illinois. Senator Garrett, I was noticing in the 18 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 130th Legislative Day 11/17/2010 definition Section of your legislation the “Service Boards” for mass transit. Those are not traditionally State agencies - although I think your intent is to make them State agencies. But my question is, where do we draw the line, in your estimation, in the future of having the Inspector General of the Executive Branch of State government going out and overseeing units of local government, which is essentially what these service boards are? Where do we stop doing that, where the big brother of the State of Illinois comes in and starts auditing and having powers over local government units?
PRESIDING OFFICER: (SENATOR HARMON) Senator Garrett.
Yes, thank you, Senator Dillard. As you are aware, we had many different versions of the bill that we have before us now. We did hear from the service boards that they wanted to have their inspector general chosen by somebody from local -- units of local government. And so we did that; we had a hearing and we received input and the consensus was that State’s attorneys would - from each county - be the ones to choose the inspector general. RTA rejected that Friday night and said that they couldn’t go along with that. That, in fact, that was too political. And so we -- as the General Assembly here in the State of Illinois - we put together, as you know, the RTA Act in 1983 - we have the right to make these kinds of changes and have this type of oversight. In a perfect world, it would have been great if we could have gotten everybody on board to come up with an agreement on this. This is the best and some people have said - RTA - an elegant solution to the issue before us. So 19 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 130th Legislative Day 11/17/2010 nobody is looking to expand oversight into local units of government, but given the task at hand, this is the best and most effective way to go about it.

Just to the bill, Mr. President. Obviously, Senator Garrett is a very eloquent person. So -- and she puts together elegant legislation. There’s no perfect way to do this. And I applaud Senator Garrett, Senator Sandoval for coming up with a - - a creative solution. But I do want to point out to the Body that - and I think Senator Righter will address it in a minute - there are substantial costs here to a State that is broke. And maybe we ought to find a way to be reimbursed for - and these are many, many double-digit positions that pay substantial salaries - a way that the State gets reimbursed for these offices. But I applaud you, Senator Garrett, for your creativity of finding your way for accountability and transparency in this hornets’ nest of mass transit. And that goes -- my compliments go to Senator Sandoval as well. And I rise in support of the bill. Thank you.

Thank you, Mr. President. Senator Garrett, the Auditor General in Illinois does not any longer perform audits of alumni associations for State universities, but he did not that long ago. He gave up that practice. For the years that he did do that, since the alumni associations were not State agencies like DHFS and other ones that -- that we’d be familiar with, the Auditor General was empowered to seek reimbursement from the alumni associations for doing those audits. Why wouldn’t we follow that lead, recognizing that this is not a State agency, and, quite frankly, require that system to pay for the cost of the oversight?
PRESIDING OFFICER: (SENATOR HARMON) Senator Garrett.
Yes, thank you, Senator Righter. The funding of the Office of the Executive Inspector General will be dealt with through an appropriations process. What we’re doing today is really amending the Ethics Act. However, I will say that we have -- and your point is -- is very valid. We have received many ideas, good ideas, on how to get the most bang for our buck, in making sure that every dollar, whether it’s reimbursement from RTA or the service boards or it comes from the State budget, 21 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 130th Legislative Day 11/17/2010 that we are able to find ways in which to keep the cost down - which is why we’re taking the step we’re taking under this one umbrella of the Office of the Executive Inspector General and having one instead of separate inspector generals for the RTA and the service boards. So we are collecting different ideas and options. And what I would like to do is hold a hearing and ask RTA, as an example, if they will be able to provide some of the funding that will go toward the oversight of their agencies.

Senator Garrett, I think what you’re talking about is how much the bill will be. What I’m talking about is who gets to pay the bill. And I don’t think the alumni associations were asked whether or not they’d be willing to help reimburse the Auditor General for the cost of the audits. They were told that they were going to do that and they were going to do that because they were not a regular State agency. I think the question, for downstate lawmakers anyway, is, why would our constituents pay more to oversee what is obviously not a statewide agency. I mean, to the downstate lawmakers in the Chamber, what -- what would be your reply to that?

I would say, if I were you and I was talking to your constituents, that we are coming -- we are coming to grips with that and we are going to find a way in which to do it. The funding -- most of the funding is already in place because the office exists. What we’re asking for is expansion of that authority to oversee the RTA and the service boards. We know that there will be additional costs associated with that. We intend to work very closely with RTA and the service boards to ensure that those costs, if possible, can be reimbursed.

I rise in reluctant opposition to what I know has been a very good effort by Senator Garrett to find a solution to a problem. It just doesn’t seem to me that it’s appropriate for us to take an office that was created specifically to inspect, if you will, or oversee State agencies and broaden that authority. And even if you’re going to do that, then there should be a mechanism in place - and like I said, we had a mechanism for years already in place, so there was already precedent to do this, with the Auditor General - and make sure that that entity that’s not really a State agency, out of recognition for that, pay part if not most of the tab for that. I hope that maybe we can continue to work down that road. My concern here is, once this bill comes out and becomes law then it becomes much more difficult to come back and say, “okay 23 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 130th Legislative Day 11/17/2010 now, RTA, you’re going to have to cough up some of that money”, because I’m sure that we’ll be hearing from them that really they don’t have any money to do that as -- as -- either. The arguments for the bill are impressive, reasonable, cogent, all hallmarks of the esteemed sponsor. However, we have a bill in the House that’s being supported by the administration which withdraws State money from the payment to counties on behalf of State’s attorneys. These counties cannot make payroll in some cases. The State’s attorneys are officers of the State. They are mentioned in the judicial article of the Constitution and we’re going to withdraw money to reimburse counties for their salary. And to -- and it’s -- and now we’re going -- with this bill, we’re going to start paying for a CTA/RTA-combined inspector general? I have to agree with Senator Righter. I’m not going to vote for this if we’re going to be taking what is arguably a true State officer’s pay and shoving it down the county’s throat, while at the same time we’re sending money north to what’s arguably a local function. I agree with the arguments made for -- for the officer. It’s their officer. If this bill wasn’t in the House, I would be more amenable to vote for this bill. But at the moment I’m a No. Thank you.

With all due respect to a couple of the earlier speakers, I -- I -- especially the gentleman in -- in Leadership on the other side of the aisle, I can’t tell you how many -- I give -- gave up counting the number of times I heard about the cost of the corruption tax on Illinois politics in government. Here is a specific remedy that we have that can address -- that -- that can address a problem where you have public agencies in ethical receivership. Let me remind the Members of the Body, Mr. President, that it was only last year that we took the deliberate step of moving all the chief procurement officers out of individual State agencies, including the colleges and universities, to the Executive Ethics Commission so as to insulate them from the coercion that could come about from people trying to pressure specific awards of contracts for goods and services. There is, indeed, a financial cost to greater accountability and transparency. But I feel -- listening to Senator Dillard, I have to say I feel like I was living -- experiencing déjà vu again, because many of the arguments that 25 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 130th Legislative Day 11/17/2010 we’ve heard in the prior discussion mirror what we used to hear here at the Capitol about the Illinois Toll Highway Authority, which said that they weren’t really a State agency - despite being the poster child for everything that was wrong in public service - that they weren’t a real State agency because the tolls that people -- hardworking people put in the bucket, they weren’t really tax dollars, and they were a independent quasi- public agency with their own board who made their own spending policies and dealt with their own revenue streams and decided contracts their own way. We changed that law in the mid-1990s finally - and I’m proud to say that I was the chief sponsor of that change - to require the Toll Highway Authority to be part of the State’s purchasing laws. Was there a cost associated with that? There was. But how much more do all the taxpayers in Illinois have to pay in a corruption tax, with us turning a blind eye and not doing anything about it - which is why I was so pleased to work closely with Senator Garrett and to partner with Senator Sandoval in order to advance this bill. Let me remind the Body of a principle that we’ve always tried to adhere to, which is that if we really want to remediate a situation in a public agency, whether it’s a Code agency in the State budget or a quasi-public agency, that best practices dictate that an inspector general be determined independently and externally. Metra, in particular, wanted to pick their own inspector general. They wanted to pick their own cops to be on the corner. This is not a situation that warrants that. They need an independent perspective. They need an outside body, like this Body, which, by the way, we subsidize all these transit agencies, so who better to ask -- to apply that leverage to ask 26 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 130th Legislative Day 11/17/2010 them for more accountability on their public practices and policies. So, in closing, in encouraging you to -- support for this bill, I want to say this, this is not the first time and it’s not the last time we’re going to hear from a quasi-public agency who wants to be left alone because they’re different, they’re special. When it comes to applying public confidence in how tax dollars are spent and having the level of accountability and transparency that’s necessary, we have to apply the leverage that we have to ensure that there’s an -- there’s independent oversight, whether it’s for these transit agencies, whether it’s for the Tollway, whether it’s for the Illinois Finance Authority, whether it’s for any particular taxing body that’s a quasi-public agency. We have this leverage; we shouldn’t let it go. I urge an Aye vote.

Yes, thank you, everybody, for your patience. I just want to reiterate that over the last six months, I learned of how -- how challenging it is at Metra and some of the other transit agencies, because they have not put into place any type of oversight. There are contracts that have been issued that never should have been issued. There are expensive contracts that have been issued that never should have seen the light of day, and these are costing taxpayers, whether they’re in northern Illinois or southern Illinois. It’s our job as legislators to put a stop to that and make sure that the proper mechanisms for oversight are in place. I don’t want to see this as a northern Illinois versus a southern Illinois, or vice versa. This was purchased in the 1970s with the intention of putting dredging materials from the Cal-Sag and Chicago’s Sanitary and Ship Canal into it. That has been not used -- has not been used for that purpose since that time. Meantime, the Village of Worth has grown up around this pit and the area now serves as a -- a recreational area. If these dredgings were put there, it would create problems for the residents and the businesses around there due to the fact that they are filled with contaminants. This resolution simply asks for the Army Corps of Engineers to find an alternative site. And this also is backed by federal support from Congressman Lipinski’s Office with a similar resolution from the Congress of the United States. I would ask for an Aye vote.

We passed legislation that corrected that problem. This is just similar to it and I, too, would urge an Aye vote.

Again, this is twenty-two million dollars of State aid to all schools that will be redirected into one school district - an important school district, but one school district. You can either believe all the reports that we hear that there’s not enough funding for schools and that funding for schools is decreasing or we can believe this statement that’s come out from the Illinois State Board of Education that no one will be affected by this. Twenty-two million dollars out of a pot that’s already shrinking must affect other school districts in the amount of twenty-two million dollars. I recommend that we vote No on the motion to override the veto.

And -- and since U-46’s dominant EAV county for the district has been Cook County for 2004, as verified by the Department of Revenue, and 33 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 130th Legislative Day 11/17/2010 U-46 is experiencing a negative continuing growth impact on its general State aid due to a glitch in the school funding formula, the State Board of Education could simply change U-46’s home county designation from Kane County to Cook County. I heard it’s been asked. I heard they said No. And I’d like to ask the sponsor what’s the story on that?

The -- the appealing application was made by the school district for the change in the designation. Unfortunately, that request was denied by the State Board of Education. They -- because the Board was seeking a legislative remedy to -- to address the matter. It was before, we, legislators, of course, signed off on this. But this is something that, as you say, has been a flaw or a glitch in the formula. And I want to reiterate -- I want to state clearly to -- to the Body here that this is money that’s been going to other school districts taken away from U-46. This is money that was -- otherwise would have been appropriately directed to U-46. So, this is money that is really owed U-46. Again, the -- the Board of Education has determined that there would be limited - very limited - gap in general State aid funding for these other school districts. So, we cannot determine how much, but it will certainly not be the twenty-two million dollars that’s been suggested by Senator Lauzen.

Yes, thank you, Mr. President, Members of the Senate. Senator Radogno and I would like to announce the formation of two bipartisan special Senate committees to recommend economic reforms for both Medicaid and for workers’ compensation practices here in Illinois. Each committee will have six members, equal numbers of Democrats and Republicans, and -- appointed by us. The committees will begin work immediately in order to make recommendations to the Senate before January 3rd, 2011. And I think we’ve got a -- a long two-year history of working together on a lot of significant bipartisan accomplishments and these are two areas of -- of great interest to everyone in the State. And so I look forward to this -- these committees working diligently and as soon as possible to get recommendations back to us. We are going to be scheduled to be in Session first week in January and hopefully we’ll have the ability to have some Floor action on these recommendations that would come from these committees. Just a point of announcement. I appreciate the Senate 40 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 130th Legislative Day 11/17/2010 President’s willingness to convene these committees. Obviously, as we’ve been on the campaign trail, we’ve heard a lot from our constituents. We look at the -- the state of our State and we know we can’t have business as usual. And both of these issues are very important. They’re very difficult and so I appreciate the opportunity to have a bipartisan ability to work on them. Now, the caution is, it’s not good enough for us to pass something out of this State, so I -- out of the Senate only. So I hope that all of us will be talking to our counterparts in the House and encouraging the Governor to take a leadership role in this as well, because it doesn’t really do anything if we just get something out of the Senate. These are issues that we really have to address. We’ve -- everyone talked about the jobs climate in Illinois. One of the biggest problems we have is workers’ comp. We have lots of different sides. We have lots of different friends with different interests and it’s my hope that we really can bring our State in line with other states and make it more hospitable to businesses locating here. Similarly with Medicaid. It’s a huge area of the budget. If we can figure out some ways to save money and deliver these important services more efficiently, we’re all going to be better off. So, I’m going into this with the best hope that we really can accomplish something. But, again, we need to make sure that it goes beyond the Senate; that it includes the House and the Governor. So, thank you, President Cullerton, and I look forward to working with you.
