What it does is clarifies that eligibility for a Veterans and a Servicemembers Court program or a mental health court program, which are probationary programs, is limited to only those defendants whose crime is eligible for probation. Thank you, Mr. President, especially for your indulgence and that of the Body. This is a bill -- an initiative of the Department of Corrections. It amends the Sexually Dangerous Persons -- Persons Act in two ways. It expands the pool of those experts who may testify about the -- as a result of the evaluation of sex offenders, appointed by a court and reporting to the court. The current law, enacted in 1938, only allows psychiatrists to perform these evaluations. And, obviously, that pool is not large enough, so that's how it -- it amends the law. Secondly, it comports with People v. Masterson, an Illinois Supreme Court case, which requires that there be a 26 STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 31st Legislative Day 4/10/2013 showing of criminal propensity to the commission of sex offenses, which is an element necessary for an individual to be declared a sexually dangerous person. It amends the Illinois Finance Authority Act and provides that the Authority may, instead of shall, administer an emerald ash borer revolving loan program and a Farm Debt Relief Program. And it provides that certain reports are to be filed at the end of the year, instead of monthly. SENATOR McCONNAUGHAY: This bill amends the Illinois Vehicle Code. It prevents low-speed vehicles and non-highway vehicles from making a direct crossing of a tollway, interstate highway, or controlled access highway. Essentially -- currently, low-speed vehicles, things like ATVs and golf carts, can only cross at intersections with stoplights and reduced speeds of -- posted by municipalities at thirty-five miles an hour. This allows low-speed vehicles to cross State highways.

SENATOR McCONNAUGHAY: As I -- I think you have probably in your district, as I do, individuals who live in retirement communities and they travel throughout their communities in golf carts. As you know, Del Webb community, right there off of Randall Road, those folks want to be able to get to either the grocery store or to get their cup of coffee and they want to take their non-highway vehicle across Randall Road.

Well, let me just make a comment here. This is a very bad first bill because it doesn't leave us an awful lot to work with here, Senator. So I'm just going to try to encourage some of my colleagues here, who are far more creative than I am, to examine your bill while I'm talking to you here and ask another question. And that is, you know, if you're going to ask people who are usually clipping along at about, I'd say, seventy, sixty, seventy miles an hour, and you know that's how fast they travel on Randall Road, to suddenly have to accommodate somebody in a golf cart who's traveling twenty miles an hour, don't you foresee a certain public hazard attenuating this bill?
PRESIDING OFFICER: (SENATOR SULLIVAN) 32 STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 31st Legislative Day 4/10/2013 Senator McConnaughay. SENATOR McCONNAUGHAY: Well, first of all, it's drafted by the safety personnel at IDOT. So I think that they've had an opportunity to look at that very -- that very question and that's a good question. But those same -- those same individuals can cross that highway on foot and they have to utilize some of their own judgment to ensure that the traffic moving in both directions gives them enough time to get across the highway. We would expect those same individuals to use that same judgment in a non-highway vehicle.

I'm not entirely sure that that was responsive to my question. But let me ask you another question, and that was -- that is this: I think we're both fans of Bus Rapid Transit in Kane County, are we not?
PRESIDING OFFICER: (SENATOR SULLIVAN) Senator McConnaughay. SENATOR McCONNAUGHAY: Absolutely we are. You and I have been advocating for that for quite awhile. I hope that we aren't concerned about the idea that senior residents in our communities getting across Randall Road is going to prevent public transit. I know that you and I are dedicated to making public transit available to a broader constituency and I -- I thought about that. And you and I have talked about those issues many times. I do not see this as, in any way, impeding the ability to promote public transit 33 STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 31st Legislative Day 4/10/2013 on Randall Road.

I'm going to ask basically just one final question, and it concerns me, given perhaps the adoption of Bus Rapid Transit on Randall Road, the prospect that a bus traveling at a rapid rate of speed might come upon a golf cart, and, dare I say, that you have two -- two family members, who might actually be related, retirees, people that we know go out and vote and really are concerned about -- about services and about having access to such a public -- public venue, that that bus might be traveling at such a rate of speed that it could not slow down in time for that golf cart, and what a complete and utter calamity that would -- what -- that would create on -- on this very, very, very busy causeway. So, but nonetheless, nonetheless, I wish you well on your first bill. You've done a good job standing up to questioning so far, but I -- I want to warn you, you have further questioning here that might not go quite as easy, however, more briefly. I wish you well. So, it does not require a helmet. It does include, I must assume, the riding of a horse. It does not include riding a bicycle. It does include dirt bikes, ATVs, golf courts -- golf courts -- golf carts. So that would mean that this is a bill unique to a suburban area of the State, right? Because you seem to focus on dirt bikes, ATVs and golf carts, to the exclusion of horses. So I'm -- therefore, I must assume this discriminates against downstate.
PRESIDING OFFICER: (SENATOR SULLIVAN) Senator McConnaughay. I believe there was a question there. SENATOR McCONNAUGHAY: So, somewhere in there. No, in fact, it is downstate where the original idea for addressing this problem in the statute came from. Golf course communities, small -- small towns where many state highways run right through the middle of town, and an individual on a non-highway motorized vehicle has difficulty getting across that highway, which is the center of town, unless it is at the intersection and unless it is posted less than thirty-five miles an hour.

For whatever reason, the federal Roth plan came up and -- and was created at the federal level before we changed our rules and -- and we're not allowed under State law to extend a Roth IRA. And so now we're bringing it forward here, as it timed out last year.

Senate Bill 1538 would add the ability to use a sling bow to the list of fishing devices permitted to take certain fish in Illinois. As amended, the Department of Natural Resources is neutral on the bill and supportive. They are -- this is for a constituent in Tuscola, Illinois, who has created a -- a sling bow concept and it's a combination slingshot/bow and arrow. You can already go bowfishing in Illinois, but you can't use a sling bow. He's selling quite a few of these out of -- out of a small light manufacturing operation in Tuscola and he can sell them elsewhere in the country; he just can't sell 'em in his home State. So, from an economic development prospective, he would like very much the ability to go ahead and sell these in Illinois. The Department's fine with it, as amended. Thank you, Mr. Speaker, and I will reluctantly look forward to questions.

No, Senator Syverson, this would extend the ability to use a sling bow for bowfishing in Illinois. Bowfishing's already allowed. There's no change to that. This would extend the ability to use a sling bow to do that.

And what's a sling bow - different than a regular bow?

A regular bow would be a bow and arrow like you'd envision in a -- you know, that you've shot many times, I'm sure. A sling bow is a combination slingshot and it shoots a bolt, an arrow, out of the slingshot, and -- just like you go bowfishing with it. And, again, the -- the fish that would be allowed to be hunted with this, the species would be the sort of nefarious invasive species that we want to get rid of in Illinois. And so it'd extend the ability to use this sling shot bow and arrow to the -- to that ability that's already there for the regular bow and arrow.

You seem to be very comfortable in talking about these sling shot bows. Have you shot those -- have you shot these before?

But what has happened is, if you have a fire at your home and the heat from that fire damages or melts the siding on the house next to you, suddenly that house is brought into the whole storm chaser concept. Becomes extremely -- a lot of paperwork of things that come along that then become very hard to repair that home in a timely and efficient manner for the homeowner. This bill has been negotiated with the industry and with the Attorney General's Office. At this point, I know of no opposition.

Senator Manar, is there any language in the bill that -- here's what my concern is, is that obviously we have an issue, like in every state, but -- perhaps in this State more so, issue with medical malpractice lawsuits and liability. What we're doing here is setting up, by statute, a mandate that healthcare providers shall inform certain people of certain things. Do you know if, by doing so, we are making it more or less likely that we'll see some kind of malpractice suit based on a claim of negligence because someone in the family wasn't advised of this issue as you've laid out in the statute?

This was -- this was discussed with the Hospital Association and -- I'm sorry, this was discussed with the Hospital Association and that's one reason why, following committee, I went to them and said, "Bring me your amendment. The amendment clarified that -- that parents and guardians and someone in a neonatal care would be informed of the risks that they pose to newborns in terms of transferring the virus. So, the original bill said that there would be a vaccination. The amendment just simply says that the hospitals would have to include, in what they give to parents or guardians, information regarding the risks involved and how they would go about receiving a vaccination. There's no requirement for a vaccination in the bill.

I do understand that, Senator. So what -- what the concern I'm asking about is the mandate of the providing of the information. I mean, the mandate goes to parents, guardians, and immediate family members. So, here -- let me give you an example, where healthcare provider or providers do the best they can. They talk to mom and dad and they talk to Uncle Ray, but they forget to talk to the eighteen-year-old sibling of the individual. Then that sibling becomes ill. Are you setting up potential for litigation there because the healthcare provider, including the -- maybe the hospital, did not -- or the doctor, who is employed by the hospital - so now you got the doctor and you got the hospital on the hook - did not comply with the mandate? 66 STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 31st Legislative Day 4/10/2013

Senator Righter, I -- this wouldn't increase or decrease the -- the chance of that potential litigation because there are already mandates or requirements that hospitals go through when -- when there's the birth of a child. There -- there's any number of things that -- that hospitals are required to do or either do voluntarily. This would just be adding one of those things. And, again, it's not the - which I made the point earlier - it's not the requirement that a vaccination happen; it's a requirement that information be provided that the risk is great when it comes to a guardian or a parent when a newborn is -- is -- is born.

You mentioned that there are already similar requirements, but there's not a requirement on this specific issue currently, so that would be a new one. And what I'm asking about is a situation where there is an illness, someone becomes ill and there are damages incurred because there was a failure to comply with this new mandate. I mean, we use a -- a -- a reasonableness standard when it comes to medical malpractice, and would some -- when a -- would a medical practitioner's failure to provide this information to the eighteen-year-old sibling constitute negligence on behalf of that medical provider, in your view?

It influences the distribution of a very small number of dollars, but the recordkeeping that's required to administer it is burdensome and expensive. And so, at a request of the community colleges, this bill, Senate Bill 1688, simply strikes that part of the formula altogether. It has no fiscal impact. It just simply, very, very modestly changes and simplifies the method by which whatever we appropriate is distributed and it does it in a way that is opposed by nobody.

This bill is an initiative of Columbia {sic} (Columbus) School in the Edwardsville, Illinois, school district. Matt Maddox, the teacher, and a group of students at that school brought this bill to my attention last year. And what it does, simply, is provide -- mandate -- it's not a mandate as we know mandates, but it adds October the 7th to the calendar of commemorative holidays in Illinois schools. It does not mandate any school closure. Doesn't mandate any teaching or anything of the sort. It adds a commemorative holiday consistent with the many others, including March 29, which is the Viet Nam War Veterans' Day. December the 7th is Pearl Harbor Veterans' Day, and I believe there's one, the Korean War Veterans' Day and Susan B. Anthony, Christa McAuliffe, who was a school teacher by the way, and others. The -- the purpose of it and what appealed to me was these -- this current conflict, the one in Iraq, which is dying away, and the one in Afghanistan, which is still going on, are wars that were begun with wide popular approval, similar to the war I was in, Viet Nam, and similar to the Korean War, and similar to those wars, the popular support dropped off. They became highly controversial. And perhaps it's because of the national leadership, the military leadership. It's far beyond my competence to determine that; that's up to -- the historians. But it's important for us to remember that the soldiers, the Marines, the pilots, the men and women who served these units, the officers and the NCOs and the enlisted personnel, did their duty. There were nine thousand killed and thousands brought home injured, many permanently, and they should be honored and not forgotten by this great republic. Thank you, Mr. President. Senate Bill 1737 would allow for a correction where the county collector inadvertently fails to send the correct tax bill. What happened is, in -- in Edgar County, Illinois, the Edgar County Clerk staff inadvertently put a decimal place in the wrong place and shorted the entire Chrisman School District part of their -- several -- about a couple hundred thousand dollars' worth of their annual assessment that they would otherwise be due. Under current law, oddly enough, it takes two years, up to two years, to correct that. And so what this bill would do is say, where there's an honest scrivener's error, then they could go ahead and send the correct bill out for this year, but it couldn't be due any sooner than thirty days after what it would otherwise be due, and that way the taxpayer is not disadvantaged. It came out of committee unanimously and it makes a minor change in the definition of someone who has been a low bidder that's won a contract that needs to make a minor change in the price of what they are providing a university. It is -- it's limited to perishable goods, so it's -- it's food. And it brings this in line exactly the way the four-year public institutions have it. So the community colleges wanted their language to be just like the -- the other four-year public institutions for perishable goods. Senate Bill 1778 amends and repeals the Savings and Loan Act of 1985 to provide for the transition of the last savings and loan associations to savings banks. Bill also makes technical changes to outdated banking practices by removing oversight requirements from the Department of Financial and Professional Regulation. The bill also extends the power of the Secretary to act as receiver of failing banks, with the ability to repudiate contracts and placing litigation on hold. This bill has a show of support of all the financial institution organizations in the State.

Provides that beginning January 1, 2014, the amount that a rental company may charge for a collision damage waiver shall increase (to) thirteen dollars and fifty cents per day. Beginning January 1, 2015, continuing every year thereafter, the charge for a collision damage waiver for rental automobiles shall increase by the lesser of: Consumer Price Index for all Urban Consumers for the preceding calendar year as determined by the U.S. Department of Labor; or five percent. Currently, the charge for such a waiver is fixed at twelve dollars and fifty cents a day. I know of no opposition.
