He -- he's serving as a Page for a Day today. He's a College of CD -- or a College of DuPage student right now. He'll be attending Wesleyan University starting next year. They have a construction program in which the students actually build houses and they sell those houses. This would change the process so that the school district can engage the services of a real estate broker to sell property constructed by the students at a commission not to exceed seven percent and that the property is publicly listed on multiple service listings for fourteen days and the sale of the property occurs within 120 -- days. Currently, they have to use the regular State process of sealed bids and auctions, and it just isn't working for them. So this would help them out. There's some safeguards in it that they'll get a fair price and it'll be done properly. So I'd ask for an Aye vote. Thank you.

I -- I don't know precisely. It's a threat, same as it's used in the Criminal Code just generally. I don't have a Webster's Dictionary at my disposal, but, you know, that's a commonly used term.

Typically, you -- we define terms here, even commonly used terms. But are there any exceptions to this for things that might be said in the heat of the moment?

I think anything that would amount to extortion, even if it's in the heat of the moment. If you say to somebody in the heat of the moment, "Either you do this, either you pay me this, or I'm going to do this to you", I think that could amount to extortion.

So let me give you an example. If you're -- if there's a divorce proceeding, and husband and wife clearly don't get along, and they're having an argument over the disposition of property and, either party, after they've been sitting there for three hours trying to hammer out this list of the disposition of property, one of 'em gets up and says, "Gosh, dang it, I've had enough. I'm going to kick your rear if you don't do this", or "I'm not going to sign it". That's a better example. "I'm not going to sign this document if you don't give me that piece of property that I want." That's a threat. I just made a threat in that hypothetical example and I'm doing it to induce the person to give me property, and I would suggest that this happens all the time in disputes between families, particularly those that have become so unsettled as to end in divorce proceedings. 16 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 95th Legislative Day 4/6/2016

So what I would say to you is, right now extortion exists at the federal level and there's something called prosecutorial discretion and the likelihood of a -- of a prosecutor bringing such a case is unlikely. Same as if you think of assault for example. You know, under the circumstances that you've just described, when you said kick your -- kick your butt or whatever - I didn't -- I didn't say ass - you know, theoretically a prosecutor can bring -- bring an assault charge in that -- that case, but we rely on the discretion of a prosecutor to not go to that extreme.

First of all, I think the term was "kick your rear", but that's okay. Let me give you a different one, same vein though. Let's assume dad hasn't paid child support for months and mom's under court order to go ahead and give the kids over for the weekend and mom gets mad and says, "Dang it, you haven't paid child support. I'm not giving you the kids".

Hello. Thank you. Actually, I've seen those cases get farther down the line and you do end up in charges, and I guess that's my point. While we're here doing this -- and by the way, I completely understand what you're trying to do and it makes sense, but I think, while we're here doing this, we should take the time to make sure we've thought through that so we're getting at the truly bad guys and we're not getting at what happens all the time in life, where two individuals have known each other forever, maybe they're business partners, maybe they're actual partners, you know, a husband and wife, but they get mad, they've had enough, they say something in the heat of the moment, they really didn't mean it, they were just mad at the situation at that moment in time and they had no intent of actually following through on it. Okay? And I think -- and -- and with -- I find it interesting here, because usually you and I are on the opposite sides of this. I'm the former prosecutor and you're telling me that prosecutorial discretion oftentimes is not enough and we need to write in statutory exculpations to make sure that people aren't charged with crimes. In this instance, I'm suggesting we need to write in the statutory defense here to say that in the heat of the moment, when someone says something that they'd regret or they might -- but we need to do it now. And with all due respect to the Body, you know, I've sat in court and lost cases because the General Assembly didn't take the time to do it right. On the other hand, you could very well have a prosecutor -- and by the way, the office I was out of -- you and I have talked about cameras for a long time and you would say that no one would've ever not exercised 18 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 95th Legislative Day 4/6/2016 prosecutorial discretion and go ahead and -- and charge somebody for filming an arrest. That happened in the county I was in. They were charged for filming an arrest. Okay? So I just think -- and then we came here later - I think it was your bill, Senator - to change the entire statute so that that wouldn't happen again. And by the way, it wasn't just Champaign County; it happened in Cumberland County and there was a whole litany of places. The Chicago Tribune did a whole series on it. So I would just suggest that while we're here, with absolutely no disrespect to you or the intention of this bill, that we should take the time to go ahead and get it right the first time so that we have a bright line and the prosecutors know that something that's said in the heat of the moment between loved ones or between business partners, or any of those, for lack of a better term, familiar relationships, don't end up coming in afoul of this -- this legislation, Senator. And we've got plenty of time. I mean, there's -- we could have an amendment by next week if -- if you would agree to that.

I -- I appreciate the sentiment of your concern. I -- I -- I couldn't imagine a heat of the moment exemption to this, because certainly -- and I understand what you're trying to get at, but certainly something that does amount to what this -- what -- extortion as it exists now on the federal level, said in the heat of the moment, could -- could be violative and could be a -- a legitimate threat. Let's say, in the heat of the moment, somebody says, I don't know, "Give me ten thousand dollars or -- or else I'm going to burn down your place". Right? Somebody can -- that -- that exchange could potentially take place and -- and it will have been extortion. So I don't think "in the heat of the moment" exemption would be appropriate. I do acknowledge - I'm a former prosecutor as well - that there -- that overreach exists and an overreach exists with a lot of the currently existing offenses in our Criminal Code. You know, that's one of the reasons why - I think the -- the -- the discussion we usually have is around preserving judicial discretion - that's why we want to preserve judicial discretion and not leave everything up to -- up to prosecutorial discretion. So, I think this is designed to mirror extortion as it exists at the federal level and give -- give local prosecutors the ability to do the same as done on the federal level.

Well, I won't belabor the point, but to the bill and I'll respond to the example you gave. In the example you gave, that's extortion and it would -- it would -- it would come under all kinds of -- litany of crimes that already exist today, but you could create this one and it wouldn't apply. I'm suggesting we should build in a statutory defense and, as you know, that becomes a fact- based conversation for the judge and ultimately for a jury to determine whether or not it was the heat of the moment because this was a husband and wife and they'd been arguing all day about their divorce proceedings or is it some unknown character walking up to a building and saying, "Hey, give me ten thousand dollars or I'm going to burn your building down". Those are two totally different things. What I'm saying is -- and -- and what I'm -- I 20 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 95th Legislative Day 4/6/2016 can just tell you right now what -- what's going to happen is the arrest will be made and, even if you do have a prosecutorial discretion that later tosses the charge, that person's now been charged, put in jail, et cetera, et cetera. So, I -- I guess -- again, we've got time here. I just think it would make sense to walk through that so you can get it exactly the criminal conduct you just mentioned in your example without dragging in the millions upon millions of spats that happen every year in this country and -- and in this State between familiar partners, business partners, and other people that -- that -- you know, people get in a huff and they say something and -- and you know they didn't mean it. Well, you know, there's no -- I don't see in -- yeah, I mean, I - - you could say that the intent to carry through with it would even be something you could add to this to get at the actual behavior you're talking about without needlessly ensnaring otherwise innocent people. Sometimes when we -- we get caught up in this debate about, well, what the sponsor or what the Chamber intends, and the problem with that, as you know, is that the court, when there is a lawsuit and they have to interpret the language of the bill, they don't care what you or I said on the Senate Floor if they can read the words and figure out what it says. So, help me with understanding, according to the plain language in the bill, how threatening a strike or a boycott would not fall under the parameters of extortion.

Well -- well, I mean, the exchange of ten thousand dollars is -- is lawful, but it's -- I think it's wrongful if you say to a restaurant owner, "Give me ten thousand dollars or else your place will be burned down". That would be wrongful. But the exchange of ten thousand dollars generally is lawful. If you just decided to give me ten grand, I'd, you know, gladly accept it and report it on my income tax. That would be lawful. But -- but you -- you -- you exchange -- you -- you -- you saying or me saying to you that "Give me that ten grand or else your house is going to burn down", that would be unlawful and -- that'd be wrongful, but -- but I -- you know, I -- I -- I'm not sure that that would be necessarily covered unless we have an extortion bill.

With -- Mr. President, with all due respect, we are talking about the creation of a Class 2 {sic} (3) felony, brand-new crime in Illinois. I think that deserves not only a little bit better in terms of what people can and can't hear in the Senate Chamber, but also a thorough debate. Let's flip this question of the wrongful threat, because, honestly, I'm not sure what that means and I think it's because I'm not clear what is -- what's an okay threat. What's a threat -- what is a threat that's okay? You're asking -- you're -- I'm trying to figure out what a wrongful threat is, because you're saying that threatening a strike or threatening a boycott isn't -- doesn't fall under the parameters of Senate Bill 2778 because it's not a wrongful threat. I asked you if a threat to do something legal would fall under that; I'm not sure I understood your answer. So give me an example of a threat that would not fall under the parameters of this legislation.

You know, Ladies and Gentlemen, I can't imagine there is going to be anyone in this Chamber who's going to vote against this bill, because nobody wants to go back home and look the voters in the face and say -- and be asked the question, "Wait, you voted against making extortion against the law? Really? Really? I can't wait till the next election to vote you out." Yeah, nobody's going to vote against this. Here's the danger with bills likes this, and particularly language that is vague, and with all due respect to the sponsor, the threat, the unlawful threat -- I'm not sure if the term unlawful threat appears anywhere else in our law or our Criminal Code, but at some point -- I mean, there are lots of people in this Chamber who expressed concern about the prosecuting attorney who finds some language in the law and finds conduct that he or she finds offensive and then, the next thing you know, you've got a criminal case being charged when it was absolutely not the intention of the General Assembly and the Governor when they signed the bill for that conduct to be criminalized. Senator Rose talked a little bit about that, as did I. I would just -- as this bill -- and certainly it's going to fly out of here, and moves over to the House, the people who have the ability to adjust the language in this bill, be very, very careful about what they are doing. Thank you, Mr. President, Ladies and Gentlemen of the Chamber. 26 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 95th Legislative Day 4/6/2016 It's rare that I do this, but I'm -- I'm going to read the entire bill, because I think it's important for the Ladies and Gentlemen of the -- of the Senate to hear the language of the bill. "A person commits extortion when he or she knowingly obtains, or causes to obtained, property, services, something of value, advantage or immunity, from another person, with that person's consent, when the consent is induced by wrongful use of the threat of fear or actual or threatened force, violence, or under color of official right." This is not something that is totally foreign to criminal law. It has existed for some time in federal law. It's an oversight that the State of Illinois has not had it in State law. Some of the circumstances suggested by Senator Rose earlier, quite frankly, is -- some of those circumstances is covered by our intimidation law that exists right now and the same vagueness that Senator Rose referred to that may allow somebody to do an overreach -- a prosecutor to do an overreach, they can do that right now with our intimidation law that's on the books. And I've seen no bills proposed to repeal our intimidation law. So, let's not try to excite somebody that -- that, you know, we're going -- we're - - we're taking a major step beyond -- having faith in our prosecutors, and if not our prosecutors, we have another level of discretion in -- in our judges to make sure that the offenses brought are -- are -- are reasonable. So, I urge your support.
