So I -- today I want to introduce two distinguished gentlemen from the south suburbs of Chicago, specifically in the great municipality of Monee. Today I have my Page for the Day. His name is Jason Farquhar. And just a little bit about Jason: He's in the second grade. He's eight years old. He doesn't have a 6  STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 102nd Legislative Day 4/20/2016 girlfriend - that's a good thing, right now. His favorite subject is math. He plays football. He plays my favorite position, right guard. He's a hard hittin' baseball player as well and he's got a gun for a second baseman. He's kind of a little bit disappointed today because the Blackhawks did not prevail yesterday, but he's confident that they will win. He has four siblings - one brother, three sisters. His favorite movie is Star Wars. He loves Luke Skywalker. And I guess the last thing that we're most proud of is that he's a Cub Scout. He just did a -- I think it was a three- or a five-mile hike. He's part of the Pack 125 and he's a Wolf, and he's really excited to be here. I was just hoping that we can give a warm Springfield welcome to my proud Page for a Day, Jason Farquhar.

I would like to please present a proclamation on behalf of one of our guys who is here with us every day protecting us as we move through the Capitol Building, Chief Odie Anthony Carpenter, Jr. "WHEREAS, on December 22nd, 1972, Odie Anthony Carpenter, Jr. was hired by the East St. Louis, Illinois Police Department" - thank you, Mr. President - "as a patrol officer; and WHEREAS, on May 1st of 1975, he was promoted to detective by the East St. Louis Police Department - a designation he held until his resignation on December 31st of 1984, upon relocating to Springfield, Illinois, and being hired as an Apprehension Specialist by the Illinois Department of Corrections and working in this capacity until September of 1987; and WHEREAS, on January 19th of 1988, he was hired by the Illinois Commerce Commission Police as a Police Officer II; and WHEREAS, on December 16th of 1989, he was promoted to Sergeant in charge of Training Operations; and WHEREAS, Mr. Carpenter served in this capacity until July 16th of 1999, at which time he was promoted to Police Commander in charge of Statewide Operations and then later promoted to Deputy Chief of Police, serving as such until July 15th of 2009; and WHEREAS, on July 15th of 2009, Mr. Carpenter was appointed Chief of Police of the Illinois Commerce Commission Police; and WHEREAS, this appointment made Chief Carpenter the first African American to head a State 15  STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 102nd Legislative Day 4/20/2016 Police Agency in the history of Illinois - a position he held until his retirement on December 11th of 2011, having served the citizens of this State for thirty-nine years; therefore be it PROCLAIMED, BY THE SENATE OF THE NINETY-NINTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we recognize the prestigious efforts of retired Chief Odie Anthony Carpenter for his nearly forty years of dedicated service to the well-being and security of Illinois' citizens; and be it further PROCLAIMED, that a suitable copy of this proclamation be presented to Chief Odie Anthony Carpenter with our sincere appreciation for his esteemed career." The people that use this are the casinos and the independent video poker games and we feel it's very appropriate to have more nationally accredited people doing the testing, instead of just having one.

It provides that all non-relative providers in the child care assistance program for the first time shall participate in an orientation and pre-service training within six months after they begin providing services. The training will be an annual process for providers. Relative providers in the program shall be encouraged, but not required, to attend these as well. The providers shall be paid fifteen dollars an hour for their attendance. And also it states that the State shall provide health insurance to the qualified home care providers. And I'll be happy to answer any questions.

And I just want to bring to attention of the Senate, as we continue to tinker with our day cares, our health, moving and shifting people around, the beneficiary are the children, the families that have to be cared for, and to make sure that the adequate training, that the adequacy and that it's codified, that this become a negotiation as we move forward in Illinois and keep evolving the budget - what budget? - to evolve the concepts that are necessary to put 'em on the table, because right now these populations are on the menu if indeed they're having inadequate trainings and dealing with our most vulnerable, our most treasured child -- children, knowing that at fifteen dollars an hour, to -- to -- to encourage their participation. There will be online training also. There'll be those who will want to opt out because of their longevity. This is a multiverse and I think it's too much to discuss in this particular setting. That's why I commend the sponsor to be able to bring this forward and, as she's indicated, to bring it to the full table, as she is a -- one of our Majority Leaders also, to continue to push the envelope, make sure we have sunshine on this issue so that we can discuss exactly how we move the billions that are truly under this Dome, and someone is getting that money, once someone told me. And it's very clear about prioritizing, and at least put it again in place so that at the end of the day when we make these selections that we are truly doing the people's work, 'cause we don't need to walk with the great. She is definitely walking with the needy. So in this case, if we could encourage our providers, who are families out there, to get this training and to give 'em a decent 60  STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 102nd Legislative Day 4/20/2016 opportunity and make sure that they're covered by their health, so they can adequately give better support to the children and those that they're caring for, and I would ask for your Aye vote.

This adds the law enforcement agency the use of a drone for law enforcement training purposes as one of the exemptions under the Act. It also provides law enforcement agency usage of a drone for training purposes on private property requires lawful consent. It also let's -- law enforcement must provide advance and onsite public notice when the agency intends to use a drone for training purposes on public lands, highways, and roadways, or areas belonging to State or political subdivisions of the State. Information collected by the agency use of a drone during law enforcement may be retained by a supervisor at the agency and may be disclosed to another government agency. However, any such information must be deleted as soon as it's no longer required for training purposes, unless there's reasonable suspicion in the information that contains evidence for criminal activity or the information is relevant to an ongoing investigation or pending criminal activity.

But, again, with this -- what we're trying to do with this bill, Senator, is for training purposes. I know it was brought up in committee, what if someone was smoking pot in the backyard? Well, this bill is not designed to look for someone smoking pot in someone's backyard. This is for training purposes. It -- what - - it is put in the bill in the event of criminal activity. I think a simple example would be if someone was seeing someone being murdered, whether you'd shot someone several times, whether that individual was stabbed. Well, if the drone, in fact, did take that image, I would think that everybody would be happy that they turned that in to the law enforcement agency. You have the State's Attorney - all of you know, as attorneys, State's Attorney approves charges. So if there was a charge brought up on a drone while it was doing training purposes on that training day, State's Attorney -- it goes to the State's Attorney. They approve charges or not.

You know, you brought up the scenario in committee, as well as now, about the possibility of can it happen? I'm not going to stand here and lie to you, saying it can't, but at the end of the day, we're asking for permission. We can't do it now. You know, anybody can have a drone and -- and do the recording, but if you're law enforcement, we need the permission in order for them to do the training. This is what the bill is about. This is not about trying to infringe on someone's privacy, whether Mr. and Mrs. Whatever is doing something in their backyard. This has nothing to do with that.

I can see the training academy at the Chicago Police, simple example, is on Loomis Street, Loomis and Jackson. That area is where they do the training in the parking lot for pull-over stops and hypothetical situations that -- what can occur and what happens when you pull a vehicle over. Now, could it cross over onto Jackson? Yes, absolutely. But to go five or six blocks in, that is not the intent of this bill. That's a little bit too far-reaching, Senator.

Senator Muñoz, I -- you know, I know that you've -- you've done a good job historically of bringing good bills with regards to law enforcement, and as I expressed in committee, I've got -- I -- I share some of the reservations that we've heard from the other side of the aisle. I want to focus in on this notion that this is for training purposes and that information is supposed to be deleted as it -- at the moment that it's no longer required for training purposes, except that there's -- and unless there're -- there're a couple of exclusions to that, and one is if there is reasonable suspicion that the information contains evidence of criminal activity and information is relevant to an ongoing investigation or pending criminal activity. Is there anything that narrows down whatever that criminal activity will be? Could it be a misdemeanor? Could it be -- there's a wide range of criminal offenses in our Criminal Code. It -- it occurs to me that, with this language, there could be a -- a wide breadth of argument as to we've got information that could be relevant to some criminal activity. It could be even selling loose cigarettes. Is there anything that narrows that at all in this bill?

Does anything in this bill limit it to police departments and municipalities the size of Chicago or does this apply to just any police department who either now or in the future obtains drones and wants to do some training, and -- and if you have any knowledge of how many law enforcement agencies may exist in the State of Illinois?

But this opens the floodgates to what could be done with drones. I know the vast majority of 'em don't have drone training programs today, but when we pass law, it applies from today going forward and -- and this is dangerous. Is there any chance that we can get an extension and try to narrow this language?

We've heard of, quite frankly, of abuses in other areas from other police departments that don't run as well as some larger police departments. When we talk about the notice provision, the notice, as pointed out by Senator Connelly, the notice will go -- if you have a property, it'll go to the owner of the property, but there are a lot of people within that property that -- that may have units within that property - backyards - that have their privacy rights, Ladies and Gentlemen. And -- and -- and the -- the exceptions to information being deleted leave a -- a huge escape for -- for a law enforcement department to say that they're using it for training purposes, but they're actually using it inappropriately for -- investigatory purposes. I -- I - - I share the sentiments of Senator Righter that this is not right. I -- unfortunately, I -- I -- I seriously urge my colleagues to either vote Present or No on this bill, because privacy rights are at stake.

The bill amends the governing Act for all nine public universities to provide legal authority for undocumented students, who meet the conditions necessary to be deemed an Illinois resident for tuition purposes, to be eligible to -- to access State-based financial aid. Financial aid includes any student aid or -- or benefit funded or administered by the State, State agencies, public institutions, or the university, such as scholarships, grants, awards, stipends, room and board, tuition waiver, or -- or other financial or in- kind assistance. The bill excludes access to grants provided through the MAP grants. This is an initiative that -- all the public universities are online {sic}. All they really want is just to have the ability to decide and give aid to a student, an undocumented student. We have all the universities on board with this bill. And when you're talking about a hundred and forty-four thousand students that are at the public universities, only fifteen hundred would qualify for any type of financial aid by the institutions. Like I said, all the universities are on board with this. We have educated these young men and women from the age of primary to secondary. Now they are in college. They are, you know, pursuing professions that are going to benefit our society, our State of Illinois. And I will be happy to answer any questions.

This, at a time when resources are scarce, you're going to add more people to the same potential pool of money. And it's not going to change; it's not going to add money to the pot in any way. What this is going to do is give the opportunity for someone that is undocumented or, if you consider -- to say it another way, you can say they're not a legal citizen, and you're going to give them the opportunity to take a scholarship away from someone that is legal. And so, it's up to you. At a time when the -- the resources are scarce and they're not going to grow -- I mean, in fact, even in -- in this committee, believe it or not, someone said that this will somehow be better because it'll increase the amount of money. Now how it does that, I have no idea. We know that the resources are scarce. What we're going to allocate, in money, for these students is not going to change, but you're going to add more people to it that have an opportunity. They're going take -- they're going to take that scholarship away from someone else. Those that obtain it that are undocumented, illegal citizens will take it away from someone that is legal. I urge a No vote.

Let me just clarify something. This is -- this allows the students to compete. This gives the ability for the university to offer some kind of financial assistance to -- to young men and women, who are already paying in-state tuition, who are working two and three jobs to stay in school. There is a list of qualifications that they have to meet in order to even compete. When we talk about young men and women, we're talking about sometimes students that have a 4.0 average that other universities would love to have, other states would love to have. We want to be able to give the -- the control to the universities to be able to let these young men and women compete for some of these dollars that are there. It doesn't include the MAP grant. The MAP grant was taken out. This is other types of -- of scholarships that some of the universities have and we -- all we want to do is be able to give this opportunity to these students. We are not taking anything away from anyone other than adding maybe fifteen hundred students to that amount of a hundred and forty-four thousand students that already compete. So all we're asking for is to give the ability to the university to be able to have that power to decide, because right now they cannot do it based on the federal law.

A few years ago, of course, the State of Illinois adopted a policy of "60 by 25" by which our State committed to having sixty percent of our adult workforce earn a postsecondary credential by the year 2025. Those of us on the Higher Education Committee, other Members of this Chamber, have heard Jim Applegate, the Director of IBHE, and other higher education leaders make clear that we cannot attain that goal affording college access only to traditional students. We can only reach this necessary goal of sixty percent of Illinois' adult workforce having a postsecondary credential, and our State thus being robust to compete in our regional, national, and international economies, by nontraditional students earning degrees after high school. Those nontraditional groups, of course, include first-generation college students, ex-offenders, low- income students, students of color, and undocumented students. Furthermore, please note that our State has already invested its resources in these children, as they have attended our elementary schools, middle schools, junior highs, and high schools. This investment obviously has proven to be prudent and effective, for these students have earned admission to our nine public universities. The money has already been spent to prepare these students for college. So this bill would give these students, who have done all that we encourage them to do - to study, to get good grades, to participate in extracurriculars, to get their college applications turned in on time - this bill would give those students the opportunity to bring our investment in them, our K through twelve investment, to degreed status - of obvious benefit to the students themselves, to their families, their communities, and our State. We're talking about -- and by the way of -- one of the speakers, former speakers on the other side, talked about that -- trying to make this a illegal taking away something. I am both offended and -- I'm offended by that comment and it's very divisive to start indicating that this will -- this is what the intent is. We have passed legislation, as one of the original Members of the Latino Caucus who's non- affected. But I wake up every day with affirmative action as my coat, because as a Puerto Rican born in the United States of America, if affirmative action laws weren't here for women and people of color, then will I be on that grill? Because then you wouldn't have to honor me. They wouldn't have to worry about us minorities, because I wake up with affirmative action laws that provide me these opportunities that I can go, and you have to abide by that because it is a law that makes you do that. Because if you didn't have it, oh, Lord, have mercy, what would you do to the Puerto Ricans - what you want to do already, take away our citizenship next? You blessed us in 1917 because you had a war coming and you wanted to draft our men. And my dad was one of those World War II vets - not one fingerprint, not one interview. They gave him a blessing and they took him to Bunker Hill, they took him to San Juan, they took him to war. And you all honored my dad here - thank you and I bless you for that. It is both offensive and divisive to start talking about whose going to take what. When we talk about in the State of California who allows undocumented students to apply for and receive state-funded financial aid. In Minnesota, students who meet the Dream Act requirements are eligible for state financial aid. In New Mexico - and that's how it's pronounced - allows state financial aid for undocumented students. In los Estado de Texas, all students meeting the guidelines of residency shall qualify - in Texas - qualify for state financial programs. The State of Washington allows students granted Deferred Action to child -- for Childhood Arrival status to apply for and receive State Needs {sic} (Need) Grant. So when we're here to bring Illinois together, I'm not concerned about Iowa and -- and my neighbors in Indiana, who, by the way, trash us every day, just go to any conference. We're here to bring Illinois together and divisive comments will only take us backwards. I'm moving into a Jetson system not into the Flintstones. So let's be very clear, as a non-affected U.S.-born Puerto Rican from the City of Newark, New Jersey, my community is only here by the power of affirmative action on a Commonwealth that was created - that today sits in Washington and no one wants to claim it - the oldest colony in America, in the Western Hemisphere, if not in the world. So you want to talk immigration, you want to talk international politics, well, bring your lunch. You're talking about fifteen hundred of your kids, our citizens. And as a former parole agent, I'm not concerned about them. As a former child welfare specialist, we service them. These are human rights. So let's keep our divisive politics out of this about what your policies are in the Presidential or immigration. You know, as I'm listening to this debate, I -- I find myself thinking about how often in our public discourse we hear people say, "Oh, the sky is falling in Illinois because our population is dropping or our population isn't growing fast enough". We hear that all the time. And there's a reason that people have that set of concerns and that reason is that when people come here our life improves. When people cross our State lines and choose to make their home here, life here gets better. And that's true if they come from Kenosha, it's true if they come from Davenport, if they come from St. Louis, if they come from Paducah, if they come from Gary, if they come from the east coast or the west coast or the south, if they come from Mexico, if they come from South America, or Poland, or elsewhere in Eastern Europe, 109  STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 102nd Legislative Day 4/20/2016 or in Asia, or in Africa. It makes our life better. It makes our life -- culturally richer and more enjoyable, but it also makes our economy more vibrant. In order for that second part of the bargain to hold true, the economic growth that comes from immigration, we have to make educational opportunity available to those who come through -- across our borders. And we're giving up on that opportunity if we don't pass this bill. We're saying, "Well, it's great, we're for it, if you come here under certain circumstances, if you come here from certain parts of the world; but under other circumstances, never mind, we don't want to benefit economically as a State". That's a bad economic bargain. It's unnecessary, it's unwise, in addition to obviously being unfair to the young people who are being locked out. So I think this bill is an important statement about who we are as a people and what kind of State we believe ourselves to be. I also think it's a very sensible economic step that will help our future financially. I strongly urge an Aye vote.

All we -- all this bill is doing is giving the opportunity to the universities to make the decision of any dollars that are there, that these young -- this one percent, fifteen hundred students that qualify - not that all will take advantage of it - but there's at least one percent of the overall university students are the ones that are trying to just at least be able to compete. We're not taking anything away from anyone. They just have the ability to compete in the process and it's up to the universities to decide, you know, if they want to be able to give a stipend, a waiver, some kind of financial help to the student. You know, we have some great students who are 4.0 averages. These are geniuses that we want to be able to keep here, graduate, and they can work here in our great State of Illinois. So all I'm asking, for Aye vote. Do it for the students out there that really need to be able to continue with school. As you know, all these students -- many of the students that came down are -- are -- are American students, U.S. -- U.S. citizen students who, right now, are in favor of this. They want to be with their -- with their fellow students and -- and fight this fight for them, because they know it's not -- it's not fair. Allows the Board of Trustees of the University to sell, lease, or transfer property and all the property they sell goes to, one hundred percent, scholarships.
