He's a senior at the Islamic Foundation School, where he is an Illinois State Scholar, who participates in the National Honor Society, the Illinois Council of Teachers of Mathematics, Model United Nations, and the debate club. Sultan has completed his memorization of the Holy Qur'an and was the first graduate of the memorization program at Islamic Foundation. His activities range from shadowing doctors to volunteering at nursing homes to prepare for the goal of becoming a physician. Sultan enjoys reading, playing sports, and giving time to his family and local mosque. Today, as a Senate Page, he hopes to advance his knowledge of politics and gain perspective on how to create a better sociopolitical impact for himself and his community.

He's also a resident of Bridgeview. He's an honor student there. Ridwan is -- is very active in his community and -- in addition to being an academic achiever. He does a lot of volunteer work at hospitals, research centers, and -- and soup kitchens around the Southwest suburbs. Ladies and Gentlemen, in the President's Gallery, 5 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 101st Legislative Day 4/19/2016 I'm honored today to have two different sporting champions from my district, from Mt. Zion. One is wrestling and one is for volleyball. On March 12th, the Mt. Zion Jr. High Wrestling Team won its second State title - two State titles. The first was Lukas Eagle, who wrestled in the 126 (lb.) weight class and was with a final record of 40 and 0, and the second was Brody Norman, who wrestled 85 and his final record was 39 and 2. We also are lucky -- and -- and if the wrestlers would stand, please. And then, also, they are joined by the Mt. Zion Girls' Volleyball Team. And, ladies, please rise. The Mt. Zion seventh-grade Girls' Volleyball Team has also won the Class 7-4A Championship. They ended their season 27 and 1 on March 15th. And the Mt. Zion Braves are coached by Miss Kyla -- Kayla -- Kyla, excuse me, I apologize, Skinner and Alicia Thompson. They have long and impressive biographies, so I won't read them in their entirety, but -- but I want to just let you get to briefly know these two young women. Emaan Arif comes from Lombard. She's a junior attending the Islamic Foundation School. She's done work with 9 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 101st Legislative Day 4/19/2016 National Honor Society, Robotics, UNICEF. She holds workshops to raise awareness within youth on social, political, and economic matters, and her hopes are to one day go to UIC and enter the field of medicine, so let that's be -- let that be an admonition to us to ensure that UIC is properly funded. And here, sitting to my right, we have Noor Alyousef, who's a resident of Lincolnwood and also a student, a junior, at the Islamic Foundation School, an honor student. She's involved academically and socially in a number of community organizations, including the Muslim American Society. She also hopes to go into medicine, starting at UIC, and eventually pursuing a career in Pediatric Anesthesiology. Please join me in welcoming these two impressive young women.

13 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 101st Legislative Day 4/19/2016 Ladies and Gentlemen of the Illinois Senate, it's my great pleasure to introduce to you Pastor Corey Brooks from Chicago. Many of you may have heard of him, having been written up as the "rooftop pastor" in Chicago. This crazy guy, on the south side of Chicago -- across the street from his church there was a motel, which was a center for drugs and prostitution. This guy literally climbed up on the roof of the motel and said, "I'm staying here until people donate enough money to buy this motel and tear it down." Pastor Brooks was on the roof for three months - December, January and February in Chicago - without even coming down to go to the bathroom, but he succeeded. People donated enough money. The building has been torn down. It's now a vacant parking lot and he's now attempting to raise money to build a community development center to get kids off the street, to keep 'em out of gangs, and keep 'em out of drugs. This is clearly not a Republican issue, it's not a Democrat issue - it's for the good of the kids in Chicago. He's having a gala on May 27th in Chicago. I hope those of you who are able, will consider joining and will do anything you can to help raise funds for this very good cause to keep kids out of violence and out of drugs and out of gangs in Chicago. Senate Bill 2221 is an initiative of Cook County Sheriff Tom Dart, who's worked on it in cooperation with the Cook County State's Attorney's Office, and it seeks to close a little bit of a loophole that exists right now in tracking DNA evidence when the State Police crime lab has established a link between a sample and -- a DNA sample from a rape kit and an actual profile of a known suspect that's in their DNA database. A couple weeks ago, the Sun-Times did an extensive report on this problem. What this will do is ensure that, in addition to alerting the police department that has sent in the sample, State Police will also alert the State's Attorney's office and then that way we'll make sure the information is followed up on. There have been a few cases in Cook County where the State Police has found a -- a -- a potential match and the department, the investigating department, has not followed up on that lead. Yes, thank you, Mr. Chair {sic}, Members of the Senate. Senate Bill 2228 is very similar to a bill that had passed both the House and the Senate last year. The Governor had done amendatory vetoes. This bill now incorporates all of the Governor's amendatory vetoes. It is providing civil enforcement of marijuana. And it provides that the possession of ten grams or less of cannabis is a civil violation punishable by a fine of a hundred to two hundred dollars. For individuals in possession of ten grams or less of cannabis, it requires law enforcement and circuit court clerks to expunge records of civil violation on or before January 1st, and it also reduces and restructures other penalties for cannabis possession. It -- this Senate bill also creates a presumption that an individual was driving under the influence of cannabis if that person has ten nanograms of THC per milliliter in saliva or five nanograms in -- in his blood. That hasn't existed in law before. So, we do have as proponents of this now the State's Attorneys, the Cook County -- Cook County Public Defender, as well as a number of other groups, Cook County State's Attorneys as well. I think what we're trying to do here is really going a long way towards more consistent enforcement of cannabis laws across the State and making sure that all people are sort of treated fairly and equitably, which has not always been the case to date. Now I heard you right at the very end of the presentation of your bill -- of this bill say that one of the troublesome pieces of drug enforcement policy in this State with regards to cannabis has been that people are treated differently from jurisdiction to jurisdiction. Did I hear you correctly?

Yes, and this is going to -- this provides a uniform approach, although there's still local -- still there's an ability for locals, as you know, to make their own distinctions on how they want to do this by -- you know, the Supreme Court rules allow for the enforcement of ordinances and tickets done differently at different local levels. So there'll still be that discretion, but it provides a uniform approach unless a local -- local ordinance or ticket approach and judicial circuit decides to do something different.

Well, Senator, that was good, because, all in the same answer, you clarified the importance of having a statewide standard and, at the very same time and with equal force, reinforced the importance of local control. And I want to try to bring those two together a little bit. What language is in the bill that makes it clear that local jurisdictions can treat offenders differently with regards to -- with regards to how many times someone can go through this process and simply pay a fine and suffer no more ramifications? What's the language in the bill that makes it clear that locals can treat people who've been through this process the third or fourth or fifth time differently than people who've been through it the first time?

What is different and what -- where the Supreme Court rules give you flexibility is how you enforce tickets or ordinances locally. So, any municipality can - they have the discretion if they want - make somebody come before a judge to say you need to go to a substance use treatment. There's that flexibility by the Supreme Court rules to be able to do that at the local level.

Senator Steans, I'm looking at page 173 of the bill. Your bill on that page, beginning with line 13, says civil law violation punishable by -- it is a civil law violation punishable by a minimum fine of one hundred and a maximum fine by {sic} two hundred. The proceeds of the fine shall be payable to the circuit -- the clerk of the circuit court. Within ten {sic} (30) days after the deposit of the fine, the clerk shall -- shall distribute the proceeds of the fine as follows. Where in this language does it say that local courts can say to an offender, no, this is the second, or the third, or the fourth time you've been through that? Where's the deference to the Supreme Court rule to which you refer do that? Because -- to be honest with you -- now, wait, Senator, because I'm -- I've been an attorney for twenty-some years and I've never, ever heard of a Supreme Court rule that could instruct the law on something as big as whether or not it is -- becomes a criminal offense if it's the second or third time we've been through that. Well, now that I can -- have a chance to answer the question, if you look at page 176, Section 17.5, local ordinance. "The provisions of any ordinance enacted by any municipality or unit of local government which imposes a fine upon cannabis other than as defined in this Act are not invalidated or affected by this Act.

Thank you, Mr. President. Senator, there is a difference between a State civil offense and an ordinance violation. You're talking about two different issues here. An ordinance -- I agree with you on the ordinance violation, but that's not what you're creating in this bill. What you're creating in this bill is -- by decriminalizing the possession of marijuana in small amounts, you're creating a civil offense in State statute, not by ordinance. So, let me -- I want you to finish. So, understanding now that we're -- those are two different things, I want you to tell me, in the creation of the civil offense, where does it say in here that locals have the ability after the second offense, or the third, or the fourth, to require something more than just a fine? Where is that language in here?

That's true, but they are still -- you're -- again, you're creating something in State statute that's a civil offense and the bill in the civil offense says that whether you go through this process once or twice or fifteen times, they're still going to pay a fine between a hundred and two hundred bucks, and no judge, no judge, in -- in -- in punishing someone under the State civil offense, can order them to do any drug -- drug rehabilitation, no community work service. The State court doesn't have that authority under this bill, Senator. So, what -- you know what, Mr. President, why don't I just go to the bill.

Thank you very much, Mr. President. I -- and thank you for your indulgence. There is an amendment out there, Ladies and Gentlemen, and we -- it was offered in this Chamber and it will be offered in the -- in the House if this passes, to put some cap on how many times someone possesses cannabis in this amount and can simply do the same thing over and over and over and over again. And the argument by the proponents here is we need to have a statewide standard, but, oh, by the way, the locals have flexibility. Well, we need to pick one or the other. Either it's important to have the statewide standard or it's important to let the locals decide how these people get punished, but you can't 58 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 101st Legislative Day 4/19/2016 talk about those in the same breath and say both are good. There needs to be a limit on how many times someone goes through this process. And if I might, Mr. President, like we discussed before, in my district, these cases, these small cases, they are prosecuted, but unlike some people would have you believe, they're not hung with a felony or a misdemeanor and they're not going to jail like some of these proponents claim. They're being brought before a judge and they're being evaluated, because many of these kids, who are college-aged kids, they have a drug problem. They have a drug problem. And if you think that young people who have a drug problem should have the opportunity for treatment, then this is a bad bill, because this bill says, you know what, if you or you can get your parents to write a two hundred check, that's all you need to do, and the result of that will be young people in certain parts of the State not getting the drug treatment that they need. Absolutely. The bill simply forecloses the possibility of misdemeanor criminal charges under State law for possession of less than ten grams of cannabis. It grants wide latitude to local governments to enact their own enforcement parameters. Very cognizant of the concerns that had been raised by the previous speaker and that's why we added this. This had been put into the bill.

Yes. Again, local governments have the ability to do that now, frankly, and prosecutors may collaborate with local government units to create an incentive for treatment, such as counseling or community service, in lieu of a fine. That's totally available as an option under this bill.

And my last question is, would you -- Senator, would you briefly, from your analysis, describe why the State's Attorneys of Illinois have come out in favor of this bill?

It -- it provides for clear ability to now test for the presence of cannabis. There's new saliva tests that are available now that are not, under law, able to be used. We allow -- allowing for that now, so you can do both roadside testing and it collects -- creates clear parameters of when somebody is under the influence, which we don't have now, quite frankly. It also sets levels for the blood test. And we've -- this is more conservative than what had passed both Chambers last year with the incorporation of the amendatory vetoes that the Governor had made.

61 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 101st Legislative Day 4/19/2016 In other words, this provides a clear, objective test of impairment to assist the State's Attorney to prove impairment in court without -- without what is occurring now, the haphazard way of showing actual impairment, which is very difficult to do after the fact. Currently in the law, a trace of marijuana, which is in the bloodstream for a month or more, is cause to revoke one's driver's license. It's so vague it becomes, in effect, unenforceable. This gives the State's Attorneys of Illinois the option and the tools necessary to bring safety to our roads from those who abuse marijuana and other drugs. Is that correct?

How are -- how -- how are they going to determine that if it's not alcohol, if it wasn't the makeup and wasn't a burger, that this was high THC levels that break the law?

But, you know, currently there's not clear standards for this right now on how to do this and particularly with, you know, now medical marijuana available here, you have any trace, that can get you driving under the influence even if that was something that you had ingested, you know, weeks before. But let's just say a medium-sized joint. How -- how many is that? I'm sure you've answered this before.

The truth of it's, it's at least twenty, and the truth is that law enforcement does not have the ability to determine whether the THC levels are putting that person at a level of impairment that he is a danger to the public. They don't have -- they don't have -- practically, can they? They can if they have the saliva test, if they are able to take a blood test. If they are able, yes, they can, but, practically today, they can't. You know, also, this is -- this is not par with the way we treat other people when they have a open container of alcohol. You take a twenty-year- old at one of the universities, and he can be charged with a Class A misdemeanor and up to twenty-five hundred dollars, where his younger brother, who is fourteen, can be fined twelve times for the same amount. And you don't think he's got a drug problem? You don't think that leaning towards marijuana because he only gets a fine doesn't put him in a position of an addiction that could lead to death in the future? Yes, it does, and we all know that. When we had the -- when we've -- we -- you know, we -- we've had these opiate, heroin, you know, hearings throughout the State for years now. Are there other problems with opiates? Yes, there are. There's overprescribing problems with our physicians. But by saying that this is only -- it's just -- it's no big deal, your twenty joints is okay, you can continue that lifestyle - for us to say that and say we're only going to fine you two hundred bucks is not much of a statement about how we care and how much we care about our young people today. You know, we don't -- just because you have a picture of some old hippie sitting in the back of his house in his privacy and doing marijuana, this is not the same. You're saying to young people, you can't handle life and this is a way you're -- this is a way you overcome it. This is a wrong message to send to our young people. This is a bad bill. It's not on parity with the way we deal with alcohol for sure and I don't see -- you know, in the midst of what we're confronted with in this State, this is your cornerstone legislation? We should be embarrassed. I urge a No vote.

At the same time, we were very careful to make sure we preserve the ability of local folks, local municipalities, to implement ordinances if they so choose to ensure that people can come in front of a judge if so desired, get assigned to treatment if needed. That ability and that flexibility is still maintained in this law. I think it was very carefully crafted. So these are devices that essentially impersonate a cell phone tower and, therefore, they're incredibly powerful surveillance tools. If I -- I use one of these -- if I were to place one of these in this Senate Chamber, it would essentially trick all of your cell phones into believing that it was a cell phone tower and then be able to communicate with them. So, for instance, it could -- you know, pull text messages off your phones, push malware on to your phone, drain your phone's battery, figure out a log of your calls, as well as your location and so forth. The purpose of this bill, which is a negotiated bill and now a bill, I believe, without opposition, is to put some guardrails around law enforcement use of these cell site 72 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 101st Legislative Day 4/19/2016 simulators. It does a few things. Number one, it says they should be used for location surveillance only, not to drain telephone batteries and so forth. Number two, they should be used for location surveillance only with a court order. And number three, if, in the process of using one of these pursuant to such a court order, a non-target's data is caught up, that data needs to be deleted.
