Senate Joint Resolution 48, otherwise known as the Witczak brother resolution, declares that seven Witczak brothers severed honorably in the Armed Forces, with five during World War II and two in the Korean War. They're lifelong residents of LaSalle County, grew up during the Great Depression, and exemplify a great commitment to their country. The Witczak family deserves the utmost honor and respect. Seven bothers from the Illinois Valley all serving in World War II or the Korean War are a unique story that merits recognition. Naming this section of Route 251 is a small token of our appreciation for their service and sacrifice, and a way for our communities to remember them for future generations. "All my brothers fought so bravely, so many battles", Anthony Witczak said, of Peru. "This is a great honor to have the road named after my family. My brothers, wherever they are, appreciate this." The seven sons of Thomas and Clara served in different capacities of the U.S. military that spanned from World War II and Korea. Joseph Witczak, the first brother to enlist, was wounded during operations for the U.S. Army in the Pacific Theatre. John Witczak and Casmir Maurer, the adopted son of Thomas and Clara, both served in the U.S. Army, Pacific Theatre. Anthony Witczak, a sailor in the U.S. Army {sic} (Navy) during World War II, also served in the Pacific and is the last surviving brother. Francis Witczak was the only member of the family to serve in -- in Germany for the Army during World War II. Five years after the Second World War, the U.S. began operations in Korea and the last two sons of Thomas and Clara heard the call of {sic} service. Both Thomas Witczak and Edward Witczak, Sr., served in the U.S. Army during the Korean War. The seven brothers served the United States a combined eighteen years. Senator, what is a pirogue?

I'm glad you asked. A pirogue is a narrow canoe that was built by the Illini by hollowing out a tree stump. It can be up to fifty feet long. The Illini and other Native American tribes in Illinois built and used these boats to navigate Illinois waterways. They were so resourceful in the -- the design of this canoe that forms of the pirogue are still in use today.

I -- I congratulate the distinguished Senator from the City of Chicago for sponsoring this bill which really has to do with downstate rivers. And I want to call to his attention the fact that a similar craft was used in 1672 by a Jesuit named Jacques Marquette, who was the earliest mapmaker of the Illinois territory. Father Marquette and his Jesuits came here to found reductions, they called them, similar to the Paraguay reductions, which were independent cities dominated and controlled by Indian tribes. The French king was paid off by the fur traders and he paid off the Pope at that time - I hate to say it. My Irish mother would roll over in her grave if she knew I was saying the Pope actually was influenced by that kind of a bribe. And the Pope ordered the Jesuits to leave North America as a result of those activities of the Jesuits. This bill fixes a mistake that was created inadvertently by increased minimum liability insurance coverage for school bus operators that prevented many operators from actually becoming able to be licensed by the Secretary of State. As a result of Public Act 97-1078, bus driver permits are required to carry an increased minimum insurance of two million, but due to the Secretary of State's two-year licensing for school bus permits, new licenses did not require the increased coverage until January 1st of '16. This two-million-dollar minimum has been interpreted to mean a two-million-dollar primary policy, which is rare and extremely expensive, as opposed to common practice of combining primary policy as well as umbrella to meet the limit. This language allows school bus operations to continue current practice by allowing primary coverage as well as the umbrella policy to satisfy the minimum liability requirements. This language is intended to provide flexibility and affordability to reach the two-million-dollar minimum limit. I'm not aware of any opposition to this bill.

I just want to start by saying I appreciate the -- all the debate when I 42 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 5/18/2016 initially called the bill. I understand where everyone's coming from, but I firmly believe this is the right thing to do. We're trying to prevent our youth from starting smoking. We know that if we raise to twenty-one, that fourteen- and sixteen-year-olds are not in the same social setting as twenty-one-year-olds, so that will be a barrier for younger -- our younger children to start smoking. We also know statistically if people don't start smoking by the time they're twenty-one, it's very unlikely that they will start smoking at all, which is the object of the bill. I said before it's very costly to the private citizen. It's costly to the State of Illinois. It's harmful. That is -- indisputable evidence that smoking is harmful to you, your organs, and will kill you. I have with me a pack of cigarettes that's warning -- got a warning given by the Surgeon General that "Smoking Causes Lung Cancer, Heart Disease, Emphysema, and May Complicate Pregnancy". Regarding the military - and I appreciate the argument on that as well - we're putting our military and our men and women in harm's way. Why would we want them to -- hurt them more by allowing them to use a -- a harmful product? So I'm -- I'm asking for your sincere consideration. This bill may not stop all our young from starting, but if we can stop some - ten, twenty, hundreds - it's worth the -- the effort and you can go home and tell your constituents that you -- actually, by voting on this bill, you've saved someone's life. You've saved someone money and you saved the State money. I'd appreciate your Aye votes.

Today we have Senate Bill -- I mean, House Bill 5736, which amends 44 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 5/18/2016 the Covering ALL KIDS Health Insurance Act and extends the sunset date from July 1st, 2016, to October 2019. As you know, this program -- this program has been set to expire now and we're trying to make sure that the federal match that we get for this -- for the ALL KIDS continues there. As you know, we receive annually about forty million dollars on an annual basis on the ALL KIDS program. Right now there's over forty thousand children that will be affected if this bill doesn't -- if we don't extend the sunset. And I'll be happy to answer any questions.

Senator, I just -- let me make sure I get this fully understood and maybe this will help some of our Members understand this process as well. So this is -- this is the -- under the ALL KIDS program, this is those that are above the Medicaid level and this is the -- so the population that, in the past, we did this as a means for people who are transitioning from welfare to work. These are going to be lower to moderate income levels, where then these children would get help in maintaining Medicaid coverage; however, based at the higher income levels of this, they would actually be paying a premium as well. Is that correct?
PRESIDING OFFICER: (SENATOR LIGHTFORD) 45 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 5/18/2016 Senator Martinez.
Thank you. Thank you, Senator, for that question. The program provides health care coverage to children through the age of eighteen that right now are not eligible for the health care plan under the Public Aid or CHIP and whose family income is between two -- two hundred and nine to three hundred eighteen percent of the federal poverty level. All families covered under this program are required to pay a monthly premium of forty dollars for one child and eighty dollars for two. Again, the federal match under this program is eighty-eight percent until 2019. And we are talking about -- about close to forty thousand children right now that are covered under the program.
PRESIDING OFFICER: (SENATOR LIGHTFORD) Senator Syverson.
Thank you. And for the benefit, I guess, maybe of some of our Members if they're not familiar with it, one of the areas of concern that has been raised is -- is -- is built into this legislation is that there are about seven hundred and fifty individuals who would be undocumented that would actually qualify to be under this plan. And -- but, I guess, for our Members to understand, when we talk about a certain population that we want to have developing a pathway to citizenship, for these seven hundred and fifty-six people to be on this plan, that means their parents have to be actually working, paying taxes, because they are above the poverty level, so there has to be reported income. So these are working families that are paying State and federal taxes. In addition, they're willing to pay premiums for coverage. 46 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 5/18/2016 So a totally different scenario than if you're talking about covering undocumenteds under the regular Medicaid program, which is totally different from what this is. So am I explaining that right for this population?

Thank you. You are correct, Senator Syverson. There's only seven hundred and fifty-three children that right now are undocumented that -- whose families qualify and are paying into the program to make sure their children are covered. Out of that -- out of the four -- forty thousand children, only seven hundred and fifty-three are undocumented, but families that are paying income tax, that are paying their taxes, that are actually paying into the program, so it's not a free program. These are -- these are children that don't qualify because they're -- they're in an income that's higher than the regular Public Aid Code, so they are actually covered, but they actually pay into the program.

Thank you. Just to wrap it up, I would urge our Members to support this legislation and I know it may get confusing when we're talking about covering undocumented under the Medicaid program or non-Medicaid program. But this is not the Medicaid program. That's a discussion for another time. This is for individuals that all of us who have talked about the concept of pathways to citizenship for certain individuals, these -- this small population that we're talking about are people who are working, 47 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 5/18/2016 paying taxes, and willing to pay a premium to get this coverage. And so I would urge support for this legislation and thank you for bringing it forward.

Thank you, Madam President. This has been a very successful program here in Illinois. I really believe that when we talk about protecting children and their health care, this is an important bill. The fact that we're also getting a federal match of over forty million dollars annually to Illinois, it's important during these times right now. Like I said, the -- the -- the undocumented amount is just a small amount of children. But, you know what, I think all children, regardless of their status, should be covered because, again, these are the children that go to our schools, that share everything with other children. I think it's important that we keep them -- keep 'em healthy, and they actually have the ability to be able to pay for this program, because they do not fall under the Public Aid Code. So I urge an Aye vote. Let's do it for the children. I want to see fifty -- fifty-nine votes up there. I think it's very important for our children. Thank you very much.

This is a day about Indians and tribes and I -- I got a settlement of Indians in southern Illinois that's been down here 50 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 5/18/2016 since the 1800s. They would like to have a name - so their name is "Vinyard Indian Settlement" - so they can have State recognition. And in this law is -- a lot of Indians think, you know, they're going to have a casino. There -- there's no casino in this bill. It's in there where they can't have a casino. They just want to be recognized and they're liable {sic} for some federal funds. This came out of the Senate {sic} 113 to nothing. We had an amendment put on it. I don't think there's any issues or anybody is -- has a problem now.

Isn't so much of what goes on here in Springfield money? This gives them a chance to compete for other grants that are out there - federal grants, primarily. So why should we worry about it? It's not State dollars. It's federal taxpayer dollars. It's not us. Let's pay -- let them have their piece of the pie. Ladies and Gentlemen, we have to 52 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 5/18/2016 look after taxpayer dollars.
