12 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 118th Legislative Day 5/24/2016 Thank you very much, Mr. President. House Bill 4627 is actually an initiative of a situation that occurred to one of my constituents who was a returning veteran and was prohibited from registering for the next semester's classes because he was still in active duty, even though he would've returned home and been able to start that semester on time. So what this legislation does, it amends the Acts relating to public universities and it requires that each public State university establish an admissions process in which honorably discharged veterans are permitted to submit an application for admission to the university as a freshman student enrolling in the spring semester if the veteran was on active duty during the fall semester. It's a real simple piece of legislation. Most of our public university honor this process. There was just one specific university that prohibited this measure and we just want to make sure that we're sending a -- sending a message and creating in statute that all of our State universities must admit our veterans who are returning home and want to further their education. I'd be happy to answer any questions.

Many of you may or may not know, I grew up on a small farm and was proud -- a proud member of the 4-H as well. Today, we'd like to welcome over forty 4-H members from across Illinois who are attending the University of Illinois Extension 4-H Legislative Connection event being held today and tomorrow at the Capitol. These youth will be visiting Members of the Senate and represent the Illinois 4-H Youth 15 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 118th Legislative Day 5/24/2016 Leadership -- Team Leadership {sic} (Leadership Team) and Speaking for Illinois 4-H program. The teens are from twenty-one different counties throughout the State, representing nearly two-hundred thousand 4-H participants in a hundred and two counties. They represent a huge variety of Illinois 4-H programs - from both urban and rural programming efforts, leadership programs such as Teens as Teachers, and are involved in many different 4-H projects from child development to livestock, the arts to shooting sports, foods and nutrition to leadership, and many other subjects. It provides procedures for access and control of digital assets of persons who are deceased, disabled, or subject to the terms of a trust. It provides for planning of management of disposition of digital assets as an individual would plan for the disposition of real and personal property. It also provides legally enforceable directions for disposition of digital assets in a will, trust, power of attorney, or other written record. I would be remiss if I -- I did not thank Senator Mike Hastings, who brought this bill last year. It passed uniform -- 57 to nothing and did not get a -- it didn't get anywhere in the House of Representatives, but this is his initiative and I want to thank him for his work on it. This bill allows the Department of Central Management Services to conduct an annual energy efficiency audit of State-owned real property, to rank State-owned real property according to their energy efficiency, and encourage energy efficiency audits of State-owned real properties based on those rankings. And I think the -- the best part about this bill is it incentivize agencies to be more energy conscious in how they use their, you know, their energy. The cost savings from any improvements or any conservation measures, the -- the agency may be able to retain a certain amount of the savings that is realized. So it actually incentivizes State agencies to act in a more environmentally friendly nature. Thank you, Mr. President.

This bill creates the Land Trust 31 STATE OF ILLINOIS 99th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 118th Legislative Day 5/24/2016 Beneficiary Rights Act, which provides that rights held by beneficiaries in a land trust will not be affected if a new trustee replaces the current trustee, as long as the beneficiaries remain the same. In addition, this bill allows for a prior trustee of a land trust to bring suit or have suit brought against them for matters involving the trust. This law established by practice, in reality, has always been consistent with this legislation, and this proposed legislation is simply codifying existing law and will serve to protect the land beneficiary in the past, present, and future. As a parent of a student, this independent board will give -- gives them just what that is, an opinion. It gives an opportunity to go back and oppose the ruling that was made by the school board.

Finally, the bill provides a -- that the court shall order expungement of juvenile court and law enforcement records if the person was arrested and not charged; charged, but the charges were dismissed; charged, but found not delinquent; placed on supervision, which was successfully terminated; or adjudicated for a petty offense.

Unfortunately, many of our school districts are utilizing this availability to transfer -- to levy high in one fund and transfer those moneys into another fund to avoid going to referendum and asking the taxpayers for additional taxing authority. I just caution you, when you look at this legislation, that you may have to go home and look at your constituents and explain to them perhaps why you raised their taxes.
