Current… under current law, there's a tax sale that's supposed to take place on Monday. But what… what this Amendment would do it… extends the time for approximately four months to give individuals additional time to redeem those taxes. So, I'd actually adopt the Amendment and debate it on Third."

Currently, there is a tax sale that's supposed to happen on April 3rd. "…if you don't… listen, I… I am trying to make sure the property tax owners that I represent, the owners who have come to me and asked that we do something. That property tax owners… that homeowners… that community leaders have asked that we do something. My job, as their State Representative, is to respond to that and to act accordingly. That's what this Bill does."

So, I think the explanation here that… from the previous speaker… the explanation you gave where we are delaying… this Bill delays the tax sale from April… the March-April period to the August-September period, correct?"

"Yeah. Representative, correct. That's correct. And I think it's important to note that this is consistent with the way the tax sale and the time frame was previously before we took action as a General Assembly. So, this is… so, all of the… the angst about this being additional taxes and fees. There are always going to be taxes and fees that are placed on these… on these tax sales. So, it's… it will not happen. There's not a chance… there's not a situation where these… these… a buyer will come in, buy the taxes and then not charge any fees. What is also important to note is that after two years of the tax sale the buyer can then put the homeowner out of their home. So, there is a… there is a… I repeated this story in Revenue Committee yesterday. There are… there are thousands of these cases, but there is one in particular. There is a senior citizen who has… who owes… who has purchased their home. Their home is fully paid for. She recently had a stroke. Her taxes are due to be sold for her owing $1,300. We have to make sure that we are responding to and protecting those taxpayers." Harris, D.: "But… and… but I'm not sure how this Bill does that. I mean, that… that homeowner has two years after the tax sale in which to pay the taxes, correct? Is that correct?"

"There are Treasurer fees. There are buyer fees. All of those fees are accruing." Harris, D.: "I understand there…"

"So, it's not like the…" Harris, D.: "I understand there…"

"…there will not be fees." Harris, D.: "I understand there may be additional fees, but when you talk about putting…"

"But they… yes, they will have two years." Harris, D.: "…when you're putting people… when you're talking about putting people out of the home, they do have two years in which to make good and pay the taxes and fees, correct?"

"That is correct." Harris, D.: "Okay. So, how do you answer the question though that or the… the issue that was brought up earlier that if you extend it out each… each…"

Harris, D.: "How do you… how do you issue… or how do you handle the issue that was brought up previously or mentioned previously that each month that goes by 1.5 percent… 1.5 percent is additionally charged to that homeowner. "I am." Harris, D.: "I should… I should shut…"

"Ladies and Gentlemen, please, it's going to be a very long afternoon if we can't keep the noise down in the chamber." Harris, D.: "I'll try to get closer to the microphone. How… how do you handle… excuse me… how do you address the issue that was brought up earlier that each month that goes by, the more you push it out, 1.5 percent interest is added to the tax bill? Conceivably pushing it out, if you go 12 months, you're talking about an 18 percent."

"So… so, Representative, although there are many instances where the initial year it's zero percent, those sac… those fees can grow to as high as 36 percent for subsequent years. But the point is, what we are trying to make sure is that these individuals have the additional time and this is not inconsistent with the way the law was worked previously." Harris, D.: "It is very dif…"

"It is consistent with the way that we have… we use it… we've executed these tax sales in the past." Harris, D.: "Right. But it is… it is different from how the other counties handle it, correct?"

And… and again, I'm coming back. I'm not sure I understand what… we don't want people to lose their homes, got it, but I'm not sure I understand what the protection is in this Bill to keep people from losing their homes. If whether the tax sale occurs in March or the tax sale occurs in August or September, they have the opportunity to make the tax payments whether it's to Cook County or to the tax buyer. So, I'm not sure I understand the protection that you're talking about that exists in this Bill."

"Well… well, first, it gives them additional time. Let's… let's start there. But then, after that, the homeowner… the property owner has the… has the time to pay for partial… make partial payments before the check… before taxes are purchased or sold if it's through the county." Harris, D.: "Okay."

"If those… if those taxes are then purchased by a tax purchaser that has to be redeemed at 100 percent. There is no partial payment. It requires full payment to the… put to the tax buyer before those property taxes can be redeemed." Harris, D.: "Well, I appreciate it. And to the Bill, just briefly, Ladies and Gentlemen. I understand what the Gentleman's trying to do. I'm not sure I understand that the protection's there that he really wants to get into the law. But the other thing is that the previous speaker made reference to is that we're talking about something which occurs in Cook County… and this is only a Cook County-related Bill… on Monday, Monday, April 3. So, this Bill has to get from here, get to the Senate, get signed by the Governor in order for it to take effect. So, the Bill looks good, but in the reality and I don't think it can be enacted between now and Monday. I'm not sure that we want to put this out of here in the form that it's in right now. "Thank you, Speaker and Members of the House. I think it's important to know what happens to somebody who is in the situation where the taxes aren't paid and there may be a tax sale. First of all, the suggestion is that the tax buyers get nothing whereas the individual is going to owe one and a half percent to the county for whatever delay there might be. The reality is that the tax buyers not only can be charging well above zero percent interest, they automatically escalate the interest as the debt increases. Second, there are significant taxes and fees that are charged to the homeowner, at the end of the day, by law the clerk has to charge a $37 prior year open tax search. The Treasurer has to charge a hundred dollar sale and error fee. The buyer has to pay $494 for a court filing cost. There are many others I have not mentioned, but the point is all of these have to be paid by the individual trying to get his or her home back. So, the reason for the delay is, first of all, many people will pay up if they have a little extra time. And second, if the sale goes forward, people are socked not only with the old taxes but with very significant costs that are associated with buying their property back. So, I support this Bill. It's a good Bill. I do know that there are two property tax sales at least in Cook County and I'm assuming in the remainder of the state that there's a scavenger sale and also the annual sale. Does your Bill address the annual sale only or does it address the scavenger sale as well?"

"Okay. So, that still gives the opportunity if for some reason there's some issues about timing, I think you have an excellent Bill. I fully support it. As far as the annual sale, we have that immediacy going on. And I'm not sure exactly when the scavenger sale comes to fruition, but I think it'll be important for us to be prepared for that as well. And I urge an 'aye' vote on this."

I would ask, should we wait until… 'til the deadline is passed and act… and act? The fact is, regardless of what the Senate does, we have to act now. We have to act now to protect homeowners; we have to act now to protect property owners. There are fees that are paid initially by tax buyers, but those are going to be paid… they can be passed on to tax… to tax those homeowners. It's the clerk's filing fee, $37; the certificate of purchase, $10; take notice and variable mailing costs, $10; certificate of deposit for redemption, $10; preparation for redemption of redemption bill, $3; fees paid to the Treasurer, $100 sale in error interest fund; $80 indemnity fund; $10 to the tax sale auto… for tax sale automation; $10 for publication; buyers' fees, $494 in court filing costs; $35 in petitions and on and on and on. The fact… we are trying to protect 50 thousand homeowners across Cook County who are going to have their property… could potentially lose their home because they have not paid their property taxes. We can… we could argue about the… the semantics or we can act. I would argue that it is up to us to act now. And I urge an 'aye' vote."

Also, it is important that this Bill has the language that nothing in this Section shall be construed to otherwise impair the ability of the licensee to enforce its rights under the mortgage with that mortgagor. Nothing in this Section shall be construed to otherwise impair the obligations of the mortgagor under the mortgage with this licensee. There… at this time, there's no objections to this Bill. Second part of the Bill is a follow-up to a Bill we passed last year the House… excuse me… Senate Bill 2861. 2861 established an Illinois Code of Military Justice, similar to the Federal Uniform Code of Military Justice at the national level for active duty soldiers, this Bill cleans up a Section of that. The third part of the Bill makes changes to what's known as the State Guard. I am now serving in the General Assembly. The program works. Individuals move off of it. It works so much and it is so effective that the Governor has actually started to change his mind about it. We… if we remember, on February 15, he stood in this very chamber and said and stated how he wanted to work toward child care. He shook my hand right at the end of the aisle when I said, I look forward to continuing to work with you. He also proposed, going back from 162 percent of the federal poverty level to the 185 percent level that it was at prior to his emergency order. And if I'm not mistaken, that proposed budget also included the idea of adding this population back. I'm simply stating that no other Governor should ever be able to shake it up where this population is not included."

First, it does something clerical. Today under the law, JCAR is supposed to do an audit of every agency's bills within every five-year period. We simply don't do it. We never have. Those of the Members of JCAR that are here on the floor know that well. There are no resources to do it and hasn't been done. And so, the Bill would say rather than requiring that it be done for every agency every… within every five-year period, it just 10000032.docx 74  STATE OF ILLINOIS 100th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 32nd Legislative Day 3/30/2017 simply says JCAR can do an audit of agency rules at its discretion after giving the agency notice. Second, over the years and this relates to both Democratic and Republican Governors… so I don't want my friends on the other side of the aisle to think that there's anything to do with the current Governor. So, this relates to both Democratic and Republican Governors, agencies that declared emergencies that they have created, in other words, a Bill might say to an agency you have to create rules within two years and a year and eleven months later the agency scrambles to do emergency rules. Now, what does that mean? Under the rules of JCAR, if an agency does the regular rulemaking process, it goes through a process that takes about three months or more where there's public comment, where there's debate, where there's a lot of discussion, can be public, can be private, a lot of negotiation. But when they issue an emergency rule, that emergency rule takes place immediately. You can't stop the emergency rule except some time later after it goes into effect without any public comment or any public debate. This Bill would simply say an agency can't create an emergency rule by simply letting time pass and making it into an emergency. The third thing the Bill does is probably the most important part of the Bill and that is… relates to the issue of rulemaking. There are agencies, and yes, both under this Governor and Democratic Governors who have simply bypassed the rulemaking process by creating policy within the agency, by creating a form, by setting up a fine to someone, by making all kinds of decisions, which are in fact rules, but they don't ever put into the rulemaking process. "JCAR is a separate agency under the General Assembly. And JCAR should have at its discretion the ability to or to not do audits of each state agency's rules. If your comment is that we should do them then someone should introduce a Bill to appropriate whatever amount of money it takes to cause that to happen. You've met the JCAR staff. They are overworked. We certainly could not put them about the business of auditing every state agency's rules every five years. And so, this doesn't say we won't do it. It says we have the discretion. It's not… you say the word 'may' is in there as if it has no meaning. Here it has meaning. It means we decide… 'may' do this." Wheeler, K.: "Right. "We have certainly tried to do that. As you know, on JCAR I'm the person that scrutinizes these emergency rules the most. And again, I'm referring to the Administrative Procedures Act… the specific Sections of the Administrative Procedures Act that sets forth the requirements of what an agency must show to properly invoke the emergency rulemaking authority. They have been unable to do that on countless occasions. Isn't that accurate?"
