The Higher Learning Commission sent a letter that was copied to all of us talking about concerns that they have for our funding of higher education. As you may know, the Higher Learning Commission is the gatekeeper for all colleges and universities in the state, and it serves as a gatekeeper for the federally recognized financial aid for students. Back in February, this Commission sent a letter to the Governor and to the Leadership in the House and the Senate talking about their concerns for our funding or lack of funding for higher education. They further documented in the letter this week that they've been monitoring our situation and it was observed increasing dire efforts of that... our lack of a budget is having on these institutions of higher learning. This will embody... this will embody a wide body of reforms that we have worked on to the civil asset forfeiture statutes in the state. This is an issue that has... garnered national attention. We have worked diligently with members of the law enforcement community, with the prosecutors. We've reached a consensus on this Bill. It has passed out of the Senate unanimously. It's coming back over here for Concurrence. The Bill will contain several key reforms to the way the civil asset forfeiture works. Right now, as you may or may not know, law enforcement can seize the property of anyone that they believe the property to be involved in the commission of a crime. And the burden of proof falls on the property owner to go before a judge and petition for the return of their property if they view that it was taken in error. So, our Bill contains a vast number of reforms. And what the Amendment does is adding one word back into the statute that was deleted in the original Bill, and that was the word 'honorable'. It's a technical change, it does not change the meaning of the Bill. And here's the sentence that we're talking about. Basically this is what it says. And just for... to the Bill... for the Body as a whole, those 100 votes were totally obviously bipartisan and we worked very hard to make sure that there was minimal impact on the pension fund. These... this is for a very small group of downstate firefighters, less than a dozen, that changed their careers in public safety from police to firefighters. It keeps them still... it puts them on Tier 2. So, it is not putting them to Tier 1. It allows them to be Tier 2 which was an agreed upon bipartisan agreement. It also goes forth and they must, and this is very important, they must have left the police departments or their police service in good standing. So, we're not taking any bad apples and rewarding them. We're simply realizing that many times men and women change their career paths, but they still are public servants. I think when we look back at the past votes we had 82 original 'yeses' on House Bill 688; on House Bill 618 we had 100 'yeses'. That's pretty darn close to unanimous 'yeses'. I don't see any reason why anyone would fail to concur on this Bill. And I certainly urge an 'aye' vote on this. This is something that we need to put in place. It is not going to do it. What we're doing is simply rewarding or actually making it equitable, it's not a reward, this is an earned... definitely an earned pension. These men and women pay into the pension funds. People that are on Tier 2 pay in much more than they will ever get out. And so, therefore, I certainly urge an 'aye' vote on this. Thank you."

It's a great talking point; I hear it constantly. I was one of the people that voted for the 2013 pension reform, not because I don't think people deserve their pension, but more because that I think the system itself is going to cave in out from underneath us if we don't do something to fix it. And there's a lot of people that went without pay for went... higher pay for those... the promise to those benefits. And so, if we don't do something... You know, what I heard a lot of and I will continue to talk about is... is one the statements that's being made out of the Governor's Office, and even by some of my colleagues on the other side of the aisle is, you know, it just doesn't go far enough. A Representative earlier asked us, have we seen... he was concerned that we hadn't seen are mail because there was a letter from the university Presidents or the universities' groups about how the university system is on life support. We've seen our mail; this is the mail we're getting. This is the mail we're getting, and every day a person from your side of the aisle has stood up and agreed with us. Well, take some action. Take some action as a caucus. Ask the Governor to stop the political games, ask the Governor if he truly wants a Special Session to be... to be... to have any type of good results, call a Leaders' meeting. He hasn't even asked the Leaders to meet to talk about the budget. How many days are we going to sit here before they sit down and begin to negotiate the budget in a bipartisan fashion. And I'm not giving any secrets here because it was reported in Capitol Fax that we had a meeting yesterday on the issue of workers' compensation reform. I believe we could possibly get there. Representative Brady and I sat down and I think we had a good discussion. Are we in agreement? No, but it was progress made? I would say yes. I'm not in the... the business of negotiating in public, SO I'm not going to tell you all the specifics because I want to get to a point where we have an agreement. If that's a prerequisite, we'll sit down and try and hammer it out.
