And it's good to know that the support comes in for those hospitals, because in Illinois a list just came out of the top hospitals in the United States and eight of the nations, eight of the nation's best hospitals are located right here in Illinois. So if you get sick, this is perhaps the place to do it. The best hospitals made up the list in a number of categories: teaching hospitals… major teaching hospitals, large community hospitals. It ranges from Illinois Masonic to Edward Hospital in Naperville, Central DuPage in Winfield, Northwestern Memorial Hospital, a list of really great hospitals throughout the State of Illinois. Burke, K.: "One moment. No, they do not have to, you know, it's not check the box. You don't need every single factor in order to prevent a disconnection, but these are the factors that the court should look at in determining whether or not a disconnect is proper. And so my Bill would add one additional factor that the court can look at. And it's actually conn… it's, I would say, related to an existing factor which is that no substantial disruption would result to existing municipal services facilities. So it's looking at the issue of economic disruption if the disconnect were allowed."

So… so the issue is that you've got part… you've got a territory designated as a TIF District and those folks in the TIF want to get out of the village, so we would stop them from doing that because it would impact… impact… it would impact municipal service and apparently some of their tax revenue. Is that right?" Burke, K.: "Correct. Correct."

"This particular factor, there's currently six factors, this would be a seventh. This one, if there is a TIF on the area being sought to be disconnected, that's an automatic deal killer. In other words, you can't disconnect if there's a TIF on the property?" Burke, K.: "Correct."
"Okay. So, there are a lot of dormant TIF's out there where the communities had hoped that activity would be caused and developed, but it doesn't always work. What about those situations? Now they can't disconnect?" Burke, K.: "That would be a factor that the court would look at. In this particular…"
"Whoa… whoa… wait a minute. Wait a minute. You just answered that differently." Burke, K.: "No, they would not be able to."
"Okay. All the remaining factors are a weighing and a balancing test. In other words…" Burke, K.: "Exactly."
"…if the disconnection will disrupt unreasonably the growth perspectives for the village. Number five, if the… if there will be a substantial disruption to existing municipal services. Those sorts of factors incorporate what I think Chicago Ridge is dealing with right now. Burke, K.: "I think it would clarify it and I think that… because there is… so in your… in the situation you asked about where a TIF just isn’t working out. Well, that TIF will eventually expire."
"In 23 years." Burke, K.: "Well it depends on what point it is on…"
"Correct." Burke, K.: "…in the… I mean it could be in year 18 of the… of the TIF that it's in. So there'll be an opportunity, but in this… this situation really highlights why letting someone disconnect when they're in a TIF, why it's detrimental. In this particular case, the piece of property is square… is right in the middle of the TIF that's been established. So if there were the ability to disconnect it would eviscerate the TIF and make the other properties that are part of the TIF… it would make the redevelopment and economic development of those impossible."
"I don't want to debate the facts of the particular case but I would point out what you just said it's in the middle of the TIF, but one of the requirements to disconnect is that the property be on the border of the municipality…" Burke, K.: "It is."

"Okay. So, to the Bill. I believe that the existing law, which is facts specific, which is driven by the individual case by case, already addresses the concerns being raised by this Bill. This Bill, instead, is creating an absolute killer for a potential disconnection over one issue that may or may not matter. I think that the existing law already deals with this. We don't need to add this additional layer so I would respectfully urge a 'no' vote."

Number three, what we know about this Body down here is that we are very cavalier about holding to the 23-year normal requirement for TIF's and extend… and instead… instead we are very good at extending one TIF after another TIF. Meaning that you can tie up property for well over 30 years when they possibly wanted to disconnect. So, for those reasons I think it's not very prudent of us to lock up other people's property for your one off instances… instance here for basically what looks like a special deal for Chicago Ridge. I really encourage this Body to vote 'no' on this legislation. Thank you."

And a lot of these are people straight out of college that don't have the finances to do this, and we obviously have a severe substitute teacher shortage as it is. So, what this Bill does is in current law it says that they absolutely must get a physical and this just changed… changes the 'shall' to a 'may'. I just want to make sure folks understand that currently you're required, so just what the Representative said, when you come to work for a school you have to evidence of physical fitness to perform the duties assigned and freedom for communicable disease. We are now making that optional if we are to adopt this Bill. I think there's going to probably be some significant difference of opinion as to whether we should do that or not. I know that many of us who've had to go through various processes have to get a physical exam prior to beginning those processes. Again, maybe there are good reasons for this. It's just hard to see them at this time and so until I really understand that a little bit better, I would think you need to get a physical before going to work for a school, particularly since all of the children have to get physicals every year before they can attend school themselves. He served as a Deputy Service Aid, a Corrections Officer, a Patrol Deputy, and he was the Commander of the St. Clair County Special Response Team. Most recently, Lieutenant Eversman served as the Commander of the St. Clair County Drug Tactical Unit. Kurt has made a huge impact on his fellow deputies and he has a very, very humble legacy that all of his colleagues are extremely aware of.
