And you often hear news about how there's an exodus of people leaving our state, well I'll tell you there's also an infusion of people coming in to our state because tourism records… our tourism is setting records in the State of Illinois. The Mayor of Chicago said that in the first 2 months of this year, January and February, hotel demand increased by 12.5 percent. The city has held more meetings and conventions in the first months of 2018 than it did during the same period in many previous years. And that comes on the heels of unprecedented tourism numbers in 2017, when an estimated 55 million people visited the city. They’re from my district, a little old town called Harco. And I want everybody to know they're apart of the Team Pact Program which I knew nothing about until this morning. This allows teenagers to understand how government works and actually puts them in mock situations where they're able to debate bills and things. So this is a fantastic program and I hope that we can bring it. I think many of you probably knew about it and I didn't. I'm hoping to expand it in our district. If a body, a local body, after this reform is put into place, feels that it does not reach or meet their obligation how is that going to be addressed again?"

When the Court Fines and Fees Task Force was put in place the initiative was to review the impact of those court fines and fees on the community, on the agency but in particular from the experience of the poor and the minority community the court fines and fees had a constitutional question behind it. And what I'm hearing…"

"…unfortunately, I'd like for you to clarify, is that if an agencies budget is impacting they have the ability then to say I need more money therefore we can adjust these fees upward if we need to?"

"Just final two thoughts, Mr. Speaker. Just one is that I'm wondering in this process, and I haven't seen it in this draft, but is there a process by which that is explicit in this language that would collect and track the data over the next few years until we get to the point to review prior to the sunset?"

"I thank you… I thank you for answering the questions. Just 30 seconds. To the Bill. This is probably one of greatest reforms that we will do out of this chamber in this Session. And for us as Legislators we have to make sure we keep our hands on the wheel on this system. The General Assembly, as well as the Supreme Court, is questioning the constitutionality of fines and fees today. So even if we pass this legislation there is still a question of the constitutionality of fines and fees being placed on a citizen who has demonstrated clearly they have no ability to pay. And so I hope that this Session we not only look at that but in… if there was a middle button, and there is called 'present'…"

We had a situation in Glenview where there was an Uber driver that was pulled over and unfortunately he was driving a passenger while he was drunk. "What… what we did is we tiered it. So it's… they're going to look at their local businesses first and then they can look at the adjoining counties and then statewide. The point is to keep businesses within the counties, within the communities, then within statewide. In fact, there are many small businesses that aren't minority owned. In fact I'm a member of the Quad County African-American Chamber and they have procurement process programs all the time to try to get individuals to get the lowest bidder. This actually would allow a local business that's minority owned to be able to competitively compete."

"So let me clarify just the language that is presented in the Bill itself. It says that if the local company bids will be deemed lower than the non-local companies lowest bid if the local company bid is no more than 10 percent higher but they have to be within the county for which the bid is going out or the city. Now this is the scenario and problem that I experience right now. African-American businesses don't exist in Champaign County under contracting service or providers as they do in Peoria County. And so those who may be in Peoria County are not local to Champaign County, under your legislation, they would not have an opportunity and they currently don't have an opportunity to participate. And that's the problem that I see in this Bill. So decades ago when the statute was drafted for Chicago Police and Fire Pension Funds, the… the COLA determined not by your years of service or by your… the day that you started working but rather by the day that you were born on. And what it did was it… for people born before the date they received a three percent simple COLA, people born after the date received a one and a half percent simple COLA. However, over the course of the last 30 years the Legislature has regularly, on a handshake agreement, moved that date forward so that all of the Chicago Police and Firefighters have always received a 3 percent simple COLA, even though the statute is written at one and a half if you're born after a certain date. We just did this last year for the Fire Fund… or two years ago for the Fire Fund where we moved again the date forward. What this would is this would eliminate that provision in the law. The Chicago Police and Fire Funds have been at three percent simple. It's just by weird cork of law it was written that if you were born after a certain date then you got at a one and a half percent. Now think about that for a second it's not the date that you were hired right. So someone could be hired and then someone hired six months later and the person who was hired six months later would be entitled to a three percent simple COLA and the person hired six months earlier would be at one and a half percent simple COLA. Which is why the Legislature has seen fit every three, five, eight years to come in and move that date forward. This is the silliest nonsense I've ever seen in my life. They all get a three percent compounded COLA. The hit that is… is calculated is not really a hit because they're going to get the three percent simple COLA, not a compounded COLA, they're going to get a three percent simple COLA no matter what. They're calculating the number off of the false one and a half percent simple COLA that they're not going to get anyway. This is just codifying what we're already doing and it's taking the nonsense out so we don't have to come back here and explain this Bill every five or eight years. It's the right thing to do. It's not an enhancement. It's not a sweetener. It doesn't change the finances of the system. Please vote 'yes'."

That's actually the direction the American College of Obstetricians and Gynecologists would like to go but the FDA is a little behind in doing that. So this creates another step for that. I think so often when we begin to talk about hormonal birth control or any form of birth control in this chamber we automatically jump to ideas of promiscuity which came up in the last debate from a couple years ago when we did this, questions of morality, questions of who's having sex and who's not. But really there are other medical reason why this would be necessary. Endometriosis has already been mentioned but there are a number of complications from polycystic ovarian syndrome, some women have debilitating menstrual cramps where for a young woman that means missing class time or work time because of the pain associated with her period. There may be issues of preserving their fertility, so stabilizing their hormones so that they don’t go into early ovarian failure. There are a number of medical reasons as to why this necessary and I would hope that we would think about those medical reasons, especially in light of the Bill we just discussed in terms of preserving fertility. We do this in terms of public health with access to vaccinations and other medications. This is just one step for young women to be able to have uninterrupted medical treatment of whatever their issue may be. And also, again, uninterrupted access to planning their families because we know if they are able to choose when they enter into motherhood their trajectory of life is very different than if they're one of the young women who falls into that category of 50 percent of unplanned pregnancy. First of all I'd like to commend the Bill Sponsor for working on this Bill for so long with all of the organizers and the advocates, who mostly as I've seen are young people who are lifting their voices to say this is something that's really important to them. That they are in the schools every single day. That many of them can represents either for themselves or for their peers in the school. That mental health challenges or just mental health in general is something that they want more attention paid to. And because a school is an environment where we have young people gathering on a daily basis this is an opportunity to make sure that some of those mental health needs are met. If we did that in the criminal law it would be unconstitutional to say to someone after they've committed an act well you can't do that and we're going to punish you for it. Shouldn't be any different here. I recognize what the Gentleman is trying to do and perhaps if he set his base line and his numbers in a different place we might have a different conclusion. But we can't tell elected officials, who are elected locally by your constituents, that they are doing something wrong for something that is beyond their control. They can no longer do what they should've done in 2001, or 2002, or 2013, or '14, or '15. "Now there were conversations with HFS as we've progressed through this Bill they are still opposed as I would expect them to be. They're opposed to any reform or any changes to the MCO. But I would like to add something, Representative Breen, there is a recent audit conducted on the whole MCO program for a program that was worth over $7 billion and the audit was perhaps the worst audit I've ever read and HFS agreed with the audit… with the findings that there is no oversight from HFS on the MCO. So we couldn’t figure the MLRs. We couldn't figure out how they came up the capitation rates. They can't even explain how much they've paid in administrative costs. So they were doing a very poor job in overseeing the MCOs and I don’t trust that the MCOs are going to do a very good job in taking care of this population."

House Bill 5342 would allow a member of the Chicago Municipal Fund to purchase service credit in the Chicago Firefighters Pension Fund, Firemen's Annuity Benefit Fund. So this situation arose out of a unique circumstance where a Chicago firefighter ran for Alderman in the City of Chicago after serving 18 years as a firefighter. While he was serving eight years as an Alderman he was stricken with a medical condition. And after serving 26 years for his municipality, as a firefighter and Alderman, he would be entitled to no social security and no pension because there was no reciprocity between the funds. Any other city worker, who worked a front line worker or who was in the Municipal Fund, their pension benefits would continue to accrue in that same 10000125.docx 198  STATE OF ILLINOIS 100th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 125th Legislative Day 4/27/2018 fund. This is just simply allowing the fundamental fairness of someone who has served their city for 26 years to be entitled to the same pension benefit that others who have served for 26 years would have. "Thank you, Mr. Speaker, Members of the House. House Bill 5136 is a Bill regarding teacher evaluations in the states ongoing efforts to implement the objectives of the Performance Evaluation Reform Act that passed in 2010. If you recall this Act required school districts to create joint committees. These committees are made of school administrators, management, and teachers. This Bill is requiring the joint committees to meet at least once per year to assess and review the effectiveness of the districts evaluation plan for the purposes of continuous improvement. Obviously this is an area that certainly lends itself to evolving best practices. And we want to ensure our school districts joint committees are meeting to discuss the most effective approaches and strategies. Keep in mind many of our joint committees throughout the state already do this. This won't be a big change for them. We added an Amendment to make these meetings not subject to the Open Meetings Act and it did remove all opposition. "Again, most joint committees are doing this. It's my understanding there's a very, very small percentage of joint committees throughout the state that are not doing this. I know for instance up in Chicago they actually meet, I think, monthly to discuss this. So there isn't a big change in… in practice. Most of your joint committees are meeting at least once a year as they should. We're talking about teacher evaluations. Representative, you know how important this is. These joint committees should be able to meet once a year to discuss this."
