WHEREAS, The members of the Illinois House of Representatives wish to recognize David A. Strother's legacy on voting rights in the State of Illinois and the United States; and WHEREAS, David A. Strother, once widely believed to have been the first Black man to vote in the United States as a result of the addition of the Fifteenth Amendment to the Constitution, was certainly the first to vote in Illinois on April 4, 1870; and WHEREAS, David Strother was born to Henry and Leah in Lexington, Missouri on August 18, 1843, the son of slaves who bought their freedom; he worked as a cook's assistant on a Mississippi steamer; he served as a civilian cook with Company G, 17th Illinois Infantry, of the Union Army during the Civil War; at the urging of 44 local area men of Troop G, he settled in El Paso; he became a barber… that's El Paso, Illinois… he became a barber and set up a chair in the corner of an insurance and justice of the peace's office in January 1864; he was soon reunited with his mother and his brother, Charles, who joined him at his new barber shop; and WHEREAS, El Paso then operated under a special charter approved by Governor Richard Oglesby in 1867; Article XV of the U.S. Constitution was declared in effect on March 30, 1870, stating that the right of citizens to vote shall not be denied on account of race, color, or previous condition of servitude; the following Monday, April 4, was El Paso's city election, held one day prior to almost all others; and 10300023.docx 4 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 23rd Legislative Day 3/16/2023 WHEREAS, David Strother, accompanied to the polls by Mayor James Wathen, was initially rebuffed by election officials unaware of the new law; after election judges were shown a copy of the amendment, he returned to the polls at the judges' behest, where apologies were made; he proceeded to cast his vote, and his brother voted soon after; and WHEREAS, News of David Strother's historic vote was spread by Gersh Martin, El Paso's newspaper editor, who telegraphed the news to the Associated Press, and soon people all over the United States were reading about the barber who had cast the then believed first Black vote; and WHEREAS, David Strother continued to live in El Paso for the remainder of his life, passing shortly after suffering a heart attack on March 12, 1905; his loss was keenly felt by the El Paso community, who remembered him for his generosity and gentlemanly conduct; and WHEREAS, David Strother's vote on April 4, 1870 marked him as not only one of the first Black men to vote in the United States but also marked a milestone on the path to equality for our State and the country; therefore, be it RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE HUNDRED THIRD GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we recognize David Strother's legacy on voting rights in the State of Illinois and the United States. This Bill was brought from the Humane Society and will ban the procedure of declawing cats. It is very cruel to the animal and pretty much cuts up to their knuckle… amputates, actually, that’s a better term, up to their knuckle and it is very hurtful. There is a medical exemption on this as well for cats. So, if there is a cat that has a deformed claw or disease, infection, then the procedure can happen. But I… I ask for an 'aye' vote."

This has… this has dropped by 90 percent in the last 20 years. So, the attention it's getting is making it work for what you want. But we have to worry about these… a lot of senior citizens that can't take the risk of being scratched because if they will catch an infection in their legs, their poor circulation. I actually know a person who was scratched from their cat that for a month and half had to fight to keep their hand. So, in some cases this is very necessary. And there are pain medicines that these cats are given if this has to be done. Yes, there is. Don't nod your head. Ask a vet. How many vets have you talked to about this Bill?" Hernandez, B.: "Several."

"Thank you, Madam Speaker. House Bill 1591 is a product of the Dobbs Working Group. When the Dobbs decision was released, the language of the decision took aim at two very critical landmark decisions, Loving v. Virginia and Obergefell decision. Loving is the… the decision that… that repealed anti-miscegenation laws. And Obergefell was the decision that created marriage equality for the LGBTQ community. In revealing the statutes, we discovered some archaic language in our Marriage and Dissolution of Marriage Act that really have an incredibly distasteful history. Four states and Illinois, in 1915, enacted these… these prohibitions. So, for… our current law prohibits a marriage in Illinois if it is obtained here by residents of another state who do not intend to remain in Illinois and the marriage would be void in their home state. This comes out of the Uniform Law Commission in 1905, and the primary motivation behind these statutes was to prohibit interracial marriages that Illinois and most other states did not expressly prohibit. And Section 218 expressly and singularly uses the term 'intermarrying'. It is well past time to remove this archaic language from our laws, and I ask for an 'aye' vote."

"I'm not aware of any such case. And, in fact, the Illinois Appellate Court in Jane Doe v. Lyft made clear that that but for the statutory exemption granted by this Body in Section 25(e) of the Transportation Network Providers Act, TNCs are common carriers. And I just want to highlight for the Body the reason why the law imposes the utmost standard of care for common carriers. In that case by the Illinois Appellate Court, the courts said the app matched Doe with an Angelo McCoy, a driver in the Lyft network. A short time later, McCoy arrived at Doe's location and Doe got in the backseat of McCoy's vehicle. At some point during the ride, Doe fell asleep. McCoy then drove to a secluded alley where he brandished a knife, zip tied Doe's hands, and repeatedly sexually assaulted her. After the attack, McCoy drove away with Doe still in the backseat of his vehicle. Doe eventually escaped when McCoy stopped briefly for a traffic light. This case highlights the inherent danger that transportation network companies and other common carriers naturally, you know… I think what I'm getting at here is that the point is, that the reason why we have a higher standard 10300023.docx 75 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 23rd Legislative Day 3/16/2023 of care, with respect to common carriers, is that the minute the passenger steps into that car, they are completely at the driver's mercy for their safety. There is… simply isn’t a policy rationale to treat Uber and Lyft differently than every other private livery service. In fact, before the rideshare companies entered the market place, all private livery services, except taxi cabs, had to reserve those rides in advance. There's simply no rationale for treating Uber and Lyft differently in a day and age where they now dominate the industry. It's understandable that a decade ago, when this was something new and the businesses were just get started, that the General Assembly might've treated this differently. Uber and Lyft now, you know, for the next generation, are almost considered a verb. And the way that you hail them is the same as you can hail a taxi cab. You can use an app for that too. And that doesn’t make a taxi cab not a common carrier."
"Well, I'm reading that, on Monday, a California… California court upholds their proposition 20… 22, which this article says is a win for democracy and free markets in securing the status of delivery and rideshare drivers as independent contractors. The… when this… when this discussion was had in the General Assembly, all these things were sorted out. Why now? Why the change?"
"I think we can all agree that the world has changed tremendously in the last decade. A decade ago, when I stepped out the door of my office building, I could raise my hand and easily hail a taxi cab. Look, we've seen recent statistics where less than 25 percent of 16-year-olds are bothering to get a driver's license these days. They rely on… on rideshare apps like Uber and Lyft to get from point A to point B. And the question I'm asking is, does this Body want to exempt those rideshare companies from exercising the utmost standard of care for our children's safety? That is the question we're answering here. We don’t need to decide whether or not a court would ultimately find, as a matter fact, that agency liability applied or whether or not they're an independent contractor. What I'm asking is, does this Body think that we should provide a statutory exemption and protection from the utmost duty of care for our children when they step into an Uber or a Lyft? I don’t think so."

So, sometimes these are the only sources of transportation that people that don’t live in the bigger cities have. You know, you get the impression that there's… there's no way, you know, to get damages. But every Uber, Lyft, they all have requirements for the amounts of insurance that these drivers have to carry with them. And I don’t think there's a single one of us that gets inside an Uber or a Lyft vehicle and doesn’t realize that we're in someone's private vehicle. Not only is it similar to what was just mentioned, that rideshare companies have generated multiple millions of dollars that most of it does not get passed on to those rideshare independent contractors, as they describe them as. This Bill will not change from being independent contractors. What it will do, though, is make sure that Lyft, Uber, and any other rideshare company has the same standard that any other company has. And 10 years ago, when this was established, my concern about rideshares at that time was that they would eliminate an industry in this… that case, taxi cabs, that provide jobs in low-income communities for many, many people. And because rideshare is available now, this particular Bill, which I believe is very, very important, establishes the duty of care on Lyft and Uber and the large companies who are making multiple millions of dollars off of people driving for their own… in their own cars, at their own expense, where they take majority of the money. And we've seen across the nation where rideshare independent contractors have been trying to organize around this level of exploitation they've experienced. In the for… in the context of the common-law notion of the responsibility of an invitee, rather than an agent, you… like a taxi… like a Lyft driver would be, I believe it would be… how do you distinguish between the invitee nature of a taxi cab company? Because I believe that, as a… as a taxi cab rider, you are an invitee of the actual company. Whereas, in the issue of a Lyft driver or an Uber driver, you are the invitee of that driver. So, can you distinguish between those two or is there a distinction here that needs to be… needs to be drawn?"

If I call Uber or Lyft, they're just facilitating the… the relationship between us for that one particular purpose. In your private car, I am your invitee. So, you owe me the highest duty of care. I guess I want to know is, is there a distinction here that must be drawn between invitee of the taxi cab company versus invitee of the individual who's driving his own car to pick me up and take me some place?"
"Okay. I think the issue that we're having is you're applying the wrong analysis to this situation. Invitee of… you know, as I'm familiar with that doctrine, applies more to real property and whether or not you invited, for example, somebody onto your property. Maybe you have a nuisance like a pool. And so, there's a higher standard of care. This is a commercial space, think UCC. What we're talking about here, you know… I'm guessing, if there were particular facts with respect to how much control a company had over their driver… and we could go into all the factors, which I think mitigate in favor of a Uber or Lyft driver not being independent contractor but actually being controlled much like an algorithmic manager, with respect to how drivers accept riders, how fairs are set, which they have no control over. But the fact of the matter is that I know I've heard a lot about how Uber and Lyft are just tech companies. Again, common carrier doctrine, basically attaching to… attaching a higher standard of care because of the fact that the passenger is completely at the mercy of the operator, driver, in this case, for their safety." Williams, A.: "True. And I think elevators have been held to be that as well. So, you certainly can't hail an elevator or you can't hail a plane. But the… the analogy, really, is between a cab and a taxi and an Uber. They are the exact same thing. In Chicago where I live, we've virtually seen the taxi cabs disappear and we've replaced that almost entirely with Uber and Lyft. That's how you get from place to place. The opposition arguments were, I'd say, bordering on absurd. I mean, to say that this about tech and this is a tech company is really… really just not accurate. So, how… it's not how you get there. Hernandez, N.: "As we still celebrate Women's History Month, I'd like to highlight Sylvia Mendez, who is a Mexican and Puerto Rican American civil rights activist who was instrumental to a landmark segregation case of Mendez v. Westminster. She was born in 1936. At the age of eight, she was denied enrollment at whites-only elementary school in Orange County, California, which was part of the Westminster School District. Mendez was told she could not enroll at a nearby school established specifically for Hispanic children, which consisted only of a two-room wooden shack. White children went to school in a modern building with many more amenities. Mendez's parents sued and the case made its way to the Ninth Circuit Court of Appeals, which upheld a lower court ruling which sided with the Mendez family. Following the Ninth Circuit Court ruling, the Governor of California ordered California public schools to admit Hispanic students, ending school segregation for Hispanic children in California almost eight years before Brown v. Board of Education and establishing an important precedent that led to future change. The Mendez family were assisted by a number of organizations, including the NAACP, which was represented at the time by future Supreme Court Justice Thurgood Marshall. Earl Warren, the Governor who desegregated California schools, later became Chief Justice of the Supreme Court and presided when Brown was decided. Sylvia Mendez was eventually able to attend the school which initially refused to enroll her. It wasn’t easy, and she faced harassment and bigotry. She fought through, however, wanting to succeed after all that had happened. Sylvia Mendez became a nurse and worked in her field for 30 years. Today, at age 86, she lives in Fullerton, California with her 2 adopted daughters. She travels and gives lectures on the historic contributions of her parents and their co-plaintiffs for the cause of desegregation. Sylvia Mendez's story reminds us that the bigotry and the injustice can only be changed when we refuse to accept them. There will always be an easier way, but the way to better the world lies in meeting adversity head on and persisting in the face of it. Gender and racial equality require each of us to act with intention against the status quo. "Recognition of a true trailblazer in honor of Women's History Month. As a police detective, I feel a special connection to the woman I am recognizing today. That woman is Joanne Mariani, and she was the first Illinois female State Trooper. She was born October 28, 1924, in Cumberland, Maryland. Joanne began her 10-week training course at the Illinois State Police Training Academy on May 10, 1963. Back then, the police academy operator operated on a 7-day work week, often training 14 hours a day. This alone tells you how tough she was and how tough it needed to be to be a police officer back then. During her time at the Academy, she resided the… at some family members nearby while her classmates were quarantined in the barracks. Upon on graduation from the Illinois State Police Academy, Mariani became the first woman trooper in the Illinois State Police and was affectionately called a 'Trooperette'. Mariani was a mother of three while enrolled at the Illinois State Police Academy and brought her eight years of experience from the Evanston Police Department as a patrol officer. In Evanston, she was regularly dealt with crimes involving women, children, and young girls. While with the State Police, she was assigned to District 3 as a plain clothes detective available for special assignment until her resignation in 1968. She passed away on July 7, 1992, at the age of 67. Thank you, Joanne, for stepping up to serve and protect the people of Illinois."
