Ah.. now this Amendment total requests the original total request of Appropriations for the high-. way safety programs would have been $13,433,200. An addi- tion of $4,400,000 would be transferred from the Road Fund and the Driver's Educational Fund into the highway safety fund. As the State shares in this in this jointly program of $30 million would be transferred from the Road Fund and $1,400,000 into $700 installment would be transferred from the Driver's Educational Fund. As compared with the Bill as originally introduced, this incorporates along... a line item rather than a lump sum. This reduces the Appro- priations to the Secretary of State by $200,000 and it reduces GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES  12. the Appropriation to the State Police by $1,422,000. Again, this Amendment has been worked out with both sides of the aisle. And I would ah.. appreciate the adoption of Amendment No. 1, to 4452."

"Thank you, Mr. Speaker. Mr. Speaker and Members of the House, a year or more ago, the Division of Watersays received an application for a permit to fill a portion of Peoria Lake in the Illinois River. There were many objec- GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES  tions raised and the objectors were quite vehement in their attack and as a result of ah.. two Hearings in the Peoria Area, the Department issued a final order denying the filling of the portion of Peoria Lake in the Illinois River. But, in that final order, it provided for a study of the Lake to determine a number of things, one of which was ownership, secondly, desired public development and the use of the submerged land. And thus, this Bill is before the House at this time. The Bill further provides that the Department should work closely with units of local govern- ment who are concerned and the final ah.. order approved ah.. should report and shall be a guide for all future applica- tions for permits of this type. For this reason, it's an important Bill and I would ask for your favorable support."

The Bill provides scholarship grants to be ad- GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES  15 ministered by State Scholarship Commissions to those in- dividuals who wish to become certified teachers, but who have bilingual ability. There is a great demand for the teachers such as this throughout the State of Illinois. The Bill was held in both the ah.. Elementary Education Committee and Appropriations. The adopted Amendments recommended by Repre- sentative Berman. And, I would appreciate your support."

"Ah.. yes. Representative Meyer, ah.. the Amendment was recommended by Representative Berman which we adopted yesterday that provides, if the student does not teach, I believe, for two years in the District, he has to ah... there is a pay back provision with interest ah.. to the State."

"And, also, is there a ah.. Are these granted on the basis of need."

"Oh! Yes. They're granted on the basis of need by the Scholarship Commission."

"Ah.., will the Sponsor yield for a question, GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES  please? My understanding is that there is a big surplus of linguistic teachers. And so, if there's a big surplus of Spanish majors, that are already certified, why should we give them $200,000 to take non-certified people and send them to summer school so they can take more language?"

"The findings of the Commission, Representative, were that ah.. we do not have enough certified bilingual teachers. Now, there are many people in the State ah.. who may be ah.. bilingual but they're not certified. As an example, there are a number of ah.. teachers, in fact, who are certified ah.. from Cuba, as an example, who taught in Cuba or who taught on an Island of Puerto Rico, but they have not been certified in Illinois and they may have to go back to one of our Universities so they could qualify for certification. We also found that ah.. a number of young people Spanish Speaking Students graduating from High School ah.. had bilingual ah.. ability ah.. in that they came to Illinois, perhaps, in ah.. when they were twelve, thirteen or fourteen years old, retained their bilingual ability, come from, perhaps, ah.. ah.. a lower middle income families and would like to go to school to become certified. And, they not only possess the bilingual ah...ah.. ability, but they also have that ah.. cultural background ah.. which helps them relate to those students whom they would be teaching, we hope."

"I understand. I've got one other question. Are you saying, then, primarily, that the $200,000 is going to GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES  17. be used for people who are native speakers rather than college graduates? Is that what you're saying, that you want this for natives like the people who come up from Cuba?"

"Either one would be used. It strickly would be used to ab. help those individuals ah.. who are bilingual to become certified as teachers. I only mentioned that as a matter of ah.. of.. of circumstance. There are many people, much as this, who would be available."

"Well, Mr. Speaker, may I speak to this a moment?!"

"Wh.. First of all, ah.. I.. I think, the cause is wonderful. But, by the same token, there's a big surplus of.. of Spanish Teachers right now. Now, if they tell me that they want people, who are native... native speakers, then, I could understand it. But, I can take instance after instance of where there are fifty to seventy-five applicants where, at least, Downstate for every Spanish Speaking Teaching position. And, I.. I just... It's a good cause, but I'm not going to support it."

"Mr. Speaker and Fellow Members of the House, I'd just like to make three points. One, we need money in this State very badly for many many purposes more valuable than this. Two, my grandmother was Pennsylvania Dutch. She spoke Pennsylvania Dutch. Ah.. all of her children spoke good English. They didn't have to have a grant to do it. All we're doing is promoting ah.. the continuation of other GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES  18. languages besides English which is the normal and the proper language for this Nation. Number three, is if I wish to learn a language, and I have the money to do it, I should... I can spend my own money to do it. There's no reason for the State, spending their money, if I want to learn another language. I climbed the other day, yesterday, many years ago, Omaha Beach. I didn't know any French. I rolled over the top and there was a Frenchman, at the top of the crest of that hill. He was in a two-wheel cart with a horse. I said, 'what?', I pointed to the horse and made a motion of what is that. He said, 'chevel'. My first word of French. Now, if I want to learn German or Hindustani or whatever it is, ah.. let me do it. But, ah.. don't expect. But, I. don't expect the State to be paying my way to do it. That's up to me like everything else is in life. Stand on your own feet."

"No, it's a real loss. This Bill was put in ah.. last year, I believe, and the Governor vetoed the Bill and said they should go through the Court of Claims. But, this year they hadn't did that. And so, the Chamber requested me to put the Bill back in again. And, I talked to the Governor's Office and he said he would sign it."

"Well, Mr. Speaker and Ladies and Gentlemen of the House, ah.. at the present time, during fiscal year 1972, service recognition bonds, which were issued to provide for bonuses to Veterans, are being retired ah.. by virtue of ah.. Cigarette Tax and ah.. a portion of the Horse Racing Tax. These Bills ah.. provide that the amount, which is... excuse me. At the present time, the amount, which is received by the Cigarette Tax and the Horse Racing Tax, which is in excess of the amount necessary to retire these bonds, is going over into the General Revenue Fund. It amounts to a spillover of approximately thirteen to fourteen million dollars a year' through fiscal year 1972. Ah.. commencing in the fiscal year 1973 and thereafter, these monies, which were used to retire the service recognition bonds, will be used to retire the bonds which were issued for the reconstruction of McCormick GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES  Place. There will be a surplus of taxes received from the Horse Racing Tax and the Cigarette Tax. These four Bills, Mr. Speaker, would permit that same spill-over of excess funds to go into the General Revenue Fund. It would permit that all funds in excess of the amount necessary to retire the McCormick Place Bonds be ah.. ah.. transferred over into the General Revenue Fund. It's provided for in the Governor's budget on Page ah.. 8140. These Bills were considered in the Revenue Committee ah.. and received a sixteen to zero vote. I urge the support of the House."

"Ah.. Dick, of course, I'm in support of this Legislation. Could you inform the House as to what approxi- mate funds that we're talking that will spill over to the Revenue Fund, if you have any sums at the present time?"

"Ah.. the amount ah.. is approximately $13,000,000, thirteen to fourteen million dollars a year. You ah.. On Page 8140 of the Budget Book, you'll see there's a twenty- nine million dollars, this year, which goes over into the General Revenue Fund. But, there's no question but what the Governor can transfer over ah.. all over fourteen million. So, it's somewhere between thirteen to fifteen million dollars every year."

"Could you tell me how much the tax was, Dick, on the ah.. the cigarettes that were used to retire the Service Recognition Bonds?"

"Yes. It's one cent a pack and it's about four- teen million a year from cigarettes. And ah.., horse racing is ah.. ah.., I believe, it's four percent which is about ah.. fifteen million."

"Well, I.. I thought that the surplus monies here were used to run the County Fairs throughout the ah.. the ah.. State."

"No. That's not ah.. That's not correct. The ah.. The Harness Racing Tax goes into the Ag Premium Fund. These funds ah.. don't go into the Ag Premium Fund at all. They go right into the Service Recognition Bond, Retirement and Interest Fund. And ah.., the amount that's necessary to retire those service recognition bonds is used to retire them, that, which is in excess of the amount neces- sary, goes over to the General Revenue."

"Well, this penny ah.. penny tax, we put on cigar- ettes, a penny a pack to pay for these bonds, ah.. we could do away with that penny a pack now, if we didn't need the money for General Revenue?"

"Well, we need the money, first, to retire the McCormick Place Bonds. And, the amount, which is received in excess of that, would go into the General Revenue."

"In reference to House Bill 4671, we're giving the authority to the Governor, the Director of Finance to determine when and where we're going to have excess funds. Now, I was wondering if we have, in any other category or in any other Bills, this same privilege or power?"

"Ah.. yes. This is the exact same authority which the Executive Department has at the present time under the Service Recognition Bonds. It's the.. It's the exact parallel. The amount, which is in excess of the amount necessary to retire the Service Recognition Bonds, is, by direction of the Executive Department, transferred over to the General Revenue. This provides for the exact same authori- ty ah.. in the future in fiscal '73 now that the Service Recognition Bonds have been retired and we're using the money to retire the McCormick Place Bonds."

"Dick, do ah.. I'm sorry, maybe you explained this earlier, but I was wondering the amount of money that you're anticipating in transferring."

"Well, you'll see on Page 8140 of the Budget Book, there's twenty-nine million dollars in fiscal '73 which is GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES  31. transferred to General Revenue. That's provided for in the Governor's Budget. Ah.. these Bills will enable him to trans- fer approximately $15,000,000 because there's question but what he can transfer $14,000,000 already. So, the.. the Governor will ah.. request the.. the Treasurer to make the transfer. The Treasurer won't make the transfer unless the funds are in excess of the amount necessary to pay off the bonds."

"On Page.. Page 1 of the Bill, Line 21 through 28, George. But, before I ask the question, I.. I certainly agree with the concept of Communities working together to provide a common ah.. Waterworks System for several Communi- ties. But, I'm disturbed with some of the language that's being put into this Bill. Line 26, 'in the event that no water is supplied by such joint waterworks system or ever sold to such a municipality!. They'll still be tied to pay for the.. the ah.. system itself. Can you tell me why this was put in?"

"Well, John, I.. I think, the problem is that ah.. you have to incur certain initiating ah.. expenses to get the whole program going. In the instance that deals with our particular Communities, the seven Communities in- volved had to ah.. almost ah.. make voluntary charitable GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES  contributions in order to get it underway. And, I think, the problem is that sometimes, when these ventures start out, ah.. people don't know quite enough about them to deter- mine whether or not they really want to go for it. And ah... this merely ah.. indicates that the Communities, in their initial engineering expenses, ah.. agree to bear them even if it be at the threshold of going ahead with it in more formal fashion and they decide it's not for them."

"George, the part that I'm really worried about is one of the Communities says it is for them and they can't purchase water."

"Well ah.., there are seven involved. They ah.. have all indicated their willingness to participate. Ah.. they have to contribute something in order to get the thing underway. This provides for that. Now, if they wish to disengage, they are still committed to that initial share of the expense. And ah.., that's the only significance to it that I see."

"Well, I'd like to speak to the Bill, ah.. Mr. Speaker."

"As I said before, I don't have any quarrel with the concept. But, I do have some doubt in my mind where people, who will participate to create this waterworks system, a common waterworks system and then not have the opportunity to purchase water. I think, that the only reason they would join or participate in the first place, would be GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES  47. so that they would have a future source of water. And, when you tie the taxpayers of this Community to this type of a thing, and then not have a guarantee, it leaves a big ques- tion mark in my mind. Now, they pay that.. A fellow got a pretty good job that's ah.. putting this thing together, Mr. Brosak. He's being paid some $25,000 a year. And, I was very concerned with the interest rates when I find out that, for the last eighteen months, they want to increase it to seven percent. And, for the last eighteen months, there hasn't been a sale of bonds anywhere near six percent or over six percent. But, they wanted to raise the interest rate which you judiciously took up, Mr. O'Brien, and only left it seven percent per year. But, it really isn... wasn't necessary because the Bond Market doesn't require it right now. I'm gonna vote for this Bill. But, I think, when this Bill gets over to the Senate, some thought should be given to Lines 21 through 28, and possibly, an Amendment drawn to clean up the language there so that the people, who do participate, will be guaranteed water if all systems are 'go'. "Would the Sponsor yield for a question? George, by looking at the synopsis here, I see that it authorizes the Public Water Commission to construct water transmission lines outside the member Municipalities. Now, is this giving them condemnation authority to cut swaths through farm lands to insert their water mains or will that have to come in GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES  another part of the Statute?"

"Ah.. Charlie, this particular Bill, as you know, modifies certain paragraphs of ah.. the Act itself. In the Act, which includes these modifications, there is already the power of condemnation. And, the condemnation issue would arise, let's take our own example to which this Bill relates, if the Village of Plainfield wished to have water, unless we have the authority, under this Bill, to run our lines out there, ah.. they may not have the money to run to us. That's the issue. It's.. It's to ah.. convenience a Community that doesn't lie closely adjacent to the District to get water from us. Because, and I say us, I mean the Commission, it would then have the authority to run the lines out there. if they pay their appropriate share of it. Otherwise, they couldn't. get to us."

I think, there are no further objections to it. It's ah.. It's a Bill that would give tax relief to private airports. Specifically, it would permit them to ah.. be taxes according to their use rather than their actual zoning classification. The mechanics of the Bill would ah.. allow Counties of more than 200,000, where classification of property is permitted, to classify private airports on the base for use as an air- port. They would be assessed on the basis of their market value as an airport. When the land no longer was used for GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES  airport purposes, the ah.. owner of the property would have to pay the difference between the taxes ah.. than he had paid on the basis of an airport ah.. and the taxes which otherwise would have been due for the past three years plus five percent interest. It would assist the ah.. a number of the private airports which are facing ah.. financial difficulties and the threat of going out of business because of the high value of their land and higher taxes. And, I urge your support."

You'll recall, this Bill was discussed at great length one day ah.. through the eloquence of our esteemed Colleague, Representative GENERAL ASSEMBLY STATE OF ILLINOIS HOUSE OF REPRESENTATIVES  60. Ewell. And ah.., he ah.. provided so much input to this good Bill that ah.. now able to amend it satisfactorily, I'm sure. And, I move the adoption of Amendment No. 3."

"Ah.. Representative Hall, what's specifically... does this Amendment do? And, is this what we had in Commit- tee?"

"Well, we had this Bill in Committee."

"Yeah.. I know you did."

"Ah.. this.. this Bill ah.. specifies in the Law that Treasurers or County Fee Office Holders will deposit their funds regularly when received ah.. with the County Treasurer in the case of County Offices and with ah.. the Treasurer of the Unit, any other Unit of Local Government. This is in accordance with the 1970 Constitution. And, heretofore, there's never been specific Legislative direction on ah.. what to do with ah.. fee ah.. monies. So that, in some cases, ah.. monies haven't been deposited when they should have or on a logical basis."

"No. Ah.. I'm aware of what... But, what does your Amendment do?"

"Ah.. Amend.. Amendment 3 changes.. changes the previous wording ah.. so that ah.. Amendment 3 says, 'shall deposit'. And, this is referring to all of these Units of Government, 'shall deposited all such collected fees on re- ceipt with the County Treasurer or Treasurers of such Units'." Does the collector give it additional... make it more ah.. ah.. mandatory?"

"Orig... Originally, the wording was, 'shall de- posit daily, weekly or, at least, monthly'. And, we have eliminated that and it says deposit when received."
