I don't know where our former colleague, Roscoe Cunningham is today, but in past Sessions, Roscoe worked very deligently to try and amend the medical Practice Act so you didn't have to get a doctor to have your ears pierced. I'm happy to announce that after much work on the part of Roscoe and legislation which I've introduced and a lot of study on the part of the Department of Registration and Education (sic), they have issued a policy statement dating April 21, 1981 indicating that no longer do they feel that you have to have a doctor to pierce your ears. So for all the women of Illinois and any of the men who are so inclined, you can go forward, henceforth, and pierce your ears without calling in an doctor and a nurse. "Yes, I did, Mr. Speaker. This Motion is offered because of the development of events over the last two to three months. You may recall, Mr. Speaker, immediately after your election as the Speaker of this House you in cooperation with your Republican leadership announced that it would be your intent that there would be no deadlines developed for this Session of the Legislature. That proposal Was drafted for consideration by the Rules Committee and actually voted upon by the Rules Committee. At the time of the adoption of that elimination of deadline by the Rules Committee, there were several Democratic Members of the Committee which concurred with your decision. The Committee there upon voted out to the floor the Committee decision that there should be no deadlines for this Session of the Legislature. As subsequent events developed, we have now placed ourselves in a position where, because of enaction on your part, we are now laboring under a set of deadlines for introduction of Bill, Committee, and floor consideration. This has resulted in a very low number of Bills being introduced. Members were led to believe that there would be no deadlines. They felt that there was no urgency for them to go to the Reference Bureau to get their Bills drafted and consequently we are now considering approximately 1000 less Bills than we were two years ago. For the last two weeks Members have suffered through extreme tension and turmoil because they have not received fair consideration in Committee. Many Members have actually sat in Committees for four hours at a time waiting for their Bill to be called. They're told by a Committee Chairman, 'You're the next person on the call list' and three hours later their Bill has still not been called. Therefore, Mr. Speaker, I am suggesting with my Motion that we adjust the consideration by Committee of 20 STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 31st Legislative Day April 30, 1981 Bills during this Session to conform exactly to the time period allowed two years ago. The Motion would provide that the deadline for Committee consideration of Bills would be postponed for one week and for non-appropriation Bills that the deadline would be May 8th and for appropriation Bills the deadline would be May 15. I repeat. This would simply place the House of Representatives in the same posture that we found ourselves two years ago, and I would recommend an 'aye' vote in support of this Motion."

"Mr. Speaker and Members of the House, the Minority Leader in his remarks I think neglected to discuss all of the events which occurred this Session to refresh our memories, but simply took a few items out of context to make a case for his Motion. I would simply like to remind the Members of the House that this General Assembly, under the leadership of Speaker Ryan, has been underway earlier than any Session that I can remember. Speaker Ryan urged the Members to get their Bills to the Reference Bureau, have them introduced, attend Committee meetings, have them heard, called, and acted upon. And indeed as the Minority Leader indicated, it was our intention to make that bold step forward and eliminate deadlines which we have been using for the past number of Sessions. I might also add that the Minority Leader opposed that concept as did most of his Members that wanted to retain some sort of deadline. We find ourselves where we are today for a number of reasons. Almost all of which we could put at the feet of the Minority Leader. The Gentleman from Cook, who leads his party, shows to interject in the course of this Session other matters which tied up consideration of rule changes until just a few short days ago when various Motions were 21 STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 31st Legislative Day April 30, 1981 defeated. Mr. Speaker and Members of the House, it was indeed our sincere desire to move forward at an early date to accomplish what we had set out to do. And for various reasons we were not able to achieve those goals. It is my view that the Minority Leader has been the principle cause for finding ourselves with a large number of Bills still pending in Committees. And I suggest, Mr. Speaker, that if any Member is deeply concerned and upset about the overload in the Committees, they go talk to Minority Leader and ask him the question because it is because of his stewardship on the minority side of the aisle that the Bills are tied up in Committee at this point. The Minority Leader did not give consideration to the Members during the proceeding two or three months because of political items that were on his personal agenda, and all the Members, all the Members are now suffering perhaps. I don't know if they are or if they aren't, but if Members are being short changed as the Minority Leader indicates in his remarks, the reason is because of the actions that the Minority Leader perpetrated upon the Democrats in this House as well as the Members on this side of the aisle. Now, Mr. Speaker, we are where we are for whatever the reasons may be. Mr. Speaker and Members of the House, I'd like to remind you of last November's election where the voters adopted a referendum to reduce the size of this chamber and to go to single Members districts. Certainly, one of those reasons were what the voters of Illinois perceived to be, accessive salary levels for Members serving in a Legislature. But perhaps more importantly, certainly just as importantly, Illinois citizens feel that the Illinois Legislature is not an orderly process. The citizens of Illinois feel that it is too chaotic, that there's no accountability, that citizens cannot keep track of what's happening. And it is 22 STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 31st Legislative Day April 30, 1981 for those reasons principally, Mr. Speaker, that I rise to oppose the Gentleman's Motion. We have deadlines in the rules which we adopted the day that the Speaker was sworn in. Those deadlines have been with us up until today. Even though we had hoped to change them, the fact of the matter is, we did not. And Illinois citizens who have been watching the process here in Springfield knew that the deadline for the Bill activity, House Bills and House Committees, was Hay 4th or 5th, whatever it may be. It would be a disservice, Mr. Speaker and Members of the House in my judgment, to change the rules of the game for the people of Illinois who are watching the legislative process. I say to you, Mr. Speaker and Members, more than ever it is important that we maintain an orderly process in the General Assembly and that we not change rules at the last moment so that no one really knows what to anticipate or what to expect. Mr. Speaker and Members of the House, if we were to extend this deadline it would mean we would have to extend other deadlines for one week or two weeks or three weeks and that would simply plunge this General Assembly and this House into utter chaos where we would have to go back to the days of the Democratic rule of the House with user lists, with Roll Calls on hundreds of Bills at once. Where you would be forced, as Legislators, to vote 'yes' or 'no' on hundreds of Bills not knowing what was being voted upon. And if you decided to stay off of those Roll Calls, you'd be criticized at home for being absentee Legislators just as the proponents of the single Member district initiative said during the course of the campaign. You cannot win if you extend the deadlines. You can simply enforce the opinion that Illinois citizens have of this Legislature by extending the deadlines. Now that concerns me, Representative Telcser, because I think you must admit that the drivers and the managers of this particular Body happen to be on your side of the aisle. I don't want to continue the agony any longer and for another week to sit in Committees for four and five hours and not have Bills called, but it's the Chairmen on your side of the aisle that are controlling those Committees. I, for one in deference to my leader and I'm sorry to say that I must do that, I will vote with your side on this issue, but I think you're wrong in your rationale. You're driving the car. You've got the horses and you can do whatever you'd like, so don't try to blame it on Members on this side of the aisle that we don't have the Bills."

With all due respect to Mr. Mautino, I think that he did hit the nail on the head when he talked about that Mr. Telcser and the Republican's here in the Majority, but it's an old floor tactic if you fear that you might lose the Motion you start attacking the other side so you regroup your forces on your own side of the aisle instead of looking at the issue here. The issue for all of us is that we spent ten days on 5% gross receipts tax. We had a two week vacation and part of the rules is that we had any Bill that was put into Legislative Reference Bureau before March 15th had a right to be introduced and then impliedly to be heard. And there are a lot of Members on both sides of the aisle that truly are trying to represent their constituency and those 25 STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 31st Legislative Day Members are just now receiving their Bills. April 30, 1981 It's not their fault the Legislative Reference Bureau. Those gentlemen and ladies are working very hard but they also were faced with a 5% gross receipts tax, hundreds of Amendments, and they were working their nails down to the bare bones also. So the object really here is that the Motion being put forth is in compliance with the rules and that is that there are a lot of Members that put in their Bills before March 15th and had not the opportunity for those Bills to be posted and heard and they should have that right. In other words, I think that the Majority Leader is wrong and if you look at your Membership instead of trying to use floor tactics you will see that your Membership is also trying to have some fairness here and trying to represent their constituency."

The problem I believe with the Motion is not that it's mistakenly intended, not that we don't need time to go to Committee and to work on problems in Committee, not that there aren't Bills with merit. I would concede all of those facts. The problem with the Motion is that we have more deadlines coming up on the Calendar because the Motions to change the rules failed. We have a Motion for final consideration of Bills in the House. There's a deadline for that and that deadline's coming up quickly and then we're going to have Senate Bills coming over and that's going to be another crunch. And then we're going to have a situation with appropriation Bills. We're going to have a close of the Session problem. We're scheduled to be in Session here every working day straight through till the 30th of June. And I'd make the prediction that we're going to be in Session most of those nights and a great number of 26 STATE OF ILLINOIS 82ND GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 31st Legislative Day April 30, 1981 those weekends. What we have to recognize is that there's just elements of self discipline that we have to enforce. I've got Bills that I would like to have heard, but if we don't discipline ourselves to do that, if we don't discipline ourselves to deal with appropriation matters, Senate Bills, deadlines for final passage, we're never going to control this process at all. The process is going to be completely out of control. That's the problem with the Gentleman's Motion, not that in itself it's bad but that there are other deadlines that are coming up. And, for that reason, I would urge defeat of the Motion."

If you're going to kill it in Committee, that's one thing, but give us an opportunity. had Bills that we being drafted as of March the 11th and couldn't get them out because the Governor's Transportation Program took up ten solid days. And when I went to the Bureau, they said, 'I'm sorry we haven't worked on your Bill because we got the Governor's Bill'. Now, Ladies and Gentlemen, if that's justice, if that's the legislative process, I'll eat it. think we're entitled to an extension of the deadline so these Bills can be heard in Committee and voted up or down." I'm delighted to hear that the Majority Leader has strong commitment to orderly procedures, the right way of doing business, a care and concern for the procedural niceties that will make this House run in an orderly fashion. I say that I haven't seen any evidence that that commitment, in fact, is real. The reason that we're in this hassle and in this mess right now is because the Najority Party refused to follow orderly procedures and the right traditional way of doing business with respect to the introduction of rules. The problem is that they did not propose a set of permanent rules. "Instead of the Minority Leader being the fly in the ointment, the reason that things are not operating in an orderly and unchaotic fashion. I would say, in fact, he went out of his way to help the Majority Party out of the tangle it had created for itself. He offered House Resolution 117 which included all of the Republican proposed rule changes as a set of permanent rules for consideration by this Body. What happened to House Resolution 117? The Speaker of the House fast gaveled it out of contention, out of consideration by the people on this floor. Again, today the Minority Leader is graciously going out of his way to help undo the tangle the Majority Leader and the Speaker have created for us. I think instead of castigating him and trying to blame the Minority Party for the disorder that we right now face, I think that that responsibility should clearly be on the shoulders of those who gave it to us in the first place, the Majority Party, the majority Leader, and the Speaker. The reason for the introduction of the proposal to lift deadlines was to reduce the workload, reduce the opportunities for individual Members to offer their work to the House. In fact, what you've got is a crunch in which telling people we were going to lift deadlines. They perhaps were a little 'lax', a little slow and now, in fact, you've got us just where you want us with Republican Bills coming out of Committee, Democratic Bills going unheard, individual Members having their rights trampled on. Not by the Minority Leader, not by the Minority Party, but by the Speaker of the House and the Majority Leader."

The Democrats tied up the Reference Bureau for five days drafting Amendments on the transportation Bills and now complain that the Reference Bureau isn't doing its work. Now they're spending all afternoon tying up this House so the Committees can't meet and get the Bills out of Committees. I think that all of us have heard that phrase used and in fact we have a rule within our rules that says that a Committee Chairman shall post a Bill within 30 days after it has been assigned. We have within that rule that that Bill shall be heard within 45 days after it has been assigned. That rule was a protection that every Member have one shot. Now we not only have had.... not had one shot, as some of you Members may know. I haven't got up on the floor on a Motion on any of my Bills because I think the rules ought to protect me that I don't have to get up on the floor of the House. But what has happened, we have not only not had one shot, I had a Bill that was in the Reference Bureau in early March that yesterday was not yet assigned to any Committee. How could I have that one fair shot? I think that all of you, and I remember in all the years, the six years that we have been in control as Party that the Committee Chairmen were always instructed that before we had our last Committee that all of the Bills that were assigned shall be posted. That gave every Republican, every Democrat that one shot that you all deserve. So all we are talking again is a matter of fairness. I think the rules ought to protect all of us. I don't rise here making any disperging remarks over the Chair, over the leadership, over the Committee Chairmen or anything. All I say that I, as a Member, have not been protected by the rules and at this stage of the game the only thing that will protect me is this extension of the deadline. The Majority Leader got up and spoke to us about an orderly process. In his opinion, it would be a denial of an orderly process to extend the deadline one week. And yet there is on the Calendar a Motion sponsored by the Majority Leader to extend that deadline to the summer, to next year. Indeed, to abandon it all together. If it is an abandonment of the orderly process to extend it one week, what is he trying to do to eliminate the deadline altogether? The Majority Leader also got up and spoke to us about how everyone understood exactly what was going to be happening. How everyone understood that the temporary rules were still in force and how everyone understood what the deadlines were. Well, the Majority Leader couldn't even tell us what the deadline was. He said it was May 4th or it was May 5th. He didn't know what the deadline was. So... If he doesn't know what the deadline was, how should anyone here be expected to know exactly what the deadline was? Lastly, there were a number of Bills which did not get to the printers in time to be distributed to the Committees in time to be heard this week. You cannot have hearings on Bills which are not printed, and a number of people, I understand it was about 100, but there were a number of people, whatever, that did not have their Bills printed in time to be heard this week.
