"So that you would not be isperiling the existing program and its funding."

"That's exactly right."

"But that would not prevent an Amendment in the appropriation Bill that simply took money out of the existing program and put it into this as a separate line item."

"Well, if it did, then the program that I'm seeking would not be implemented, and so I..."

"Why is that?"

"Well, it has been my express intention all along that I am not trying to impair the basic program that the state operates, and this Amendment is a... an effort to make that intention as clear as possible to everybody on the floor of the House."

"Why don't you just put it in a separate line item?"

"We will... We will do that, but I have been... I have been promising that and as good as I think my promises are, other people want more assurance. And this is an effort to try and give as much assurance to people who are concerned about that issue as possible. I'm the Sponsor of the Bill. I'm attempting to amend my own Bill. I mean, I think most of the times, we let Sponsors amend their own Bill. I consider it to be a technical Amendment."

"Representative Bowman, I notice by reading the Amendment that you are saying that at least $108,000,000 has to be appropriated or no scholarships will be given. "Yes, that's the Board of Higher Education allocation of the Governor's bottom line. So that if the Governor's budget passes intact, the Board of Higher Education recommends that that's what we appropriate to the monetary award program, so I took that number."

"Well, alright. So that basically what you are saying that is if it's amended down, let's say $107,500,000 that no scholarships could be given, correct?"

"Oh, DC, no, no, no, no. Under... under the new program scholarships could be given, not under the cld program, surely. We are going to spend that $107 plus million dollars."

"Well, what I'm saying... what I'm saying, you're sitting here saying that if it's exactly $108,000,000 has to be appropriated or no scholarships under the new program can be given..."

"That's right."

"In other words, if somebody brought it down by even five dollars, that that program would be voided because of it's less than exactly what you had in there, correct?"

"Well, that's right and, of course, as you probably surmise, that would be a way that someone might wish to surreptitiously make sure that the legislation went unfunded; however, my feeling is that, you know, the person we are talking about is the Governor, for heaven sakes. I mean he's the one that's got the asendatory weto authority. I think if he didn't want the legislation, he'd just veto the underlying Bill. So I don't understand the source of your concern."

Now she comes along with an Amendment, and the effect of her Amendment is to cut in half the number of students who will be awarded scholarships under the Bill that I am proposing, 2400. The... and furthermore, not only does she cut the scholarships in half, but the brunt of the cut is going to be felt by students going to the University of Illinois in particular. You know, everyone seems to be under the misimpression that Northwestern is somehow making more money on this Bill than anybody else. Let me tell you, the University of Illinois students are getting $650,000 under House Bill 2400 as it now stands. Northwestern would get $332,000, their students would. But, if this Amendment goes on, the University of Illinois would lose $450,000. Northwestern would lose $100,000. The brunt of this Amendment is going to be forced onto University of Illinois students, and I think that is... that is inappropriate. $450,000 is too much to lose when... and you are cutting half the kids out of the program. The uniform methodology which is the... the methodology that I use in the underlying Bill is in use in most of the states in this country and, indeed, the Illinois State Scholarship Commission begins with that as its base and simply applies arbitrary rationing mechanisms to that figure. It is the basis on which ISSC really does start its own calculations. So I think this Amendment is at best unnecessary and at worst destructive. One of the goals of the legislation is to make sure that additional money will be available to those needy students who are in the top five percent of their graduating class. The information that I have, however, suggests that this language will use the needs analysis standard that the Commission is using nck. Sc that thcse students... an analysis of needs would not have to be done all over again. We would not have to reinvent the wheel, if you will, in terms of needs analysis systess. We would simply use the system that is in place now for making determinations under the Frogram as... as proposed by Representative Bowman's legislation. So, again, I cannot respond to the numbers because I don't have them at this moment. But I, again, I chose this language or chose this Azendment so as to avoid using an arbitrary determination that was created anew in this legislation, but rather Use something, a system, that had been tried by the Scholarship Commission before."

To repeat what was stated before, the whole fund, at this point, only produces about five million dollars a year. We simply would like to have this Authority as another option to address a difficult downtown rehabilitation problem in an old satellite downtown that's similar to several of the towns that already have this Authority. And we think we could use this added option. Would ask for this Amendment to be passed."

"Thank you, Mr. Speaker, Members of the House. House Bill 2394, is an attempt to correct the Illinois Statutes as it relates to park districts and small municipalities. At the present time, there are two small municipalities in suburban Cook County that are encompassed within one park district. They would each like to have their own. Because of the current law that addresses that, it's a very, very cumbersome process. Both municipalities, in this respect, are in agreement. What House Bill 2394 allows these two municipalities to do is to have one detach, have referenda for the election of new park board commissioners and provides for divvying up of the property amongst the two. And, in that respect, it only relates to municipalities...municipality under five hundred. And there's a repealer clause effective January 1, 1987. I would be happy to answer any questions; and if none, I would appreciate the support of the House on House Bill 2394."

I think that would be a very difficult position to explain to those individuals who already have been involved in the special assessment procedures. Therefore, I stand in opposition."

"Thank you, Mr. Speaker, Ladies and Gentlemen of the House. This Bill amends the Uniform Limited Partnership Act which was passed back in 1917. And when it did pass in that year, there was a requirement that all of the limited partners sign, in their Own signature, a...their certificates. This was at a time when limited partnerships contemplated very few partners. Icday's econcay, se have limited partnerships that have up tc forty-five thousand people. And so, it's very burdensque tc collect all of these signatures from the potential limited partners. So, in an effort to help facilitate the marketing of these limited partnerships and, at the same time, protecting the publics right to know who these limited partners are, this Bill would simply remove the requirement that the signatures be submitted and filed but still indicate that the nases would be filed. I'd be happy to answer any questions. I know of no opposition to the Pill, and I would appreciate your support."

House Bill 2807 is an administrative Bill which addresses itself to a problem that's arisen regarding the licensing for 44  STATE CF ILLINOIS 83RD GENERAL ASSEMBLY HOUSE OF BEFBESENTATIVES TRANSCRIPTION DEBATE 115th Legislative Day May 8, 1984 large interstate trucking firms. Under the Interstate Uniform Frorate Compact, a trucking agency is to submit an estimate of the proportion of miles that would be traveled in Illinois. Subsequent to the tise that the trucker pays that licensing fee, the Secretary of State audits those accounts to determine the actual number of miles traveled in Illinois. And often times, and most times, an adjustment is made necessary by virtue of that audit. Under existing statute, the fira has only six months from the date it pays that fee to file an application for a refund, where it's been detersined that there's been an overpayment. The problem is is that the audits are not even performed until many times one or two years after the date that the fee is paid which would make it impossible for the trucking firm to in effect receive that rebate. So, what this Bill does is simply say that the firm has twelve months after the audit by the Secretary of State tc file a claim for a refund. I knçs cf no opposition. The Bill was approved unanimously by the Transportation Committee, and I would respectfully urge your support."

"Well, in the first place, Mr. Speaker, there's no fiscal implication of this in the first place. So, I think that'd be out of order. The genesis of this Bill was with the Legislative Audit Commission. And to give you a little background, East St. Louis Community College is unique in Illinois in that it is totally paid for by state money. No local money is involved whatsoever. The other thing that's unique about it is that the board is not elected in the college district. It's appointed. And the third thing that's different about it, up to this point, under which... regarding to... this Bill would attempt to remedy that. Every other community college in the state is under the direction of the Community College Board. In this particular case, the East St. Louis Community College Board has the right to refuse to accept regulation by the State Community College Board. East St. Louis Community College has had a lot of problems. And for that reason, I ask you to vote 'no' on this Fill and defeat it."

"Thank you, Mr. Speaker. I rise in suffort of House Bill 2815. The Illinois Community College of Fast St. Louis has for about four or five years had a number of problems and have received a special operating route to go. And if anything to encourage you to vote green would be a letter that comes from the state's attorney in that county. And it has to do with misspent funds. The state's attorney was asked to prosecute that, and the state's attorney has declined to prosecute the case. He did say that it was a very thorough investigation, and the Department of law Enforcement should be complimented on the thoroughness of the investigation. But, the second paragraph says, "I choose not tc proceed with any criminal charges in the matter, basing it mainly that the money was used for educational purposes even though it was taken out of the wrong year's acney, and the Lady did the wrong thing." And he goes on to say in the third paragraph, "another major reason", and 1 quote, 'for not chosing to proceed is that the history of the nisspent money at the state community college. The General Assembly of the State of Illinois has for years been aware of the fact that there are problems at the state community college. They have, however, chosen not to do much but threaten to reduce... threatened the reduction of monies appropriated to that institution.' It goes on to say, 'I think it is a serious matter that should be remedied. However, I think in light cf the history of the relationship between the college and the General Assembly, the problem is best handled legislatively or possibly through civil action.' The civil action has been taken to the office of the Attorney General to see if we can get the money back that was misspent this time. But the Bill simply makes this community college treated like every other community college and that that board does not have any special veto power over the guidelines and standards, rules and regulations, set up for all community colleges. Thus, this community college would be guided as all of the rest. I ask for your 'aye vote on the Bill. I believe it be a step in the right direction. "Thank you, Mr. Speaker. I rise in support of this legislation. The State Junior College has had a history of terrible audits over the past years. We've worked with them. The Audit Commission has set up a situation where we bring them in every three months to see how they're progressing on improvements. One of the things that we criticize the Junior College Board about was that they were not providing adequate supervision over the State Junior College. I think when you realize that every penny that's spent in this Junior College is state funds, that what the previous speaker mentioned is that we should be very, very conscious of the problem. It's all... All of the money is our money. There is no local real estate tax money going into the support of this institution. With the Bill... With the passage of the Bill before us, it will allow the Illinois Community College Board to send in their staff to work with the Junior College and, hopefully, solve some of the many, many problems that Junior College has. And I would ask for your support of the legislation."

"Yes, Mr. Speaker, as has been pointed out, this... Well, let me just go back a little. I think Representative Younge has felt from time to time that we wanted to abolish the college. I think East St. Louis above all the places in the state probably needs a junior college more than anybody else. I have in my hand the most recent audit by Arthur Young and Company. I'm sure you would recognize that as being responsible. It is a deplorable audit. Even then after ten years, they have not been able to come up with a satisfactory inventory even of their equipment. From time to time, they couldn't tell you how many students were there, how many teachers were there. But we think there is still hope. But we would like to see them under the direction of the State Community College Board, just like the other colleges. And we think that is at least one hope of improving it. I'd appreciate your vote."
