"To the Bill. You know, all of our constituents are in this kind of an in-between situation. And when we… when we come back to Springfield, there's an expectation that the people's work will be undertaken. And unfortunately, again, when we… when we bring a notion that is really not even the idea of 09900072.docx 4 STATE OF ILLINOIS 99th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 72nd Legislative Day 7/15/2015 the Sponsor and then suggesting that somebody else supports this, and then running it again, and again, and again, and again, and again, I think this pours fuel on the fire that we are coming here to Springfield, not to do the people's work, but for some kind of political theater. And unfortunately, what I termed a clown show last week has been reinforced here today. So I find it unfortunate. The Sponsor is a serious Legislator. He has brought very serious matters repeatedly before this chamber that we are engaged in this repeatedly and… and for what may be a record eighth times. We'll have to have staff do some… some research on that. But I… I think it's entirely unfortunate that while the people that are here today are expecting the people's work to go forward, this is yet another example of theater that is fruitless, that is meaningless, and that, frankly, will result in us not getting any closer to what the people of the State of Illinois need. You know, we are kind of at this day where some state employees have been paid. We are probably headed towards the Appellate or the Supreme Court looking at the rest of the good people that work for the State of Illinois getting paid. We continue to talk about a revenue situation or… or, frankly, a spending plan that… that was sent to the Governor and largely vetoed that was $4 billion… 4 billion with a 'b' out of balance. I think that in and of itself kind of highlights how disingenuous this entire process has been. You know, in my tenure, every year until this year, at minimum, there would have been a… an agreement on what the amount of money coming into the State of Illinois would be. That's largely been driven from this very chamber. In my tenure, every year until 09900072.docx 5 STATE OF ILLINOIS 99th GENERAL ASSEMBLY HOUSE OF REPRESENTATIVES TRANSCRIPTION DEBATE 72nd Legislative Day 7/15/2015 this year it would have been passed on a nearly unanimous basis on certainly a bipartisan basis. So here we are rounding the corner, middle of July, we still don't even have agreement on the money that can be appropriated from this chamber. So I think, unfortunately, going through this exercise, yet again this week, is unfortunate. I think it… it's illustrative in… in exhibit A to wasting more of the people's time, more of the people's resources, when they are desperate for this Body to move forward with serious discussion. And I think that's what we should do. Thank you."

You know, I've supported it every time and I… I support the concept, but every time this issue comes up for a vote in the current form, it crea… it causes great concern for our units of local government, because as I've argued on the floor before, this Bill is incomplete. This concept is incomplete unless there's going to be some relief provided to our units of local government on these mandates that we impose on them. Has anyone suggested to you or have you thought yourself of maybe improving this Amendment so that it has an opportunity of passing?"

I'm concerned that the distinguished chairman of the Revenue Committee is… is really somewhat demeaning the process here. You folks down there are silly. We know that if there's any property tax change, freeze, whatever it may be, it's going to come as a result of some sort of compromise that's going to be reached between the Governor and the General Assembly. This individual Bill, in my estimation, it's not going to move. Vote how you want on this Amendment because, quite frankly, with all due respect to the Sponsor, it's not going to mean a whole heck of a lot at this point. Thank you."

"John, just want to get a little clarification about exactly what the budget impasse is. It's my understanding that the reason why that we've been coming down here for all of this time after the 30th of May was because, prior to enacting a budget, the Governor was requiring us to first look at aspects of his Turnaround Agenda. Is that accurate?"

"All right. Now, if it's my understanding… if my understanding is correct, we just recently received a portion, if not all, of the Governor's Turnaround Agenda. So it's my understanding that the first component of the Governor's Turnaround Agenda is House Bill 4246, which deals with Tort reform. "I… I apologize, John. I was just trying to establish what are the components of the Governor's Turnaround Agenda that has led to this impasse? So, my question initially was… was it's my understanding that the Governor filed on July the 8th, a couple weeks ago, House Bill 4246 which dealt with Tort reform. Is that accurate?"

"I'll take your word for that."

"All right. And then, he also filed on the same date… and again, he wasn't actually filing the Bill because, again, he's not a Member of the General Assembly. So he would have to encourage someone to sponsor this legislation on his behalf. So having said that, the next component is Turnaround Agenda, from my understanding, is House Bill 4247, which is essentially a antiunion collective bargaining prevailing wage Bill. Is that accurate?"

"All right. And then, the next component to the Governor's Turnaround Agenda is House Bill 4248, which appears to be some type of worker's compensation reform legislation. Is that accurate?"

"Okay. So, then, the next component that, it's my understanding to the Turnaround Agenda, is property tax reform, correct?"

John Bradley (D)

"Yes."

André Thapedi (D)

"And that's what we're doing here today is that we're knocking off at least one aspect of the Governor's Turnaround Agenda to try to relieve this impasse for the people of the State of Illinois. Am I accurate?"

John Bradley (D)

"Yes, in part. And also to provide real tax relief on a real Bill to the people of the State of Illinois."

André Thapedi (D)

"Understood. And… and that's one of the reasons why we're down here at an impasse because this is a component, referring to the tax relief that we've got up on the board right now, House Bill 680, to provide a certain component of the Governor's Turnaround Agenda so that we can relieve this impasse. Correct?"

"So, I don't understand, what is the problem in having the entire Body supporting this particular piece of legislation. If this is a piece of legislation that's an vitable… a vital component to the Turnaround Agenda, everybody on the left side of the aisle, of which I'm a Member, is voting for the Bill. Everybody on the right side of the aisle, for some reason, is not voting for the Bill. I'm perplexed. I'm perplexed. And I don't know if this is actually gaining any steam. I would suggest, humbly, that this is actually kind of becoming a caricature of the process. It is, yeah, in and of itself, unfortunately, becoming a joke. So I would ask that you consider pulling this and then let's have a real… I mean, we're going to have a Committee of the Whole, which I'm sure will be every bit as genuine as the previous instances. Come on. We know this isn't going anywhere, John."

The Governor's au… and it's dated toda… today, Representative. The Governor's Office of Management and Budget reviewed Floor Amendment 1 to House Bill 4142 and concludes this proposed one-month FY16 budget Bill puts the state on the same path to an unconstitutional and unbalanced budget as House Bill 4190 with Floor Amendment 1. House Bill 4142 with Floor Amendment 1 impacts four agencies and has an annualized GRF cost of 177.5 million. The… the Governor's Office of Management and Budget analysis assumes all programs would receive the same one-month funding level for each month in fiscal year 2016, except for the Youth Bill which assumes three months of funding. Therefore, House Bill 4142 with Floor Amendment 1 continues the one-month plan which will ultimately require an annualized expendure… expenditure level of over 36 billion of GRF taxpayer resources in fiscal year 2016, leaving this plan an estimated 4 billion out of budget and, therefore, unconstitutional. So, Ma'am, same inquiry. "I… I would just have to say that I think that the Office of Management and Budget needs to go back and find a new green eyeshade and perhaps sharpen its pencils. Since that what we're talking about today is a limited spending plan in this Amendment, Amendment 1 to House Bill 4142, it is by no means funding all of State Government. It isn't even an algorism that says that what this is, times 12, is what we've spent on that… those programs last year. So I just think that… let's talk a one-month budget. This is not meant to say we can extrapolate. I fully expect that there will be further discussions about a 12-month spending plan. And obviously, this 12-month spending plan may mean very different allocations across these and all the other programs in Illinois State Government."

It… it is astonishing that we're continuing this process which is so wrong. We got to hear from some people today about some programs that are important to them, but instead of actually working on a balanced budget, we get a one-month temporary budget that has the same trick bag in it. And that's after we had $31 billion worth of tax increases. Where did it go? It paid for indebtedness. So you come to us today with a piece of the pie which we can't pay for. That's very interesting. What are we going to do about our colleges and educating our kids at the secondary level? Well, there we go again. And on, and on, and on to the point that now we've not had a balanced budget since 2000, and the eyes of Illinois, and the eyes of the nation watch what we're doing. Because somebody, at some time, is going to have to pick up the tab for what's happened, if you will, the sins since 20… or, I'm sorry… since 2000, the sins of this Body. And I'm sorry, I'm not picking on you, you're just carrying the Bill. I understand that. But this is the wrong time to bring one-twelfth to the table with no revenue. I ask this Body to vote 'no'. The budget shall set forth the estimated balance of funds available for appropriation at the beginning of the fiscal year, the estimated receipts and a plan for expenditures and obligations during the fiscal year of every department, authority, public corporation, and quasi-public corporation of the state, every single college, and university, and every other public agency created by the state but not of units of local government or school districts. The budget shall also set forth the indebtedness and contingent liabilities of the state and such other information as may be required by law. But here's where it gets perport… important. Proposed expenditures shall not exceed funds estimated to be available for the fiscal year as shown in the budget. Yes, we need to work on reforms. I will work with you on reforms, but we're not going to get that done in time. We need to straighten out this financial situation. And if we can't do it on a full basis, if you're not willing to talk about the steps necessary to provide funding for these programs, then either do it on a temporary basis so we can continue the talks or stand up and say… have the courage to say that we shouldn't provide funding for these services. That is a legitimate argument to make. I'm open to hearing it. I don't mind if you say we should not be in the business of caring for children with autism. I do not mind if you say that we shouldn't be in the business of providing relief for people who are victims of domestic violence. I'm okay with that. That is a legitimate discussion to have. I disagree with you, but don't say that you want to provide the service unless you're willing to do what it takes to provide the service. Until then, vote on this Amendment, provide the temporary relief and when you're ready to talk about what we actually should provide or what we shouldn't, we'll have that discussion."
