We know her as a woman who, through her efforts, worked hard in efforts like child literacy and moved our nation forward advancing literacy throughout this nation and, I think, therefore, other nations as a champion cause. She'll be remembered as a woman who had a great sense of humor, welcoming demeanor, and just an all-around wonderful woman, but, more importantly, I think, a wonderful mother. As this Body will recall, during the Budgeting for Results meetings, a group of legislators meet to determine what statutes may be removed or repealed because they no longer are applicable. Substantive portions of that are brought as individual pieces of legislation for all of you to consider. In front of you today is Senate Bill -- 1008. And what it does is it removes the Illinois State Police from a diesel-powered vehicle emissions inspection report requirement, which they have received audit reports on for the past several years, as they no longer conduct this program. And it also changes certified mail to regular mail for the Department of Juvenile Justice to inform parents and guardians of any changes to the status of their youth. And that's being done now by registered mail as an efficiency with regard to cost. So we wanted to bring these measures to you individually so you could consider them. I have suggested to many of those individuals that we craft a resolution as a placeholder; that in the event we return to this type of a program, we definitely have the Senate and the House's concurrence that this is the direction we'd like to go in. So even if you can't support it, I do offer that as a possible solution that we can work on together. So thank you for bringing that up.

Thank you, Mr. President. This amends the Illinois Procurement Code. It is a CDB bill. Clarifies the process for procuring construction management services under the Code. This removes the language that requires CDB to use a request for proposal for construction management procurement; instead, replaced it with language that requires no less than fourteen days' advance notice published in the Board's procurement bulletin setting forth the projects and service to be procured. The current statute requires a mailing to all prequalified firms. This is costly and never been done in practice. So this is just codifying what's actually being done. There's no opposition. What this does is keep those funds generated in any county in the county's pet population control fund or their animal control fund, which funds the animal control facilities and services. The bill does not increase any fees or fines. This also changes the administer {sic} of the State funds from the Illinois Department of Public Health to the University of Illinois College of Veterinary Medicine. There is no opposition.

Thank you, Mr. President. This legislation is dealing with a number of issues, but the -- the main one it's dealing with is sting operations that occur in restaurants, truck stops, bars, and social clubs. And as some of you have -- have noticed, there has been an increase of -- of stings that the Gaming Board has been undertaking that is totally different from other types of law enforcement stings. This legislation, the -- the goal of this, is to put some guidelines and rules in place that make it fairer for those owners to -- to, I guess, argue or fight against this issue. With other types of stings, when it comes to alcohol and cigarettes, in this -- when they do stings, people go into the store, they get their cigarettes and their tobacco, and they have to interact with the -- with the person at the counter and that's when they're going to check IDs. The concerns we have at -- at social clubs or at restaurants or bars, we've had cases where they'll -- they'll send someone in on the sting. They'll come in during busy hours, quickly sit down at the game, a -- a videogame, one time, before anyone can even get over to them, and then they turn around and -- and send them a five-thousand-dollar fine. And they normally don't notify them for over ninety days. And so for those restaurants that have video loops, usually running fifteen 40 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 112th Legislative Day 4/19/2018 to thirty days, those loops are already gone and so they don't even have a defense. So this legislation sets some guidelines that the Gaming Board has to do if they're going to implement stings. It also puts some time frames in for notifying the owners that these stings occurred, so they can retain their videotapes to be able to challenge it. We've worked with the -- we've worked with the Gaming Board on this, we've worked with the video gaming groups, and the -- the Liquor Association and I think we've addressed most of their concerns. I don't know of any opposition to this and I think it's something your locals would -- will certainly appreciate. Be happy to answer any questions on that.

No one has spoken to me and I haven't seen any on the computer system. I would just candidly expect that the administrations of some public universities might be, but I've not heard from anybody.

My information is that the University of -- of Illinois is opposed. And I would suppose that is due to the fact that they have a lot of situations now that are becoming difficult to administer the proper education in our universities, given the lack of funding and the like. So don't you think this might be a hindrance in their ability to continue to operate properly?

Senator, I have strong views on the question of funding for public universities. But there was very recently a strike of the Graduate Employees' Organization at the University of Illinois. And I think it's pretty instructive as regards to this bill. Okay? So one of the main issues in that dispute between the administration and the graduate students was, Should there be a guarantee for graduate students to have tuition waivers? Which has been standard procedure at that institution and peer 60 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 112th Legislative Day 4/19/2018 institutions for a very long period of time. The students - I would say, thank goodness - won, because it would have been, in my opinion, devastating to the University's mission over the long term had they not been successful. But now think about it, what that means, because the teaching assistants and not the research assistants were in the bargaining unit, in terms of what they're actually able to bargain for. It's going to create a situation where teaching assistants have tuition waivers and research assistants, who in some cases are actually more prestigious, don't. That's a really wacky imbalance, in my opinion, and a dangerous one, not just for morale, but also for the ability of the University to continue to recruit the kind of people they want to have as their graduate students. I -- I think it's an important -- important distinction to eliminate.

Are you aware that our public universities are having problems meeting the deferred maintenance of their institutions?

Senator, I think we're in agreement that our public universities are criminally underfunded by our State government. Sounds like we're in agreement about that. Again, I've got a lot of thoughts about how we might best fix that. I'm sure you do too. The reason there's so much deferred maintenance is that in dealing with these awful budget situations for a lot of years, the universities have tended to say, we're kind of in the people business and we need to make sure we do everything we can, even with inadequate resources, to attract the kind of undergraduate, graduate student, and faculty that we need to maintain the quality of institution. This bill is about enabling that to continue, specifically for research assistants.

To the bill. I -- I just think at this point in time, when we find our public universities struggling throughout the State, that this is a bad precedent to add one more layer of burden upon them and I -- I think it's a bad timing. And so, while I appreciate the sponsor's intentions, I will be a No vote and I respectfully ask everybody else who supports our public universities and want to assist them to get through our financial crisis to vote No.

Well, the information I'm getting from staff is that a single student at the University has filed a slip in opposition to the bill. Like I said, I have heard nothing from the University. Looks like our information is not in agreement with what you just shared. And as I mentioned to the previous questioner, I think that the victory that graduate students won in that dispute, specifically on the question of tuition waivers, is unbelievably important for the University's long-term ability to meet its educational mission.

The idea here is that if you were a graduate student working as a teacher in exchange for a wage or if you're a graduate student working as a researcher in exchange for a wage, you ought to have equal ability to participate in the collective bargaining unit.

So, then, help explain this to me, 'cause graduate students that are teaching are already covered, are they not? There's a bargaining unit already, the GEO. They just got done -- the march that you were in was -- had -- had a strike.

I think it's a -- a really serious problem, given the relative roles played by teaching assistants and research assistants at a university.

Thank you, Mr. President, Ladies and Gentlemen of the Chamber. You know, in all of this esoteric discussion about universities, what are -- we're forgetting something here. They're students. They're students! Okay? They're like students who work at the bookstore or students who work for the football program. They're students, okay? And I don't think it's beyond the pale to say that maybe we shouldn't be handing over, by State fiat, labor organizational rights to students. Okay? Second, the sponsor himself referred to the underfunding problem in higher education. And while we could debate the degree to which they're underfunded, 66 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 112th Legislative Day 4/19/2018 one thing you cannot debate is -- that is if you have any feel whatsoever for the condition of our financial status, you know that they're not going to see leaps and bounds in their funding for at least the next few years. So your choice here is whether or not you want to make their task even more difficult. Because if you vote for this and it becomes law, they're going to have to pay these kids more. Now, some people will say, well, that's great and I get that they're politically active. But it's not good for the rest of the kids on campus, is it? It's not going to be good for the rest of the students and I think we should be concerned about all the students who go there. This will leave less money over for the services that they rely on. I would urge a No vote. Thank you, Mr. President.

A previous speaker just referred to the subjects of this legislation as just students. In fact, they're employees. They're employees working on some of the fundamental services delivered by the higher education institutions. And -- and whether they're also students or not, they're active with the fundamental service that these higher education institutions deliver, and so they shouldn't be treated any differently with regards to collective bargaining rights than any other employee. With regards to - I've 67 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 112th Legislative Day 4/19/2018 been around here for a while - with regards to how people slip in favor or against a bill, an institution like the University of Illinois has actively participated on a number of bills down here through the years that I've been here, and when they want to be heard, we hear from them. We hear from them very loud and clear. I sat in the committee earlier this week and I saw witness slips on certain bills that numbered to the thousands. We're not going to stop and try to find out why each witness slip has been filed. When an institution, like the University of Illinois, wants to be heard and if they truly object, we would know why. And to the extent that they haven't expressed themselves with any specificity, even to the Members who have raised issue about the witness slip, they don't even know why. So if the University of Illinois strongly objected to this, they would communicate to us. But with regards to the heart of the bill, there -- there hasn't been a really legitimate reason not to push a green bill -- button on this bill. I also walked with some of those employees. I don't know, I wasn't on TV, but I do urge a Aye vote on this bill.

Thank you, Mr. President. Just a few things. First of all, I wasn't particularly taken off guard to learn that the University might have told some Member in some kind of quiet communication they're not supportive of this bill. The bottom line, though, is that I've carried bills that the University didn't like. They have always been very open with concerns and they've been very quiet about this one. And to the second to last speaker from Coles County's {sic} comments, I think the reason that the University 68 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 112th Legislative Day 4/19/2018 has been quiet is that this is not a bill that gives to one group of students and takes away from another group of students. This is a bill that creates parity between all graduate student workers, correcting what I think is a pretty basic mistake in the way the law is currently construed. Now, perhaps the University would rather, in these difficult fiscal times, to have no students unionized whatsoever. That's a really different public policy question we could discuss and probably come down on different sides of that question. But that's not what this bill is about. This bill is about the question of, given that we already have a robust system of unionization of some graduate students at our public universities, do we want to continue to have this two-tiered system that drives a wedge and makes the place in aggregate less attractive for people to come to from all over the world. I think that's not what we want and that's why I think we ought to vote Yes on this bill.
