With the amendments we adopted today, we have eliminated all of the opposition, but for that of the School Management Alliance. Their opposition is limited, as I understand it, solely to the dollar amount of the valuation. We're happy to continue those conversations in the House. I've asked them for more information, but I'd like to send this over in its current form. It's much improved and I believe ready to be considered by the Senate and sent to the House.

Mercy Multiplied is a organization that -- a nonprofit Christian organization dedicated to help young women break free from life-controlling behaviors and situations. As you know, my daughter was on the waiting list to get into Mercy when she passed away. The great thing about this organization is, one, the courage of these young ladies to step forward and say, I believe in myself enough that I can be transformed. And so we've done everything we can and we want to promote their organization today and I want to introduce you. First, my wife, sitting up here on the left, Victoria. And -- and, as well, these beautiful young ladies, who are my heroes. Just so everyone knows, Mercy has homes in St. Louis, Louisiana, Nashville, Sacramento, in the UK, Canada, and New Zealand and it's free of charge, because no one wants to make -- make money off people's problems and this way they know they're cared for and loved and the compassion works. Colton is a -- he interns in my office, plays football at the -- at Augustana College in my district, and has been a huge help in the office, is a great -- great guy. And then also with -- with us is Colton's girlfriend, Autumn Anderson, no relation by the way. I'm sure there is somewhere down the line. Autumn is a sophomore at Augie. She's a cheerleader. She's studying pre-med and psychology. She wants to be a nurse practitioner and she is also -- if you guys don't know, in the Quad Cities, we have a Arena Football team, the Quad City Steamwheelers, and Autumn is also a -- a dancer for the Steamwheelers. Thank you, Mr. President. This is a vehicle bill to Senate Bill 3467, which passed out of the Commerce and Economic Development Committee. This bill removes provisions from Senate Bill 3467 that provides a HUBZone small business's price bid for a State contract shall be deemed lower, if the bid is within ten percent of a competitor's bid. Senate Bill 2675 simply codifies federal HUBZone definitions. It allows procurement officers to establish rules relating to HUBZones and to the Illinois Procurement Code. HUBZones are administered by the U.S. Small Business Development Administration. The boundaries for HUBZone areas in the State are set by the SBA. So it's -- it's a little complicated, but give me a chance to explain it. With -- with the amendment that was added on in the House, the timing of the enactment of this bill related to the timing of the passage of a budget, excuse me, would determine the effective date. So as we know in recent years that the timing of the budget has been suspect to many factors. I'll give you an -- a hypothetical. If a budget is passed and signed into law in May and this bill is signed into law in July after the enactment of the budget, then it would be applicable to fiscal year '20. If it's the other way around, it would be applicable to fiscal year '19, the upcoming fiscal year that starts on July 1st.

That's not diminishing the value of the proposal, but if that were the case, Senator Righter, then the provisions in this bill would be applicable to the following fiscal year's budget.

So if -- if a budget is passed, which I hope it is, which we're working toward, before May 31st, I would hope that the Governor also signs this bill, because as part of the discussion, this has been happening going back to administrations on both sides of the aisle and the opposite side of the aisle has always expressed frustration about how Governors of both parties have handled their budgets. So I would hope that we pass a budget before May 31st that gets enacted and the Governor signs this bill. Whether or not he does that before or after is out of my control as well. So, in that scenario, the intent of this bill would be for it, as it's written, to be enacted in fiscal year 2020.

23 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 119th Legislative Day 5/3/2018 When we first heard this bill in State Government Committee and when we consider the -- the terminology of offshoring and transparency and governmental reform, it seems like good practice to go back to a -- a new era where no Governor can do this anymore, and certainly it was started several administrations before, but when you peel back the layers, there are actually some good government reasons for doing this. And entering into an intergovernmental cooperation agreement does allow the Governor's Office to access federal funds. For instance, the Early Childhood Development, it operates primarily on federal funds. The Office of Governor runs on General Revenue Funds, so it cannot receive, through the Governor's Office directly, these federal funds. But we need those federal funds to help us implement our Early Childhood Development. So an intergovernmental agency agreement is then used so that another State agency can act as the fiscal agent and receive funds and pay the Governor's Office staff for their services in Early Childhood Development. So that would be one area that the terminology "offshoring" might in fact be a good government reason, because we want to access as much federal funds, especially in the area of education. Likewise, the Dunn Fellowship Program, it was moved to a intergovernmental agency agreement between Department of Central Management Services and the Government's {sic} Office and it allowed the Dunn Fellow Program to make use of the assistance and procedures of the operational - - time sheets and the -- using the same time systems as the rest of the Governor's staff. There's other examples within Health and Human Services, the -- the Innovation Incubator. It is one program that they worked with a intergovernmental agency agreement. So I'm just saying, let's not be hasty and act to do away with 24 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 119th Legislative Day 5/3/2018 something. Maybe we should learn more about it; that there are reasons that it makes good sense and not just good political terminology. So I would ask everybody to reconsider and therefore I will be a No vote, even though I -- you know, at the first part, it sounds like good reform transparency. Perhaps there's another way using these intergovernmental agency agreements we can accommodate both purposes, have the transparency and the ability to access funds or make better efficiency and operational cooperation. I mean, certainly the agencies do operate under the Governor and that, I think, is -- is reason enough to allow this flexibility. So, therefore, I will be a No vote. Thank you.

Have both Democrats and Republicans practiced this in the past?

Yes, Governors of both parties have participated in the practice of offshoring salaries of employees that are devoted to that Office specifically, to agency budgets, drawing out of appropriations that were in many cases not intended for people, but for programs - both sides of the aisle.

SENATOR McCARTER: So, this -- this concern -- there's a concern apparently over not -- the Executive Branch, the Governor, not having the influence that he wants within these different departments, having someone there to make sure they're guided according to his wishes, which we understand that. Right? I mean, we understand that he wants to have that guidance of -- of where those departments are going. Is there any reason that, even though these -- say, someone that was Human -- in -- wants to be -- have influence over Human Services could not be in his budget, but be the person responsible for having influence in Human Services? Any reason that couldn't take place?

No, there is no reason and I would -- I would argue to answer 26 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 119th Legislative Day 5/3/2018 your question, Senator McCarter, that happens today as well. There are employees that are direct employees of the Governor's Office, who are tasked with making sure that the administration's desires, having been elected the Chief Executive, are carried out by agencies. So that happens today. What also happens today is the opposite of that when it comes to accounting for how salaries are paid for in the budget of the Governor's Office. So it happens both ways. We -- we're just saying, let's just make sure it happens this way. And -- and the intent of this bill is not to say that a Governor shouldn't be able to manage agencies and the direction of agencies; the -- the intent is to say, let's have a true accounting of what the cost of an office is.

Well, here's one of those times. This is a bill of -- for transparency, both Democrats and Republicans are practicing this in the past. Now it's time to do it right. With a Republican Governor, with a Democrat Governor, there's no reason not to be transparent in this way. This is a good bill. So, let me just remind you, I think we should do more of this, 27 STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 119th Legislative Day 5/3/2018 maybe less legislation, but more legislation that is good in principle and less in partisanship and probably would produce more for the people of Illinois.
