Today we're recognizing "women of wisdom" and so we are all supporting Senate Resolution 269, which honors -- honors elderly female residents in nursing homes, and these women are among the oldest Illinoisans of every race, ethnicity, and socio-economic status and have contributed mightily to our communities throughout {sic} their passion, ingenuity, and tireless determination. And I just simply want us to recognize these wonderful women who has been pillars of our communities throughout the State of Illinois. Thank you, Mr. President and Members of the Senate. We -- in -- in furthering our -- our honoring -- furthering our honoring of "women of wisdom", I have two constituents that I wanted to introduce to you all. They're -- they obviously could not come down to the Capitol, but I want -- this is in support of Senate Resolution 269 and the -- these stories are interesting. This -- one is, her name is Mary and she stays at the BRIA Health Service in Chicago Heights. She's ninety-seven years old. Her story -- she was born in Chicago in the year 1921. She says I love practicing my religion, which is Christianity. I have three daughters that I love so much. Now I have grandkids too. I loved doing house chores, like cleaning and cooking, but now I cannot really do so much. I love it here at BRIA, enjoy participating in games like bingo. I do prefer to sit in my room and watch TV or listen to gospel music for the better part of the day. My family visits me here and brings me goodies. My daughter always says, "My mom has always been a wonderful and hardworking individual. She looked after my siblings and I. She taught us so much and is a good mother. We went to church, school and family gathering. Now that she's old, we do our best to cater to her needs and we hope she stays with us longer to enjoy what she deserves in life." So this "woman of wisdom" is Miss Mary and, again, she's ninety- 14 STATE OF ILLINOIS 101st GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 27th Legislative Day 3/27/2019 seven years old. My second one is Miss Carmella and she lives at Prairie Manor Healthcare Center, also in Chicago Heights, and she is one hundred and four. Carmella is one hundred and four years old with a wonderful sense of humor. She loves to socialize with the residents and staff. She states that she worked hard all her life and that's why she's still going strong. She's the matriarch of five generations. Her favorite day is Beauty Shop Day at a hundred and four years old. So we're sending all our love and wishes and sending everything we can to those two beautiful ladies that live in my district. And they're two "women of wisdom" we're honoring today.

Thank you, Mr. President, Ladies of the -- of the -- Ladies and Gentlemen of the Senate. Can I please have your attention for just a quick moment? This resolution today declares March 27, 2019 as Elderly Women of Wisdom Day in Illinois to honor all women residing in skilled nursing facilities for their lifelong services to their families and communities. Today, as we honor these women -- these women are elderly women who acknowledge they have lived -- they have lived their lives with boundless spirit, courage, and 15 STATE OF ILLINOIS 101st GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 27th Legislative Day 3/27/2019 commitment. They're some of the oldest women living in Illinois. Many more -- are over than a -- over a hundred years old. They raised families, they served in the military, they were farmers and factory workers, and they lived through the Great Depression. Elderly "women of wisdom" have a rich history. They made our great State what it is today. Unfortunately, these women are often forgotten because they live in nursing homes, and their friends and their family have gone before them. You should have received stories about someone who lives in your district. I encourage you to read their stories and learn about these courageous women. Whether their courage was on the battlefield, fighting to make their neighborhoods safer, or struggling to get their children the education they -- and health care they needed, they have a great story to tell. These are the stories of the women on {sic} our history. Please join me in honoring their commitment and contributions to our great State. I want to share with you two women that live in my district. One is Nina. She was born in 1919 in Abbeville, Mississippi, and eventually moved to Chicago. She was a housewife and raised two sons. Nina has been very involved in her church and has been a leader in her church community for over forty years. She has always had an artistic spirit and uses it -- it to color and draw as her hobby. This has continued on here at the Glen Elston, where you can find her diligently working on many of her coloring books. And the other young lady that I have in my district that I am honoring today also is Francisca. She is eighty-nine years old. She was born in Visalia, California. She moved to Mexico at a young age and then came back to California, where she learned -- where she made her life for herself and worked in all types of jobs. Her favorite 16 STATE OF ILLINOIS 101st GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 27th Legislative Day 3/27/2019 position was working in a nursing home with her supervisor by her side and learning how to cook for residents of many different backgrounds and preferences. Long after she came to Chicago, she took up employment in the manufacturing world, making chocolate candy for Fannie May and for M&M. She also worked in a factory that manufactured small motors. Francisca's hobbies include knitting and cooking, especially her favorite Mexican dish. I want people to honor her and honor all those elderly women that are in a nursing home and to make -- make sure we continue to honor them all their lives. Thank you.

Let me tell you a little bit about Georgia. Georgia was born in 1925 in Arkansas. As a little girl, she worked in the cotton fields. Eventually, she and her family moved to Chicago in the 1940s. She raised four sons. And Georgia is an amazing woman, who always shares her positive vibes with others and provides words of wisdom. She enjoys listening to music and singing. I thank the -- Madam President for sponsoring this wonderful resolution that recognizes "women of wisdom". I, too, have several people in my district that I would like to honor today by reading a little bit about their history. Grace was a very active senior of Streator, Illinois. Early in her adult life, she worked in Owen -- at the Owens Glass Factory in Streator. Eventually, she married and raised six wonderful children. As her kids got older, she went to work as a cook at the local junior high, where she had a positive and lifelong impact on students. She worked there until her retirement. She loved that learning environment so much that she donated her teaching -- time every Sunday to teach Sunday 18 STATE OF ILLINOIS 101st GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 27th Legislative Day 3/27/2019 school. Grace became a member of the Streator Women's Club and volunteered at every community event, such as Relay for Life and serving as a Girl Scout leader. I also have June {sic} (Julia). June {sic} was born in DePue in 1912 to a family that eventually had eight children. June {sic} worked at the Westclox factory in Peru for a short time before her marriage. And the Westclox factory at the time was the first -- the factory where the first quartz clock was created; at its peak, had over six thousand people working at this factory. And I'm honored to say that actually my district office is in the Westclox factory. She and her husband were married for sixty-five years before his death. Julia lived on a farm and enjoyed cooking, baking, playing bingo, and playing euchre. She even frequented the riverboat casinos until she was ninety-eight years old. She and her husband raised three lovely daughters. And in conclusion, I would like to highlight Helen, who was born in Missouri. After she got married, she stayed in Missouri and worked on the farm. She also worked in the Finance Department at the Veterans' Hospital in Missouri for more than twenty years. Helen took care of her husband until he passed away, at which time she decided to move to Mendota, Illinois, to be near her husband -- or excuse me, to be near her son, John. Helen enjoys relaxing at her home at Heritage (Health) Mendota. She also likes to go out to eat, where she loves to order her favorite food - jumbo shrimp and coleslaw. Again, I'd like, you know, to recognize these young women for their accomplishments and we're honored today -- or we're glad to be here today to honor these "women of wisdom". Thank you.

I'm going ask the elders to please stand. The African Methodist Episcopal Church was born through adversity and it grew out of the Free African Society. If I can just get a moment. It was established in Philadelphia by Richard Allen, Absalom Jones, and others in 1787. And due to the racial discrimination at the St. George Methodist Episcopal Church, members made plans to transform their mutual (aid) society into an African congregation. Bethel African Methodist Episcopal was dedicated in 1974 with Richard Allen as its pastor. The geographical spread of the African Methodist Episcopal Church prior to the Civil Rights -- the Civil War was mainly restricted to the Northeast and Midwest area. The most significant area -- era of denominational development occurred during the Civil War and Reconstruction. Because of its rapid spread below the Mason- Dixon Line, the African American -- the African Methodist Episcopal membership has now reached four hundred thousand and today the African American Methodist Episcopal Church has a membership in forty-four countries on five continents. Reverend John Franklin White is the 130th Elected and Consecrated Bishop and the Presiding Elder -- Presiding Bishop of the Fourth Episcopal District of AME Church. He supervises the AME Churches and pastors in Canada, Michigan, Indiana, Minnesota, Wisconsin, Iowa, and Illinois. Senate Bill 1636 provides that a construction contract may allow up to ten percent of any payment may be withheld until the contractor completes fifty percent of the project. After a contractor completes -- or after the project is fifty percent complete, up to five percent of retainage may be held from any subsequent payments. This passed both the Senate and the House last year, was vetoed by the Governor. We'd ask -- I'd ask for your Aye votes.

Just for the Body, we debated this bill at some length in committee and I appreciate the effort that the -- the sponsor here is making; however, many of us think or thought, certainly as presented in committee, that this issue, the retainage, the amount of money that is held back in construction contracts, which is a common practice in the construction industry, this legislation would shift that and it would shift it by mandating certain retainages in certain situations. To me, this steps on the toes of a contract right that two parties have today. Senate Bill 1842, with Committee Amendment 1, simply extends the statute of limitation to allow for prosecution of any offense under the Illinois Funeral or Burial Acts {sic} (Funds Act) to within one year after the discovery of the offense by the victim. This was an initiative of the Randolph County State's Attorney in response to a situation where they found out about misconduct, but the statute of limitations had already come and gone. Well, Senator, I'm trying to -- trying to understand exactly how this works. So let me just give you an analogy and tell me if this is how it -- how it pays out -- or how it works. So an individual gets caught stealing from, let's say, a -- an -- an RP Lumber store and you caught them stealing that. Under current law, that individual then is charged with either a misdemeanor or a felony and that's the end of it. Under this legislation, the individual would pay for the product plus give you a ten percent bonus on top of that product for not -- for, in turn, for not being sentenced. Is that -- is that right?

I think there's a timeline there involved, but, essentially, what it would do is it would allow that person to avoid the misdemeanor or felony offense and then, yes, if they go through the process with the State's Attorney, if they reimburse the retailer, then their record would be wiped clean.

So, in this case, it's kind of a conflict of interest, because it's the -- in that particular case, the -- the -- the retailer then is -- that -- as opposed to current legislation where they may not get -- they may not recover that item, under this legislation, they get the full recovery retail price of that plus they get a ten percent on top of that. The bill, as I read it, prohibits a judge from sending someone to the penitentiary if that's what is left on their sentence. Can you clarify that for me, please?

Thank you, Madam President. I -- I'd be welcome -- welcome the opportunity, Senator. So, yes, I think -- I think your -- your read is -- is incorrect. The -- the confinement is permissive. It is not mandatory. It does not prohibit the judge from allowing an individual to go into -- into -- into those -- those options that I laid out. So, no, it's -- but it's permissive -- it's permissive authority on behalf of the -- the judge.

What information -- I mean, is there a requirement about what kind of information the judge needs to have in front of them before making the determination whether or not some kind of electronic home detention or monitoring -- monitoring might be available?

So, Senator Righter, as you know, the judge is the closest individual to the facts of the case, so they are -- they are the one who are -- who's in the best opportunity to -- to look at the circumstances around -- surrounding the -- the inmate. But the actions and activities that will take place, it will be done so in 50 STATE OF ILLINOIS 101st GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 27th Legislative Day 3/27/2019 consideration with the -- with the individuals who -- the individuals who are -- the parole and -- and pretrial and -- and the services that are available that -- that -- that are -- that are surrounding that individual. So they would have -- the judge won't be doing that on their own, but there will be services laid out for -- and a plan laid out for that individual to -- to say which one of those placements would be most appropriate.

Senator, I'm going to go back to my first question about the nature of the bill and whether or not a sentence to the Department of Corrections is being prohibited and I'm going to read from your bill. Starting with page 14 at line 20, "An offender sentenced to a term of imprisonment for a Class 3 or 4 felony, other than a violent crime as defined in Section 3 of the Rights of Crime Victims and Witnesses Act, in which a {sic} (the) sentencing order indicates that the offender has less than four months remaining on his or her sentence accounting for time served may not be confined in the penitentiary system of the Department of Corrections…" That to me reads to be a prohibition on the judge's discretion with regards to sentencing. Would you disagree with that interpretation?

Again, Senator, as -- as you read, it said, "may not", not "shall not". But then in the second sentence {sic} on -- on page 15, line 2, it says, "but may be assigned to electronic home 51 STATE OF ILLINOIS 101st GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 27th Legislative Day 3/27/2019 detention under Article 8 {sic} (8A) of this Chapter" -- "of this Chapter 5, an adult transition center, or another facility or program within the Department of Corrections." In the time that I've been here, any time I've seen the language used this way, it's a prohibition - you "may" or "may not". "May not" usually means you can't do it. If it's truly the intention to make this permissive, there's an option to take the bill out of the record and add an amendment on here, which I'm guessing would probably garner more support than this may right now as it stands, because we are telling the judge now, you can't send this someone to the penitentiary even if in your judicial discretion, which we are for sometimes and not for other times, you deem that's appropriate. Respectfully, I would urge a No vote.

It requires the Department of Human Services to establish a five-year Customized Employment Pilot Program to help people with intellectual or developmental disabilities find employment with competitive wages. Thank you. I just want to compliment the sponsor here and also just the negotiation process on this. I've talked about this bill a lot back home from a perspective that this bill had been - - the law on this had been over here on this side. The Governor moved it here and there is a tendency to want to move it all the way back. And the reality is we needed this to land somewhere in the middle. And I cannot thank the IEA on their negotiations on this enough as well as the Senator on this. We have landed into a great place and I know my districts back home that wanted to see this flexibility, once they saw where this bill landed, are very pleased. The bill also provides that a court shall not order the sealing conviction record for a financial exploitation of an elderly person or a person with disability, aggravated identity theft against any person over sixty, and abuse or neglect of a long-term care facility resident. I know of no opposition.

I'm sorry, I -- I had pushed the button and I didn't know if you saw it. So Senate Bill 69, I understand what the sponsor is trying to do and I appreciate her efforts. The problem I have 74 STATE OF ILLINOIS 101st GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 27th Legislative Day 3/27/2019 with this bill is that it reverses us, takes us back to the past when it comes to sealing of records. We worked for years to try to be sure that crimes that we give a person the sentence for would not be a lifelong sentence. We even have sealing of records available for murder. After ten years of being on the registration list, murder registration list, many after three years, they could seal their records. This bill ignores all the historical work that we've put in trying to reform criminal justice in Illinois. When people have a lifelong sentence, the communities pay for it, 'cause we pay for their children's food, their -- you know, with food stamps, we pay for their health care, we pay for everything, including for the -- for the person who committed the crime who ends up in a cycle of going in and out of prison, in and out of prison. So, for that reason, I do not support this, because this bill is going to cost us far more money than it's going to save us. And any time that you can seal a more egregious crime, such as if they killed the senior citizen, they will be able to seal the record, but if they don't kill 'em and they just steal five thousand dollars or more from 'em -- extort 'em out of five thousand dollars or more, that record cannot be sealed. So as uncomfortable as this is for me to stand up and say this, I realize that we were sent down here to Springfield to carry the voices of ordinary people and to be sure that the government is really operating in the best interest of its citizens, and when a person is locked out of society for life for a crime like this, we all pay and we pay over and over and over again. For that reason, I do not support this legislation.

What -- this legislation would -- will update that -- that particular law. Video streaming, as you know, is becoming more and more popular and, unfortunately, there have been incidents across the country of drivers, operators of motor vehicles, watching videos on their personal cell phone or their electronic device while they're driving. So what the -- there's some concern that the current State law is somewhat unclear. It could use further clarification to make sure that's prohibited. So this legislation specifically states that watching video on a personal electronic device will not be allowed. I'm happy to answer questions. I'm not aware of any opposition.

What this bill would -- right now we have drainage districts across the State, and as we've had urban areas expand over into those areas, we actually have municipalities and counties who can better service some of these areas. So what it does is it provides for the opportunity to transfer drainage responsibilities from drainage districts to other units of government. It protects property owners. I've worked with the Farm Bureau to try to soften the language on this. We only apply it to drainage districts that are seventy-five -- at least seventy-five percent inside of a municipality. It applies to four watersheds in the Chicagoland area. I would welcome any questions.
