They were number thirty-five in the country. They went 19 and 1 in their last twenty games, playing one of the toughest schedules in Illinois. It's with great sadness that I ask this Body to, once again, remember the life of yet another Illinois State Trooper who was recklessly killed in a crash. Trooper Gerald Ellis died Saturday morning when his squad car was struck head-on by someone driving in the wrong direction on I-94 east of Libertyville. To be honest, I'm at a loss of words, as Trooper Ellis is the third trooper to be killed in a crash this year. We can't even begin to imagine the extent of the anger and sadness his family must be feeling, but we can honor and remember his service and the sacrifice he made. I'm sure everyone has heard about Trooper Ellis' heroic story now, but for those who haven't, allow me to do my best to explain how courageous he was. On the morning of Saturday, March 30th, Trooper Ellis was on his way home on I-94 when he noticed a car driving in the wrong direction toward oncoming traffic. According to an unconfirmed eyewitness account, Trooper Ellis selflessly veered into the path of the wrong-way driver, saving the lives of the people behind him. This isn't the first time that Trooper Ellis made a swift, in-the-moment decision to save someone's life. Just a week before he died, he went out of his way to save the life of an overdose victim. Even though it 27 STATE OF ILLINOIS 101st GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 29th Legislative Day 4/3/2019 wasn't his call to respond, Trooper Ellis went to the incident site anyway, used Naloxone and a defibrillator to help bring an overdose victim back to life. His actions are the true definition of heroism. Trooper Ellis put his life on the line every day to save others, and because of him, so many families get to hold their loved ones again, but his family never will. So today I'm asking that you keep his wife, two young daughters, and the rest of his family in your prayers as they endure what no one should have to endure. Trooper Ellis will likely be remembered among others who have been killed so far this year, but let us do our very best to remember each one of these troopers individually and not just a number that makes up this year's puzzling statistic. I would ask that we have a brief moment of silence in Trooper Ellis' honor.

I'm -- I'm joined here by a distinguished guest here that I have today. And that -- I know we usually don't do this, but we're going to read a Proclamation today for a friend. And this Proclamation is introduced {sic} by President John J. Cullerton and myself, Senator Terry Link, and it's presenting to Ron E. Powell. Ron E. Powell served as the President of Local 881 United Food and Commercial Workers International Union and retired December 1st, 2018, after more than fifty-seven years of dedicated service to the working men and women of Illinois. He served currently in the honor of {sic} the United States Army and studied at Northern Illinois University. He led the first recognition strike of {sic} Jewel Tea Company in DeKalb before joining the staff in Local 881, serving the union as a field representative and director of field operations, vice president and -- executive board, the secretary-treasurer. In 1983, he was elected president of 881 in 1983 and became the longest-serving constitutional officer of the union's history. He was elected vice president of the Illinois A.F. of L-CIO Executive Board in 1986 and served under five different board presidents. And he has a dedicated career of 30 STATE OF ILLINOIS 101st GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 29th Legislative Day 4/3/2019 protecting the rights of union members, workers throughout Illinois, northwest Indiana, and helping countless workers find their voices in jobs. I -- I just wanted to highlight the fact that Ron has served the working men and women in this State for so long, after fifty-seven years of service. I find it to be very interesting, if you look at his record, that he served as a staff assistant to the Speaker of the House from '71 to '75 and was the Parliamentarian of the House in '73 to '75, a little -- a few years before I -- I got here. But during all these years we've been interacting -- the fact is that he also knows what we do and what we do down here and that's really, really very important. He also, himself, was a -- a -- serving as a trustee in his own village. Is this bill designed to tell the Douglas County Circuit Court how to rule in its pending case with EDP against the local townships in Douglas County?
PRESIDING OFFICER: (SENATOR MARTINEZ) Senator Cunningham.
No, it is not. This bill is designed to clarify a long- standing State law that established county governments would set the rules for the siting of windmills in the State of Illinois. There was a debate had by this Body, I believe about a dozen years ago, where it was considered -- the -- the Body considered how we would -- what sort of rules would be set up and how windmills would -- would be sited. Some states have kept that decision-making power to themselves and it sets statewide regulations. Illinois decided to give this -- the rulemaking authority to county governments. In this particular instance, the county government set up rules for the county and this particular company has followed those rules for placing the windmills. As you alluded to, there is a dispute going on regarding this right now in court. This bill is designed to clarify what the intent of the General Assembly was in the bill that we passed some twelve years ago.

I know. So the -- the -- Senator Cunningham, the EDP was the 36 STATE OF ILLINOIS 101st GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 29th Legislative Day 4/3/2019 only company that testified in favor of this bill at the hearing in your committee, was that not the case?

I don't recall if we took testimony from -- from anyone else, but obviously, yes, they testified in favor of it.

And the subject matter of EDP's testimony was that the intent was to essentially overrule the court case in Douglas County Circuit Court.

I don't believe that was their specific testimony. I think what they pointed out, and what renewable companies throughout this State have pointed out, is that they have made multimillion- dollar investments in our State - hundreds of millions of dollars' worth of investments in our State. They have employed thousands of workers in our State and will continue to do that going forward. They made those decisions, they decided to invest in Illinois based on an existing law, based on a law that this Body passed. A -- a unit of local government has sought, and I believe in an unjust way, to undermine that. That is putting this project and dozens of other projects, dozens of other investments in the State of Illinois in jeopardy. So the belief is, we need to clarify that law. That's to ensure this investment continues. That is why 37 STATE OF ILLINOIS 101st GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 29th Legislative Day 4/3/2019 this bill is before us today.

Ladies and Gentlemen, I -- I know how this is going to go, exactly how it went in the House, but just for the record, there used to be sort of a gentleman's rule here that we didn't go retroactive on bills and we didn't run to Springfield when there 38 STATE OF ILLINOIS 101st GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 29th Legislative Day 4/3/2019 was active litigation pending in -- in counties. And -- and frankly, I think that the windmill, which is EDP, has a very good chance of winning that court case in -- in -- in Douglas County. But instead of allowing citizens to have their day in court on both sides -- and by the way, I have constituents on both sides of this debate, very good friend, constituents I've known for almost twenty years on both sides of this debate. But instead of allowing those folks to have their day in court, we're going to statutorily tell -- legislate an outcome for that court case. And, you know, it's one thing to have a set of rules going forward; it's another set of rules -- thing to have rules that are retroactive and are going to affect what I appreciate Senator Cunningham has admitted, is this Douglas County court case. EDP was there. They were the ones testifying in committee, and they said that they simply didn't have the time to wait for the courts to get their ruling. Didn't have the time - and that's what this is all about. This is special legislation affecting a court case in Douglas County that, frankly, EDP itself probably wins. I don't know. I'm not their attorney. I'm not the attorney on the other side. But that's why we have a judicial system, that's why we have judges, to interrupt the laws that we made ten years ago. It's one thing to go forward; it's another thing to go retroactive. You know, I have, over the course of several years here, tried fervently to avoid taking positions on bills that would overrule a court case or tell a judge how to decide. And it's -- you know, our job is to legislate going forward; it's the court's job to interrupt what we've legislated. And with that, I -- you know, I'm going to vote No. I'm not sure how anyone else will vote. I'm fairly -- I've got a good hunch, but I'm going to vote No. This is special legislation for one 39 STATE OF ILLINOIS 101st GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 29th Legislative Day 4/3/2019 entity and -- tell a judge how to rule in a court case and it's just not appropriate for us to be involved, especially when the citizens should be allowed their day in court on either side, on either side. That's why the courts are there. Thank you, Madam President.

Thank you, Madam President. I appreciate the concerns voiced by the Senator. I understand he has a situation in his district that he's trying to take care of. All of us would do the same. I would suggest to the residents of his district and the residents of any district in the State of Illinois, if they have a problem with the siting of windmills in their community, to do what the law says, and that's go to their county board. There is a venue -- there is a place that our law has contemplated for local citizens to go to debate and -- and influence the way windmills are sited. I think that's the proper venue for their dispute. Secondly, I'd like to address the notion of this being special legislation. That is not the case. As I mentioned at the outset, there are dozens of renewable companies who are looking at Illinois, who are going to make multimillion-dollar investments in our State, employ hundreds, maybe thousands of workers, and pay millions of dollars in property taxes to our local school districts. They have to make decisions about whether or not their 40 STATE OF ILLINOIS 101st GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 29th Legislative Day 4/3/2019 investment here in Illinois will be able to move forward. We, as a Body, need to -- to send them a signal that they can, they can make those investments and it will -- and -- and that local groups will not be able to shut them down; that they will have to go to their county board in order to make any sort of adjustments to the siting of those windmills. We can't -- Illinois can't afford to let this happen. We can't drive businesses out of the -- out of our State with needless government regulation. I'd support an Aye -- I -- I would appreciate an Aye vote.

Regarding this particular Senate Resolution 83, declares April 2nd, 2019, as Pay Equity Day in the State of Illinois in order to raise awareness about this endemic inequity. We pass this every single year to identify how -- what 41 STATE OF ILLINOIS 101st GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 29th Legislative Day 4/3/2019 day in the year women must work to earn the same amount as our male counterparts. We have made a lot of information known about the fact that it is eighty cents on the dollar for women in general; however, black women must work until August 22nd to make the same wages and Latino women must work until November 20th to make the same wages. So on this day, the day after the actual Pay Equity Day, I just would ask everyone to acknowledge the fact that there are things we can do to change this. And I'm really proud to serve in a Body where we keep working to do that. Thank you, everybody.

For a hundred years, Easterseals has been the leading advocate and service provider for children and adults with disabilities, veterans, older adults, caregivers, and their families. In 1919, following the sudden death of his son, Edgar Allen founded the organization. In 1931, the organization authorized a "Bill of Rights" for children with disabilities, which 42 STATE OF ILLINOIS 101st GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 29th Legislative Day 4/3/2019 led to government-funded disability services. In 1945, Easterseals expanded its children-focused mission by opening programs and services to include adults. Easterseals has become the leading national network of more than seventy community-based non-for-profit organizations that deliver high quality, local services and support. Illinois is well served by four Easterseals organizations with twenty-two locations across the State. Easterseals is a strong partner with local, state, federal government, corporations, foundations, and other sectors to provide or connect individuals and families to early intervention and childhood education services, autism spectrum disorder services, employment services and placement, mental health services, respite, camping and recreation, and caregiving and aging supports.
