Thank youy Mr. President, Ladies and Gentlemen of the Senate. House Bi11 3-0-2-8, in its current form, does two things: one is it clarifies khat we w1ll be using General Revenue Funds to pay for the State fairs, instead of the Agricultural Premium Fundz so that we do not have to continue those transfers every yearz and secondly, by the amendment we adopted yesterday, it guarantees that the thirty-six million dollars of excess funds that are sitting in the Road Fundz will, in fact, be paid back within three years from today. We w1ll be borrowing it this year. We shall voluntarily pay some back next year, and if we do not, the Comptroller will take one-twelfth of whatever remains unpaid and take it from General Revenue and put it back into the Road Fund the third year. The Secretary of Transportation, in his testimony yesterday, though he is not enamored or in love with that which we are doing, did indicate from a cash flow basise that this did no 4  STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 102nd Legislative Day June l3, 1990 risk at all to the cash spending plan of the Highway Program of Illinois, and in faet will not in any way impair or impact any road, bridge, airport or anything else the Department is doing. With this guarantee that the funds We are using that are currently sitting in a banky can be used to maintain a balanced budget fcr needed programs and paid back before the Road Pund needs them, would urge a favorable roll call on House Bill 3028.

As Senator Carroll has just indicated, the second part of this bill is -- forms an integral part of the bipartisan Senate budget plan. The Office of Thrift Supervision, the FDIC and the RTC Oversight Board are asked to provide Illinois S & Ls, which are threatened with seizure, an opportunity to qualify for open thrift assistance before a takeover is attempted by the Federal Covernment. This has no cost to the State, and I would like to emphasize that. In fact, we will probably save money because Illinois has, at present, two hundred and forty-three S & Ls with total assets excess of sixty billion dollars, twenty thousand employees, and combined net profits of sixteen million. For the sixth consecutive year our S & Ls have been veryz very profitable. They 've had their most profitable year, and now they wait ln threat of seizure. It just costs us more in federal dollars. As Ilm sure everyone is aware, on May lstw as -- as required by 29  STATE OF ILLINOIS 86th GENERAL ASSEMBLX REGULAR SESSION SENATE TRANSCRIPT 102nd Legislative Day June 13, 1990 law, the Compensation Review Board, having heard public testimony j and considered -- made sone recommendations concerning the base 1 I compensation of a1l State employees, includin: the hundred and sixty-five or so that are State officers and Constitutional Officers, the entire Judiciary, and of course, the General Assembly. Senate Joint Resolution l92 is, I Ehink, a reasonable response to the recommendations of the Compensation Review Board, and what it saysy essentially, is that the increased compensation that was recommended for State officers pursuant to the Compensation Review Actz dated April 25, 1990, be reduced to zero. We are recommending, although the Compensation Review Board, in my judgment: made quite a compellin: case for increased compensation for the Constitutional Officers, the Stake Cabinet and Code Department Directors, the members of the Judiciary and the Members of the Assembly -- although, in my judgment, they made a compelling case for increased compensation, recognizing that we are indeed in tight fiscal straits in this State, this recommendation contained in Senate Joint Resolution l92 would reduce to zero percent those proposed recommended increases: and would further approve the recommendation for annual increases as set forth in the report. That report sets forth -- it is recommended that a11 salaries of public officials on July 1, 1991, and July l of each year thereafterz receive a cost-of-living adjustment. By the lesser of a cost-of-living index to be determined, or five percent of the current salary, and the cost-of-living index is the one that's used by the United States Department of Labor, which, in fact, I'm told, last year amounted - - was in the amount of some 3.7 percent. That index was adopted, the report says, because it is one of the most conservative of available indexes. Here you are wanting to raise the salaries of a thousand-plus employees of the State. Senator Davidson said this is a tough budget year. It is a tough budget year, and we fve had other tough budget years, but Ladies and Gentlemen, there isn't one employeez that I'm aware oft in State Government that isn't going to qet a pay increase. There hasn't been one State employee that I'm aware of, except those covered by these resolutions: wbo hasnlt gotten some pay increase in the past three years. The only ones who haven't are the people sitting here, the people sitting across the rotunda, the executive braneh officers and the judqes. How many employees could you hire in you businesses back home if you said to them, ''Youdre not goins to get a pay raise for three yearsz or five years.î' Not many: I don't think. Not many . Now I'm not standing up to oppose this resolution to plead for us. Each of us know the kind of time and commitment and talent that We give to our jobs, and in al1 lack of humility, on behalf of each of us, the public gets their good money's worth, regardless or whether We get a pay raise out of this one, out of Senator Roek's resolution: or not. But let me mention one other area of government that causes me great concern, and that's the Judiciary. Let me read from the report of the Compensation Review Board. Illinois judge: -- quote -- fllllinois judges are required to contribute as much as eleven percent of their gross pay to their retirement fund. This is one of the highest, if not tbe highest such contribution in the United States. Indeed, some states fund the retirement of judges with no payment for -- from the judge. Federal judges are not required to make any payment -- any payment into their individual retirement fund, because they receive full salary for life. This substantial retirement eontribution makes comparisons of Illinois judges' salaries with those of other states misleading. We heard 37  STATE OP ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 102nd Legislative Day June 13, 1990 testimony'' the Commission dld Hthat after deductions for retirement and taxes, the net pay of a State court judge may be less than four thousand dollars a month. The most compelling argument for a substantial increase in the compensatlon of the Judiciary is the comparison of salaries of Illinois court judges with those of federal judges. As of January 1991, a trial eourt judge in the federal system will be receivin: an annual salary of a hundred and twenty thousand eight hundred dollars, which is forty thousand dollars more -- forty thousand dollars more than the current salary of a trial judge in the Illinols State Court.'' A more dramatic example: made by a spokesman for the Joint Commission, is that a maqistrate in tbe federal court -- a magistrate, who qenerally cannot try a case without the agreement of the parties, will be receivinç approximately a hundred and eleven thousand dollars. Almost seventeen thousand more than a Supreme Court Justice of the Stake of Illinois. The top 1aw school students are being hired by law firms in the City of Chicago at starting salaries equal to associate judges and circuit court judges in the State of Illinois. Shame on us for not recognizing the quality and the commitment of the Judiciary in Illinois. Now webve agreed, by the passaqe of Senator Rock's resolutionz not to sive them an increase, but to give them a cost-of-livin: adjustment that starts in 1991. That is small, inadequate compensation for the Judiciary of this State, but at least it is some small recognition. If you vote Yes on SJR 164, you're saying to another equal branch of qovernment tbat theydre not even entitled to that. I can't do that, and I hope a majority of you won'k do ehat, either. I urge a No vote.

Come January, we have a new Governor coming in. We, needless to say, hope it will be Jin Edgar. You, hopefully, will be wronq, and you hope it's Neil Hartigan. But the simple fact is, itfs going to be a new Governor, and I want to give you one comparison outside of the legal field. Secretary of Transportation: a budget of well over a billion dollars a year, is paid seventy-one thousand dollars. You know an engineer with a couple years' experience, with a master's degree, kill start at over sixty thousand, and their budget consists of beinq able to get three or four pencils in their drawer. NoW you start to compare the private sector to what webre asking the Secretary of Department of Transportation to earn, and gou look at the responsibilities and *he differences. It is in the Judicial field and Senator Berman is right, and -- and I second everything he said, but just look at the Governor's Cabinet. The Director of the Department of Public Aid makes rouqhly half of what someone in *he private sector in those sort of fields makes. we Want - We hope Jim Edgar, you hope Neil Hartigan if we want a new Governor to have the kind of cabinet we need to solve these budget problems wedve been wrestling With year in and year out, you know, gang, you can't starve the cabinet to death forever. At some point we have to get . those salaries back eo a competitive level so that We can ask people in the business world who are in their fifties to take these jobs. You don't have a eabinet made up of twenty-five-year-olds. You need to have a salary commensurate with the ability level of the people We want in the Cabinet, and that's Governor of this State.

I don't know hoW many of you came out of county sovernment, but I did, as chairman of the county board . And I remember very Well that the county employees were worklng from eight to five, but I also remember very Well that the circuit court judges started at nine. maybez and they quit no later than four: with rare exceptions, unless they had a murder case or some other hot issue case that had gone to the jury. We, the county and the State, pay all their overhead, their secretaries, their court reporters, they save no -- they don't contribute any more to their pension fund that you and I do as a legislator. So please don't cry to me about these poor: underpaid judges. Every time there's a vacancy for judgeship, at least in this judicial Section, there's no lack -- no lack of candidates for that vacancy. In fact: think we have one nowy and therels thirty some odd applications for that one vacancy. So don't -- don't tell me how bad off they are. You vote however you want. I think it's ill-timed, ill-advised. If we 're going to continue to have citizen legislators, which the -- our founding fathers in the Constikution asked us to do - and one of the local media stations here had a very good editorial on that this past week - I think a11 of you should vote No by voting Yes to reject the recommendation of the Compensation Review Board, and I would appreciate a Yes vote.

This bill's a follow-up to last year's House Bill 90, which was -- or -- designed to allow pharmacies an opportunity to participate in HMO contractsy and thereby allow consumers to deal with the pharmacy of their choice. The amendment incorporates a two-year sunset provision, as was conkained in the legislation we passed out of here last year. The amendment also exempts HM0s which operate their own pharmacies rather than contracting out for pharmacy services. This provislon was also adopted in last year's bill. That bill fell on tough times over in the House, but an identical bill has come over to the Senate. And what we are doing in this amendment has been requested by the Municipal League and by the Tawnship Offtcials Association. It merely cleans up, or at least provides a clarification an coterminus townships. It makes it clear that coterminus status remains Within their governmental structure, even after boundary changes may have occurred during the annexation process.

Senator Berman, I had planned to talk to you before this came up, but I didn't vote for this in committee because I had some eoncerns about what this actually do and the limits that you are placing on here. Now, Ry analysis shows one thing, but is the bill ltmited to just those four things: because I read it -- it is so broad that the person who is leasing the car could -- could end up having to pay for those damages themselves instead of that two-hundred-dollar limit. As I read it, it says in any action brought by the person who io doin: the leasing. So as a result, what eould conceivably happen -- and you being an attorney -- did that include like depositions, appearing in court, and so forth and things of that nature?

And that's what I meant in committee that I had some concerns, because it is too broad, and a person rentin: a car that's involved in an accident might end up havinq to pay a11 of that cost hinself. And that's why I say it's not limited to what you said those paraqraphs on that page says it does. It says that, ''any action.''

Thank you, Mr. Presldent, Members of the Senate. I strongly oppose this amendment. This amendment really attempts to gut the bill. This bill in its current form is the way desired. This amendment deletes the bill - makes the bill a nothing bill. So I'd ask this Body to defeat this amendment.

Thank you, Mr. President. stand in support of this amendment. The sponsor, in committee, and others who support this bill, have indicated thak what they want is a disclosure of where the parts would come from that are goin: to be used to repair an automobile. That's precisely what this amendment requires. requires that the estimate thatls prepared detail the name of the manufacturer of the part. And I think that represenks disclosure. The unfortunate thing about the bill, as introduced, it seems to have an implied criticism that any part that's not made by the original manufacturer is somehow inferior, and that's simply not truew Ladies and Gentlemen. It is not true. And not every part that's made by the original manufacturer is made by a union worker either. Some of those original parts are made in foreign countries. This bill deletes that requirement -- this amendment deletes that requirement. And I ask that this Body defeat Amendment No. 1.

Senate Anendment No. l to House Bill 3019 revises the exception to the six-year period of Statute of repose in attorney malpractice cases for actions involving wills and other testamentary documents. As passed in the Housee the bill provided a ten-year Skakute of limitations in such cases, which could have meant that the Skatute could run before the will went into effect. This amendment eliminates that period and specifies that the action must be brouqht within two years after the date of death, or if the will's admitted to probate, Within the time for filing claims aqainst the estate or contesting the will, and I'd ask for adoption. That seems to be where most of the support is located for this bill, and that's basically what the amendment does. And I would move for its adoption.

Senator Welch has filed a fiscal note on House Bill 3426 on the assumption that an amendment kill be adopted that Will require a fiscal note explanation. The bill, as it is presently written and as the amendnents that were offered in committee and one other proposed amendment by Senator Joyce, has no fiscal implication. An amendment offered by Senator Kustra seems to be the amendment in question, as far as a fiscal implication -- fiscal note. So we're filing a fiscal note on a bill that has no fiscal implication, and may not have any if Senator Kustra 's amendment is nok adopted or if he withholds it, and we move iE, gek these amendments one and move it to 3rd, and bring it baek for him to try. But at this point, Iêd like to know just Where welre at because the fiscal -- there is no fiscal application to the bill or to the amendments from committee and Senator Joyce.

Well. Under the -- under Chapter 63, Section 42.32 33: if the sponsor of a measure is of the opinion that no fiscal note ls neeessary, any Member of either House may thereafter request that a note be obtained. And in such case, *he matter shall be decided by a majority vote of those present and voting tn the House of which he is a Member. So I guess what that says, essentially, is if you as the sponsory have the opinion that no fiscal note is neçessaryz and a majority of the Members agree with you, that's fine. I'm -- I'm told that tWo fiscal notes have been filed, one as to the original bill and one as to the bill as to be amended. Now, if -- if you -- ordlnarily around here we -- we honor -- and we always honor requests for fiscal notes. If -- if indeed it's your opinion that no fiscal note is necessary, we can put the question, and if a majority agree with you, then We'll move on. Senator Savickas.

Senator, I'd just say that this amendment proposed by Senator Xustra is a far-reaching amendment banning a1l types of incineration, both hazardous waste and municipal, Which was not the original intent of the bill. The banning of incineration of municipal waste would seem to me to impknge upon the powers of municipalities - that would possibly have a impaee here in the State. So, therefore, I filed a fiscal note, to see just what the cost would be to the State if we passed the amendment, if we mandate requirements on these county waste management committees that have been meeting for two years. The Kustra amendment naw would take away their authority to use incineration as an option, and that may have a fiscal impact, so I think it ts applicable.

Is your fiscal note only to the Eustra amendment? There is a fiscal note on the original? Is someone else the filer of that?

Senator Welch.

I was advlsed by the staff that to file a fiscal note against the Kustra amendment, I also had to file a fiscal note against the bill. I do not believe the original bill has a fiseal impllcation to the State. I do believe the Kustra amendment does have implications, but I was told procedure in the Senate is to do b0th fiscal note requirement -- fiscal note filinqs.

Mr. President, sinee the Chair has statedg by rulew that we can, at the sponsor's request, remove the applicability of the fiscal note to House Bil1 3426, I would like to ask if ke can do that by -- by a khirky vote, since it was admitted that Senator Savickas' original bill, 3426, and my understanding, Senator Joyce's aaendaents which he wanted to put on does not have a fiscal impact, can we just take the thirty or -- or -- can we just go with the -- the -- the vote to move 3426 with the -- with the two amendments? And Savickas says later time if he has to, he'll call the bill back. But can We jusk do it noW?

Well: upon request of the sponsor, it certainly could be done. I#m not sure it would accomplish the purpose: because the second fiscal noee request would apply to the amendment. And so once the amendment is offered, the bill would still remain on 2nd Reading. My sugqestion is that those who are interested ought to get together, and we'll get back at it tomorrow.
