Senator Welch, thank you for asking that question. I don't think I've -- I know what our strategy as a Body will be. As I understand it right now, our busy colleagues are up in Chicago holding their own appropriation hearings, and as I also understand it, may be, perhaps, in the act of doing the first thing -- doing -- for the first time in a decade, even drafting their own vision of a budget. So, I -- I think it will depend in part on the actions of the other Chamber, as well as the progress we make before the end of 3rd Reading deadline. Senator Rauschenberger, it's kind of unusual for us to defer to the House on this, and I am sure they will not put the Governor's proposed budget ideas in their appropriation bills. So, if you're saying you're waiting on the House, are you saying that you're not going to put in the Governor's proposed budget in any of these bills, as he -- as he addressed the Joint Session?
PRESIDING OFFICER: (SENATOR DUDYCZ) Senator Rauschenberger.
I don't know -- you may or may not be aware that, I think, Economic and Fiscal has already cast some doubt on the revenue estimates used to prepare the Governor's budget. We expect the Executive Branch may need to react to change their own introduced budget. And I wouldn't want to leave you in the mind that we would be in a position to let the House lead. I'm just saying that our -- the choice of our action of sending a shell bill or extending deadlines will probably be determined by our response to what their actions are. Certainly not, though -- you know, we're always interested in the House's input.

Senator, you know, you referred to the Economic and Fiscal Commission having a lower estimate of revenue. Well, Economic and Fiscal had a lower estimate last year and it didn't stop the Governor from ignoring their estimate and using the Bureau of the Budget's estimate, which was a hundred and eighty million dollars higher. So, I -- I would assume that the Governor will continue 27 STATE OF ILLINOIS 92ND GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 77th Legislative Day March 7, 2002 to use the Bureau of the Budget estimate, and he would ask your side of the aisle to go ahead and amend these bills to go along with his proposed budget that he addressed.

The Governor may ask us to do a lot of things, but this side of the aisle, in particular, has always coveted a very conservative estimate of estimates -- or, of -- of revenues, and I think it bears itself out, in the current situation we're in, had we all been a little more disciplined in our revenue estimates, as you point out Economic and Fiscal was, we might be in a little less precarious position today. But I -- I don't expect this Body to waive its constitutional responsibility and accede to the Executive Branch's suggestions if we don't think they're the right ones.

This legislation amends the Illinois Enterprise Zone Act and Public Utilities Act to remove restrictive language for Whiteside County Enterprise Zone. In 1999, we passed legislation that authorized the extension of the life of the Whiteside/Carroll County Enterprise Zone from twenty to thirty years, but for industrial purposes only. This legislation makes the Whiteside County Enterprise Zone just like the others in the State, and I'd ask for your Aye vote.

Thank you, Mr. President, Ladies and Gentlemen of the Senate. Senate Bill 1606 would amend the Senior Citizens Real Estate Tax Deferral Act by increasing the annual household income eligibility cap from twenty-five thousand dollars per year to forty thousand dollars per year. This idea came to me from a senior citizen in Downers Grove who said that this has not been raised or increased for at least six or seven years, and due to inflationary pressures, it should be raised. And the forty-thousand-dollar limit is also the limit that's used in a number of other senior citizen assessment and real estate statutes and ordinances. For example, the income limit for the senior citizens assessment freeze homestead exemption is also forty thousand dollars. This doesn't cost the State any money. We eventually recoup it with interest, and I think it's time that we adjusted for inflation this level up to forty thousand dollars. Thank you.

It allows providers to care for individuals with an extended prognosis of up to one year instead of six months, as it is now. And it changes the licensure requirements for a for-profit hospice. It says that it does not need to be part of a home health agency, hospital, or nursing facility.

Senate Bill 1637 {sic} (1634) amends the School Code to state that 35 STATE OF ILLINOIS 92ND GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 77th Legislative Day March 7, 2002 all public elementary and secondary educational institutions shall recite the Pledge of Allegiance. I had a mother call me in my district office - she had a child in grade school and a child in high school - wanting to know why they didn't say a Pledge in high school like they do in grade school. And, very honestly, I couldn't give her an answer. So we did a little research on it; this is what we found out. There are twenty states that require public schools to recite the Pledge. There are eight that encourage schools to conduct the Pledge, but it is optional. There are -- there are four states that allow the teachers or administrators to read the Pledge or post it in the classroom. Of all the states, Illinois is the only one that distinguishes between elementary and -- and high schools. So this changes that law. I know of no opposition. I'll be happy to answer any questions.

Thank you. This is a simple bill. I'm not sure if the Department of Central Management Services has signed on, but this is a leave-sharing proposition for State employees. What it does, it requires Central Management Services to adopt rules to allow an employee of a State agency to share with a spouse unused sick or vacation or personal time. And that's basically what it does. Thank you, sir. Senate Bill 1794 came out of the Senate Public Health Committee on the Agreed Bill List. Senate Bill 1794 declares that prior to a prospective resident's admission to an assisted living establishment or a shared housing establishment, the establishment must advise the prospective resident to consult a physician to determine whether he or she should obtain a vaccination against pneumonia. Senate Bill 1794 is a follow-up to Senate Bill 734, P.A. 90-366, Smith - 1997, which mandated the same requirement in Senate Bill 1794 for nursing homes. I urge a favorable vote for 1794.

Senate Bill -- 1976 provides that from July 1, 2002, until July 1, 2005, the rate of interest used in calculating minimum nonforfeiture amounts for certain contracts, which basically are annuities, shall be 1.5 percent rather than three point -- three percent. Basically, we set the minimum rate for annuities that are written. Because of low interest rates, the industry would like to lower the guaranteed rate to 1.5 percent. If the economy picks up, they can write 'em for higher; they don't have to come back to us.

The written disclosure must include the signature of the consumer, and that if there is going to be a cancellation, that there -- with that -- within thirty days after the document has been received, that it must be then returned. The amendments -- Senate Amendment No. 1 which was -- or, Committee Amendment No. 1, which was adopted, also provides some technical and clarifying language. This came out of the Insurance Committee on the attendance roll call. I know of no opposition. I urge its adoption.

Thank you very much, Mr. President, Ladies and Gentlemen of the Senate. Senate Bill 2004 amends the Hospital Licensing Act. If you remember, a number of years ago when our hospitals were having to send in their renovations and remodeling, the Department of Public Health was behind in getting approvals for these projects, so we started to charge a fee to help take care of this backlog and to hire new people. Senate Bill 2004 now rescinds the fee because we have about 4.6 million dollars in the fund to do this. And so what we're doing is saying for projects above five hundred thousand, they still have to submit their plans -- well, they have to submit their plans for everything, but for over five thousand {sic}, the Department would have the right to do a fee, and they would do it by rule. This is -- I know of no real opposition to this, and I would ask for your support.
