Thank you, Mr. President, Ladies and Gentlemen of the Senate. I’m proud to rise and present House Bill 5428 this morning. I first want to say a very heartfelt thank you to Representative Sara Feigenholtz, who is with us in the Chamber. This bill is the result of years of work on behalf of the advocates of the adoption community in the State of Illinois and seeing that our law grows in terms of respecting the human right of adult adopted persons to obtain a copy of their original birth certificate. Back in 1946, the Legislature decided that it was appropriate to seal all original birth certificates of adopted individuals. What we’re saying today is that we’re taking another look at that. And we’re -- it’s my strong 41 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 111th Legislative Day 4/21/2010 sentiment, as well as the strong sentiment of a number of you that I’ve talked to, that essentially -- that that was a flawed experiment; that what we need to do is look to the rights of Illinois adopted adults, who are saying to me and to all of us today, “We have a right to obtain an original birth certificate, a non-certified copy of our original birth certificate.” And let me walk you through how this bill works. We looked at this in three phases. 1946, as I mentioned, the year the law went into effect that sealed original birth certificates. What we’re doing is we’re saying, effective January 1st, the effective date of this bill, if you were born before -- January 1st, 1946, you are entitled to get a copy of your original birth certificate - unrestricted. The second phase is between January 1946 moving forward, to December 31st, 2010. If you were born in that period, 1946 to 2010, you have a right to receive a copy - a non-certified copy - of your original birth certificate, and if your birth parent has signed a document, which is the Denial of Information Exchange, then you get that original birth certificate, but your birth parent has the right to have his or her name redacted from the original birth certificate. And then the third phase is January 1st, 2011, moving into the -- into the future. A birth parent will have the ability to sign a Birth Parent Preference Form and there’ll be five options for that birth parent. One through four would allow access, would allow that disclosure to take place - the identity of the birth parent. The fifth option would allow the birth parent to remain anonymous and not have his or her name disclosed to his or her child. Now, if you were born before 1946, you will be able to get that birth certificate as of January 1st, 2011. If you were 42 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 111th Legislative Day 4/21/2010 born between ’46 and 2010, you will be able to get your original birth certificate, but only after a one-year public information campaign. And, folks, it’ll be an aggressive information campaign. The State of Maine did this in 2008. We are going to be doing this between October 31st and November of the following year. It’ll be October of this year going to November of the following year. So that, on November 15th of 2011, after a one- year information campaign -- birth parents will be able to come forward in that period, sign a form saying, “Do not disclose my information to my child”. And on November 15th, 2011, and thereafter, an adult adoptee will be able to get the original birth certificate either with -- with the name of their birth parent or with that name redacted if the form was signed by the birth parent during that information campaign. At the end of the day, folks, I really feel strongly that we have struck -- we -- we have definitely struck a right balance on this bill, because birth parents have the right to come forward and say, “Do not disclose my identity”, and they will be allowed that opportunity after an aggressive, vigorous, robust information campaign. But we’re also looking at the rights of adult adoptees. It’s a basic right. It goes to their identity. It goes to who they are and where they came from. Things that I took for granted before this bill. I always took for granted the right that I had to obtain my original birth certificate. I took for granted knowing who my birth parents are. I took for granted knowing about my family history and my medical history. And you know what? If this bill -- when this bill passes and is signed by the Governor, Illinois’ adult adopted community will no longer have to wait. They will have this basic right 43 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 111th Legislative Day 4/21/2010 restored unless their birth parent chooses to have his or her name redacted. This is the right balance. It’s the right balance and it’s the right thing to do in the year 2010 - to restore this basic human right to the thousands and thousands of individuals in this State who desire to know who they are, where they came from, and to get a copy of their original birth certificate. I know there’ll be a number of questions. I look forward to answering those questions. And at the end of this debate, I ask you to please vote Yes on this very important measure.

I -- let me first commend the -- the sponsor, not only here in the Senate, but also in the House, for their commitment and passion on this issue. And I readily recognize there are valid, legitimate interests on both sides of this issue that warrant consideration. But I, nonetheless, rise in opposition to the bill because I believe that by eroding this expectation of privacy - and we discussed this extensively in committee - whether that’s real or perceived, I’m not sure matters, we’re undermining the expectation of privacy at the critical point when that mother is deciding whether or not they’re going to give birth to this child or have an abortion. And anything that pushes that birth mother away from having that child - and I 44 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 111th Legislative Day 4/21/2010 think to some extent this can - I think we are going down the wrong path. I -- I appreciate the efforts of trying to minimize the risks. I think they’re sincere and well-taken. But this just makes it more likely that fewer mothers - in my view - are going to choose life. And for those that have that concern, please give serious consideration to a No vote on this bill. Thank you.

We had a very robust debate on this bill in the Judiciary Committee and one of the things we debated at length was this implied expectation of confidentiality, this implied promise that a birth mother’s identity would be -- would be protected. I want to make a couple of things clear so that I understand it and the other Members do. So, under your bill, for the first time, a birth mother would be presented with that -- that explicit option. A -- a young woman making this decision - we talked about it in committee - she may well not have any expectation of privacy because she doesn’t know what the law is. Under your bill, she would be presented with that in writing and allowed to -- to affirmatively choose to keep the birth certificate confidential. Correct?

It also came out during the hearing, which was a surprise to me and I think to others, that this -- this expectation of privacy really isn’t a credible expectation because of information that is available and obtainable by adoptive parents through the adoption decree. Yes, thank you, Senator Harmon. We did have a robust debate in the Judiciary Committee and this line of questioning was explored. Under current law, adoptive parents are allowed to obtain, through the courts, a copy of the adoption decree. And we have seen specific examples - and I certainly don’t want to divulge names, but I have seen specific examples of the adoption degree - and the name of the birth parent is included in the documentation that the adoptive parents receive through that process, through the courts. So, already those birth parents’ identity is going to be disclosed to the adoptive parent. But now we’re saying, once you’re twenty-one or older and you’re an adult adoptee, you as the adult adoptee do not have this -- the -- the right to obtain that information that is contained in the adoption decree.

Thank you, Mr. President. To the bill: I support Senator Wilhelmi’s bill. I -- he talked in his opening about striking a balance. In committee, we heard testimony from two groups of opponents - those who thought the bill went too far and those who didn’t think the bill went far enough. That strikes me as ample evidence that this is, in fact, a balance well struck. I applaud the -- the sponsor for reaching that balance. I applaud the House sponsor as well and welcome her to the Senate. Thank you. Senator Wilhelmi, the public -- the -- what you’ve described as the intensive one-year public campaign, how much money will be spent on that campaign?

Thank you, Mr. President. Senator Righter, we know from the State of Maine, which went through this aggressive campaign in 2008 -- the information we received from that state is that when they launched their public relations campaign that the cost was two thousand dollars to the State of Maine. We also understand that because of some of the revenue generation involved in terms of the fees being paid, that this could at the very least be revenue-neutral, if not a windfall.

I want to make sure it’s clear how we’re going to be getting the word out, because that’s -- that will in part answer your question, Senator. First of all, the Executive Director of the Donaldson Adoption Institute has pledged his support and his work towards this public information campaign. And let’s talk about some of the specifics that are in the bill: Number one, there will be announcements in the license renewal form sent to the owners of twelve million vehicles; number two, notices enclosed with driver’s license renewal applications; number three, public service announcements to be -- to be distributed to local and national radio and television stations; number four, press releases to be distributed to local and national radio and television; announcements posted on the websites of all adoption agencies licensed in the State of Illinois; an informational website devoted exclusively to the new law; and information distributed throughout Illinois to religious institutions, social welfare organizations, retirement homes, physician offices, and other entities that are capable of reaching individuals who may be impacted by this change in the law. Clearly, through the support of the Donaldson Adoption Institute and others in this very tight-knit community -- I think it’s very important for you to understand, the folks that are involved in these issues related to adoption, it’s a tight- knit community, and everyone involved in that community is on board in getting the word out. When you’re using the Internet, there may be minimal costs. When you’re putting, on an envelope 49 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 111th Legislative Day 4/21/2010 from the Secretary of State, additional information about this public information campaign and how you can obtain the Denial of Information Exchange form, that you can tell is minimal cost. So, Senator, I’m -- I’m -- what I’m telling you today is that the cost will be reasonable, as it was in Maine, and that we will be very determined to keep that cost as low as possible so that we can get this word out with minimal fiscal impact.

One more question, Senator Wilhelmi. Last year, do you know how many notices were included in mailings by the Secretary of State’s Office for driver’s license renewals, and what they were?

Senator Righter, it’s my understanding - and I will get you the exact figures - it’s my understanding that the Secretary of State sends out approximately twelve million notices for registration renewal in one year, and then, of course, there are a number of letters that are sent to anyone with a valid driver’s license and that number would be, obviously, in the thousands, if not the millions.

…very much, Mr. President, Ladies and Gentlemen of the Senate. Again, I think maybe Senator Wilhelmi misunderstood my question. I don’t know how many different issues are included in driver’s license renewal mailings every single year, but there are a number of them. And I wonder if any one sitting in this Chamber can remember any of the ones they saw last year. Or how many websites are out there. Or how many other -- how many public service announcements we see on television every single night - and can you remember any of the ones they talked about? I don’t doubt that there is going to be information well circulated within the adoption community, but many of the people who this will affect are no longer talking to adoption services or looking at adoption services website anymore. They’re outside of that circle of information. I -- so to characterize this as what is going to be an intensive public information campaign, it may be or may not be, but we all know that public information campaigns, many, go on in this State every single year - it catches some people; it doesn’t catch other people. Mr. President, five years ago, this General Assembly passed legislation, House Bill -- 5428 {sic} (582), that’s Public Act 94-173, that expressly, expressly reaffirmed this State’s commitment to the idea of mutual consent - that both parties had to sign off before this information would be conveyed. Every single Member of the Illinois Senate in 2005, every single one of them, and there are forty-three of you here still today, 51 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 111th Legislative Day 4/21/2010 including the sponsor, voted in favor of reaffirming that commitment. It passed the House of Representatives with only five No votes. So it’s not like people weren’t paying attention. There were five No votes. And the House sponsor - although I know how dedicated she is to this issue - voted for that as well. And I don’t raise that to embarrass anyone, but to make a point that we’ve made a commitment to these people and then we reaffirmed that commitment to these people. The notion that it may not be credible, I don’t think that’s true. It will become uncredible the moment we pass this bill. There are reasons that adoptive parents ask not to have their identities disclosed, Mr. President. This General Assembly, on more than one occasion, in overwhelming numbers, has agreed with that rationale and reaffirmed that commitment. Let us not walk by -- back from that today. Thank you, Mr. President.

Thank you, Mr. President. I want to commend the House sponsor and the Senate sponsor for their great work. And, you know, things around here never cease to astonish me. If an -- one more piece of information is stuffed in an envelope that the Secretary of State is sending out, doesn’t cost any more money - doesn’t cost any more money. So, to argue against this bill because of cost or to argue against the bill because it doesn’t go far enough is just simply disingenuous. This is also just for adult adoptees. So, by the time someone turns twenty-one, twenty-two, enough time has passed - in my opinion - for them to be able to find out who their birth parents are. Now, unless 52 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 111th Legislative Day 4/21/2010 you know someone or unless you have been there yourself, perhaps you don’t understand. I know people personally who have been troubled their entire lives because they need this information. This is simply another tool. It doesn’t affect everybody. But it will help some people who really need this information so they will know their personal identity, and I think nothing is wrong with it. Yes, five years ago, we did one thing. But guess what? Things change. This is an idea whose time has come and I would ask for an Aye vote.

To the bill: Ladies and Gentlemen of the Senate, prior to my sitting in the committee and listening to the debate on this bill, I wasn’t fully informed of the importance of this bill. And, actually, it was one of the opponents of the bill, who was arguing against the bill because it didn’t go far enough, that really tipped me over in favor of this bill, and it touches upon what are the reasons why an adoptee would want to have access to their birth certificate. And -- and too often we just think it’s, oh, well, they just want to know who the parent is. It’s not isolated to that. And the testimony we heard was from a woman who was, I believe, suffering from cancer and was denied health insurance coverage because she couldn’t establish her background and couldn’t establish the health history of her family background. So this touches upon saving lives. And the notion that -- you know, I hate disingenuous arguments and there was one that was presented that -- in committee, that this was going to somehow incent birth mothers to have more abortions 53 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 111th Legislative Day 4/21/2010 because their anonymity could not be preserved. But they’re presented with the option in this bill. And under the status quo, the adoptive parents have access to the birth certificate. So there’s this illusion of privacy out there that -- that -- that -- that doesn’t exist. This is more than about having access to a sheet of paper. This is about something that many of us here take for granted. I know that I’m of Haitian descent and I know that there are a lot of things that are tied to that. I know that there are things health-wise that may be tied to that that is helpful for my doctor when I go in there. An adoptee should have a right to that same information, because, God forbid, they’re in a situation where they may be stricken with an ailment where that information is important and they can’t access that information because we failed to act. I urge your Aye vote on this bill.

Thank you, Mr. President. To the bill: I, too, want to join in support of this legislation. As a former DCFS worker, I used to terminate parental rights as a termination of parental rights unit in another state - many of this population already in permanent placements, when we talk about this particular population of folks. And what we’ve learned - in my experiences in two states as a certified child welfare specialist around adoptions and especially, specifically, as a TPR - families and young men and women who are in these positions of adoption are - - are clear of what their positions are at that moment. However, that birth certificate and total ID, as we’re all 54 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 111th Legislative Day 4/21/2010 trying diligently to make this person whole, and in many cases, eventually working with the former -- if you will, the biological parents. But at the end of the day, there are many factions of this piece of legislation that brings it to my attention as being very important, because there is a large sector - I worked with ‘em. I had to do this work. And -- and actually I felt a little guilty not realizing, then the judge would say, well, ask the young man, ask the young lady, what do they want to do - anybody over twelve. And -- and, Mr. President, as you also worked in Dade County, you know a little bit about that court system down there as a child welfare -- and at the end of the day, I know the sponsor in the House, as I worked with her for eight years on making sure that we had access and that we were able to look at all factions of -- of life to be able to address the needs that she sees, and that I agree with - and someone who is not adopted, in my case. But coming here to the Senate, and Senator Wilhelmi bringing this forward, is very important when it comes to the human development. And, of course, all the safeguards in place for that optionee. And I would ask for you to please provide an Aye vote and go out there and maybe talk to some of those young folks who are in that position and, in many cases, can -- feel very whole as they become older. So I would ask for a lot of green switches and to please keep your mind open. This is not a political decision. This is a decision, as we say, in the best interests of the child. And in this case, and -- and it can be for the adult too. Thank you, Mr. President.

To the bill, Mr. President. And I -- I agree with my colleague, Senator Delgado, that this is not a political issue. And I congratulate Senator Wilhelmi and Representative Feigenholtz for crafting a wonderful bill with a great mechanism to determine a birth parent, especially in times of need. I -- however, and I’ve expressed this before - the Senator knows this - there is one part of this which is an obstacle that I cannot overcome to vote for this bill. And that is in the -- and I admit it’s a rare case. I think it’s a rare case. It’s speculative how rare it is. In the case where the birth mother expected anonymity and that birth mother cannot be found, the book is opened. And therefore, her silence, her inability, perhaps, to respond causes the book to be opened. And the book was closed with her consent. The law never presumes assent from silence. We -- that goes to the criminal law - the Fifth Amendment. One’s silence can never be used to argue that one assented to anything - to a contract or to guilt. This is an important principle. The rest of the bill is wonderful. If we had merely a statement that in the case where the woman cannot be found, or does not choose to respond, the book remains closed. This protects the -- the -- the implied covenant made with her when she expected anonymity. It’s a -- a basic principle of law. That’s the only issue I have with this bill. Otherwise it’s brilliantly crafted by a brilliant attorney, A.J. Wilhelmi. And I -- I would like vote for the bill, but absent that assurance, I -- I cannot. Thank you, Mr. President and Members of the Senate. I got to tell you that in my five-year career, this is one of the highlights - working on this bill with Representative Feigenholtz. I want to thank the Senate President for giving me the opportunity to do this. You know, I came to the Senate not understanding what it felt like to be adopted and some of the challenges that were included in -- in that, in that being adopted you -- you don’t have the same rights that folks who aren’t adopted have. I didn’t understand that. I didn’t understand that there was discrimination that led - because of this -- this policy that we crafted - that led to what Senator Raoul talked about, that I can get my medical history and my family history, but if you’re adopted, like Sara Feigenholtz or Ann Williams, and you can’t get your original birth certificate, you don’t get that information. And it may be a life and death situation, as Senator Raoul mentioned. I -- I think that what we -- are doing here - and I really hope this bill passes - is that we are restoring basic rights to adult adopted individuals, like Sara and like Ann, basic rights that will not only allow them to know about their medical history, but goes right to the heart of who they are. And that void will be closed with this. And if an adult who was adopted gets together with his or her mom or dad, that might not be a bad thing. And if they don’t, that’s okay too. But that document will be in their possession and that hole will no longer exist. I want to comment briefly on a couple of comments that were made by some other Members. I think that makes a difference. With regard to the life issue, many of you know where I stand on that issue. I will tell you that if I thought this bill would increase the number of abortions in the State of Illinois, I wouldn’t be standing in support of the bill. What we’ve seen in other states, like Oregon and Alabama, is that, in fact, between 2000 and 2003, resident abortions declined ten percent in Oregon and thirteen percent in Alabama. Why? Why is that? Here’s the answer, from Gretchen Traylor. She says, “When adoption is under consideration, the young woman’s overriding concern is that she will be unable to contact her child later in life, and that the child will not be able to find her as well. Pregnant women tell me that if such contact is not available, they would rather abort.” Ladies and Gentlemen, what this is going to do is restore rights, end discrimination, allow individuals to access that critically important medical history, and in the end, Mr. President, it may reduce the number of abortions in this State. This is a good bill. I absolutely can’t thank Representative Feigenholtz enough for making this part of her life passion, and part of why she’s in this Legislature is to see a day like this come to reality. I ask you for your support on behalf of Sara and Ann. I ask you for your support on behalf of the thousands of men and women who are twenty-one years or older who want access to what I have and what many of you have. And that’s all this bill does - it gives them access to their original birth certificate. Please vote Yes.
