Provides that when a person is arrested for first degree murder or any other violent crime, the judge shall order compensation of –- confiscation of the person's passport or impose travel -- travel restriction, if the judge determines that it is reasonably necessary. The initiative is from the State Police Merit Board. I know of no opposition.

Sure -- sure. First of all, this is already enacted in Cook County. It creates a Bill of Rights for homeless people. They can move freely in public buildings, equal treatment from State and local agencies, and receive –- emergency care, confidentially {sic} (confidentiality) of bill -- of records. It also amends the Human Rights Act, adding "housing status" to the bases that constitution {sic} unlawful discrimination.

I don't know what you mean by administrative act. They could possibly go to court, but there's a –- there's a high burden they're going to have to meet.

Intent of the bill is to base it solely on homelessness. So that's a pretty high burden there.

I think we're jumping the gun. That would be an issue for the trier of fact to determine whether it was based solely on homelessness. I –- I understand your point, but I think we're playing Legislature and Judicial Branch here.

I think we're mixing things up. I mean, the municipality can have their own ordinance, but they can only get in trouble if there's –- if they -- they discriminated solely on homelessness.

This bill creates a new Act. The amendment is -– the back page of the amendment is just an amendment to the –- bill of -- the –- the Human Rights Act. So, this creates the Act. You know, Senator Righter, instead of us spending time, I'll be more than happy to take it out of the record so we can legally go through this, if that's okay with you and your co-counsel over there, and then we can –- so instead of going with the –- driving everyone crazy here with our legal arguments, let's sit down and -- so we can have some clarity. Thank you very much, Mr. President and Members of the Senate. Senate Bill 1687 is essentially a cleanup bill on something that we passed last year. We passed a -- I think a pretty important bill, tightening restrictions for return to work in the State University {sic} (Universities) Retirement System. And this bill --- I'm not going to lie to you, that was -- there was some -- some sloppy aspects in the drafting of that, and this bill corrects a number of them associated with unifying the definition of "academic year" and particularly fixing an important mistake in the definition of the -- of the limitation. But there was an issue that came up in committee that -- that I want to address briefly in my opening remarks. 44  STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 35th Legislative Day 4/17/2013 The last thing that the bill does, which was of some controversy, was that it pushes back by a year the implementation date. And -- and I want to be very clear about why this is happening. The -- the bill -- the -- the law that we're changing here was an initiative of mine. It's something that I have no interest in watering down, but unfortunately, because of essentially my own sloppiness, it was an imperfectly drafted law. This current academic year that we're in was supposed to be spent building the electronic databases to implement this law. Instead, it was spent trying to figure out how to fix the technical errors and make sure that the law could be properly implemented. This bill pushes back the implementation date because the implementation can't begin until we pass the bill -- the technical fixes in the bill. That's why I, as someone who initiated this restriction that we're amending, strongly support this and feel it's necessary for the effective implementation, and it's also why the State University {sic} Retirement System, which benefits from this restriction being properly implemented, also supports Senate Bill 1687. I'm happy to take any questions.

No, if this bill is enacted, we won't be able to implement the return to work restrictions that are currently in the law and we won't achieve those savings. This bill enables us to do that. This -- the best situation would be if we could build a time machine and pass last year a bill that incorporates the technical fixes that this bill includes. But we can't do that, and therefore this bill, I believe, is necessary to achieve those savings that you and I both want.

So this is a very important point. That is a step forward with regard to pension reform. The original bill said that in - - the condition that triggered the restriction was you had to have two different things. Number one, you had to be making at least forty percent of your highest final salary; and, number two, you had to be working for eighteen weeks - and only when both of those things happened were you restricted from working while earning a pension. What this bill does is it removes that eighteen-week restriction, which strengthens the bill.

That amendment to this bill removed the Illinois Press Association opposition. We took that out. So if you fail to pay child support, it's on your record forever. So there is about -- it looks like six -- six offenses -- or five, I'm sorry. If you're -- the violation was with regard to continuing education, whatever the -- the licensee needs, say it's twenty hours, they only got nineteen, then they -- they corrected that and for -- seven years forward they kept up with their CLE; failure to renew a license on time, probably missing a payment to just -- missed a payment, that would constitute a violation - so I'm assuming they would make their payment and then seven years thereafter continue to make their payments to renew their license on time; failure to obtain or renew a certificate of registration or ancillary license; some violation with respect to advertising; or any grounds for discipline removed from the licensing Act.

It reinserts the exemption for disabled persons from paying parking fees in public parking structures. The current law states that a disabled person who is granted a meter-exempt decal does not have to pay fees generated by parking in metered spaces or in publicly owned parking structured {sic} (structure or) area. So this bill just -- I mean this amendment just retains the current language, but clarifies that the disability has to be permanent. So I -- there's no opposition and I look for an Aye vote.

And I know we're all starstruck because of the nature of the sponsor and his history of playing -- being in Hollywood, running around doing all kinds of things, even though he's disabled. We did the amendment that -- it retains this part of the bill, but further amends that -- the Illinois Lottery to delay the ability of the Lottery Department to add drawn-based {sic} games to the Internet pilot program until the Internet Lottery Study Committee report is submitted.

It's 9-something every evening that it's drawn and so -- 9:15, 9:20, whatever the time is. They have this drawing every day and this is the specified time and the specified games.

If they want to add another game, in particular, yes, they have to come to the General Assembly to get authorization. They cannot do that on their own.

Where in municipalities, when this happens, instead of the police officers getting into a high-speed chase and puts bystanders in danger, the police officer can get the vehicle's license plate's number and impound the vehicle whenever it stops or when it's found. The amendment removes this requirement and would instead require the criminal offense to be discovered during an investigation or search pursuant to their current duties. I know of no opposition. And -- and the reason they wanted to do this, it just gives the investigator an ability to exercise their powers in the event during a violation -- creates threat to the officers or someone else. And this way they don't have to contact the authority -- or wait for the authority to get there in fear of their safety to themselves or others.
