Thank you. Thank you, Mr. President. Senate Resolution 981 is in -- is a resolution regarding Operation Endangered Species. And this resolution was brought to me by a number of hardworking, visionary students at Pontiac High School. I represent Pontiac High School and these students brought this to me, this idea to me, based on the work that they're doing and have inspired in Pontiac that has really carried well beyond central Illinois. Operation Endangered Species' mission is to engineer innovative education techniques to better educate students in order to protect and bring back endangered species. So it was founded by students at Pontiac Township High School back in 2011, and today, the program is found in eleven schools and has over a thousand students participating in it. The organization started with four Alligator Snapping Turtles and today they have seventeen. Mr. Ritter and Mr. Soares, along with their students, hope to have five thousand turtles by the year 2021. The funding from this came from State Farm (Youth) Advisory Board, ISU, and -- and DNR, and several others who came together to help out. And so we've got a resolution here today that asks that the date of March 20th, 2014, today, be Endangered Species Day in the State of Illinois. We hope to gain national awareness of all endangered species by this. I'd ask for support of the resolution.

Thank you, Mr. President, Members of the Senate. Senate -- Senator, I would -- or, Mr. President, I would say that we were really not slow on the lights; you were a little slow to see the lights. Yes, yes, they were. You know, I -- I understand that the Director of the Department of Corrections is an extremely difficult job, and in particular right now. But there have been so many things happen in Corrections, I think that it certainly ought to shine a light on -- on the fact that -- that something's wrong. Now many of the things that this Director's had to do, he's -- he's -- is from the direction of the Governor, and we -- we can't, even though you may want to, we can't fire the Governor. But we can, I think, take a look at people that he appoints and to see what -- see what the results are. You know, every day I get calls from people who work at Corrections, basically saying -- and -- and -- and by the way, they pretty well have to stay anonymous. You know, I -- I hear daily from frontline staff and even other supervisors, who must remain anonymous, that things are progressively getting worse in the Department. You know, the -- they closed Tamms, for instance. Well, and he had to do that because he probably wouldn't have had a job the next day if he -- if he hadn't, because that's what the Governor wanted to do. He had to sell a prison, when we have an overcrowding that is just unacceptable. Over -- not -- with the overcrowding comes huge, huge amounts of -- of extra pay because we have to hire -- we don't 22 STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 97th Legislative Day 3/20/2014 hire them, we just ask them to work overtime, and -- and huge amounts. This, again, is part of -- you know, he has to do that because of -- because of the Governor. There -- there just have been so many things happen in Corrections. One of the things I think that -- that -- that is very evident is the fact that he has hired people to be in very high management positions who've since been fired. First of all, they shouldn't have been hired, and -- and I think they should have known the problems that they were getting themselves into. Who do we blame that on? Well, they'd have to blame it on -- put it on somebody and I think that this particular Director has had plenty -- plenty time to -- to hopefully straighten a lot of those things out. Another thing that I'd like to talk about is the process itself. I think there are a number of people on the Democratic side of the aisle who really are not very excited about this Director and would like to see someone else there. We had a hearing, and -- and by the way, this was put off -- this was -- this was -- if we did this to you -- if we were in charge and we did this to you, you would not be happy. You -- you put off -- you put off the confirmation until the -- almost the very last day and then had a hearing in Chicago on Monday - which makes it very difficult for many of us to get there. Waited almost to the last day. And then, knowing you didn't have the votes to get -- to -- to stop this appointment, you had people replaced to -- in order to get that done. Somebody obviously in a very high position in the Democratic Party wants him to stay there. I -- I -- I think if we did that to you -- and you know what, maybe we have when we were in the majority, but that doesn't make it right. Again, the process. I think we have a -- we have a Director here that something -- somebody, somewhere, 23 STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 97th Legislative Day 3/20/2014 needs to pay the price, and -- and I would recommend that he not be approved. PRESIDING OFFICER: (SENATOR LINK) Senator McCarter, for what purpose do you rise? SENATOR McCARTER: To the appointment: You know, a lot of time -- we -- what we should do -- we don't always do this, but what we should, is judge people on results. And so, you know, we're all here to make a judgment. I tell you, from having two corrections facilities in my -- in my district and hearing from a lot of these corrections officers, morale is low. How do you judge that? Well, it's hard to say. I guess you get feedback from these people. But there are some numbers that we can judge, because we judge on results, we -- results -- we judge on benchmarks, and one of those traditional benchmarks used in most enterprises is how you manage people. That benchmark is overtime. Here's overtime for the last three years under this gentleman. Fiscal year '12: 46.9 million - 1.1 million hours. Fiscal year '13: 62.8 - 1.5 million. Fiscal year '14: 50 million - 1.2 million hours. Over a hundred and fifty million dollars. Now, it takes some overtime to manage and balance employees' schedules. We know that. But not this much. A year ago, I asked for a -- a report monthly, and I was told by the Director that I would get that weekly. I never -- I never received a report. If you add even twenty percent of this that might have gone towards the last three years of pensions, you've added another hundred and fifty million dollars of liability to the taxpayers. We can make judgment on the performance of this gentleman, based on real numbers. I'm making that judgment. I've addressed it, many years ago, and there's been no change. Thank you. On Monday's hearing in Chicago, had a chance to ask the Director a few questions, and one of those questions was, are people still -- are inmates still sleeping on the gym floors, and to which he said that -- not anymore; they're -- they're -- about had 'em all removed from that position. The other question I asked that I was told in a meeting a few weeks before, that Department of Corrections, the inmates -- or, the prisons are at a hundred and fifty-eight percent capacity. The Director says it's a hundred and fifty-seven percent capacity. And upon questioning, we talked about plans for their future and -- and long range goals and plans and -- and if there's any plans to build prisons, which he responded "not today". And my -- my question, though, is, well, how about tomorrow? And -- and my concern is that we -- we don't seem to have, either by the Director or the administration, any clear, long range plans and goals, where we're going in the future. And what's also so disturbing to me is the fact that just a couple, two, three years ago, we sold -- the Governor sold the newest prison in the system, Thomson prison, because we were told then, and the Director at that time - not this Director, but the previous Director - testified at hearings that Thomson was built for the overcapacity, the overflow that 25 STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 97th Legislative Day 3/20/2014 never occurred, that we didn't have that problem; but, yet, here we are today and these discussions are going on about reducing the -- the overpopulation in our prisons, sleeping on gym floors, and the fact that -- that we're at a hundred and fifty-seven percent capacity. And -- now I'd -- I would borrow a line because my concern is, is there -- there is no vision, and I'd borrow the line from King Solomon, who said, "Where there is no vision, the people perish". So we have to have a plan going forward. I don't see that either in this administration or this Director, so I would encourage a No vote.
PRESIDING OFFICER: (SENATOR LINK) Senator McCann, for what purpose do you rise? SENATOR McCANN: To the appointment, Mr. President.
PRESIDING OFFICER: (SENATOR LINK) To the appointment. SENATOR McCANN: I represent a lot of folks who work in correctional facilities in and around my district, as many of you do as well. And I want to speak for them here today, because there are many that has -- as it has been eluded to, that would like to speak but they can't for fear of their job, for fear of retaliation. And again, it's not just about my constituents in and around -- in my district and around my district, but many of us here represent these people who do a job that none of us really want to do, but they do it every day. They do their duty. Whether it's hiring a congressman's son who has no experience in corrections whatsoever, whether it's overcrowding, whether it's overtime that never gets corrected, whether it's walking past the warden's office, walking past the 26 STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 97th Legislative Day 3/20/2014 correctional officers themselves, not paying them any respect and immediately going to the gang leader's cell to have meetings with the gang leaders, and we can go on and on and on, and I won't, we -- this is wrong. On behalf of my constituents and on behalf of all the people that many of you also represent whose voices won't be heard here today, they urge you to vote No. Director Godinez, I know, has had forty years of his life committed to public service, and I respect his good intentions, but his results are simply not good enough. And on behalf of my constituents and yours, I urge you to vote No.

Many of you on the other side of the aisle represent areas with correctional facilities in them. I have several on the perimeter of my area. Many of their employees work in the correctional institutions and live in the 51st District. When you talk to these people, you cannot -- you cannot overstate how bad the morale is within our correctional institutions. The number of inmate on staff, violent actions is up. It's not just up by a little bit; it's up by a lot. There is a real fear for the safety of those who work every day keeping the most dangerous people off of our streets. Those correctional officers, those folks who work - we ought to take their word for it, frankly. They're the ones whose lives are at stake day in and day out when they walk in that 27 STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 97th Legislative Day 3/20/2014 door. We ought to take their word for it that this particular Director is not working out. Everyone in this Chamber has a sworn duty to uphold the State Constitution. I would add to that that we have a duty to protect the people who work for us every day. And the people who work for us in the Department of Corrections, when you talk to them, when you get them outside the Department of Corrections, where supervisors are listening, or prying eyes and prying ears have quieted them, when you get 'em outside those buildings, outside those walls, they will tell you they don't want this guy. They don't like him. They don't like his conduct. When he comes in their prisons, they don't like the fact that he walks past the wardens and starts fraternizing with the inmates. But the bottom line is, they don't feel safe, and we have a duty to make sure the men and women who work in these prisons every day are safe. The number of assaults is up and it's up by a lot. I would urge everybody on the other side of the aisle to think about that when you're casting your vote. Are you keeping our correctional officers safe when they walk in that institution every day? If -- if your answer is, you don't think so, and you want to listen to the officers that work there, then you shouldn't be voting for this nomination. Thank you, Mr. President.
PRESIDING OFFICER: (SENATOR LINK) Senator Dillard, for what purpose do you rise?
Thank you, Mr. President. Very reluctantly to oppose this gentleman, who has served the State of Illinois for a number of years, his appointment. Just a couple of points that really draw attention to me and that put me over the top is that the Executive Inspector General found recently that under Mr. Godinez's watch, 28 STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 97th Legislative Day 3/20/2014 a former Congressman's son was hired as an assistant warden, despite being wholly unqualified for the job. The applicant for the job had a degree in Fine Arts, and that's great - run theaters and things like that - but it has nothing to do with the qualifications of being an assistant warden, the number two job at a correctional facility. And there are some who will say that that directly led to more inmate attacks because of the lack of understanding of prison safety. But the one that really got my attention, and it came through the attention of the Chicago Sun- Times series, was on a man named Xavier {sic} (Xadrian) McCraven. He was detailed from his job at DCFS to an investigator for the Department of Corrections prison system's intelligence unit. After that, he was sent back to DCFS. He was making a hundred and ten thousand dollars a year at Corrections. But the Sun-Times drew attention to the fact that this man had twenty-four, twenty- four, arrests, which included arson, illegal gun possession, attempted robbery, drug possession, and aggravated assault. And he was put in charge of personnel records -- or, had access to personnel records and records of streetgang members. Not exactly a way to protect the citizens of the State of Illinois. He was also fired from the Department of Children and Family Services in 2012 for sending hundreds of lewd and highly sexualized e-mails, as well as falsifying his application by claiming he was a licensed social worker. So there are a lot of things here that cause me great concern. I know that -- that Mr. Godinez -- or, Director Godinez has served the State fairly well over his time, and I'm sure that some of these he would confidentially tell you he was ordered by the second floor, by Governor Quinn's office, to do. But somebody -- somebody's got to pay the price. There are prison 29 STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 97th Legislative Day 3/20/2014 guards and their families who are put in jeopardy day in and day out. And then, overall, I worry about the safety of the people who are outside of the prison walls as well, the taxpayers and family of Illinois. So it is an entire litany of things that has allowed me to decide to not support this appointment today, including the colleagues from my -- from our colleagues who have penitentiaries in their district who tell us that guards overwhelmingly, overwhelmingly, do not respect the Director of the Department of Corrections, and that's another reason. So I reluctantly rise in opposition. Thanks, Mr. President.

I happened to be appointed to the Executive Appointments Committee to hear -- to -- to hear Director Godinez respond to a lot of these points that have been raised and respond rather well to -- to -- to -- to all of them. And what this process ought to be about -- it ought not be about the contest that we had on this past Tuesday or the contest that we were going to -- we're going to have in November. We ought not get into that -- politics within this building. If we're going to point a finger as to the problems that occur in correctional facilities, whether it's due to overcrowding, whether its safety issues within correctional facilities, instead of pointing the finger outward, we ought to point the finger inward. We ought to look at the criminal justice 30 STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 97th Legislative Day 3/20/2014 policies that have come out of this room and the room across the Rotunda. We've been going backwards, where states all over the country, conservative states, have looked at the policy that we've been embracing, that they have embraced in the past, this policy of building prisons, enhancing penalties, trying to be tough on crime, when it's actually being dumb on crime, dumb on safety with regards to correctional facilities, and these states have been moving in the other direction. And so, if you're going to evaluate Director Godinez, evaluate him on how he's spent time, both personally and through his designees with the Sentencing Policy Advisory Commission {sic} (Council), looking at how we can do things differently. This whole lock 'em up, build 'em up philosophy, it doesn't work. We can't afford it. We got a whole bunch of people incarcerated on technical violations. And, yeah, if we want to follow California -- California's lead and then invite the federal government to come in, we can do that. But that just doesn't work. We can't afford that. And so, if you want to politicize it, go ahead. You're going to do that. I mean, you had your race on Tuesday. You'll have your race next November. We went through this four years ago, where a -- a prior director of Corrections, you know, who was a good guy and he was a good leader, his existence was politicized. So I -- I guess this is the routine. It's a -- it's a gubernatorial election year. We're going to go through this and we're going to -- you know, I guess Mr. Rauner's going to make this one of his issues. But in this Chamber, I -- I really invite you all to engage with me on looking at what we do wrong, how we have contributed to the problem in -- in these correctional facilities, how we may be able to do some different things, economic development-wise, in your districts so 31 STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 97th Legislative Day 3/20/2014 you're not so reliant on building prisons for economic development in your respective areas. That's dumb policy and we ought to be smart on crime instead of going to the -- the old routine of let's be tough on crime, let's enhance a penalty and send out a legislative newsletter saying we're tough on crime, when what we've done doesn't make a bit of sense. I urge confirmation of Mr. Godinez because of his distinguished leadership over time and the fact that he does go and engage the inmates. He does go find out what's happening inside, and he answered that in the Executive Appointments Committee. And that's what he ought do. He ought to get his hands dirty and find out what's going on. I urge confirmation.

Members of the Senate, I stand in very strong support of the appointment of Director Godinez. I've had the experience, with Director Godinez, of -- when he used to work at the county. But let's just take it back a little bit further. Salvador Godinez has been working in -- in this environment for over forty years. He's been a public servant to the max. And when we talk about being, you know, the leader of an -- of institutions like the prisons, one thing that I admire about Director Godinez is that he's always had the ability to be able to not only talk to the officers, but he also has the ability to talk to the inmates. You 32 STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 97th Legislative Day 3/20/2014 know, just because the inmates are in there serving the time that they have for whatever the crime, doesn't make 'em less human. And one thing about Director Godinez is that he's a -- he's a great human being who has an ability to -- to reach out and talk to people in the prisons, you know, and -- and find out what's going on. When someone on the other side said that the morale of the officers is low; on the contrary, I hear that the morale is good. I mean, he has the ability to talk to his officers, to find out what the needs are. You know, we -- you know, we're responsible and -- and -- in trying to help find revenue and resources to make sure that the prisons are a place that people can be in -- in a very decent, you know, environment. And I think that the Director has done just that. But I really believe that when you look at the man of experience of forty years, both in this State and in other states, is it tells you the caliber of a person that he is. I think he has done a great job. When he was over the county, I mean, he was always hands-on. Whenever I would reach out to his office, he would always respond and be accessible. I think that tells you the caliber of a person that he is. He's, you know -- and I know that -- let's not judge him on what maybe the second floor might or might have not done, when the other individual -- I'm glad that individual is gone now. But you know what? The important thing is the work that he has done. The forty years of public service that he has given not only this State, but other states too, and that just talks about the kind of person that he is. There's nothing wrong in a director talking to prisoners or to inmates. That is the right thing to do because, you know what, they are human beings and they should be treated with some respect. But I do believe that right now -- let's judge this appointment 33 STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 97th Legislative Day 3/20/2014 based on who Director Godinez is. And he is a -- a wonderful man, someone who cares about the work that he does, someone who cares about the people that he serves, the people that he directs as -- the officers, and also the inmate {sic}. And for that reason, I -- I ask my colleagues in the Senate to please go ahead and confirm this man, because he is a good man.
