This is a trailer bill to Senate Bill 150, which authorizes a property tax increase to fund any expanded health care services programs authorized by a majority vote of a contiguous area through the ballot referendum. Unfortunately, the methodology applied by Senate 150 did not match that of the Cook County Clerk, and therefore it could not be levied I guess. This flew out of the House and I'd ask for a favorable roll call.

Floor Amendment No. 2 to Senate Bill 3398 deletes all, becomes the bill, and it reflects an agreement between IDOT, ISP, the Farm Bureau, Mid-West Truckers, and Secretary of State. The amendment, upon the request of the vehicle owner, imposes a ten-dollar surcharge on small trucks, twelve thousand pounds or less, identifying them as a "covered farm vehicle". The fees collected from the surcharge shall be deposited into the Secretary of State's Special License Plate Fund. The amendment also defines "covered farm vehicles", aligning Illinois statute with the federal definition. It took a lot of work to get everybody to come together. And this, again, is an agreement between IDOT, Illinois State Police, the Farm Bureau, Mid-West Truckers, and the Secretary of State. And I would appreciate your support.

Waukegan has an -- older TIFs on the west side of town that are generating revenue and three new TIFs on the lakefront.

It would require animal shelters located in the State to release impounded dogs or cats to an animal control facility or a law enforcement authority within one business day of receiving an animal. This is supported by the Department of Agriculture, the Farm Bureau, the Pork Producers. It stems out of a situation that was in Macoupin County a few weeks ago. This is a shell bill at the moment and it is being -- I'm asking the indulgence of my distinguished colleagues to move this to the House. There is preliminary language over there. This deals with the negotiations between the railroads and the telecommunications industry and some of the utilities concerning the procedures and the costs and the remuneration of going under railroad rights-of-way, primarily under. It perhaps might be sometimes over. And that's exactly what it deals with. There's a disagreement between the railroads and these other entities as to those issues. We believe it'll be resolved. The bill is a recommendation of the State Ambulance Association. It also amends {sic} the Transport Licensure Fund in the State treasury. It amends the -- amends the Emergency Medical Services. 650 mandates Department of Public Health to charge each medical provider a fee that must not exceed twenty-five per vehicle nor five hundred -- five hundred dollars per provider. The fee is required to be forwarded with each application for licensure and a license renewal. The intent of the bill is to regulate a form of patient transportation that currently exists for the safety of the patient and the public. The bill is modeled after the law the General Assembly enacted concerning the regulation and licensure of the stretcher van provider several years ago. I know of no opposition and I will answer any questions.

And I believe that this is something that I think, right now, as you see the -- the population continue to grow with all ethnicities out there, I think it's important that our hospitals have interpreters there, ready to serve, and make sure that our -- that patient is getting the correct information and that's being -- and what they want is also, you know, being given back to the hospital, the doctors, and everyone that's taking care of that patient.

In the discussions that have gone on about this bill, have you been able to get a sense of the cost that would be mandated on these health care facilities to do this?

According to what I -- I hear, is that the Hospital Association -- it's the recommendation of them, and I believe that there is no -- there are interpreters at the hospitals, but I think that we just have to make sure that they're available much more than, you know, a few hours here and there. I just -- this is -- this is something that actually took place back in 1993, when former Senator Chuy Garcia and Miguel del Valle were involved with this, and this bill passed under the leadership of -- of Republicans. So I think this is a very important thing that we have going on right now. When we see the population has grown in many -- many, many geographic areas, then it's important that we do have people there to serve as interpreters.

I'm a little shocked, Senator Martinez, that it took your second or third answer to try to work in the fact that some Republican, sometime in the last couple decades, may have been involved in something like this. But let's go back to your bill. The -- exactly what -- what are the hospitals going to be looking for? And what I'm saying is, the bill says something about ten 30 STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 5/1/2014 percent are non-English. So, if in a community -- let's say in a particular community, you have twelve percent that are non-English speaking, but there are twelve different languages among the twelve percent that are not speaking English. Does that require the hospital then to have an interpreter who can speak each of those twelve languages, or can they get -- do they need twelve interpreters, one of which speaks each of those languages? I mean, what -- what are they supposed to do here if -- if you have a situation with multiple languages?

Like I said, this is Senator Sandoval's bill, but what I'm reading on the analysis, it says that it has a hospital furnish services in a geographic area where ten percent of the population speaks a language other than English. So I think the interpreters -- we're talking about, you know, areas that have -- you know, it could be from, you know, from -- from Spanish-speaking to Polish- speaking to Korean-speaking, whatever other language; that ten percent or more of that population of that area will constitute them having an interpreter that speaks that language.

So the -- the ten percent figure is a percentage of non- English speech -- speaking population. Now what you just read to me tells me the answer to that is yes. So that if there are fourteen different languages being spoken in that community, the hospital has to have an interpreter or set of interpreters that can speak every one of those fourteen languages. That's correct. Right?

What I'm -- what I'm saying -- let me -- let me go back, and it says that the geographic area of where ten percent of the population speaks a language other than English to maintain an interpreter who speaks that language on duty. If -- if -- if that area has a population of over ten percent, say -- and you're - what'd you just finish saying? - Spanish-speaking only, then they need to have an interpreter. Other than that, I'm pretty sure that they will have an interpreter -- if a patient who happens to be Polish walks in, I'm pretty sure that they will find an interpreter that will speak that language for them.

You know what, Senator, I really can’t answer that, but I know that as someone who has been in the hospital environment around family members and everyone, I don’t think that that is something that is -- if -- if a patient speaks to you in a language that you're familiar with, I'm pretty sure that they will be able to answer right back to that patient. So I don’t think that it's a matter of bringing someone or that they're going to get paid as a dual -- person that can speak a second language, but I think that it's just pretty common that someone that does speak another language and if that patient happens to speak that language, I can see why they would be happy to facilitate a translation for them.

Well, Senator, I appreciate that. I -- I mean, but you're about ready to make it a violation of the law if they don't do this. So, what -- and -- and as always, when we pass mandates, we -- we carry the burden of making sure that the people upon whom we are placing the mandates have a clear expectation of what they need to do in order to comply with the law. So I'll ask you again, if a hospital has a nurse or some other person who's an employee there, who also speaks a different language or a set of different languages, does that qualify as the interpreter? Yes, that's fair to say. So I -- you know, if -- the bill - - the bill was presented by Senator Sandoval, but the hospital took very much interest and they helped negotiate the language so everyone's very comfortable with what's being asked of this bill.

I'm going to try and make this my last question, Mr. President, but I've failed you before on that, I know. Senator - - Senator Martinez, I'm going -- I'm going to ask whether or not you would be willing to take this bill out of the record for -- and here's why I'm asking, is because it is -- it's -- I think it's important whether or not hospitals, who in many parts of the State are operating on scarce resources - and I've heard you talk about that before on this Floor - can use an employee they already have to fulfill a mandate that you are about ready to put on them. I think that's important for them to be able to know. I think it's important for the Members of this Chamber, who are going to be answering questions from the hospital later about this bill. Should be able to know whether or not they can utilize someone who is already working for the hospital. Thank you, Mr. President.

Yes, and -- and I will answer the question. No, I am not going to take this bill out of the record, because this is language that was negotiated by the Hospital Association with Senator Sandoval. So I really believe that we have to give the benefit of the doubt to the Hospital Association as to the -- you know, interpreters in their hospitals. And I believe that this is a good bill and I ask for a favorable vote.

Thank you, Mr. President. To the bill: I just want to be sure that I was understanding the exchange here. I do understand this has been negotiated with the Hospital Association. Senator, just clarify for me one last time. If an area has, for example, ten percent Spanish population, they need a Spanish interpreter. If a Chinese person comes in and they don’t have a Chinese interpreter, they're not covered. We're trying to get to the issue where there's a large non-English speaking population to make sure there's translation services. We're not attempting to deal with every outlier situation. Is that correct?

Senator Radogno, yes. This is some -- I think what the -- and I can’t speak for Senator Sandoval, because I wasn't part of the negotiations, but I think, if I read this correctly and what I've been told by the staffer is that any area that has ten percent 37 STATE OF ILLINOIS 98th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 115th Legislative Day 5/1/2014 or more of a certain population, that they need to have an interpreter of that -- of -- that speaks that language. Now, I know many hospitals have other interpreters there, you know, or will make them available if there is someone that comes in that does not speak, you know, the language of the area -- the population of the area that has over ten percent. It's a matter of making sure that the hospitals that have a ten percent or more population of one certain, you know, ethnicity to have a -- an interpreter there available twenty-four hours or through other mechanisms that are part of this bill. But I do believe that any time there -- there is a patient that's brought in that doesn’t speak, you know, a certain language other than that ten percent, I am almost sure that they will find an interpreter available to make sure that the patient -- that the conversation of the patient and the doctor is interpreted correctly.

Thank you. I mean, I -- I do -- for the most part, I believe that hospitals in general are trying to do this, because it makes good sense in patient care. Does make sense, when you have a critical mass of a population, that we make sure there's that interpreter service. It does allow phones to be used as well.
